Judge denies Cleveland Metroparks lawsuit against Pittsburgh Zoo

A judge denied the Cleveland Metroparks Zoo s motion for a temporary restraining order to prevent the Pittsburgh Zoo from continuing to use the phrase “Asian Lantern Festival Thursday.Judge James Gwin of the U.S. District Court for the Northern District of Ohio found that Cleveland Metroparks failed to meet any of the criteria necessary under a temporary restraining order. Gwin said the phrase, “Asian lantern festival,” would likely be considered a generic term that would not be entitled to protection under trademark law. Several other zoos throughout the U.S. also use the name of the ancient traditional festival dating to 206 B.C. to describe the cultural essence of their events. The Asian Lantern Festival is in its fourth year in Cleveland, drawing thousands of visitors and millions of dollars in revenue. It is running from July 14 to Sept. 5. CLEVELAND (Legal Newsline) - The private lawyers who have recruited cities around the country to try to collect local taxes on video streaming services have asked a federal court to make their Ohio lawsuit a class action on behalf of every municipality in the state.
In a recent filing, lawyers at DiCello Levitt Gutzler, Nix Patterson and Schneider Wallace Cottrell Konecky told U.S. District Judge James Gwin their lawsuit on behalf of the city of Maple Heights is “tailor-made for class certification” because it presents the basic questions at issue in every similar case. The lawyers claim Netflix, Hulu and other streaming content providers should collect a 5% tax from viewers under Ohio’s cable-television franchise law. ....

CLEVELAND, Ohio Since 2018, scores of families who lost eggs and embryos in the freezer malfunction at University Hospitals’ fertility clinic have settled lawsuits in sealed agreements.
And since most of those cases have included protective orders, which make nearly all of the documents in the litigation confidential, it is difficult, if not impossible, for the public to know what happened in the case.
Earlier this month, an attorney for the former lab director of the hospital’s clinic unveiled a 25-page affidavit that ripped into administrators and blamed staff for “being ridiculously negligent, irresponsible, incompetent and casual in their work ethics.” ....
