Judge to take Longsoldier case under advisement before ruling

Lincoln County District Judge Matthew Cuffe on Wednesday said he would take the Allen A.J. Longsoldier Jr. case under advisement. He did not say when he would issue a ruling. 
Longsoldier was an 18-year-old Native American man who died in 2009 while in the custody of the Hill County Detention Center.
Lawyers representing both sides in the case filed for motions for summary judgments, and Cuffe, a substitute judge, heard arguments in Cascade County District Court. 
Lawyers for Hill and Blaine counties asked the judge to dismiss the case because it had already determined that the counties were not responsible for Longsoldier s death. Lawyers representing Longsoldier s estate asked the judge for a trial, saying the counties were negligent and discriminated against Longsoldier.  ....

HELENA, Mont. (AP) Seven Republicans joined Democrats in the Montana Senate to kill a bill that would have given the state more latitude in selecting drugs to carry out lethal injections, as companies restrict access to drugs used in executions.
“I was blown away,” by Thursday s 24-26 second-reading vote, Democratic Sen. Diane Sands of Missoula said Friday. She spoke against the legislation, arguing there aren t drugs available to carry out lethal injection in ways that don t result in cruel and unusual punishment.
The death penalty has been on hold in Montana since 2015, when District Judge Jeffrey Sherlock said the state s plan to use pentobarbital to render an inmate unconscious did not meet state law requiring the use of an ultra-fast-acting barbiturate. ....
