his past choices in crime, i hope it's a death penalty case. >> reporter: james harris has been formally charged with murder, rape robbery and other crimes. he is right now talking to philadelphia homicide detectives but his arraignment has not yet been scheduled. i'm jesse gary, nbc 10 news. to a developing story in north philadelphia. that's where police say two children were found alone in deplorable conditions. the discovery began when neighbors spotted a 2-year-old child wandering around on north 16th street. the child had foot burns and was dehydrated. authorities found an 11-year-old inside the home which police say was a mess and not fit for children. police are looking for the parents. tonight both kids are in the care of the department of human services. we have new information tonight about the gunman in last night's deadly attack inside a louisiana movie theater. police describe john houser as a drifter who may have suffered from depression and bipolar disorder. investigators say he opened fire inside a crowded movie theater in lafayette, louisiana, killing two people before turning the gun on himself. nbc 10 national correspondent jay gray has the latest from lafayette. >> reporter: police rushed in just after the first shots rang out. >> it was just loud like one big loud bang. made my ears ring. but i knew it was a gunshot. >> reporter: witnesses say a 59-year-old drifter, john russel houser, stood up in the crowded theater and opened fire. >> he looked like he was very calm, just standing there kind of walking down the aisle and firing. >> reporter: two people were killed in the attack, nine others wounded. >> i don't even know what to say about the situation. >> reporter: today as the investigation continues police are learning more about the man they say is responsible. >> he clearly knew what he was doing. clearly had some type of plan. because he bought the ticket was in the theater, had the gun. >> reporter: the plan that according to officers became more clear as they searched the hotel he had been living in. >> we found wigs and glasses and disguises basically in his room. it is apparent that he was intent on shooting and then escaping. >> reporter: things apparently changed when houser spotted officers in the chaos as he was trying to leave. >> he saw the local police officers went back inside. that's when he shot and killed himself. >> reporter: as makeshift memorials grow across this shattered community, police have released the names of the two women killed. 21-year-old mayci breaux and 33-year-old jillian johnson. >> don't lose sight of the fact these two individuals had a vision, had a name had a future. it wasn't to die as they did horribly in this theater here. >> reporter: now police and so many here are trying to understand how and why it happened. police say at this point there's no clear indication of a motive in the attack. the theater remains closed as the investigation continues. jay gray nbc news lafayette, louisiana. >> authorities say the violence started about 20 minutes into the movie "train wreck." many people took to social media to offer condolences to the victims, including amy schumer, who said quote, my heart is broken and all my thoughts and prayers are with everyone in louisiana. while the attack may not stop people from going to the movies it is sparking discussion about safety inside theaters. this is the second major shooting inside a crowded theater. the suspect was able to purchase a ticket and walk right in with a gun. most cinemas do not have metal detectors or armed guards. nbc 10 spoke to movie goers near allentown who said they would be open to the idea of more security. >> i'm not so keen on the pat-down but i have no problem with metal detectors. >> that prevents someone from getting shot or accidents happening, then why not. it's worth it. >> we also spoke with police chiefs in our area who said metal detectors aren't a cure-all and can be circumvented. police say the best defense is for everyone to be alert looking out for any suspicious activity. meanwhile, today's sentencing hearing in the colorado theater shooting trial was canceled. the jury that convicted james holmes is now considering whether he should be sentenced to death for killing 12 people and injuring 70 in july 2012. today a juror was sick so the group was dismissed. meanwhile, the prosecution and defense recorded testimony that will be shown to the jury when they return on monday. officers from around the state of delaware escorted the bodies of two marines and a sailor who were gunned down last week in tennessee. officers escorted the bodies from dover air force base to philadelphia international this morning. they did the same yesterday with the bodies of two other marines killed in the attack. one week ago, a lone gunman shot and killed five service members at a recruiting facility in chattanooga. a makeshift memorial meant to honor those killed is still growing. the gunman mohammad youssuf abdulazeez was killed by police. the investigation into the motive is spanning two continents. some family members are being questioned in the states and others are being detained in the middle east. let's take a look at frawley stadium in wilmington a sunny, quiet scene. the blue rocks are out of town to camel beach. loads of people in the wave pool. the weather conditions are just ideal for any kind of outdoor activity. it's going to be that way tomorrow, too. you see hardly a cloud in the sky. once again, the humidity is extremely low for this time of year. nothing really approaching. so we are guaranteeing tomorrow. that's a sure bet. 85 degrees in philadelphia now and in northeast philly. 84 in allentown. it was down in the 50s this morning. 84 in millville and georgetown delaware. the ocean temperature's still a nice warm 74 degrees. it's going to be a beautiful evening with low humidity continuing but that is going to change as we go into sunday. the humidity goes up and then we are also talking about another heat wave. the numbers on those with the seven-day in a few minutes. from the nbc 10 delaware bureau, an arrest in the murder of a woman found in a wilmington playground. 34-year-old gary perkins is behind bars accused of killing his girlfriend 29-year-old jamie murphy. the victim's body was discovered yesterday on union street. how she died is still unknown. police say perkins had harmed murphy in the past. he is charged with first degree murder. listen to these numbers. 1500 priests plus hundreds of volunteers. we are getting a better look at the staffing needed to pull off the world meeting of families and papal visit come september. pope francis will make several public appearances, it's expected. 30,000 to 40,000 people will gather at independence mall. the secret service tells nbc 10 it can't yet reveal which streets will be shut down. local vendors and restaurants say they will be open and ready to serve up whatever they can for the millions expected to come to philadelphia. >> we are planning to be open as of right now. yes. >> how do you do that? they are saying no food deliveries after wednesday. >> yeah. stock up as much as we can. limited menu. >> restaurants tell nbc 10 they won't be able to have food delivered starting days before the papal visit. big trucks will be banned from city streets. lots of road construction related to the pope's visit is under way. traffic in center city is expected to be congested this weekend because of street work. the good news here a lot of the streets will end up with smooth blacktop. expect repairs to continue for at least a few more weeks. count on nbc 10 to follow every development advantage of it right now in cape may. not everyone is lounging in the sand. >> nbc 10's drew smith is live in atlantic city. >> he's discovered there's no shortage of sports being played this weekend. what kind of sports are we talking about? >> reporter: basketball actually. a lot of people from all over the country are in atlantic city. the boardwalk is packed. a lot of folks ended their games and headed out here. the beach is perfect, too. people are taking part in events and they picked a great weekend to be here. in ocean city surfers came ready to compete in the twelfth annual chip miller surffest. >> we have a perfect day. hardly any humidity at all. lot of friends, family and just good people out here. >> reporter: organizers put a new spin on it showing special needs kids how to surf. >> it's awesome. the kids just love it. it's all the guys out there, local pro surfers came down to help these kids out. it's great. >> reporter: before some families could hit the beach, they hit the basketball court for the live in a.c. tournament. >> people love being down here. you have the beach for the people from the midwest and other areas not by the water. >> reporter: more than 120 teams of high school aged kids from across the u.s. and canada are playing here trying to catch the attention of college recruiters. >> everywhere. i have seen virginia play maryland, people do come from all over. >> reporter: when the sports action ends the players and their families are getting out to see what the shore has to offer. >> we took advantage of it and stayed a few days and had a nice time. >> reporter: we were talking to some of the people from out of town. they are actually going to be leaving tonight. they said the weather was so perfect today they were roads at more than 120 miles an hour but it's who the driver had along for that ride that makes this so remarkable. plus getting right to the point. what another chase suspect landed on that landed him in a hospital bed. also ahead, beware of the butt dial. why those accidental calls could land you in court. why a party invitation from a former eagle is attracting so much attention. philadelphia police want to know who shot and killed the 26-year-old man in north philadelphia this morning. police were called to glenwood avenue just after 10:00. neighbors tell us they heard a lot of gun shots out there. the victim died at temple hospital. family members say his name is rashim richards. no word yet on arrests or a motive. across the delaware several lanes of the nj turnpike finally opened about an hour ago. they had been closed for about six hours because of this. a tractor trailer overturned and blocked traffic. sky force 10 over the mess this morning in mansfield township burlington county. the truck spilled lumber all across the turnpike. two people in the tractor trailer got out with minor injuries. an allentown man is in trouble tonight after police say he led them on a high speed chase with an 8 month old baby in the car. police tell us the chase reached speeds of more than 120 miles an hour. the express times reports police arrested jesse shaw junior this morning. he told police he tried to run because he was driving with a suspended license. the baby was not hurt. a rough ride for new jersey transit customers this week. today's commute got off on the wrong track when amtrak power problems caused delays for amtrak and new jersey transit. it is the fourth time this week. new jersey transit was forced to suspend service in and out of new york city because of amtrak power problems wednesday. the delays were blamed on overhead wires, signal and switch problems. a major power outage at laguardia airport caused dozens of flight cancellations this morning. 45 flights were canceled and five delayed after the power went out at the delta terminal around 4:30 this morning. a contractor accidentally cut two electric feeders that serve a portion of terminal c. generators were brought and it was back on by 8:30. a york county man is in jail tonight for torching a confederate flag mounted on the back of a car. 48-year-old matthew becker was at a convenience store in hanover at 4:30 this morning. police say surveillance video shows becker setting fire to the flag which melted on to the car. no one was hurt. becker is in york county prison on $200,000 bail. two weeks ago, the confederate flag was removed from in front of south carolina's state capitol. the act came weeks after a 21-year-old man allegedly shot and killed nine people in charleston. the suspect, dylann roof posted photos of himself online with the confederate flag. roof faces federal hate crime charges. to a wild police chase in arizona. it was all caught on camera. keep your eyes peeled on that black truck. at one point the man is surrounded by police and nearly runs over an officer trying to escape. eventually, he ditches the truck, starts running, nearly getting nabbed by that dog in the carport. police caught up to him. he spent the night in the hospital because he fell into a cactus during the chase. now your nbc 10 first alert weather with chief meteorologist glenn "hurricane" schwartz. >> what a way to start the weekend. we've got a spectacular evening and a spectacular saturday that is coming, too. little bit warmer but still very low humidity lots of sunshine and no rain. little bit stickier on sunday. the humidity up a bit. still not terrible. the heat wave number three, some of you might consider it terrible by late next week because we have a lot of hot weather coming. a lot of sunshine today, 85 degrees, the humidity only 28%. two degrees warmer than this time yesterday. by tomorrow it will be a couple degrees warmer than today, at least a couple degrees. 80 in lancaster, one of the cool spots outside the poconos. we have had a land breeze at the shore for most of the day so it's still fairly warm there. 79 degrees in atlantic city international. what about right at the beaches? well we've got that too. northwest wind it's still about 80 degrees in sea isle city. atlantic city marina 77. 81 degrees in beach haven. very warm water just offshore. little bit of a southerly or southeast wind this weekend could bring those ocean temperatures up even higher than the current 74 which is still pretty high. fairly warm ocean. we have perfect conditions again. large area of dry weather covering much of the the east. that's going to continue. as we go through the evening hours, we will have another relatively cool and comfortable night, especially north and west. you see some of the temperatures in the 50s overnight and into the morning. future cast not really showing much of anything in the way of clouds. certainly no rain during the day tomorrow, tomorrow night. into sunday things start changing a little bit. but they're not really going to be going downhill a lot. by sunday morning, all right, it will be a little warmer little more humid, few more clouds around especially north and west. but that's still a pretty good day. 90 in philadelphia by noontime and just a chance of a shower mainly up in the poconos, i'm thinking. at the shore, they have the lowest chance of any kind of showers this weekend. certainly no chance tomorrow. 80 degrees with low humidity continuing. the ocean, 74 degrees. in the poconos, low humidity comfortable on saturday and then sunday, little bit higher humidity and a chance of thunderstorms. we have very quiet tropics from the gulf of mexico on the caribbean all the way out to africa. but in this super el nino kind of year this is where storms tend to develop, right near the southeast coast, the gulf of mexico, close to the u.s. they're not coming off of africa with this kind of pattern. this is an area some computer models are showing some development next week so that's definitely something to watch. not that there's anything else to watch in the tropics. nothing's going on. clear and comfortable tonight, 67 for the low in philadelphia. 57 north and west. tomorrow, lot of sunshine low humidity again, highs in the upper 80s. it's not going to feel that warm. sunday, 91 degrees and a little higher humidity, yeah, it will feel more uncomfortable. then on monday a chance of some showers before the real heat comes in and by the middle of the week we are in the mid 90s and it's feeling closer to 100. the shop famous for james and teeshirts will close, the first of 175 stores on sunday. gap has been slammed by online competition. they hope having fewer stores will spur new interest in customers. gap says it will focus on the most successful locations. one store set to close in our region is the gap at the learning more tonight about where bill cosby got quaaludes he allegedly gave to women. according to the "washington post" a gynecologist and sometimes plastic surgeon wrote the prescription. citing a 2005 deposition the "post" reports cosby told a lawyer that the doctor gave him seven prescriptions for the drugs, knowing they weren't for him. the doctor was part owner of a club that cosby allegedly frequented. he's no longer an eagle. >> but his party plans have plenty of us talking. lesean mccoy is ready to throw a bash. the invitation has attracted so much attention. plus pocket over for lesean mccoy. certainly a story that took over twitter in philadelphia last night. former eagle lesean mccoy's party invitation is when you read the fine print, it certainly raised a lot of eyebrows. here's the original invitation. notice it says females only minimum age 21. at the bottom of the invite there. each attendee has to be required to sign a confidentiality agreement and send in their social media account like instagram or twitter. mccoy was ordered to pull the invite because he used the buffalo bills logo. at last check, that e-mail address at the bottom no longer valid. the bills did release a statement yesterday saying he they did reach out to lesean mccoy and informed him players are not allowed to use team logos for personal use without prior permission. that "sports illustrated" just named philadelphia eagles fans as the most hated in the nfl. as we take a look at the eagles current home "s.i." says the hatred for eagles fans began at franklin field back in 1968. that's when angry fans famously pelted santa claus with snowballs. of course the article mentions how 30 years later, the team had to install a resident judge at veterans stadium to preside over the fans. "sports illustrated" didn't just pick on us. they also named the new england patriots as the most hated team in the nfl. new video tonight of a shooting suspect. last monday night a 39-year-old man was shot in the leg on cecil b. moore avenue in the brewerytown neighborhood. this surveillance video shows the suspect before the shooting walking toward the victim, then a man coaxes him back to a burgundy jeep. the suspect drives off. he allegedly shoots the victim. if you know anything, call police. authorities are uncovering new details today about the gunman who went on a deadly shooting rampage inside a louisiana movie theater last night. but the new findings are raising even more questions. police describe 59-year-old john houser as a drifter and according to court documents, he suffered from mental illness. many believe his mental state should have disqualified him from buying a gun. is the big issue here mental health care or is it guns or both? nbc 10 national correspondent steve handelsman has that part of the story. >> reporter: lafayette is the third u.s. mass shooting in 37 days by a suspect said to have mental or emotional issues. in charleston where nine died it was dylann roof. in chattanooga, where five died mohammad youssuf abdulazeez. but all three accused killers got at least one gun. president obama says his failure to tighten gun control is the greatest frustration of his presidency. but in lafayette, some suggest the fix is better mental health care. >> in order to hopefully avoid situations like this occurring. >> reporter: experts say our nation's mental health system is overburdened and poorly funded. >> we probably have 3.5 million adults in the united states with serious and sometimes disabling psychiatric conditions like schizophrenia, bipolar disorder who aren't getting any treatment at all. >> reporter: care for everyone might not mean spotting potential mass shooters. >> we do not have the data that would show that improving mental health for the general population would have any impact in terms of these very rare isolated high casualty mass violent incidents. >> reporter: so colin goddard says focus on the guns. he's a survivor of the virginia tech massacre in 2007. 32 people killed. >> unfortunately i think a lot of elected officials in this country after mass shootings talk about mental health as a pivot to getting away from the real issues of how to improve gun policy. >> reporter: an urgent debate with 16 dead in back to back to back mass shootings. advocates of tougher gun control and better mental health care say far more americans are killed by gunfire and mental illness in every day incidents that in all these high profile mass casualty massacres. steve handelsman nbc news washington. coverage of the deadly movie theater shooting in louisiana continues on "nbc nightly news" with lester holdt at 6:30 following "nbc 10 news at 6:00" at 6:00. a sort of homecoming for president barack obama today. he is in kenya. he was greeted with cheers. his father was kenyan. the president met with relatives including his step grandmother and half sister. he will attend a business summit and make his way to ethiopia to meet with the prime minister. two inspectors general have reportedly asked the justice department to launch a criminal investigation into hillary clinton's use of e-mail. according to the "new york times" the inspectors general concluded that clinton's private e-mail accounts contained hundreds of potentially classified materials. hillary clinton has denied wrongdoing in the past and said no classified e-mails were stored on her private server. got a question here. have you ever accidentally called someone while sitting on your phone? we call it butt dialing. now the u.s. court of appeals in kentucky says if you do it anything you say is fair game. the subject came up in a case where an executive accidentally butt dialed an assistant for 90 minutes or so she listened to him talk about firing someone. she took it to her boss and the man sued her. the court ruled against him. this is the place to be today. a live look down the jersey shore at cape may. i spot for cape may. right? >> yeah. it really is one of the most interesting places in the country. i have been to a lot of beaches in a lot of places. it's definitely a different kind of place. another different kind of place, the weather has been great over the entire area. this is the other end of the picture. this is in the pocono mountains. lot of blue in that sky and low humidity. it is just gorgeous out there. it's been that way for the last three days. no clouds that are approaching, that's for sure. nothing all the way back until you get to chicago, at least as far as any kind of cloud cover. 85 degrees right now, 76 degrees in mt. pocono and near 80 degrees in cape may. 82 in wildwood right now. as we go through the evening, it will continue to be clear. the humidity is going to continue to be low. it won't stay that way all weekend and certainly not next week. the latest on the potential heat wave with the seven-day in a few minutes. can you hear me now? you heard that before right? apparently not so well at philadelphia international airport. the list the airport should not want to be on. plus -- >> hey! >> a skateboarder who wanted no parts of police. that's next on "nbc 10 news at 5:00." philadelphia international is the absolute worst airport when it comes to cell phone service. that's according to a network analysis company. in its latest report the company put cell phone data speeds to the test at the nation's busiest airports. in a tweet, philadelphia international says its wifi system has been upgraded and they believe it is now one of the fastest in the country. to police skateboarding on a major road is an obvious no-no. when an officer pulls this guy over the skateboarder actually tries to bail. the suspect gets the upper hand on the officer. >> hey! >> as the deputies struggle to detain the man, an off-duty firefighter pulls over to help. just as he gets out of his car, a doctor runs to the deputy's aid. the firefighter grabs the man's arm and pulls it behind his back. the officer grabs his other arm and handcuffs him. the firefighter said he's never had real self-defense training. >> i grew up with a house full of brothers and we fought and wrestled all the time. maybe a little of that kicked in. >> the sheriff's deputies say they typically don't recommend intervening in a struggle like that. they say in this case it made a return of heat and humidity in the seven-day forecast. coming up at 6:00 the punishment for the philadelphia traffic court judge convicted on corruption charges tied to ticket fixing. iran keeps their surveillance video shows the 59-year-old walking into the theater to buy a ticket but they say he didn't display behavior that would sound an alarm. houser shot and killed two people and injured nine others before turning the gun on himself. >> nbc 10 security expert is an assistant professor of criminal justice studies at pierce college. he has nearly 15 years experience in the military law enforcement and as an intelligence specialist and defense contractor. >> he joins us live in the digital operations center. bob, this is the second deadly shooting inside a movie theater. should there be extra security measures inside those theaters? >> i don't know if necessarily there should be extra security measures. i advocate for having consistency of emergency action plans and in addition to that possibly metal detectors throughout the united states. >> we found out a woman inside that theater pulled a fire alarm to get people out. experts say she probably ended up saving lives by doing that. what can the average movie goer do in this type of situation? >> it comes back to the department of homeland security. run, hide fight. by pulling the alarm, it raised awareness that there's a situation within the movie theater that there is something not right. getting back to what i just said, run, hide, fight, that's exactly what the average person can do. >> let's talk about the gunman for a moment. they say john houser did not have a recent criminal history. is there something someone should have picked up on? he was able to walk in buy that ticket and enter that theater, no one knowing he had a hand gun on him. >> definitely. there are tell-tale signs that anyone within the community or within his own family that can pick up on. there's tendencies of bipolar and schizophrenic individuals, i'm not a doctor however, i can tell you the tendencies that this gentleman showed i would err on those two sides of caution and definitely there were signs the family and community could have picked up on in advance. >> we will always be asking why. bob, thank you so much for your time. >> thank you, sir. great weather over the weekend in the summertime that means a lot of business to a lot of people. lot of pressure on the forecasters. tomorrow's an easy one. just going to be a super saturday. no doubt about that. sunday, the humidity's going up a bit and so we have to look out for any kind of possible showers. but still looking pretty good overall. next week is a different story. going to be another heat wave and it will be feeling real oppressive. getting closer to football season here. not exactly football weather coming next week though with all the heat and humidity. 85 degrees, the humidity still only 28%. two degrees warmer than it was this time yesterday. today, 86. tomorrow, 88. sunday, 91. with the higher humidity it will feel a little hotter than that. by the middle of next week we will be feeling perhaps like it's more like triple digits. temperatures in the 80s across much of the area and even in cape may and north wildwood we've got 80 degrees because it's a land breeze. so sea isle city same temperature, just about, as the inland areas. what about in atlantic county? atlantic city marina 77. northfield is 80. nothing like those kind of big contrasts you can get at this time of year when you start getting sea breezes. we will get a little more of that as we head over the weekend. we won't get a whole lot more moisture. there's a lot of dry air around and it's going to stay that way. this is the future cast showing hour by hour as we go through 11:00 tonight and overnight, we are down into the 50s north and west. we are in the 70s toward the shore. it's staying pretty warm there. during the day tomorrow getting well up into the 80s. this particular model takes us to near 90 but it's also bringing in the sea breeze tomorrow afternoon which we haven't seen in the last couple days. that's going to be a change. then here we go saturday night and into sunday still not much in the way of cloud cover. lot of sunshine here even on sunday. there we are, temperatures going up but not a whole lot of moisture. it's looking good. so the forecast for the shore generally i would say it's going to be dry this weekend. no way it's going to rain tomorrow. 80 degrees with the sea breeze low humidity. 80, a little more humid on sunday. best chance of any kind of showers this weekend would be in the poconos. sunday afternoon. but even there it's only about a 40% chance of any one spot. again, it will stay dry on saturday. the tropics as we get closer to the peak team of hurricane season are amazingly quiet from the coast of africa all the way across to the caribbean sea, there is virtually nothing. so the one area that we are going to have to be watching is actually pretty close to home off the southeast coast and midatlantic coast. we have some computer models showing some kind of development out here next week and it could at least have an indirect effect on our weather although it would be more likely to go out to sea but that's fairly close to home. that's what happens in these super el ninos. you don't get the monster hurricanes coming all the way across the atlantic. you get the ones close to the coast. clear and comfortable tonight. 67 for the low in philadelphia. 57 north and west. tomorrow, another day with very low humidity even though it will be a couple degrees warmer. highs in the upper 80s. then low 90s on sunday with a little bit higher humidity little bit higher chance for showers and storms on monday and then a lot hotter and more humid as we go through the middle of next week. by wednesday and thursday we should be feeling like we're in triple digits. >> glenn, new at 6:00. >> reporter: many of the details in this 17-page federal motion are really too graphic to broadcast. but the co-owner of capasso at this rittenhouse restaurant tells us the workers only learned about this arrest late this afternoon after that chef went suddenly radio silent earlier this week. the 41-year-old restauranteur has been a leading force behind other bars and eateries in philly and over in collingswood. over the past several weeks, prosecutors say he not only exchanged pornographic images of a 5-year-old girl whom he described as his ex-girlfriend's niece, but he allegedly also communicated his desire for in-person physical sexual abuse of his own unborn daughter and the undercover agent's 9-year-old child. >> i found out the same way as everyone else. the last three hours have been like a tailspin. you know i haven't seen him for the whole week. i wasn't sure if he was sick or something was happening. >> reporter: according to the feds, capasso began communicating with the undercover officer on july 6th and was arrested exactly two weeks later this past monday. he allegedly told investigators that he threw the cell phone containing those pornographic images off a bridge and into the river. the fbi says they later found it in his
