The CMA has today welcomed the Court of Appeal’s decision to dismiss all 4 of Facebook’s grounds of appeal in a key case on how companies engage with the CMA.

The Court of Appeal criticised Facebook’s conduct, saying the “central problem in this case was entirely of Facebook’s own making”, and agreeing with the Tribunal’s finding that the company “sat on its hands” and “did not properly engage” with the Competition and Markets Authority (CMA) following its derogation request.

Class Action Lawsuit Filed Against Apple in the UK For Overcharging App Store Customers

A class action lawsuit has been filed against Apple in the UK for overcharging nearly 20 million UK customers for App Store purchases. The lawsuit has been filed with the UK’s Competition Appeal Tribunal. It alleges that Apple’s 30% App Store fees and not offering an alternative payment system allows it to generate “excessive levels of profit.”
The lawsuit wants Apple to compensate all iPhone and iPad users in the UK, with a staggering £1.5 billion being claimed in damages. The lead claimant of the case is Rachael Kent, a professor at King’s College London. She says, “Apple is abusing its dominance in the app store market, which in turn impacts U.K. consumers.” She claims in the lawsuit that “Apple guards access to the world of apps jealously, and charges entry and usage fees that are completely unjustified. The competition watchdog still has concerns about platform technology provider FNZ’s purchase of GBST after relooking at evidence in relation to the deal.
In the latest turn of the long and winding saga, the Competition and Markets Authority has returned to the view that the transaction “would raise significant competition concerns”.
The CMA has been reassessing its decision to block the merger after FNZ launched an appeal with the Competition Appeal Tribunal.
Since the CMA launched its initial investigation, FNZ has continued to defend its position and argues that it and GBST “do very different things”. ....

The JSC interviewed eight candidates for two vacant posts at the apex court.
The list of recommended candidates will be sent to President Cyril Ramaphosa who will make a final decision on who to appoint.
The Judicial Service Commission (JSC) has revealed the names of five candidates who it will recommend to President Cyril Ramaphosa for vacancies on the Constitutional Court Bench.
The names were announced on Wednesday.
