of fire. their peacel service was shatteredy gunshots and they're celebrating the miracle of 2010. and the president is preparing to return from his vacation in hawaii and a look at the to-do list when he returns home. fox 5 morning news starts right now. thank you for joining fox 5 morning news on the first day of 2010. there is a live look outside. plenty of clouds around. we've had some fog as well. we're going to get through this. tucker barnes will tell us about the weather. good morning, i'm tony perkins. >> there is a look from some of the celebrations from the big ball drop. there were thousands of people that flocked to times square and millions more watching on television. and a lot of kissing and hugging going on last night. and they had some sleet and snow there but that didn't stop the celebration and all of the confetti coming down. they had handwritten messages for the new year. >> some of the confetti had wishes on it. >> and dick clark is now 80 years old. >> yes, he is. he is still recovering from a 2004 stroke and he says enuragement from fans inspires him to keep the tradition going. >> good for him. but i have to say something and i love dick clark, i've met him, i admire everything he's done over the years. 80 years old, i would rest. we know you had the stroke and certain things are difficult for him. >> it's time to just -- it's sort of time for them to pass the baton on and don't parade dick clark in there at the end. any way. that's our opinion. >> yes. here is tucker barns with a look at the weather. >> good morning, everybody. and happy new year. today will feature -- here is the deal with today. today our temperatures will top out in the low 40s and that is the warmest day in the next 5-7 or maybe ten days as we'll have cold air move in tonight. currently 33 at reagan national. temperatures have slowly jump add bove the freezing mark. that's good news because we had local ice develop overnight and some fog as well. in fact visibility in some spots less tab -- than a mile in the past couple of powers including a fog advisory that just expiredch a couple of problem spots out there. a decent day. we're not expecting any snow or rain showers. just dealing with clouds. we have a cold front moving through. and that will be kicking up winds and be prepared for a cold one and at 10-15, sometimes 20 miles per hour. and plenty of clouds and a few periods of sunshine. becoming breezy with winds out of the nrth and west as mentionedrom -15. high temperature looking out there. and enjoy. >> tucker, thanks. our top story this morning, a church congregation in southeast washington is celebrating what many of the parishioners call a miracle. somebody fired rounds into the church. >> stacy cohan joins us live from southeast with more on what happened. >> reporter: well i can tell you, police believe it was a 9- millimeter that was used and a single gunman that fired into the new year's day shooting. it happened on naylor road. the 3,000 block. just around 12:30 there were 40 parishioners inside the new life praise temple to celebrate new year's eve together when the suspect started shooting. about half a dozen bullets hit the front of the church. but fortunately none of the parishioners were injured. we did get a chance to hear what happened by talking to the pastor. >> we had a singing group that was up singing and the music was kind of loud. because we weren't expecting to hear no gun shots come through the window like it did. >> right now we're investigating it as an assault with a dangerous weapon, a gun. we definitely fel that at this point there is enough facts to say that it was intentional shooting at the building and anybody that would -- any reasonable person would know there are occupants inside. >> the only injuries were sustained by one parishioner hit by broken glass. at this point the church is empty. investigation is concludes and now they are searching for word on a suspect. d.c. police are asking anyone with any information to contact them. live in southeast washington, i'm stacy cohan, back to you. >> stacy, thanks. and just a couple of minutes ago we showed you the celebration in time square. >> the big party went off without a hitch but things weren't so smooth in moscow. fireworks set to go off went off a minute and a half late. no word on what caused that. they lit up skies across red square. [ singing ] at the vatican pope benedict xvi led prayers and added many to enter the clergy if it is their calling. and a message of peace from north korea for the new year. the country says it's created to creating a nuclear free peninsula and that was published by the north korea central news agency today. relations is just one item on a long lisof things for -- the president to do and there is a lot to do here at home. >> he says american's determination helped americans get through the year. doug luzader looks at the year ahead. >> reporter: the year came to a close with an interrupted vacation for the president after a terrorist tried to blow up a plane. >> we'll find all of those accountable. >> reporter: and while that may be first and foremost on minds as holiday travel comes to a close, it's health care front and center. negotiators from the senate and house are trying to hammer out an agreement and volkswagens are vowing to fight. >> i'm going to continue to fight and i'm asking people at home to see members of congress face-to-face over the break. >> reporter: and democrats will have to pivot as fast as they can with the economy and jobs with growing fear of a recession. and if the economy doesn't turn around, democrats could be in for a beating come the mid term elections when just about every house member and a third of the senate is up for re-election. and at the same time there is the rest of the president's unfinished agenda, a list that includes cap and trade energy legislation and that is just the start. >> there is seasonable industry overhall, industry reform, there is don't ask don't tell in the military. he gets an incomplete. >> reporter: it's enough to make a christmas vacation seem like a distant memory. in washington, doug luzader, fox news. and you see the president there in hawaii. he and the first family are getting ready to wrap up their vacation. yesterday he received a preliminary report outlining what led up to that attempted compass day terror attack. as you know, a 23-year-old nigerian man with suspected ties to al-qaeda is accused of trying to blow up a plane over detroit. the president says he'll meet with officials leading that review next week. a deadly attack in afghanistan has killed a local man. several c.i.a. officials were killed on a base on tuesday. bob barnard has more. >> reporter: the taliban is claiming responsibility for the attack at a base used by the c.i.a. on the pakistan border. >> i heard an explosion but the explosion looked inside the base and we do not know what happened inside. >> reporter: the taliban says an afghan national army officer wearing a suicide vest entered the base and blew himself up inside the gym. u.s. sources say the man was being recruited as an informant for the c.i.a. and had not been searched. >> obviously you have to ask, did we trust him too soon? and you have to say yes. but were there procedures that you could plausibly tighten up? that's what we'll have to evaluate. >> reporter: one of the americans killed in the attack was harold brown junior of fairfax and he worked for the state department and was a major in the army reserved and a degree from the g.w. he was a father of three and wanted the world to be a better place. leon pinetta said those who fell from home were far from home and doing the hard work that must be done to protect our country from terrorism. >> these people who died served our country above and beyond the courage and doing a good job of finding the enemy. >> reporter: and michaelo han lon says the c.i.a.'s role in afghanistan is vital to the success in our mission there. >> we have to work closely with the afghans and to partner with the police and arpy. if we don't do those things we can't achieve our primary objective which is to get them to do the job so we can come home. >> reporter: bob barnard, fox 5 news. >> until then only four c.i.a. operatives ad been killed in afghanistan since 2001. the case begin five blackwater guards has been thrown t. 17 people doctor -- were killed. the district judge slammed prosecutors who he says built the case on sworn statements given with the promise of immunity and said that went against the advice of the justice department and violated the guard's constitutnal rights. pakistani officials will see terrorism charges against five d.c. area men accused of plotting a terrorist attack there. the five men were arrested in early december. all five could face life sentences in that country. they are due in court on monday. talking a -- taking a look at other top stories. police say a man was shot while in a car sending him crashing into the retaining wall of a nearby cemetery. it happened a half an hour before midnight in the 4800 block of north capital street. no arrests have be made. the man died. a man's body found along the woods in the 3100 block of park drive in southeast yesterday afternoon. that man had been shot to death and tied up with duct tape. his identity hasn't been released and so far police don't have a motive. it rounds out a deadly past 24 hours in d.c. four new murders and investigations since yesterday. still 2009 saw the lowest number of homicides in years. police chief cathy lanier and mayor fenty will talk about that more today. and a murder investigation is under way at a shopping center. police found a man with a gunshot wound to his chest in the 3300 walk of walters lane in forestville last night. the victim died at the hospital. investigators haven't released any details on a suspect yet. up next local moms and dads have more than one reason to celebrate the new year. >> details on our areas first babies of 2010 and how this can end 2009. five sets of twins born in the span of 36 hours. one very busy maternity ward. all of this happened at one hospital. that's coming up. ro feiehrth h it's 9:15 now. making headlines this morning. the battle rages on between fox and warner time cable. they threatened to pull stories if a dispute over fees wasn't reached by midnight but a temporary contract extension is in affect. news scroll want it's to pay $1 per provider to transmit the programming. the new year is extra special for gay and lesbian couples in new hampshire. at midnight a new law allowing same-sex marriage went into affect. more than a dozen couples braved the cold to exchange vows early in the morning. others will begin having private ceremonies. couples in civil unionare allow to convert their statuses to married. new hampsre joins massachusetts, vermont and connecticut and iowa in same- sex marriages. and some laws are changing. >> david lee miller has more. >> reporter: some never saw they would see the day that south carolina, a area with tobacco jobs, are seeing a no smoking agenda. >> many aren't too thrilled. >> i believe in freedom and choices, so for me to say you can't do this but you can do that, i don't think that's the way we operate here. >> reporter: budget pieces are behind new laws taking place across the country in 2010. several states are cracking down as things seen dangerous, unhealthy or rude. >> who the government to dictate what we can and cannot have. >> reporter: starting january 1st, new hampshire, oregon and illinois will join the list of states banning texting while driving. and california will ban villafied france fats. >> if a customer wants to be healthy and the government says that's what you have to do, who am i to argue about it. so i'll go with what they want. if they want zero trans, i'll give them zero transes. >> and teens in texas need adults to take them to the tanning bed. these are dozens of laws going into affect. david lee miller, fox news. here at home you'll want to pay closer attention to parking signs in the district. beginning mid mnth drivers will have to pay to park on saturdays and the payment for timing for some spots is changing. and nighttime parking enforcement downtown hours will be extended to 10:30 p.m. and starting today it will cost you more to drive on the dulles toll road. rates will increase by 25 cents at the main toll plaza and on and off-ramps. it's part of an agreement to bring metro to dulles airport. the decision came following a series of hearings this year. expect rates to increase again in 2011 and 2012. baby new year is here. he's a 7-pound bundle of joy. born at 12:03 in alexandria. his parents are from alexandria. >> and in rockville a baby girl was born at shady grove at 12:26. and a real baby boom for one hospital. five sets of twins born within 36 hours. the delivery rooms and nursery are busier than usual at frederick memorial hospital. tisha thompson spoke with the new parents. >> reporter: they're seeing double at frederick memorial hospital. meet sarah and jessica, darryn and lauren, daniellea and oscar, brock and garret and two more who were a little camera shy, all twins, all born within 36 hours at the same hospital. >> 13 pounds of babies. >> reporter: this mother says a sonogram missed one of her babies. >> i found out there was another baby and i said stick around to make sure there isn't another one in there. >> reporter: three sets arrived ahead of schedule and will spend the next several weeks with nicu nurse dorothy corbett. >> all of a sudden it was the christmas rush to get in for new tax breaks. >> reporter: she says the hospital always has one nurse per baby so they had to call in extra staff. at just 32 weeks, warren and darryn are the smallest of the lot. barely 4 pounds apiece. >> i'm just so happy that they made it. they're fighters. especially 's reaply helping hi because -- ally helping him out. >> reporter: and father said his grandmother was a twin but mom thinks there is something in the water. >> boil your water, ladies, if you have it. >> reporter: but the nurse has her own theory. >> luck. >> people are blessed. >> >> no wonder they were one-hit wonders. >> i pride myself in keeping up with music and i just can't any more. i'm not that interested any more. >> do you think the music isn't as good as it used to be. >> that's what i think. but older people think that. back in my day they played an actual instrument. >> it is true though. >> it is true. >> tucker, do you know those songs. >> two of them. >> you hang out with young folk. >> i'm going to stop you there. we've all been here way to long today. let's talk about the fact it's cold out there. there is a dense fog advisory to the east and south. that's been led to expire and temperatures are gradually starting to warm up. now 34 degrees at reagan national. 34 in annapolis. this is good news because temperatures are generally above the freezing mark. gaithers birth is -- bathers burg is 36. and there could be slick sidewalks where we've had a chance to refreeze surfaces. the fog is bad to the west where visibility is less than a mile li places like dulles and baltimore. there could still be leftover fog and that should burn off and we'll be in for a quieter day today. and not expecting anything in the way of rain shower activities. and you can see breaks if clouds and a few periods of sunshine during the course of the day but partly cloudy throughout the day and the trend is going to be to get things colder and colder as we get into the weekend. as our flow in the atmosphere is out of the north and west. so a frontal system to get -- through here. and winds will pick up and that's your tell tale sign that the cold air is on the way and we never get a chance to rebound this weekend. in fact temperatures all weekend long will be well below sea ample -- averages. becoming breezy this afternoon with a high temperature of 41 and this is the warmest high temperature we're going to see any time soon. winds out ofhe north and west at 10-15 miles per hour. tonight getting cold out there. partly cloudy and cold. 24 in town. teens to the north and to the west. and a five-day forecast which features a lot of old man winter. the next couple of days, high temperatures will only be if the low 30s. in fact we'll be lucy to break the freezing mark much before monday or tuesday and looking long-term into the middle and end of next week, the temperatures will stay well below where they should be this time of year. so be ready for cold into 2010. and that's a look at the forecast. i'll throw it to gurvir. >> thanks a lot. new years is all about new friends and before he break we asked you which do you think these things are out and in for 2010, ripped abs or ripped jeans? >> we are saying that ripped jeans are in and ripped abs are out. you see this every ten years they come back in d thank gosh for that because we would all weather work on our clothing than our physique. and cup cake trucks are in. cup cake stores were in last year and now we're taking it to the next level. they come right to your door and who doesn't love that with a dessert. >> and this list is so much fun. we were looking at it a little while ago of the you work on this with dan zack, is that right. >> uh-huh. >> so how long does it take you to come up with the list? >> we start sending the first misses off in november and telling people to think that they're going to see and ten for the last week webasically locked ourselves in conference rooms, combing down hundreds of items until we think what is indicative of the coming year. >> it is going to be hard. >> it is hard. because you're trying to think of things that not only are a fun item but also represent larger trends like the trends of trying to save money versus trying to be flashy or the trend of trying to be green versus trying to have powerful chemicals. so we try to come up with things that are fun but things that represent what is going on in society. >> you said the list is longer than the list that is -- that you actually publish. >> in the annuals for nobody's eyes but ours. >> what stands out to you >> i had a couple of favorites for celebrities and some to watch are rose mand pike and kerry mulligan who starred in education. and we're putting them in as opposed to emily blunt, another marvelous british actress who was in in 2008 and 2009. so if you like that brits, that's something to watch. and one of the items that i liked is de-friend which is a word that if you're on facebook you know. in 2008 and 2009 it was about building your list, collecting friends. and in 2010 we think it's going to be more about cure ating friends and about keeping your relationships to a manageable level and making them more meaningful. >> i think people are starting to do that. >> once you get to 500, cut it back. >> who needs 500 friends, right? >> anything else? >> what jumped out at you? >> i ran down the list and number one on your list up here, out is black president's. >> we say black president merchandise. because at the beginning of the year, you could not walk two stores without seeing an obama t-shirt and bobble head and obama cover for your ipod and now that we're settled in and the novelty is worn off, but we're seeing this amazing barbies and things from the princess and the frog which is great because little boys have someone to look up to and now little girls have someone to look up to. >> and i like that. and gilbert arenas is ouand earl boy cuss is in. >> and gilbert arenas will never be out but with earl stepping in, it's nice to have another wizard to watch. >> and arenas is facing his own trouble with the gun stuff. >> he will always be -- he will always be in the news. even if he's not in. >> fraud is out, adultery is in. we've heard a lot about infidelity in the last couple months. >> we went from the beginning of the year, we went from burnie madoff and fraud to at the end of the year another celebrity had another affair. we ended the year with tiger woods. so we're not condoning adultery we're just saying that it seems to be everywhere. >> and to round things out, you have things that are fondly remembered, paula abduhl, free baggage, and good ridden to simon cowell, crocs and uggs and jay leno. >> a happy decade. >> thank you monica. >> thank you. >> tony. many people are hoping to find a new job in the new year. up next, mixed news about the unemployment outlook for 2010. find out how many states are having a hard time keeping those unemployment checks coming. and if you're looking for a new job, check out myfoxdc.com, we have listings for all fields and experience levels. as we go to break. another look at today's trivia question, how much trash did time square partyers leave behind on new years 2009. the answer is coming up in just a few minutes.  as the unemployment rate hovers around 10%, manystates are treading water trying to keep up with unemployment checks. >> many states say they're out of cash. molly henenberg has this report. >> reporter: as 2009 ends and 2010 begins, slightly fewer americans than expect ready filing new claims for unemployment benefits. the labor department announced today new applications for unemployment checks fell by 22,000 last week to 432,000. economists had expected the number to increase to 460,000. still with the national unemployment rate around 10%, millions of americans are out of work. and that's putting a severe strain on states paying out weekly unemployment checks. 25 states and the u.s. virgin islands are out of money for unemployment and borrowing from the federal government to the tune of $26 billion. borrowing the most is california, then michigan and then new york. and the labor department says based on unemployment projections, 40 states may have empty coffers for iner unemployment by 2011 and will have to borrow up to $90 billion more. analysts say states have been generous by adding extra weeks may have to cut back. >> states need to step up to the plate now and say what are our priorities? and i think that they'll conclude that the hard cases, the truly poor and needy must come first. and so we have to kind of shift the line and make sure that those in the middle class that have other means to take care of themselves do so and that those in most need are addressed first. >> reporter: money for unemployment comes from payroll taxes on businesses. and while groups representing state workers say they expect some benefits to be reduced, they also expect states to raise some taxes to keep their unemployment programs afloat. >> they'll be looking at raising the so-called taxable wage base which is the wages paid by plowers -- employers to employees subject to tax and raising tax and perhaps the program will balance out and also the state will be able to pay back the loans that they've obtained from the federal government. >> reporter: but these are lean times for businesses too. and states need to be cautious in increasing taxes on them says bill beat as it could bankrupt more companies and put more people out of work. molly henenberg, fox news. and coming up next kevin mccarthy from 106.7 the fan will give us an idea on what movies you might want to check out over the holiday weekend. and find out what movie the first family went to see on vacation in haii. fox 5 morning news continues. it's 9:44 now.  welcome back. 9:47 now. the obamas made new year's eve a movie night. the first family visited a movie theater near their rental home to see avatar. they were joined by friends for a private screening of the 3-d adventure movie. there was plenty to see at the movies in 2009. >> movie reviewer kevin mccarthy with the fan shared his top picks for the year with me. >> so what are the best movies of this year? our friend kevin mccarthy from 106.7 the fan is here to break down his favorites. merry christmas. >> merry christmas. >> happy holidays. >> that too. >> and i was telling you before we started, my mom used to put up ornaments of movies every year to satisfy me because i love movies so much. so this is really cool. >> it looks good. and you have your favorites for 2009. >> i do. my top ten movies of eyear. this was a tough list to put together. and to quote roger e bert is that he said this is like 1976 with a ton of classic films this year. i think it's been a great year for movies. some bad films but there has been some great movies this year. >> so let's start with number ten. >> drag me to hell. saying that title on television, i don't know how we're getting away with that but we are. this is the pg 13 throwback to horror where it's not ultraviolent. it's about shadows, trying to scare you on a natural basis as opposed to being bloody and gory like saw. and sam ramey directed spiderman and the evil dead movies so this is a great horror movies. it came out in may and i still think about the rest of the year. >> and i'm not a horror fan. and number nine is the hangover. >> this is a comedy played out like an action movie. you had the three guys waking up in a hotel room not knowing what happened the night before and missing a friend. it is one of the funiest movies. the guy who did old school and road trip did it. >> i love old school. >> that is great. and will farrell's last great movie. he hasn't done a great movie in a while. >> maybe in 2010. >> hopefully. >> and at number 8 you have an education. >> this is starring peter scars guard and carrie mulligan. and it's a young girl who gets an education in the real world. it is very brilliant. it is unbelievably acted and amazing overall. >> really heavy. >> it's heavy but it's also very lighthearted. but it's -- the script is so good and so refreshing, i just loved every minute f it. >> okay. watchman at number 7. >> zack snyder's epic comic film. this was one of the most visually pleasing films of the year as well as emotionally grabbing. i was stunned by visuals. if you check out the dvd it's cool. get the blu-ray and he walks out an explain how he shot all of the scenes to check out the blu-ray. >> so what do you have? at number 6 is the hurt locker. >> this just got nominated for best picture in the drama department and is up against up in the air. i think it's a realist portrayal of the current war about guys disarming ieds in afghanistan and it is truly -- the first 8 minutes, and if you watch the first 8 minutes, if you want to get a taste of what it'sike. it is so intense and so emotional, it will blowou away. no pun intended. it's great. >> and star trek at number five. >> how could you not put this on the list. jj abrams was able to connect the audience and let all nonstar trek fans be able to enjoy a star trek. and that happened when wrath of con came out but abrams was able to bring in general audiences to war a star trek and the score for the movie, the music is so unbelievable. i love this movie. i was so surprised by it. unbelievable. and he did not use a lot of egi. he tried to keep it as realistic as possible. >> and i remember you telling me you liked district nine when we talked. >> first time director and actor, a film that took aliens and made them seem human. you have these aliens, which are never really there, they had to drop them in and this actor who i thk should be nominator for his best actor and it is a rare gem that came out this year. it was made for a low budget but looks amazing. look at avatar. between a $300 million budget and there is no story or emotional connection but they have that connection with great visual. >> andin glorious bastards and this comes in as number three. >> this came out on dvd. i think i watched the opening scene five times this past week. christoff walts is one of the lead stars. he's in the beginning 15 minutes. he's throughout the whole film but the beginning 15 minutes will win him the oscar. he is nominated for the golden globes. the dialogue is up there with some of my favorite dialogues like chino and dinnero. and it is classic tarrantino. >> and you have 500 days of summer and up in the air. >> 500 days of summer with the roe pantic come -- romantic comedy and showed the guy as the sensitive one as opposed to the girl. and generally in film it's always the females the sensitive one. this time they switched it and it's more realistic. i think guys are sensitive when it comes to relationships and then finally up in the air. >> i love george clooney in just about anything. and he's terrific in this. >> six golden globe nomination. jason wrightman, three great films. i love the ending and it's very ambiguous and he didn't end it on a hollywood note and it's about a man becoming a man. the best film of the year for 2009 and my critics association, the washington area film area critic association named it the best film of the year as well. >> and can we catch any of these or some of these on dvd and blu-ray?
