AURORA, Ill. - A 35-year-old man is accused of driving drunk and causing a crash that killed his passenger Sunday in west suburban
Gustavo Gutierrez-Aguilar is charged with multiple counts of aggravated DUI and one count of reckless homicide, Aurora police said in a statement.
The crash happened about 6:15 p.m. at the intersection of Mountain Street and Austin Avenue, when Gutierrez-Aguilar lost control of the car he was driving and slammed into a tree, police said.
When officers arrived, Gutierrez-Aguilar, who got out of the car, was struggling to walk and maintain his balance, according to police. Officers allegedly noted a “strong” smell of alcohol on his breath.
Officers on scene found the driver of the vehicle, who they allege is 35-year-old Gustavo Gutierrez-Aguilar, struggling to walk outside of the vehicle and struggling to maintain his balance. Officers say they smelled alcohol on the driver’s breath, and he was transported to an area hospital.
Officers also found a man inside the vehicle in the passenger’s seat. The man was also hospitalized, but he was pronounced dead as a result of his injuries.
Gutierrez-Aguilar faces seven felony counts, including six counts of aggravated DUI and a felony count of reckless homicide. He was taken into custody by police after being treated for his injuries.

A 35-year-old Aurora man has been charged with reckless homicide after a crash Sunday killed a passenger in his vehicle.
Gustavo Gutierrez-Aguilar, of the 0-100 block of Margarets Lane, was drunk when he lost control of his car and struck a tree at Mountain Street and Austin Avenue, Aurora police said in a news release.
The crash happened around 6:15 p.m. Police say they found Gutierrez-Aguilar outside the vehicle. He was having trouble walking and maintaining his balance, and an officer could smell alcohol on his breath, police said.
