sure what you can see it's very dark. this all started in building c inside the vaughn correctional facility. that is where 100 inmates are housed. it happened about 10:30 this afternoon. right now what you are seeing is an overwhelming police response, ambulances, other law enforcement continue to pour in. we saw correctional emergency response and tactical teams along with the fbi has been on scene. it's been reported by recorded phone call from inside the prison to local news journal newspaper that inmates want better treatment. that may be the reason for this takeover. so as it stands right now, four officers remain being held hostage. no word on their condition. or how many inmates are holding them. >> progress toll 40:00 p.m. this afternoon that one correctional employee was released and transported by ambulance to a local area hospital with non-life threatening injuries. at this point we do not know if there are any other injuries or persons injured. work wig the department of corrections the fbi and delaware state police we continue negotiations to obtain a peaceful and safe resolution. >> reporter: now just a little background here. the james t. vaughn correctional facility is delaware's largest state prison. it houses 2500 inmates. it also houses the state's death row population, but right now, this maximum security prison going into crisis motor going on its seventh hour right now, and just a few minutes ago, i did speak with a corrections officer. did he not want to be identified. i told him, crazy day here, h you h? he slugs his shoulders told me, guys, every day is a crazy around here. we'll have more tonight at 10:00 o'clock. >> all right, chris, thank you. in berks county a toddler is dead now prosecutors say her parents are to blame for not getting her medical care. ella grace foster died at just two years old. >> prosecutors in this case say the little girl died from pneumonia. fox 29's dawn timmeney is live in reading. dawn? >> reporter: well, lucy and iain, district attorney here tells us that the family called their pastor whose actually the little girl's grander father the night before she died, and he anointed her basically praying and rubbing oil on her forehead, but no medical treatment was sought because it is simply against the family's religion. >> to me it's incomprehensible. >> reporter: berks county district attorney john adams details the tragedy that unfolded in this house on ta talbert role in upper top hawkin township in last year. state police responding to the death avenue two-year-old little girl. the children had basketball sing sick for 24 to 48 hours. her breathing was labored. she died in her father's arms after his wife called him home from work. >> both parents indicate that they did not believe in medications or doctors and the death of the victim was god's will. >> reporter: jonathan and greg foster are members of non denomination al church and it is completely against they are religion to take any live-saving measures. an autopsy two days later revealing the little girl died of pneumonia. >> if the victim would have received medical treatment that there was a 95% chance or better that the victim would have survived. >> reporter: the parents have been released on unsecured bail and are back in their family home caring for their six other children who range in age from infant to 10 years old. the district attorney says a very close eye is being kept on them. >> sure there's a safety plan that's been imposed, and the children are being monitored so that if there is an illness, they will will be taken to doctor. >> reporter: according to the district attorney, that has already happened. another child was sick after little ella grace died, and that child was taken to see a doctor. the parents face up to 12 and a half years in prison if convicted of involuntary manslaughter and endangering the welfare of a child. iain and lucy? >> thank you, dawn. next step in the sexual assault case against comedian bill cosby decide two things where to hold his trial and who will hear the case. a judge today set a february 27th hearing on those issues. cosby's defense team is worried the potential pool of jury ours in montgomery county have seen too much news could have ratch of this case. prosecutors don't have problem with bringing in an outside jury but they want the trial itself held in montgomery county. right now that's set to begin in june. young teacher is in jail tonight accused of having sex with a student and police say their relationship began at a school for troubled girls in delaware county. fox 29's dave kinchen is live in radnor. dave, what happened here? >> reporter: well police say it all started with teenager passing a note to the teacher asking about kissing that teacher and police say what happened next was a month long sexual relationship. >> did you have sex with the minor? not one word from former radnor township teacher nina scott. 28-year-old facing 34 counts of institutional sexual assault of a minor after an alleged sexual relationship with a 16-year-old female student when she attend the village school for troubled girls in rose montgomery. >> the only way i can describe what this teacher did is down right disgusting. >> cops say scott and the teen had sex in scott's downingtown apartment and on the grounds of the village school between february and october of 2016. a claim the school disputes. >> just from a personal perspective as a parent and as a police officer for 36 years, never ceases to amaze me when you put children in the care of a position such as a teacher that they violate that trust. >> reporter: police say the keep-year-old girl was moved to a youth services center luzerne county where investigators found her journal and love letters written from scott calling the teen her girlfriend. scott also said her two-year-old daughter is their daughter adding, we miss and love you, too, giving your daughter a hug and a kiss. >> what did she say about these charges? >> first and for most i'm not going to comment on the facts that at this point. i think it's really important to remember at this point that, you know, miss scott is presumed to be innocent first and for most. that's the most perform thing. >> reporter: investigation documents say it started with the teen writing a note to scott asking about kissing her with scott replying that it would be their secret. police also say scott originally lied to them to protect her job and child but ultimately admitted to the physical relationship. >> right now we're in the process of reviewing the charges. reviewing the allegations. >> reporter: village school also released a statement saying that it's their understanding the alleged incident did not, did not happen on school property. they also say that nina scott was suspended and then fired once charges were pending. back to you. all right, thank you will have little bit of a wind especially by 11:00 o'clo 11:00 o'clock. a chilly breeze with a temperature of 40 so wind chill will be a factor. take a look at these future wind gusts. now tomorrow morning, not so bad but by the afternoon it will be gusting to 25 miles an hour in philadelphia and its suburbs. gusting to around 20 miles an hour in the poconos. putting a bit of a chill in the air with information from a student or students. >> it was reported to us by word of mouth that there was a rumor more that this person may be in possession of something that he shouldn't have in school. >> reporter: security officers and upper darby police say they wrestle from the 12th greater and his 11th grade companion this metal box. inside a 9-millimeter handgun ready for use. >> it was loaded with a clip. two rounds in it in the clip. >> reporter: police said they also found four vials of marijuana in that box. both teens were charged with weapons and drug offenses. security officials praised the kids who brought them the information and the adults who headed off a dangerous situati situation. >> that handgun never made it into school. it was headed off before that situation occurred and that is a testament to our school security and our administrative team that work well together with the upper darby police. >> reporter: 12th greater has been in trouble before. targeting pope francis at his own high school via twitter when the pontiff visited philly in september of 2015. superintendent michael chitwood read the tweets. >> i'm a terrorist but it's fun. i'm assassinate the pope. then on the 25th of september he says, i'm gonna buy a big ass gun and really shoot up ud. >> chitwood says the teen now 17 was charged and locked up for awhile. >> this kid should have been put away somewhere for evaluation, now he's trying to walk into school with a gun. to a place that is overwhelmin overwhelmingly goodie sent kids. report roar back at the high school news of the
