CLEVELAND (Legal Newsline) - The private lawyers who have recruited cities around the country to try to collect local taxes on video streaming services have asked a federal court to make their Ohio lawsuit a class action on behalf of every municipality in the state.
In a recent filing, lawyers at DiCello Levitt Gutzler, Nix Patterson and Schneider Wallace Cottrell Konecky told U.S. District Judge James Gwin their lawsuit on behalf of the city of Maple Heights is “tailor-made for class certification” because it presents the basic questions at issue in every similar case. The lawyers claim Netflix, Hulu and other streaming content providers should collect a 5% tax from viewers under Ohio’s cable-television franchise law. ....

Two Georgia residents have filed suit against Ledger SAS, Ledger Technologies Inc., Shopify (USA) Inc., and Shopify Inc., accusing the companies of mishandling a massive data breach that caused customers to lose money, face threats of physical violence, and feel vulnerable in their homes. The Northern District of California class-action complaint contended that the defendants negligently allowed, recklessly ignored, and intentionally tried to cover up the breach.
The plaintiffs explained that Ledger, “one of the market leaders for crypto-asset security,” sells solutions to consumers to help keep their crypto-assets safe. Its main product is a “hardware wallet,” a physical item similar to a USB drive that consumers use to access crypto assets, the complaint stated. Reportedly, Ledger sells its products through a number of distributors and also directly to consumers through its own website, which Shopify powers. ....

St. Michael Medical Center has settled a class-action lawsuit brought by a nurse who alleged staff members weren’t properly compensated for lunch and other breaks.
The 2019 lawsuit, filed in federal court by a nurse at the hospital’s former Bremerton campus, alleged that nurses’ unpaid breaks and 30 minutes for lunch are “continuously subject to interruption,” which violates Washington state labor laws and the federal Fair Labor Standards Act.
Virginia Mason Franciscan Health, the hospital system that owns St. Michael, reached a settlement on the case in late January, according to court documents filed last month. The settlement amount is undisclosed. ....

On Wednesday, Celgene Corporation and its parent Bristol Myers Squibb Company filed an opposition to the plaintiffs’ motion for remand in an antitrust lawsuit alleging that the defendants overcharged the plaintiffs for two cancer treatments, Revlimid and Thalomid. The defendants had previously asked for dismissal for failure to state a claim upon which relief can be granted, or in the alternative, transfer.
