One would be to appeal to a larger panel of the Ninth Circuit. Its called an en banc hearing. 11 judges picked randomly from the remaining 26 judges in the Ninth Circuit. He could appeal to the u. S. Supreme court and he could try the case on its merits in district court. He seemed to suggest he would do that by saying that he will win eventually. The fourth option would be to rewrite the Executive Order. Make it clear that legal permanent residents such as green card holders are not affected by the travel ban.
