with more on what this means and what is happening next. >> reporter: the court found the ban violated the united states constitution, a big victory for marriage equality supporters in virginia. the panel of u.s. court of appeals ruled 2-1 that same-sex couples do have the right to marry but not everyone was happy to the ruling arguing to enforce the ban on same-sex marriage judge palm niemeyer said failing to define marriage as a union between a man and woman would allow everyone to marry like father-daughter arguing that a majority of virginians back marriage equality. a plaintiff in the lawsuit against the state spoke after the decision was made from richmond. >> as a mom i'm so proud that virginia, our home state, has recognized that we are just like everyone else who desires to be married. we thank judges niemeyer, gregory and floyd for hearing our case and rendering their decision on our behalf. >> reporter: the state of virginia does not have to start handing out marriage v.a. has caused this problem and one of the ways we can help solve it is to give veterans a choice. the v.a. reform bill announced monday would allow vets who have been waiting for care longer than 30 days or live 40 miles away from a v.a. facility to see a private physician. open up to 27 new v.a. facilities and give the secretary more power to fire executives in the agency. the bill has a $17.5 billion price tag. >> planes and tanks and guns are a cost of war. so is taking care of the men and women who used those weapons and who fight our battles. >> reporter: veterans groups say if congress passes the bill, it will make a difference. >> for those veterans who are waiting right now who have been on the secret waiting lists, who have been reached out to, coming out shadows now, immediate
