no. reporter: creado too took a plea deal, admitting he recklessly deprived brendan of oxygen but never said how or why he did it. the judge sentenced d.j. to ten years in prison. outside, no one from the prosecutor s office or the boy s mother, sam dinoto, would comment. both d.j. s attorney he absolutely believes this was a plea that was too good to turn down. he s going to do ten years instead of potentially the rest of his life. reporter: along with his parents and grandparents the wrong person is sitting in jail. reporter: say he didn t kill his little boy. something happened to brendan that night. he was stolen out of thin air, and i hope some day we get answers. it won t stop until i find answers or i die. reporter: now, d.j. creado was initially arrested on that murder charge january 11th of 2016. we can tell you that the judge will give him credit for that year and nine months that he s already served. on top of that, he only has to serve 85% of h

jim. we know the jury was having hard time deciding because they kept asking to see the interview video with david dj creato the morning that his son was reported missing. so they were really trying to look into that video for answe s and ultimately a jury of 12 people could not decide together on whether or not he was guilty or innocent of killing his son. now the jury got back to work this morning at about 9:15 and then by about 10:45, they came back to the judge to tell them they just could not agree. all 12 of them not able come up way unanimous decision. much of the this case was circumstantial evidence. knowing that david dj creato was the only known person to be with his son brendan back on the morning he was found dead and also seeing in a long series of text messages that dj creato was having a lot of trouble with his teenaged girlfriend at the time who didn t like being around his son. however there was no evidence presented that linked dj creato to the crime scene
good afternoon we begin with breaking news in the trial of david creato jr. the south jersey father accused of killing his own son. the judge dismissed the jury after failing to reach a verdict. for more on what this means for the case we go live to katherine scott live at the courthouse in camden. reporter: that is right rick and sara, the jury said they could not reach a verdict so this morning the judge declared a mistrial in this case and dismissed the jurors, there was an indication this could happen. yesterday the day wrapped up the jury saying they were having trouble reachling a verdict and the judge encouraging them to go back. and today they influenced they could not do it in light of the that the jury is not in a position to be able to reach consent in this matter. accordingly at this point in time i m going to dismiss you and thank you for your services. so the judge thanked the jurors for their service and left the courthouse without any comment. around 11:
