they re trying to show you there s a clash between law and a very certain candidate, because the week has now begun, and these judge us unanimously ruling a president could be tried for an election and the states try to bar that same candidate for similar conduct. so what is the distinction here? well, trump lost this appeal yesterday because he s not above the law. he is below the doj and jack smith when it comes to his own conduct and being accountable for it and even if he also, as a matter of job history, once oversaw the federal government including the doj as president. so that case is back on track unless the supreme court weighs in. the case is about rather random states and local judges can simply decide and announce that trump committed insurrection before he even goes on trial. in other words, is it constitutional and fair to ban candidates and basically decide elections that way? i ll tell you right now, most legal experts do not see precedent for colorado t ....

on this point. i am quoting here, we cannot except former president trump s claim that a president has unbounded authority to commit crimes. and we neutralize the most fundamental check on the executive power, in recognition, an implementation of election results. and going on to say, nor can we sanctioned his apparent contention that the executive has carte blanche to violate the rights of individual citizens to vote, and to have their votes count. the court throwing out trump s arguments that he should not have to go on trial, on federal election subversion charges. charges that you would expect, vowing to appeal to the supreme court. but he only has until monday to decide whether he can do that. let s talk right now with cnn analyst, norm eisen, and prosecutor, joe moreno. i m so happy that both of you are here today. first of all, we have been talking about this for the better part of a month, norm. the fact that it took this long, it s perhaps a surprising announce ....

right now. good naming from new york. i m chris hayes. it is all about the clock and the calendar. that has been clear ever since the first criminal charges came down against donald trump last spring our justice system moves at its own speed. but there s a finite amount of time for the ex president to be tried and the 91 charges he now faces before voters go to the polls on election day. now of, course everyone knows this, and trump certainly knows this. it is why, remember, he announced his 2024 campaign for president all the way back in november of 2022. that was one of his first attempts to shield himself politically from the legal accountability that he knew was coming. and of course, since then, trump has been doing everything possible to slow down the wheels of justice. he is basically in a race with a very sluggish system, trying to make it to november 5th when he very well could be elected president again before justice can catch up and put him on trial. the g ....

alleged role in the january 6th insurrection. we ll all be able to listen live tomorrow morning. let me make it easy to follow the conversation tomorrow. you ve been hearing a lot about the 14th amendment. it s at the center of the case. it has five sections. of the five, you may only really know section one, the one about due process, laws, that one. it s the other white meat, section three. that s the one that s important, the so-called insurrectionist band. at its core it says, you can t hold office if you ve engaged in an insurrection. if it were that easy, i wouldn t have to explain it to you, would i? and the supreme court wouldn t take it up. there s a couple words you to pay attention to. it s the words that bring us here today, the court there tomorrow, and that court will dissect these words when trying to understand whether the insurrectionist ban of section three fully does apply to donald trump. the first words to consider is officer. the big question, is t ....
