So, when a generalist judge gets one of these patent cases, they have to figure out what the patent means in order for them to figure out whether the patent is a valid claim of an invention and whether the defendants invention infringes the patent. Fdrs first new deal the nra was unconstitutional because it delegated in the case of carter cole to a consortium of private entities, the coal miners Coal Company Officials and private citizens the power to set terms of competition and set wages and set working conditions, et cetera, essentially a delegated governmental functions to a private entity and that violated the constitution. That was one of the real major flash points of the new deal controversial between fdr and the Supreme Court back in the 1930s and since then there hadnt been another case holding that delegation was constitutional, but we have one now and its on the docket and, you know, ive given you a feel, i think, for what the challengers have said and will say in the Supreme Court.
