This after the magistrate who was supposed to hear the application was reportedly involved in an accident .
News24 understands he was hit in a shooting which claimed the life of a lieutenant colonel on Sunday.
The bail application of alleged underworld figure Nafiz Modack was postponed on Monday due to the unavailability of the magistrate, who was understood to have been wounded in a shooting in which a Cape Town police officer was killed.
Modack, Zane Kilian and alleged money launderer Ricardo Morgan are accused of the murder of Anti-Gang Unit (AGU) detective Charl Kinnear.
Zane Kilian’s lawyer has approached the Western Cape High Court to appeal against a decision by a magistrate not to grant bail to the former professional rugby player implicated in the murder of Anti-Gang Unit (AGU) section commander Lieutenant-Colonel Charl Kinnear.
In the application, Kilian’s advocate Marius Botha argued that the case against Kilian was weak and that the possibility that he would be found guilty was “remote”. Kilian is appealing against the ruling made by magistrate Nonkosi Saba on 18 March, refusing him bail.
The debt collector is charged with murder, conspiracy to commit murder and contravening the Electronic Communications and Transactions Act.

Kilian is accused of playing a role in the 18 September 2020 murder of Lieutenant-Colonel Charl Kinnear who was assassinated outside his Bishop Lavis home in Cape Town.
He also faces charges in connection with the attempted murder of attorney William Booth, who was shot at outside his Cape Town home on 9 April 2020 a case in which underworld suspect Nafiz Modack now also faces charges following his arrest last week.
