Carson v. Makin. Mr. Chief justice and may it please the court. Like all discrimination based on religion it should be subjected to strict scrutiny and held unconstitutional unless maine can show it is necessary to achieve a compelling government interest maine cannot make such a showing the First Circuit never held that it would. Instead they held there are two kinds of religious discrimination, the bad kind and the good kind. The First Circuit recognized maine cannot discriminate against schools because they are religious but held it is free to discriminate because they do religious things such as teach or receive instruction in religion. If First Circuit was wrong. Religious discrimination is religious discrimination. And unless it can survive strict scrutiny, it is unconstitutional. The First Circuits refusal to apply strict scrutiny on stats use distinction was baseless.
