This bill applies directly to BYU as the only private university with a police force in Utah. (Preston Crawley) The Utah Legislature is considering a bill that establishes regulations and authority given to law enforcement agencies in private schools. According to sponsor Sen. Curtis Bramble, R-Provo, SB191 applies directly to BYU because it’s the only private institution in Utah with a police agency. The bill establishes a certification process for private police agencies and describes policy and procedure requirements. It also establishes due process procedures for taking formal action against a private law enforcement agency.

Brigham Young University’s police force is here to stay. State officials announced Tuesday that they won’t appeal an administrative law judge’s decision to dismiss the state’s effort to strip the private university of its police powers. That decision ended a two-year battle where the Department of Public Safety took the unprecedented action of seeking to decertify the entire department after the state said BYU police failed to conduct a proper internal investigation into a lieutenant who inappropriately accessed police reports and passed information to the school’s Honor Code Office.

State decides not to appeal decision allowing BYU to keep police force

Deseret News Share this story Steve Griffin, Deseret News PROVO The Utah Department of Public Safety announced Tuesday that it will not appeal a recent ruling that allows BYU to keep its police department. Commissioner Jess Anderson on Tuesday sent a letter to Chris Autry, the managing director of the Brigham Young University Police Department, stating, “I have chosen not to pursue an appeal of Judge Catten’s order on your motion for summary judgment. “The decision to decertify BYUPD was difficult and weighed heavily on me, but I was left with no alternative, given the evolution of choices made by BYUPD. I respect the decision made by Judge Catten, his time invested into legal research and analysis, and his decision identifying a lack of statutory clarity and guidance under these circumstances,” Anderson wrote.
