Trade Court Upholds Anti-Dumping Duties On Chinese Garlic
Law360 (April 19, 2021, 9:27 PM EDT) A U.S. Court of International Trade judge upheld anti-dumping duties Friday on fresh garlic from China over a challenge from a Chinese exporter, finding that the exporter had not been upfront with the U.S. Department of Commerce about its U.S. sales.
Court of International Trade Judge Gary S. Katzmann denied Qingdao Sea-line International Trading Co. Ltd. s request for judgment on the agency record and sustained Commerce s final results, finding that Commerce identified many inconsistencies in Sea-Line s reported U.S. sales price even after probing the company for more information.

CIT Says Commerce Properly Calculated Rebar Subsidy Rates
Law360 (February 19, 2021, 3:53 PM EST) The U.S. Court of International Trade rejected a challenge to countervailing duties on Turkish rebar, ruling Friday that U.S. trade officials used reasonable metrics to conclude the imports were being improperly subsidized by the Turkish government.
Judge Gary S. Katzmann rejected multiple challenges to the methodology used by the U.S. Department of Commerce to arrive at its conclusion, and said İÇDAŞ Celik Enerji Tersane ve Ulasim Sanayi AS and Çolakoğlu Metalurji AS benefited from various programs implemented by the Turkish government, including interest-free loans and cheap natural gas.

This morning in metals news: the United States Court of International Trade issued a ruling on the Section 232 steel tariff; meanwhile, the Biden administration has reversed a Trump administration decision regarding tariffs on aluminum from the United Arab Emirates; and, lastly, new orders for manufacturing goods rose for an eighth consecutive month in December.
USCIT dismisses Section 232 steel tariff challenge
In early 2018, former President Donald Trump imposed tariffs on imported steel and aluminum. Using Section 232 of the Trade Expansion Act of 1962, Trump imposed tariffs of 25% for steel and 10% for aluminum.
It is unclear if the new Biden administration will ultimately rescind the tariffs in a blanket sense (more on that shortly).
