bad breaking news story. guy who shot the cop was not caught last night. obviously when we have breaking naus like this even police get their information wrong sometimes. so they initially thought they had caught two guys, both guys in the car break in. it turns out this was a armed carjacking and guy who shot the cop got away. the guy and the gun are still on the streets, police looking for him, all they have is a first name right now, second guy that they did catch somewhat cooperating but not fully cooperating. who was the other guy we arrested? we told you a all morning they were looking for somebody. they were looking for the shooter. other guy they had in custody turns out to be another robbery victim. witnesses around the scene at the time said police were there because there was a mugging by the el train. we are taking you to the scene at 59th and market for you people just joining us. eight minutes before 9:00 last night. woman ran to police for help. it turns out she was a carjacking victim wasn't just a car break in. the there was a violent crime in progress. officer jim mccollough and his partner trying to catch the two guys as they are in the car and they both run out. one guy with the gun and woman now tells police she saw a gun. that guy used a gun when mccollough tackled them and shot mccollough and it turns out he has gotten a away. we have gotten new information from commissioner ross who got new information overnight from he came into work this morning, here's the latest. >> we found out it was intact a carjacking, they tried to carjack a female who was seated in the car. we do not believe that we have the actual shoot inner custody. we have direction on that but we do have the second male in custody. the non-shooter. we're working hard to develop additional information. >> reporter: i was told you are were looking for third guy but you are just looking for a second guy. you never had two guys in custody or wrong guy. >> it is only two. i think what happened was the third guy was actually a separate robbery victim which was usually loosely connect to this but that is a little confusing. so rather to get into all that, that is where we are right now. >> reporter: you don't have the man in custody who shot officer mccull. not at this time. we are looking for him. homicide division has direction with regard to his identity. but we have non-shooter in custody. >> reporter: there is the breaking news, guy who shot the police officer last night not caught. he is still out there. obviously if he will shoot a police officer, he will do it again. you will see the swat team involved as soon as they learn maybe where this guy is but right now they don't necessity where he is and he and his gun are still out there if they tried to kill a cop once these officers know he won't hesitate to do it again especially now that he is wanted for the attempted murder of a law enforcement officer. any new news we will get it hospital right now and is that where dave kinchen is at penn presbyterian. >> reporter: that part of the story also developing in bits and pieces. we know officer mccollough is in stable condition and sources telling us he is expect to be released today, released from penn presbyterian hospital where he met with mayor jim kenney overnight. by the way we can tell you that the the officer's jurist considered by sources to be a flesh wound that the bullet it did not pierce any bones. so that is good as well. the ppd's top brass they tell us, of course, officer mccollough is 24 years old and been on the force for two years. he is joined here the at the hospital with his fiance and his mother. he had has a two-year old daughter, now officials officer mccollough applied his own tourniquet. mayor certainly good news right there, as we want to continue to monitor this at the hospital. back to you. early morning fire spread in upper darby starting just before 2:30 at 100 block of ardmore avenue. fire officials say that home was being renovated n1 was living there one fire fighter was treated for a sprained ankle. no word on how that fire started. philadelphia police are looking for a person responsible for shooting up a car in the city west oak lane section overnight. shooting happened around 1:00 o'clock this morning on the 6800 block of side ham street. police tell fox 29 that three people were taken to the hospital gun the shot wound. one of them is in critical condition. a car, driven to the hospital, to take victims was riddled with bullets. no arrests have been made. still no word on the motive behind a deadly triple shooting inside a kensington home yesterday morning. this happened on the 600 block of east west more land street. police say the suspect called 911 saying he shot someone but was not ready to surrendered just yet. when swat team arrived the man refused to open up the door, investigators say he fired a shotgun when they climbed to the roof. the the suspect eventually surrendered and three bodies were discovered inside. none of the victims have been identified and police are unsure of the motive at the this time. charges are this morning in the shooting death of the four year-old philadelphia girl. police say that a man who was either the girl's father or stepfather admitted to accidentally shooting the girl at a kensington home saturday afternoon. police were initially told that the girl's five-year old brother shot her. pennsylvania officially becomes the 24th state to legalize medical marijuana over the weekend. governor wolf was surround by supporters during the bill signing yesterday, at the state capitol. the bill lets patients take marijuana a in the form of the bill, vapor, ointment or liquid. patients cannot smoke it or grow it, the earlier, just before. that is why police were in the area to begin with. so they don't have the shooter of officer jim mccollough in custody, they don't have the guy or his gun. we also said they never found his gun. now we know why. because they never found the shooter. here's commissioner ross who just talked with us with an update. he just found this out too. here's what he said about a blaze and his current situation. >> so blaze was diagnosed with ewing sarcoma, after a couple weeks of limping he was diagnosed in february. he is currently under going treatment. he is about halfway done. and then a couple weeks he will have extensive surgery, they are going to take out the diseased part of his leg and make a graph from his lower leg. >> okay. >> so he will require extensive recovery and we were hoping to do that at home and that is how basement remodel happened. >> how did the villanova fans come around. >> well, amy has been a big fan for a while. we went to villanova a we contacted a family friend to do the basement rehab for us and he kind of got the ball rolling. couple phone calls here and there. we ended up connecting with reid dunphy and she connect with ashley howard. >> the basement was actually done so he can play at home, during his rehand billtation and what did you think when you came down in the play house and the basketball guys were down there, were you surprise. >> yeah. >> i am so happy, that i got to chance to see you on the parade route. we were covering the parade, of course and afterward i was talking to the fans and out of the corner of my eye i spotted blaze and mom and i am so happy i came over. here you are, look. do you remember that, when i met you you on the parade route and you gave the big v forville know of, mom and dad with
