Whitsunday businesswoman cleared of assault allegation

A district court judge has labelled an assault case against a Whitsunday businesswoman and former council candidate as one of the most “trivial” he’s come across in three decades as a jury took 12 minutes to find her not guilty.
Judge Brad Farr questioned why the Director of Public Prosecutions had allowed it to run as a jury trial labelling it as “extraordinary”.
Heidi Michelle Ward had been charged with assault following an alleged incident on December 1, 2019.
“The only reason justice prevailed is because of my sheer determination for the truth,” Ms Ward said.
“I burst into tears. I was so proud of myself.” ....

A RoadTek Mackay senior supervisor raped and sexually assaulted a drunk woman during a party after cleaning up her vomit.
Graeme Wayne Webb had been well aware of his younger victim s intoxication when he took advantage of her vulnerable state, Mackay District Court heard.
Now he ll spend nine months behind bars.
The incident occurred in 2019 in a Central Queensland town, west of Mackay.
Crown prosecutor Tiffany Lawrence said the woman had been helped to her room where she had woken up a few times, vomited and gone back to sleep.
Webb had entered her room and started to clean up her vomit, including wiping between her legs and near her genital region. ....
