At no point in the sad decade-long history of the state Joint Commission on Public Ethics has anyone ever said that the major flaw in its structure was the fact that it can t directly sanction misbehaving members of the state Legislature.
Until last week, that is, when Gov. Andrew Cuomo was asked if he supported a bill that would reform JCOPE s goofy appointment system, which grants state Senate Republicans the power to name three commissioners to the panel while the chamber s supermajority Democrats only get one appointee, and voting requirements that can stand in the way of investigations even when they re supported by a majority

VICTOR Proceedings in a driving while intoxicated case against former Assemblyman Brian Kolb continued Thursday in Victor Town Court, with plans for a possible verdict on the morning of July 15 after Judge James Mulley of Penfield Town Court has had time to review motions, memos from the prosecution and defense in addition to all relevant evidence.
Beginning at 10 a.m., the prosecution called three expert witnesses who provided testimony, before getting cross-examined by Kolb s defense attorney Christopher Schiano. Schiano attempted to cast doubt on the procedures for maintaining and servicing the DataMaster DMT breathalyzer with the first witness Steve Carluccio, supervisor for New York s Highway Safety Technology Unit s Equipment Repair division.
