The trial of Marvin Esquivel Lopez, charged with killing a mother and her two children in his Des Moines home almost two years ago, ended in mistrial Thursday after the jury was unable to reach a verdict on two of the three charges.
Esquivel Lopez, 31, went on trial last week for three charges of first-degree murder for the slaying of Rossibeth Rosie Flores-Rodriguez, 29, and her two children, Grecia Daniela Alvarado-Flores, 11; and Ever Jose Mejia-Flores, 5. The jury began deliberations Friday afternoon, and by Wednesday told the judge they had reached a verdict as to the killing of Flores-Rodriguez, but remained very far apart on the other two charges.

It strains credulity, prosecutor Kevin Hathaway says, that Rossibeth Rosie Flores-Rodriguez would kill her own two children before threatening and ultimately being killed by her landlord. This woman loved her kids. They were her life, the assistant Polk County attorney said Friday. She came to a place where she had nothing, where she knew no one, and she did it for them. And the suggestion that she could have done this to her own children is simply absurd, and the defendant’s claim that she did is impossible to accept.
