VICTOR, N.Y. (WHEC) We could have a decision in the drunk driving case against a former assemblyman by July.
Deputies say Brian Kolb crashed a state-owned SUV on News Year s Eve back in 2019. The crash happened on County Road 41 near his home in Victor.
Deputies charged Kolb with DWI and making an unsafe turn.
Kolb, a former top Republican in the New York State Assembly, admitted to drinking four or five cocktails at the Erie Grill in Pittsford, according to court documents. A breath test showed his blood-alcohol level was 0.16% twice the legal limit.

VICTOR Proceedings in a driving while intoxicated case against former Assemblyman Brian Kolb continued Thursday in Victor Town Court, with plans for a possible verdict on the morning of July 15 after Judge James Mulley of Penfield Town Court has had time to review motions, memos from the prosecution and defense in addition to all relevant evidence.
Beginning at 10 a.m., the prosecution called three expert witnesses who provided testimony, before getting cross-examined by Kolb s defense attorney Christopher Schiano. Schiano attempted to cast doubt on the procedures for maintaining and servicing the DataMaster DMT breathalyzer with the first witness Steve Carluccio, supervisor for New York s Highway Safety Technology Unit s Equipment Repair division.
