Appeals Court: No emergency stop to remove Asheville Confederate marker

ASHEVILLE -  The North Carolina Court of Appeals has denied an emergency motion to stop the ongoing demolition of the Vance Monument, bringing removal of the marker to a locally born Confederate governor closer to its historic fulfillment. 
The May 21 decision by the state s second-highest court is a blow to the last ditch efforts by a historic preservation group opposing the demolition of the monument to Confederate colonel and governor Zebulon Vance. But it does not appear to be the last word in a legal fight that could still halt the city s removal of the iconic 75-foot obelisk from its prominent spot in the center of Asheville s bustling downtown. ....

As Asheville demolishes Vance Monument, lawyers quickly make Appeals Court arguments

ASHEVILLE - The long-anticipated demolition of a Confederate governor marker took a pause this week as workers puzzled over safety issues but the legal battle continued as lawyers hurriedly filed arguments with the North Carolina Court of Appeals as to whether deconstruction could continue.
In the latest round, the city on May 20 filed an answer to a historical preservation group seeking to stop the Vance Monument demolition. The group, the Society for the Historical Preservation of the 26th North Carolina Troops, made a motion with the state s second-highest court May 19 saying the removal should wait until a N.C. Supreme Court decision on a similar case. ....
