. right now at 10:00 a second scare in the air just days after a man tried to blow up a plane bound for detroit. this time another disturbance, same airline, same flight and the similarities don't stop there. thanks for joining us. i'm will thomas. i'm maureen umeh. today's incident comes as we learn more about the man accused in friday's failed terror attack. the susct o of the hospital and in federal prison. let's get to roz plater live in the newsroom with new details on this. >> reporter: investigators are trying to figure out if the suspect is indeed connected to al qaeda as he claims or is he some sort of lone wolf sympathizer, all this as a second incident today set off a panic. flight 253 from amsterdam to detroit, the crew reports a nigerian man on board is acting strangely. then locks himself in the bathroom. they call in the f.b.i. it has all the haul marks of an -hallmarks of an alleged botched terror attack on christmas day and passengers were underrably nervous. >> it's very upsetting that it's happened in two days. >> reporter: turns out authorities say the man was sick but the similarities raised the red flag. umar farouk abdulmutallab is the man accused of a foiled plot to bring down the northwest flight on christmas day. investigators say the 23-year- old nigerian is claiming to be onnected to al qaeda but is he really? >> we don't know. there's allegations that have been made public in the criminal complaint but the f.b.i. now has that matter. it's under investigation and we shall see. we asked samuel for some insight, an investigative reporter from nigeria who sought asylum here in the u.s. he said abdulmutallab is the kind of candidate the so-called taliban has been recruiting. he's the son of a prominent banker educated in london wi a u.s. visa. >> [ indiscernible ] >> reporter: he says like other extremists, they often use technology as a brainwashing tool. >> they use the internet to woo them, let them believe -- [ indiscernible ] >> reporter: abdulmutallab is out of the hospital tonight and in a federal prison about 50 miles outside of detroit. investigators say he's being trted for burns he allegedly got as he tried to set off those explosives. >> roz plater in the newsroom. thank you. the white house says president obama has told u.s. officials to maintain heightened u.s. security. already passengers are reporting extra security at check points and more baggage searches. the explosive that abdulmutallab is accused of using is known as petn. it's categorized as a high explosive which means it's very volatile. it's often used in military explosives and blasting caps. it's a popular choice with terrorists because it's small and powerful. it's the same chemical shoe bomber richard reed used in his attempt to blow up an american airlines flight from paris to mom amy -- to miami back in 2001. security has been stepped up all around the world. although thsuspect appeared on a watch list, he was on the no fly list. somehow umar farouk abdulmutallab allegedly made it past all security screenings and boarded a flight bound for detroit christmas day. his father is a prominent nye jeer january -- nye nigerian banker who became worried about his son's religious concerns and reportedly took those concerns to the u.s. embassy in nigeria. some lawmakers are demanding to know what happened after the embassy got that tip. >> was it a failure of these agencies to communicate or were the markers that we put on this individual, were they not significant enough to bring this individual to a higher level of awareness that said okay, he needs to be put on a for fly list. >> reporter: mulled mud was never on a u.s. no -- abdulmutallab was never on a u.s. no fly list. his name was on a database of a half million people flagging him for possible terrorist connections. some are suggesting that even travelers on that largest list should be subject to additional screenings. >> we ought to in our age put 500,000 names on a computer and have everybody who is trying to come to the u.s. go through that list. that doesn't mean they're convicted of any wrongdoing but it would be basis enough to take this guy out of the line in amsterdam and do a full body check. >> reporter: lawmakers are also expressing concern about lone wolf terrorists who become self- radicals and about terrorist the terror suspect plus reaction from the white house. another big story we're following tonight. an off-duty sheriff's deputy wound up at a shootout in his own neighborhood. it happened this morning in oxon hill, maryland. jessica weinstein picks up the story. >> reporter: it all happened at the two houses behind me. now an alexandria sheriff's deputy is being hailed as both a hero and a good neighbor after responding to an in progress burglary at the home next door while he was off duty. tonight john pierson showed us the bullet hole in his garage door, grateful he was inside his house this morning. >> i would have been in the garage and hit me, you know. but thank god it didn't happen. >> reporter: he and the alexander sheriff's deputy across the street were preparing to go to church with their families he says when someone told the deputy about break-in at this home on their street. the deputy sprung into action, confronting the two intruders as they jumped out a window. >> we're all neighbors. we all look out for one another. >> reporter: a neighbor indeed because when one of them pulled out a gun and began shooting, the deputy returned fire. no one was hit and the men escaped but the incident has transformed one of the more reserve deputies on the force into a hero. >> i'm very proud of him, very gauge rouse act -- courageous act. took a lot of courage on his part to do what de. >> it could be any one of our houses. >> reporter: joseph says on addison road it's simply the community way. >> most of the neighbors are pretty close-knit. they know each other. if we hear something that's out of the ordinary or you hear some noise, you can't just act like you don't hear it. it could be your next-door neighbor or it could be your house. >> reporter: prince george's county police are still looking for those two suspects. they did put up a helicopter earlier today to search for them but so far they have not been able to track them down. >> the officer has been told he can remain home until he is ready to return to work. an accused gunman behind a triple shooting on christmas day is under arrest tonight. police picked up 20 year-old marlowe garcia this morning. he's charged with first-degree murder in the death of 21-year- old miguel romero. the shooting happened just before 5:00 friday morning on a house along 4th street. that's in the petworth neighborhood in nortest. to the other victims are still recovering from their injuries. the family of a missing 11- year-old girl found dead will not have to pay for her funeral. authorities claim a registered sex offender abducted sarah foxwell tuesday night from her home in salisbury. her body was found christmas day after a massive search. a funeral director in salisbury says anonymous donors have paid for the girl's funeral and burial. 30-year-old thomas leggs has been charged with kidnapping and burgry in his disappearance. so long snow. hello sun. after days of cold and rainy weather, today we finally got a little warmth and sunshin a live look now at how things are. will the warmer weather last through new year's day? that is the big question. fox 5's gary mcgrady down in the weather center with hopefully some answers we want to hear. >> it looks like we're going to be ringing in the new year with cold weather. maybe even a little bit of snow. maybe even a little bit of rain. kind of a mixture there. tonight we're watching some clouds on the increase. they're moving in from west to east. trueview will show that for you. but along with the cloud cover is snow through most of ohio. a little bit of leading edge rain and a mixture in between. now, it looks ominous and it looks like it could come right across and bring us a little bit of rain and potentially some snow. this won't be able to crawl over the mountains. it looks like what gets close to us will be in extreme northern maryland up into southern sections of pennsylvania. you can already see a strip there running out through southern and central sections of pennsylvania. we will stay dry, though. there may be a sprinkle or snow flake here or there but it doesn't look like it's going to be a big deal. along with that comes some clouds. they'll start to increase over the next few hours. that's going to basically kind of put a lid on our temperatures. but the temperatures have been dropping out there pretty quickly, especially in the suburbs. so with the increasing clouds tonight, the burbs will be freezing in below. temperature here in the city basically settles right down into the middle 30s. winds out of the southwest at 5 to 10 miles per hour. not so much sunshine tomorrow but it's not necessarily going to be very cold tomorrow. it's going to feel chilly with the breeze, though. but as we get into tuesday and wednesday and thursday, some very cold air is coming down out of canada. so we're going to find ourselves right back in the 30s for highs. then the potential for a bit of a advisory for parts of prince george's county tonight. take a look at this map. these are the areas affected by this boil water advisory. a water main break is forcing washington's suburban sanitation navigate the after christmas sales. >> keep it on fox 5. we're just getting started at 10:00. malls across the country were flooded this weekend with shoppers rushing to return or exchange those christmas gifts. no doubt retailers wanted them to spend a little more, too. many stores unveiled huge after christmas sales to try to snag those big spenders. while malls were overflowing with people, it was a much different scene for a neighborhood -- for neighborhood boutiques. >> bad weather can really work against the little guy. the last few weeks haven't exactly been kind to store front merchants. tisha thompson headed to old own alexandria to take a closer look at what keeps them going. >> reporter: whether it comes to shopping in old town alexandria, it's all about the weather. until this weekend the weather was pretty crummy from the rain to the big snowstorm way back at the beginning of the month which wiped out old town's famous scottish parade. the snow scared away the big owds that normally piles into the scott yich merhant after the parade. >> when it rains t slows right down. i mean, people don't want to come out in it but yet they'll drive 20 miles in it to go shopping somewhere else. >> reporter: specializing in cigars and all things scottish, john penn estimates this little shop took a 30% hit during the holidays. but he's not too worried because most of the independent retailers here rely more on a steady year-long customer base. >> people here in old town, we have our couple hundred regulars every week. they keep the doors open. >> my son is going to have a corn cob pipe to be popeye. >> reporter: this week old town is also relying on customers like dave barton. people still searching for the unique gift they were never able to find elsewhere. >> my kids tried to shop at a mall, an unnamed mall and they were in traffic for hours. so this is much nicer. and the store merchants are wonderful. >> reporter: teresa she owns she's unique jewelry and says unlike the mall, stores here rarely get returns. >> so far we don't have any returns this year. >> reporter: she's put her cheapers inventory on sale because she's found the expensive stuff is easier to sell. afor making it this year, she says? >> oh, i think i hang on, see what happens. we believe the economy should be getting better and we don't know what happens. just ry, try our best. >> reporter: the folks at she's unique says for independent stores it's not so much the holidays that make or break you but when yourlease is up. and for them it's not for quite a christmas shopping made a 15% of last year's sales. merchants won't know the full picture till december sales numbers are released next month. but retailers are banking on big business. they are slashing prices but that's not all. >> i definitelthink there's going to be a lot of great free shipping offers, a lot of 50% off the entire store after christmas. i think this year is going to be probably thebest we've ever seen. >> a little strategy for you here. the experts say when you're ready for another deal-seeking trip to the store, map out your adventure first. not sure why you're not seeing any of those deals. map ought your -- map out your ventures first. >> that was video of black friday. >> that's pretty good. here's another tip that's timely. if you have gift cards for christmas, you might want to cash in sooner than later. yes, you may be all shopped out but as fox's doug lieu luzader reports, the rules on cards are changing and that may have a big impact on stores and you. >> reporter: this is the day when so much of that holiday shopping rush pays off and for some the best gifts come in the smallest packages: gift cards. >> i like getting them and i like giving them. >> i like to buy my own things. >> reporter: for stores it's a double bonus. some people end up spending far more than the cards are worth when they redeem them and some never bother to redeem them at all and the stores make out but even that can help consumers, says john stosle at fox business. >> it allows stores to charge less for the products that they do sell. the market sorts it out far better than the bureaucrats ever will. >> reporter: but the bureaucrats are trying to sort this out and next ear a new law goes into effect designed to help consumers deal with all the fine print, the sort of thing that can make redeeming these cards so annoyi. >> i got burned by some of them that had the fees. >> so many go unused. i look at my miles as i'm cleaning up and i notice i have a ton of gift cards i still haven't used. >> reporter: if you do replace them for a time, the new rules which go into effect next august mean which they can't expire for five years and those enactivity fees will be limited. while consumers may like the new rules, the down side is they could end up costing stores more meaning prices for all of us could go up. it's enough to make anyone think of an easier gift. just give cash. >> congress is regulating cash because they're deflating the currency. so the hundred dollars you give to someone now might be worth $10 by next year. >> about $600 to $700,000 each and an air traffic controller can make about $150,000 a year. in los angeles, adam houseley, fox news. the weather just won't let up making travel difficult for the ninth straight day across the country n. chicago there was much more snow than expected and that forced 40 flights to be delayed. the suburbs got socked with a foot of snow yesterday and more today. they thought they were only going to get about half of that. in deluth, slippery roads after a weekend of storms that dropped two feet there. they got 13 inches on christmas day alone nearly doubling the previous record. winds were up to 45 miles an hour making it officially a blizzard w. temperatures going nowhere but down refreezing is a major concern. in kansas, a snow emergency the. nearly a foot falling this weekend forcing the counties to urge people to stay home and to increase the number of plows and salt trucks available for service. state officials say since christmas evening, they've had 50 accident scenes and rescued nearly 300 cars that stalled on the roads. construction crews working at ground zero don't have to go far to grab a bite to eat. you might call it the sandwich shop in the sky. that is exactly where it's located. the high-rise deli builds sandwiches while crews rebuild the strayed center. we have a closer look. buckle up. >> reporter: most new york city sandwich shops are at street level. but one day this one will tower 105 stories above the world trade center site. a subway sandwich shop was built inside these shipping containers at a steel plant about 45 minutes from ground zero. now it's been moved to the world trade center site and fitted to a huge construction crane. >> they have to follow all the same rules that all the other restaurants follow anywhere that they're built. >> reporter: as the tower rises, one story at a time, so will the subshop. this way hard-hats won't have to go down to the street to get something to eat. instead they can get their sandwiches, chips and drinks right where they work. >> it would be great for the guys. they don't have to spend half their lunch hour going down to the ground. they'll be able to spend more of their lunch hour relaxing and eating lunch. >> reporter: this will be one of new york's most exclusive restaurants. only workers with access to the site can eat here. as for the men and women behind the counter? frederick, already down to 30 degrees. manassas sitting at 28 degrees right now. and culpeper was at 25. 30s back out to the northwest for pittsburgh. here's some colder air though. chicago 20. detroit 25. and columbus 25 degrees. that is moving in our direction. and we just get a sense here way out in the northern rockies, montana, wyoming. there's another slug of some cold air and then back up into canada. that's the cold air that's really going to start settling in here for tuesday and wednesday and thursday as well. it will take our temperatures right back into the 30s. and it looks like we'll have a hard time getting into the middle 30s, okay. so just so you know, the colder air is on the way. we've had high pressure today but notice the clouds kind of on the increase coming across western maryland here. and a lot of snow moving through ohio. this is not going to get here. anything that comes across the mountains will stay just to the north of us. maybe northern sections of maryland get a little sprinkle or a little snow flake. but look at this. most of it getting up into pennsylvania and then you can see it's having a hard time as it's coming across the mountains. but speaking of the mountains for western maryland, back out into extreme western virginia and then eastern west virginia, looks like they'll have a chance of maybe getting four to six inches of snow over th next couple of days. this winter weather advisory, you can see extreme western maryland and then most of eastern sections of west virginia could get 4 to 6 through tuesday morning. again nothing for us, though. max hd future cast tomorrow morning at 7:00 a.m., we'll start with some clouds. we'll have passing clouds through the day. and the winds will stat kicking up as well. notice all the snow back out there into the winter weather advisory. nothing for us as we go into tuesday. lots of sunshine. but the winds will kick up 35 miles an hour so the windchill value on tuesday it's going to feel like it's in the 20s. this is what we're watching for the end of the week. this is wednesday at 8:00. another southern storm system coming out. this does not look like it -- look like almost or the blizzard that we had last weekend, okay, but it is another storm system taking a southern track. our guidance is suggesting this will go out to sea and just brush us latter part of the week with maybe a little bit of rain and snow mix. doesn't look like a big snowstorm, at least not at this point. overnight tonight your forecast. increasing clouds. around freezing or a little bit below that out in the suburbs. we're middle 30s here in town. not so much sunshine tomorrow. we're going to have a breezy chill as the winds kick up out of the west at 15 to 25 miles per hour so that 44 for tomorrow is never really going to feel like 44. it's pretty much going to feel like it's in the 30s all day long. on tuesday it's going to feel like it's in the 20s so very blustery there even though we're going to have full sunshine for tuesday and for wednesday, staying cool on wednesday. then we get into the thursday time frame. new year's eve perhaps lingering over into part of new year's day with maybe a snow- rain mix depending on what that storm wants to do toward the latter part of the week. good for you, will. you were listening and predicting snow toward steve smith. he bounces off one hit into the end zone. 47-yard touchdown. the panthers pound the giants 41-9. a cowboys win tonight will eliminate the giants from the playoffs. the ravens looking for a sweep of the steelers in pittsburgh. second quarter, baltimore trails 13-3. a leaping todd heap. he then falls backwards into the end zone. a 30-yard touchdown. the ravens cut the deficit to 13-10.
