Judge rejects effort to overturn Wolf dining ban


A Commonwealth Court judge has rejected an effort by a group of restaurants to overturn Gov. Tom Wolf’s ban on indoor dining implemented in response to rising COVID-19 cases.
Three Luzerne County restaurants — Tammy’s Kitchen in Larksville, Benny Brewing Co. in Hanover Twp. and Breaker Brewing Company in Wilkes-Barre Twp. — joined a statewide coalition of more than 20 Pennsylvania restaurants in the suit.
The lawsuit alleged Wolf’s order, which went into effect Dec. 12, violates the equal protection clause of the U.S. and Pennsylvania constitutions by unfairly treating bars and restaurants differently than other businesses that attract large groups of people. ....

NEPA restaurants join suit to overturn indoor dining ban


Three Luzerne County restaurants and one in Lackawanna County have joined a legal battle to overturn Gov. Tom Wolf’s ban on indoor dining recently implemented in response to rising COVID-19 cases.
Harvest Seasonal Grill and Wine Bar in Moosic is among a group of restaurants statewide that signed on as plaintiffs to a recent lawsuit seeking an emergency injunction to overturn Wolf’s order and/or not let him extend it past its current expiration date of Jan. 4.
The business owner, Dave Magrogan, who owns nine locations in Pennsylvania and Delaware, testified Wednesday during a hearing before a Commonwealth Court judge. ....
