Man sues Norfolk for being struck by a train

WILLIAMSON A Kentucky man is suing Norfolk Southern Railway Company after he was struck by a train in his vehicle.
Zachary Peterman filed the lawsuit against Norfolk, Allan Thorne and Todd Rollins alleging the parties failed to activate the train s whistle and failed to reduce speed when approaching a railroad crossing, according to a complaint filed in Mingo Circuit Court.
Peterman was operating his vehicle on Dec. 19, 2019, when he approached a railroad crossing in Naugatuck on Railroad Avenue. He claims despite taking all due care for his own safety, his vehicle was struck by a train and he was severely injured. ....

Widow accuses Norfolk Southern of causing husband's cancer, death

WILLIAMSON A widow is suing Norfolk Southern Railway Company for her late husband s cancer and death.
Elva Robertson s late husband, Freddie Robertson, was employed by Norfolk from 1970 until 1996, and during that time he was exposed to diesel exhaust and fumes, as well as second-hand smoke, according to a complaint filed in Mingo Circuit Court.
Elva Robertson claims her late husband developed lung cancer and it metastasized to his brain because of the defendant s utilization of known cancer-causing materials in its day-to-day operations.

Norfolk failed to provide Freddie Robertson with a safe place to work and failed to monitor the diesel locomotives, facilities, equipment and other areas for diesel exhaust and second-hand smoke, according to the suit. ....

WILLIAMSON A Lenore man is suing Coalfield Lumber Co. for negligence when removing trees from his property and damaging the property in the process.
Bryan Jude and Coalfield Lumber Co. Inc. were both named as defendants in the suit.
Freddy Copley claims the defendants removed trees from Copley s property, according to a complaint filed in Mingo Circuit Court.
Copley claims the defendants failed to clean up their mess and failed to compensate the plaintiff for the logs removed from his property. He claims they also crushed a septic tank and failed to make a house seat and essentially ruined the property. ....

Couple blames Mingo County attorney, former delegate for husband's injuries at party

WILLIAMSON – A Mingo County couple has sued an attorney and others, claiming the husband was severely injured when a porch railing at a building owned by the attorney broke.
Michael and Kelly Bucci filed their complaint in Mingo Circuit Court against attorney Justin J. Marcum, T&K Development LLC and several individual John Doe individuals and corporations. Marcum is a former member of the House of Delegates who briefly ran for state Senate.
In his answer, Marcum denies the allegations and seeks to have the case dismissed.

According to the complaint, Michael Bucci was an invited guest to a building, which is home to Marcum Law Office PLLC and owned by Marcum, located in Williamson on November 16, 2019. When he was exiting the building, he says he leaned on a rail on a porch on the rear of the building when the rail broke or gave way, causing him to fall 6-8 feet to concrete below. ....
