Good afternoon we begin with breaking news in the trial of david creato jr. The south jersey father accused of killing his own son. The judge dismissed the jury after failing to reach a verdict. For more on what this means for the case we go live to Katherine Scott live at the courthouse in camden. Reporter that is right rick and sara, the jury said they could not reach a verdict so this morning the judge declared a mistrial in this case and dismissed the jurors, there was an indication this could happen. Yesterday the day wrapped up the jury saying they were having trouble reachling a verdict and the judge encouraging them to go back. And today they influenced they could not do it in light of the that the jury is not in a position to be able to reach consent in this matter. Accordingly at this point in time im going to dismiss you and thank you for your services. So the judge thanked the jurors for their service and left the courthouse without any comment. Around 11 30, prosecutors and little brendon creatos mother left the courthouse without comment either. Since closing arguments, the jury spent a lot of time together revisiting evidence and some evidence they heard multiple times. Including the video of him hearing his son was dead. He maintained his innocence but prosecutors say he killed his son because he got in the way of his then girlfriend. There was no video or dna evidence linking creato to the case. Through the trial they felt they established motive and opportunity the defense team said that prosecutors did not meet their burden of proof. Creatos attorney is decision pointed with the outcome and his family walked out with the attorney but they deferred to him comment. Dj wanted to go home to his family. And its heart breaking for all of them. So at this point creato remains in custody and his Attorney Says he will file a motion to reduce hi bail so hopefully he can walk free but the judge will revisit this matter on july 5th, the thought is that they will have a retrial in this case but that is not determined as of yet. Call 911 if you spot him. Investigators are trying to investigate how a girl became injured inside of a home in the olney section of philadelphia. Now a scene where police were earlier this morning. And he told me his daughter is now brain dead and his sons whereabouts are unknown at this hour. A heart broken father and his son spoke with police this morning after a har if iing and strange night. It became with a call about a stolen car and ended with a 7yearold girl fighting for her life. Beautiful, smart, intelligent, active played with all the kids on the block. Im in shock and disbelief. Rihanna says she was jolted out of bed with terrifying screams that seemed to be coming from her neighbors home and walked out of her home into the night and a streetlight illuminated the scene below. The child was on the grown and the cop was trying to resuscitate her and they brought her to the hospital. They got a call on the 5900 block of north american street when an officer arrived she told him that her 18yearold car sped off with her car. They went down into the basement to get her i. D. And made a horrifying discovery. She ran out with her 7yearold daughter in her armed, she was frantic and stated that the child had a plastic bag over its head. The officer called for backup and continued cpr in the back of a Police Cruiser as they rushed to einstein hospital. And the search for the brother intensified.
