GovGuam: In-person abortion law requirement not an obstacle

While the American Civil Liberties Union has sued the government of Guam, alleging the part of the abortion law that requires doctors provide information to women in person is a burden, the government of Guam stated that’s not the case.
The ACLU and Guam attorney Vanessa Williams sued on behalf of Hawaii-based doctors Shandhini Raidoo and Bliss Kaneshiro, who want to be able to provide telemedicine medication abortions to women on Guam. Since mid-2018, no doctors on the island have provided abortions after the last doctor who did the procedures retired.
Deputy Attorney General James Canto II stated in his opposition to a motion for a preliminary injunction that the ACLU s and the doctors’ claim the “in person” part of the law poses an inconvenience. ....

Doctors seek preliminary injunction in abortion lawsuit

Bevacqua summarized documented instances of abortion among CHamorus in the early 1900s.
He noted the 1990 law banning abortions in Guam introduced by then-Sen. Elizabeth Arriola, which was later struck down by the court. Bevacqua highlighted the efforts of women who were against the abortion ban, including attorney Anita Arriola, then-president of Guam Nurse’s Association and now-Gov. Lou Leon Guerrero, and his mother, Rita Lujan Bevacqua, who succeeded Leon Guerrero as president of the Guam Nurse’s Association.
“With the current lack of access to legal abortion in Guam, the same concerns that animated opposition to the 1990 ban are once again relevant,” Bevacqua stated. “In my opinion, forcing people in Guam to travel several thousands of miles, … to obtain care when access to safe and legal abortion can and should be made available on the island imposes a dignity harm on Guamanians.” ....

Attorney: Law change would void ACLU abortion lawsuit

A change in Guam’s current law to allow telemedicine medication abortion would mean the American Civil Liberty Union’s lawsuit against the government of Guam isn’t necessary, said attorney Vanessa Williams.
“If the legislature updated the laws sufficiently to allow the physicians in this suit to provide care to people in Guam using telemedicine, then the lawsuit would not be necessary, and GovGuam would not waste money defending unconstitutional laws,” Williams said.
Williams and the ACLU, on behalf of two Hawaii doctors Shandhini Raidoo and Bliss Kaneshiro, filed a lawsuit against the Attorney General of Guam, the Guam Board of Medical Examiners and the Commission on the Healing Arts of Guam. The plaintiffs want a court order to allow doctors to provide telemedicine medication abortion to residents on the island. ....
