Needs to be written. and again, let s realize that this is a statute that is used sparingly, rightfully so, it is for complex matters where district attorneys determine it s important to get some feedback and indication from the residents of the county list whether there is any there, whether there are criminal charges or other models that need to be taken into account. and so that is what makes it special. and every case is different. so you are not going to have an identical report or an identical form or any of the things that have been called for in the motion. that just makes it more cookie cutter, and really does a disservice, i think, to the uniqueness of the matter is that this statute would apply to. so it sounds like you don t expect this motion to succeed. but how much delay can this motion create? well, i think that is still ....

Yet to be seen. i think we anticipated that there would be a flurry of motions after an indictment, if one is coming we are still waiting for that, obviously. so to get a motion like this, which is effectively a motion to dismiss, a motion to recuse, prior to indictment, is somewhat out of the norm certainly in my experience, i haven t seen one filed with this timing. but we expect a very robust motions practice will which will cause delays and things for the case to get through whatever its ultimate course is going to be, whether that is a possible plea or in front of a jury or a whole host of options. so this is just the beginning. and again, i think that the next big step is to see what, if anything, the judges do with this motion. whether the da responds and in particular, whether they re indictments, who is named and what types of charges we might see in that. when he s fleming, thanks ....
