A jury acquitted garciazarate after first and seconddegree murder, but found him guilty on a charge of a felon in possession of a gun. His attorney appealed. To be the the First District court of appeals overturned that conviction, saying the judge failed to instruct the jury to consider garciazarate only momentarily possessed that gun.
