help the murder of her son gunned down in camden and tonight she wants answers and justice. good evening, i'm dawn timmeney. >> i'm chris o'connell. so far there are very few clues about what happened to that young man. let's get out to shawnette wilson in camden county with the story. >> reporter: chris and dawn, what i learned tonight 28-year-old brett mosque was killed on the job he has worked for the past 10 years. as you just heard, his mother could barely speak as she begged for help finding her son's killer. >> somebody noes something. somebody scene something. >> reporter: the murderer of row chill smith's son is cutting her to the core. >> somebody to go and shoot him in the head and kill my son. >> reporter: she got the call tuesday that someone had shot her twenty eight-year-old son brett moss near one of his jobs work sights in camden. investigators don't know why. >> my son is kind and loving. >> reporter: it happened around 12:00 o'clock tuesday afternoon. brett who lived in levittown work as scrap metal collector for company called emr and had been assigned to work this yard near 27th and saunders streets. he'd only been reporting there for two weeks. he was alone when rochelle says someone dragged him out of the site of security cameras into this alleyway next to the yard and shot him. he died at the hospital the very next day. >> the neighbors were elderly and they said he was sitting next to them and talk with them when the workload was light. they all loved him. >> reporter: brett graduated from kutztown university way degree in social work. he played football well enough rochelle says to go pro but an injury side lined his career before it could really take off. >> he even got picked up by the jacksonville jaguars and he got a knee injury. >> reporter: rochelle says what her son was most proud of was being a single father to his eight-year-old daughter kylie who still doesn't know her dad is gone. >> he took her swimming. he took her everywhere. had birthday parties. anything, you know, sat down, told taught her to read and write. he was good father. >> reporter: and back here live rochelle says she's offering a $5,000 reward for any type of rain out there. maybe a few showers, few raindrops around the philadelphia area will continue to fall and begin to taper off after midnight tonight. future weather shows the showers clear out. start the day dry tomorrow a bit hour humidity but the humidity starts to increase you'll feel it around tomorrow morning. by tomorrow afternoon more showers and storms possible bit more widespread than we had today. temperatures tonight after hitting 90 degrees dropping into the upper 70s. mid to low 70s by the time you wake up tomorrow morning. here's what to expect. north and west 70. 75 along 95. to the south we'll be into the mid 70s but the humidity really starts to increase. we hit 90 degrees this could be the start of a heat wave. but it won't last long. by sunday, we're looking at the end with a few showers and storms. i'll track that and let you know what to expect once that rain clears out all with the complete forecast coming up. >> all right, see in you few minutes, dave, thanks. police in new castle county, delaware on the hunt for a man who burst into an elderly woman's home. the home inn vague happened just afternoon today on the 700 block of hurfville road in the he'd din ridge community. authorities say 81-year-old answer add knock on the door and a man forced his way in and roughed her up. he ended up stealing some items inside and taking off in red car. home own are in was treated at the scene for minor injuries. the fbi working with philadelphia police tonight to track down a bank robber take close look. authorities say this guy hit up the hyperian bank on the 100 block of west girard avenue this morning. he gave a teller a demand note and got away with cash. police believe he hit another bank about 40 minutes earlier on north fifth street. any information call police. in delaware, a judge ruled today that a 16-year-old girl charged with the death of another 16-year-old will not be tried as an adult. the judge rejecting the prosecution's request ruling that the girl will be tried in family court on charges of criminally negligent homicide. now this all stems from an assault inside the bathroom at wilmington high's howard high school of technology. this was back in april. prosecutors say the 16-year-old repeatedly hit amy joyner francis in a pre-meditated attack. joyner francis a pre-existing heart condition and the medical examiner ruled the attack contributed to sudden cardiac arrest. happening now, health officials in camden county are urging caution tonight. they say a bat in haddon heights has tested positive for rabies. more concerning a man found the bat inside his home. he quickly called county health officials. >> now those officials are warning others in the county to be aware and to keep their families and pets safe. let's get straight out to joanne pileggi who's life for us in haddon heights. joanne? >> reporter: chris, dawn, we've actually seen a few bats flying around this park here in haddon heights. natural habitat of course, but there is real concern here after a bat flew into a home in this camden county community and then that bat testified positive for rabies. >> you do not want to expose yourself to this disease. >> reporter: cause for alarm in haddon heights after a homeowner discovers a bat inside the house. they did the right thing. >> definitely call animal control make sure they come and investigate so they can trap and test for this animal to see there has been exposure. >> reporter: the bat was tested and it was rabid. >> bats, raccoons all of those are rodents. so they are the most prevalent carriers of them. >> reporter: county health official say finding one rabid bat is serious. same with other rabid wildlife which typically acts strange when they're infected with rabies. >> if you see those kinds of animals in your neighborhood, the other thing you have to be concerned with your own pets. because they can also attack your pets and if your pets get bitten, if you do not keep up with your rabies shot, they can be at risk. >> absolutely that would concern me, yeah. especially with brand new baby. i would be definitely be worried about that for sure. >> reporter: health officials did not identify the family who found the bat in their home but they were advised to seek pre-emptive treatment just in case. news of the rabid bat spread quickly in town. >> there could be other bats that are infected as well, okay, yeah. yeah, that would definitely >> walk my dog every night, and in the park in haddon heights. i see bats. swoop down and come by us and i mean i don't mind them, but -- >> unless they have rabies. >> unless they have rabies. i don't know if they're rabid or not. >> reporter: that's the fear of course. you just don't know. that's why residents around here are being asked to be on the look out for wildlife that is acting strange. they're being told don't go near it, call police or call animal control. by the way, actual rabies cases are very rare, but lethal if they are not diagnosed and treated. chris? >> little creepy there joanne thank. philadelphia police arrested one man and looking for another in connection to the shooting death of an innocent man caught in the middle of the a gun fight. 25-year-old ford died last month when police say he was caught in the crossfire of two men shooting on the 5100 blog of germantown avenue. ford was killed as his three year old daughter was sitting in the back seat of that car. she was not hurt. well today police arrested 18-year-old jameel byrd facing murder charges. detectives are now trying to find 19-year-old saku monty. if you see him please call police. we're staying on top of a developing story tonight. and some terrifying moments captured on surveillance video. a man walk flood a philadelphia bar and started waving a gun around threatening several unsuspecting people inside. it all went down in the city's nicetown section. >> as fox 29' is that so bean in a kuriakose reports, the gunman unleashed a lot more than just threats. >> reporter: frank' place has stood on veepth street in nicetown for half a century. >> frank's the friendly bar. friendly place to be. >> reporter: frank took over from his father 15 years ago. pouring sweat and blood into building up the block. >> we did all new pipes, all new concrete work in and out, all the garages brand new. everything is all nice. >> reporter: bright spot in this struggling neighbor. small business own are in says he is crushed somebody has shattered the peace carefully carved out and invested in. terrifying surveillance video capturing the moment an armed man pulled a gun on the mostly older crowd that freaks the bar. even grabbing one customer and putting the gun to his head. >> i felt angry. i felt disappointed as you can see the video the way he was and the way he came in here and i was like, it was horrible. >> reporter: police say just before 2:00 wednesday morning minutes before closing time man wearing a bandana stuck up frank's customers taking cash and a woman's purse. the scared patrons hand over their valuables. new video obtained by fox 29 shows what owner frank describes as the alleged gunman casing the business. before busting in. a black sedan can also be seen outside. eventually the gunman leaves disappearing in the darkness of early morning. now frank is determined to find out who did it and he needs your help. >> hoping and praying that this guy can get caught and taken off the streets and put in jail where he deserves to be. >> reporter: police tell us the alleged gunman in that video is about 5-foot eight in his mid to late 20s. if you recognize him, call northwest detectives. in nicetown, is a ben in a kuriakose, fox 29 news. ♪ >> new jersey store clerk out smarts a couple of thieves who stormed into his shop. how his quick thinking left the crooks locked inside the crime seen trying to pry their way back out. and this man is under arrest for something police say happened on a delaware beach. it involves his 13-year-old daughter, a shovel and a sea gull. the story only gets more disturbing from there. and change for philly schools. who is off the hook for a controversial punishment. >> and some ryan lochte is saying he's sorry for bad behavior that led to couple of days of bad press. why us olympic officials are also apologizin apologizing as e comes to an end. he looks a little worse for wear but this kitten is doing just fine after two days stuck in a pipe. how facebook made this rescue it is, chris. this is a very small borough just off the white horse pike which is at the light behind me. if you blink you could miss it but suddenly it's getting a lot of positive attention as you mentioned as a result of what is in the center of the street here between those two yellow lines you will see that thin blue li line. >> thin blue line represents support for law enforcement. >> reporter: its meaning residents runs deep in the hearts of police officers and runs deep through the 1 mile borough of oaklyn painted this morning down the center of clinton avenue five blocks from the white horse pike to kendall boulevard. >> i noticed it coming up the street. that's a nice honor. >> head of the public works came up to the idea. passed it object to the police chief who got permission from camden county and the paintbrushes came out. it makes k9 officer colby, pro proud. >> nice working in the town we have such support from our citizens and residents it does mean a lot to us. >> reporter: thin blue line passes through the police and fire stations and right to oaklyn public school. >> i love it. i have blue blood in my family. my brother is a police officer in a neighboring town so it's even more important to me. >> we're such a really really small community everybody noes everybody. everybody noes every police officer, borough employees, teacher in this town so it means that much more. >> reporter: symbol of appreciation at a time when law enforcement is under scrutiny like never before. >> we do everything we can for our community, and to have them support us back it means a lot especially in today's times. >> reporter: now the borough did post a lot of its photos on facebook. it's already gotten about 900 likes and about 500 shares quite a bit international incident. american swimmer ryan lochte says he is sorry for the way he explained what happened to him in three teammates this past sunday in rio de janiero. >> that apology comes as the swimmers and olympic officials try to move on. fox's steve harrigan has the latest night from rio. >> reporter: ryan lochte takes to instagram to issue an apology for his behavior while in braz brazil. the us olympic swimmer saying "i want to apologize for my behavior last weekend for not being more careful and candid in how i described the events of that early morning and for my role in taking the focus away from the many athletes fulfilling they are dreams of participating in the olympics" he went on to say, "i waited to share these thoughts until it was confirmed that the legal situation was addressed and it was clear that my teammates would be arriving home safely". the apology coming after swimmers jack conger and gunnar bentz returned to the us aft being pulled off a plane in brazil a day earlier. and swimmer james feigen's lawyer reached an agreement which would avoid criminal prosecution. trance traps brazilian law concedes in the light of the crimes the florida couple. now police say that us a tip, will be charged with two counts of first degree murder. they say he stabbed a couple he'd never even met to death in their garage on monday night. he'll also be charged with attempted first degree murder in the stabbing of their neighbor who tried to step in. when police arrived on the scene they say he was biting one of the victims faces. police say he won't be charged host until he's released from the hospital. in california, firefighters are finally making progress against a wildfire burning in san bernardino county. authorities allowed more people to return to their homes today after they were evacuated as a precaution. nearly 100 homes were destroyed in the fire burning in the san bernardino national forest. the fire is now nearly their% contain. and health officials say miami's world famous south beach is the second location where people are contracting the zika virus on the us mainland. >> so far five cases are connected to that popular beach spot. 36 people in florida have contracted the virus locally. the centers for disease control has also announced it's expanding it's travel warning for pregnant women to include the miami area known for nightclubs and beaches. cdc says trying to eradicate south beach of mosquitoes is going to be difficult. officials say high rise buildings and strong winds make it a real logistical issue. >> we're doing everything with the county to make sure that the mosquitoes that are on miami beach are removed and specifically in that one area and i got to tell you this. i said it 48-year-old kristin lesure after his daughter lured a seagull into the hole in the sand and killed it with plastic shovel. officers say the 13-year-old put food in a hole in the sand to lure the birds and hit them with the shovel. police say she killed onsie gu gull. officers say they found the dad drinking alcohol on the beach. he's charged with endangering the well fire of a child. a new jersey transit bus driver has died after the bus he was driving slammed into another in newark, new jersey, killing a passenger. it happened this morning. police say the veteran driver at the wheel of the bus with no passengers inside hit a bus filled with passengers. 17 people are hurt. six of them are in critical condition tonight. people who were on board describe a very terrifying sce scene. >> i don't know what happened. i just saw myself in the back. i was the only one in the back was good. a lot of people was injured. i saw one guy almost died. i don't know if he died. >> right now authorities are trying to figure out if the driver of the empty bus who had been driving for new jersey transit for 27 years may have run a red light. the fbi is now involved in the controversy surrounding philadelphia district attorney seth williams and his delay in reporting more than $160,000 worth of gifts. his spokesperson told the philadelphia inquirer the fbi questioned a number of the da staffers. according to records filed only this week, williams received high value gifts between 2,010 and 2015. among those gifts, eagles side line passes and $45,000 worth of home improve manies. >> a big change today for youngsters in the philadelphia school district. officials say they're going to stop suspending so many kindergarteners. is he rethinking the way they discipline children. >> some say it's a change that should have happened years ago. fox 29's bell anderson explains. >> i have a kindergartner, and i would would be live individual if i got a call that he was being suspended. he's just starting school, right? >> reporter: right. >> yeah, that's crazy. >> reporter: admittedly i'm not parent but like many of the parents i spoke told me the new school district policy banning suspending kindergarten students that seems like common sense. >> i believe it's ridiculous because kids her age, they shouldn't get suspended. >> we want our children to be in school as much as possible, so any time they need to be at home in my opinion it's got to be for something, um, is terrible. report roar beginning this school year, the revised code of conduct no longer allows for suspending kindergarten students for reasons even the five-year-old should be able to understand. >> one thing that we know is, we can't teach young people if they're not in school. and at that age, removing a child from school then removes them from the opportunity to learn. >> reporter: it was almost unanimous among the people that i spoke to that five year olds learn very little from being suspended, but active visits told me it's still happens a l lot. >> there are about 400, um, and 500 suspensions of kindergarteners last year. about 1500 suspensions of first graders and 1900 suspensions against second graders. >> there are other things we can do to resolve conflict. >> reporter: dr. hite told me he agrees with parents and has wanted to end the policy for years. but unfortunately, it's just not as easy as it may seem. >> there's a great deal of training that had to take place prior to these young -- prior to us implementing such a policy. >> reporter: bill anderson, fox 29 news. health officials in philadelphia say that the fentanyl problem in the city is an epidemic and more needs to be done to resolve the problem. officials meeting at city hall today say in 2015 more people died of drug overdoses in the city than from homicides. the city health commissioner says fentanyl overdoses increa increased more than six fold from 2013 to 2015. the city's department of behavioral health says it's offering more treatment to addicts in hopes of curbing the drug abuse. >> we have a behavioral health access center which is at north philadelphia health system that operates 24 hours a day seven days a week. where people can go for an assessment and, um, they can be facilitated into treatment. >> health experts say fentanyl which is injected just like heroin is 100 times more potent than morphine. delaware police are credit ago k9 member of the force with helping them make an arrest. police say ace and his handler officer corey, tracked down sidney messick who was hiding from police in new castle. police say they had a physical altercation with him and he ran away. well, ace used his scent to find him hiding under some bushes. messick had active [bill o'reilly sighs] ♪ people in chile are being told not to drink water in one city after a bridge collapsed into a river as the train was passing over it. authorities say the train was carrying chloride oil and sodium hydroxide and officials are being extra careful to make sure everyone is safe. fortunately no one was hurt in the crash but investigators still don't know what caused it. in your money tonight, cracking down on ticket scalpers for major sporting events to shows on broadway scalpers will take advantage of fans any way they can. we all had it happen. >> now one person behind a hit broadway show trying to snuff out those scalpers. hamilton creator lynn manuel miranda and new york senator chuck schumer urging congress to pass legislation to crack down on ticket scalpers. in the bill scalpers who use those auto mated software box to scoop up hundreds of tickets at a time to sell on the secondary market could face massive fines. it's big business. according to senator schumer's office scalpers use those bots to grab more than 20,000 tickets to hamilton. meaning scalpers walk off with over $15 million. >> wow!
