Austin cases highlight task of balancing public safety, bail reform


Octavia Boyd sits in her backyard, wiping tears and scrolling through pictures and videos from her mother’s happiest times.
There’s one of 68-year-old Rose Davis from not long ago, sliding across her carpeted living room floor dancing to R&B. In another, she’s showing off a fashionable Sunday church hat. And in a throwback, Davis is dressed in a white starched uniform decades ago, carrying a medicine tray at one of several Central Texas hospitals and nursing homes where she spent her 40-plus year nursing career.
“She was a beautiful person,” Boyd said, “always laughing, always telling jokes.” ....

Grant-funded public defender office up and running in Travis County


Travis County s new grant-funded public defender office is up and running, taking on a small percentage of criminal cases since it was founded a year ago.
The office is designed to take on a bigger caseload as it grows. However, even by the time its four-year grant runs out, Travis County s current system which uses a rotating slate of private attorneys to argue for clients who can t afford representation will still be in place for the majority of cases. 
As of March 31, the new office was taking on about 5.5% of indigent defense cases. By 2024, officials expect it ll be handling about 30% of such cases, with the Capital Area Private Defender Service Travis County s current system handling the rest. ....

1) Jan. 23: Council Nixes Low-Level Pot Busts In 2019, the Texas Legislature legalized hemp, defined as cannabis with a THC concentration of less than 0.3%. Because the test to determine that percentage is not widely available, many district and county attorneys subsequently decided not to prosecute low-level possession of marijuana cases. At the beginning of 2020, Council unanimously voted to end such arrests (which are already discretionary) in Austin; however, Austin Police Department Chief Brian Manley pushed back, saying possession is still illegal and APD will still enforce marijuana laws. Even so, though arrests are still possible, there s no longer a possibility of a court case or jail time.  ....
