frederick, maryland. >> reporter: there's nothing to suggest gordon jr. or anyone else was smoking at the time of the blaze near the pump. investigators know that because the incident was captured on tape, caught on surveillance camera. >> a adult male pulled into the gas station. entered the building. the convenience store, utilized the restrooms, came back outside, began to fill the gas can between his vehicle and fuel pumps. >> reporter: investigators say an employee in the store saw the gas ignite and called 911. two sheriffs were nearby and arrived within a minute. >> after the subject caught on fire he ran into the building, then ran back out of the building. >> reporter: the station is owned by the exxonmobil corporation. representatives of the company declined to comment. the man who runs the station for the company also declined to comment. by midday the company had inpectors on the scene looking at the remaining pumps taking off the covers and examining the lines. the damaged pump was hauled away. >> it's not somethg you see that often. there's always reminders about static electricity, to make sure you touch your vehicle, discharge any of the static electricity that might be around. >> reporter: investigators are also looking into the possibility the running vehicle could have sparked the blaze or even a cell phone. >> exxonmobil released a statement late this afternoon expressing condolences to the gordon family. the company says it's cooperating fully with the investigation. we should also point out they believe that ainsley gordon jr. was there at 4:00 a.m. filling up a gas can. we tried to locate his family and friends, haven't been able to at this point. the fire marshal says gordon lived in germantown, maryland. it's one of the worst things that could possibly happen in this area at rush hour. metro's computers gone haywire and the traffic lights out of sy thc. all it took was for one part of this thing to break and it created chaos on the commute, on the rails and buses. an outage earlier crippled a key data center computer. that meant debit cards wouldn't work, credit cards were hit or miss. we're told most of it is fixed at this hour. then the traffic lights on the roads at montgomery county. the backup bad on route 29 around fairland road at the height of the rush. the problems may be lingering tonight. karen gray houston with the latest. >> reporter: i feel like i've been in traffic all day. i got stuck in traffic on colesville road. right now -- look at that. long lines of traffic backed up because the montgomery county computer server is not getting the signal to traffic lights to rate in rush hour mode. it was like that all morning. all over montgomery county. traffic experts telling us they don't know the reason for the computer glitch that eft the roadways clogged. the worst of it, route 29, heading towards four corners, georgia avenue, new harbor cam, wisconsin avenue, rockville pike, especially where they meet the beltway. the county says their central computer is 30 years old. they are in the second year of a six-year upgrade of the system. nothing like this has ever happened before. >> number one, i just want the redents to know we're clearly sorry this has occurred. >> the main thing to recognize right now is all the traffic signals are operating, there's no safety issues in the street. our computer technicians and signal technicians are diligently working on the problem trying to get it resolved. >> i left my house approximately 7:30 in the morning. we had a meeting at my job at 8:30. i was, like, probably 45 minutes late. >> reporter: now, there is no way to know how long it's going to take to fix the traffic computer system. what they are telling us is that they have technicians who are in the field, they are operating some of the traffic functions manually as they can. they do have a little piece of advice for drivers. just use caution. we're live in rockville, karen gray houston, fox 5 news. laura? to you. >> what a frustrating thing and a stressful morning and evening for everybody out there. karen, thank you so much. montgomery county says the problem is not the result of a computer virus. they believe it's some kind of equipment failure. one person is dead after a fiery crash on the beltway this afternoon. a van ran off the inner loop in bethesda, crashing into the woods near connecticut avenue. the van had several containers of an unknown flammable liquid inside. they did explode and the driver was killed. no word nwhat caused the crash. getting ready to pay a little more to drive the dulles toll road. the board approved a toll hike today, it will now be 25 cents more to pass through the main toll plaza and 25 cents more on each ramp. the change takes effect january 1st and it's expected to be just one step in a series of hikes through 2012 to help fund metro to dulles. stimulus money will help pay for major construction project along new york avenue in the district. the bridge over the csx railroad project is getting a major overhaul. the money will paid to preserve the underside of the bridge, deck and roadway work from north capitol street to bladensburg road in northeast the first phase is six months, with little impact on traffic we're told. the replacement itself starts in the spring. virginia republicans basks in the glow of the 2009 elections. a day after the sweep of the three top offices. now at the top, bob mcdonnell who wasted no time getting to work today. tom fitzgerald is tracking day one of the transition from richmond. >> reporter: you know, as the 71st governor of virginia bob mcdonnell will take over a state with an expected budget shortfall. big questions over how to pay for transportation projects, a divided legislature and that is just for starters. even though the comin was smooth on his -- campaign was smooth on his first day the governor-elect says rough water is expected in the days ahead. >> it was a short night and early morning. >> reporter: the early morning for the governor-elect started with a phone call from president barack obama. >> now that the campaign was over, that he hoped we would work closely together, to govern, especially with virginia being the neighboring state to the district of columbia. >> reporter: eight months ago i applied for the job of governor of virginia. tonight, you have hired me. thank you. [ cheering and applause ] >> reporter: both his campaign and victory say gop national chairman michael steele, is one that republicans nationwide could learn a lesson from. >> we have to recognize this playing field is changing for us. that running these races now, it matters what you're saying to every voter. not just a segment of the voting population. >> reporter: for his part mcdonnell would not speculate on what his election means for democrats nationwide. but says his campaign decided early on to zero in on economic, not social, issues. >> the focus on the things, the quality of life issues that people care about. that's what governance is all about. they are interested not in rhetoric, they are interested in results. >> reporter: already though mcdonnell faces a budget shortfall. outgoing governor tim kaine will craft the first budget mcdonnell works under, a tradition he would like to see changed. >> that's one of the items the lieutenant governor and i had suggested early on is to change this budget cycle so that we don't have this disconnect between the new governor coming in and not being able to submit its own budget, i think that makes it difficult for any governor. >> reporter: and in the middle of his victory tuesday night mcdonnell said he did have one difficulty of his own, not having his deceased mother and ailing father able to see their son elected governor in the state where they raised him. >> we missed having both of my parents there but they reminded me often that those big dreams can turn into anything you want to be in america, in virginia. >> reporter: the governor-elect went on to say he did have a conversation with current governor tim kaine this morning. both men pledged to work closely on the transition that will take place over the next coming months. he also started to name his transition team included in the members, mcdonnell's lifelong friend and current ceo of dominion power, tom farrell. live in richmond, tom fitzgerald, back to you. >> why wasn't deeds able to repeat the road maps of previous democrats who were victorious in their races? >> it's one of the key points that the democratic forces will be looking at. if you look at the victories that mark warner put together eight years ago and the one that tim kaine put together four years ago, key in both of those were getting moderate republicans and independents in areas like loudoun county and prince william. that did not happen last night. 2-1 margin of independence went for bob mcdonnell. also, if you look at where those victories came from, it was spread throughout the state, so deeds not being able to hold on to the independents and not being able to draw moderates to his side was a critical key in what happened yesterday for the democratic losses. >> and virginia being a key state i'm sure the democrats will be analyzing this for some time to come. tom fitzgerald, thank you very much. republicans also claiming victory in new jersey, where christie beat out jon corzine. a surprise in new york, democrats scored their only victory in the night in the 23rd district, considered strongly republican. meantime, gay marriage supporters in maine are vowing to fight on after voters decided to repeal a law allowing same sex unions. voters in washington state, however, did approve same sex civil unions. a police standoff in the district lasted for several hours today. u.s. marshals trying to serve a warrant to a man wanted for assault and that is when the standoff began. police were told he was shoulder holding a woman and child hostage on hunt place northeast. turns out they were too afraid to leave the building. the suspect surrendered three hours later. investigators believe a robbery suspect trying to get away from cops flipped his car down a ravine. anacostia police got a -- police on the lookout for the vehicle discovered the reckage here. the driver wasn't in the car but officers arrested him a short faced a judge today in cleveland. >> reporter: anthony sowell stood cuffed and quiet as the prosecutor described the evidence stacked against him. >> 10 bodies have been found at the residence of mr. sowell in addition to a skull. >> reporter: facing a judge for the first time wednesday morning charged with five counts of aggravated murder. the state making its case to keep him behind bars. >> the state believes he is an incredibly dangerous threat to the public. >> reporter: sowell denied bail by the judge. will stay locked up. the deputy police chief says this is one of the most disturbing cases he's worked on over his entire career. >> 24 years in law enforcement along with the other guys that have quite a bit more time. we have never seen anything like it. >> reporter: six bodies found inside, four buried in the backyard and a skull found in a pale in the basement. in addition to taking the home apart looking to see if there are any more cops say they are canvassing the neighborhood a half-mile in every direction to make sure there are no more victims of anthony sowell. danita carmichael's mother has been missing for a year. she said her mother's car was found nearby sowell's home and >> this case could solve unanswered questions. >> nobody came across a body. nobody saw her. no phone calls from her. we figured that somebody had to be either -- done something to her and put her somewhere or was holding her against her will. >> reporter: in cleveland jamie colby, fox news. >> police do not suspect foul play in the deaths of three north dakota college softball a gas station as the customer was filling his gas can. investigators don't know what sparked the fire. they are considering the possibility that static electricity caused the flames. a computer glitch turned the morning commute into a nightmare for many metro riders. fair -- fare cards wouldn't work, in some cases credit cards wouldn't work either. and in montgomery county traffic lights are still out of sync. the problem caused huge backups like this one this morning on route 29 near fairland road. t communications system still has problems at this hour. high school sports supposed to promote fun, team spirit but confusing calls over excessive celebrations have some people questioning where has the fun gone? dave feldman has more. >> reporter: in the washington area a wide receiver from mcnamara was flagged for pointing to the sky after a touchdown. a defender penalized after intercepting a pass. the latest incident happened last friday in a game between broad run and potomac falls. lindsay murphy joins us from ashburn with the details. >> reporter: last friday in the game broad run was hit with unsportsmanlike conduct penalties after every touchdown in the first half. many people, chest bumps and high fives are harmless but that is the issue at hand here, but this saga is just beginning. the bigger story involves senior running back t.j. peeler who verbally committed to play for pitt next year. ejected from t came following two unsportsmanlike conduct penalties. one on the sidelines after he celebrated with teammates following a score. the other on this play, his only play in which he ran 65 yards for a touchdown and then pointed his arm in the air. yellow flag that. two unsportsmanlike penalties equals ejection according to the rules. >> he just -- he's one that everyone knows, everyone likes. getting in trouble for doing a simple chest bump with a teammate? it's not like he was trying to make fun of the other team or do anything personal. >> reporter: not only ejected for that game but possibly suspected for broad run's next game, november 20th in the virginia 2a region two semifinal. the rejection is being appealed and he may see this go away. it's under review as we speak. but the bigger question people are asking, what is unsportsmanlike conduct? what kind of celebrating is acceptable? >> guys like to celebrate after a good run or pass. i think that's fine but what the coach likes to express is how disciplined they are and how, you know, they shouldn't be running around, jumping around. >> whether on the classroom or field there's a learning experience to be had here. maybe an explanation would have helped during the game, things like that, called a couple of players over, said, i'll flag you if you do that again, that sort of thing of we're looking at all those factors. again, i'm sure they are very fair. they don't want to affect play down the road. they want good sportsmanship. i'm sure there will be a good decision. >> reporter: broad run coach mike burnett, t.j. peeler, neither available for comment because the appeal is still pending. what i do know, he's handling the situation very well. he also spoke with the coach dave wanstadt that says it won't affect his college igibility. >> what people are not talking about is the great season broad run is having. >> reporter: it's a bit overshadowed. they are defending state champs. hopefully that will come to the forefront once this gets settled tonight or tomorrow when the appeal is finally done and checked off. >> lindsay murphy live in ashburn, virginia. the ncaa also imposing a zero tolerance policy for the basketball season. the major flaw with the rule, much like the broad run video, officials will be left to their own discretion. you don't like this. you have a high school star who went to play in college. you said if anthony had scored a touchdown, celebrated, he would have been flagged. you can't point to the sky. >> even running across the field with a simple point. that just seems -- i mean, high school sports? give me a break. >> i can see where it can get out of control in professional sports, and it lasts too long but give me a break. >> there's a difference between celebrating and taunting. you shouldn't taunt an opponent. you shouldn't look down on him and flex or do something on top of him but if you scored an 80-yard touchdn, your first in the high school game, pointing to the sky or spike the ball or celebrate, you have to be able to let a 16-year-old kid, how are you going to curtail that? don't show any emotion. no emotions for teens? >> i don't like that rule. swine flu fears spreading to the pork industry. the u.s. department of agculture says pigs in a commercial herd tested positive for the h1n1 virus. the first positive results from a commercial herd come from indiana. last month tests confirmed that several show pigs at the minnesota state fair contracted the virus as well. the usda officials are now stressing you cannot get the swine flu from eating pork products but the industry itself is still taking a hit. cdc director thomas frieden went to capitol hill today answered questions about the shortage of the h1n1 vaccine. he told a house subcommittee he is frustrated the vaccine is not produced as quickly as manufacturers promised. frieden says more than 32 million inspired millions of people with his poetry, now his memory will live on. >> mattie was 13 when he died five years ago. now his mom wrote a book about his life called "messenger." she shat down with tony perkins to talk about it. >> reporter: he touched the lives of many with his poems he called "heartsongs," words of hope and inspiration for good times and bad. now jenny shares the touching story of her best friend, her son. >> i wanted to have one word that people could walk away with that summarized his life, i toyed with poet, peacemaker, practical joker, all different titles and words but mattie believed from age 3 on his role in life, his reason for being was to share a message of hope and peace. through his words, through poetry, his actions, through everything. mattie believed that god spoke to him, to his heart. not in words, he believed that's what a messenger is, is you take some abstract concept, thought, understanding, and that as a messenger you give that a shape. through actions and he believed he was a messenger of words. >> reporter: mattie's legacy lives on today. a statue of mattie is the centerpiece of a park across the street from jenny's house in rockville. she goes there often with mattie's service dog mica. >> when they took the atue of the of the crate and he saw mattie's face, i mean, all of us looked and thought, wow, that's not just a look-alike, that's like the essence of mattie. looked like he was about to get up out of r. well, dogs are color-blind, they see in black and white and mica lifted his head, turned his head and jumped up shaking, crying. he ran over to the statue, shaking and crying with joy. and sniffed it and sniffed it and then sniffed it again. and then hegot obviously sad. and looked at me and looked back at the statue and just studied it. then walked around and lay in the -- on my chair he's on the left side. on mattie's chair he was always on the right. he went to the right side of his daddy's chair and lay there for two hours, wouldn't move. now when i take him to the park we always go straight to the statue. i touch mattie's hand and i go for a walk around the park. he goes to the statue and just turns his head away. he will not look at it. which is a testament to how wonderful that statue is. and the love and memory mica has for his daddy. i want people to know this is not a story of my grief. this is not a story of mattie's death. this is a story of mattie's life which is incredible. and, it doesn't end with his death. it ends with his growing legacy. i want people to know they are going to be reading a story that has as much whit and wisdom as it does sadness. >> reporter: jenny stepanek lives with the onset adult form of the disease that claimed her children. but like mattie it doesn't stop her. she received a phd in early childhood education and remains actively involved with mda. tony perkins, fox 5 news. >> an incredible woman and she told that story so well. >> really touching to hear about the dog and his reaction to the statue. >> very sweet. and very real. and through his poems and outreach mattie was able to make friends with many people including jimmy carter, oprah win -- winfrey. >> jenny writes about e-mails they gave her after mattie died. it's amazing to read that jimmy carter asked mattie for advice and jenny knew he would one day win the nobel peace the weekend is looking great. i'm going to show you the forecast in a moment. we have game six on fox, the world series continues tonight, are the yankees going to get it done? are we having a game seven? i won't tell you who we are rooting for at fox but i bet you can figure it out. 44 to 44 had degrees, it will be chilly and likely drop into the upper 30s before the game is done. highs today only in the low to mid-50s. 54 degrees, just as we expected at reagan national. and temperatures definitely dropping but not as cold as last night when dulles and bwi marshall dropped to 32 and we had a lot of frost around the region. and a freeze warning post of -- posted. that is not in the cards tonight. still in the upper 40s now in frederick and gaithersburg, washington 53. we have chilly nights in the forecast. tonight won't be as cold as last night. forecast, a light shower in spots, 40 degrees. tomorrow, more clouds than sun, a hit or miss shower possible, 56 degrees. we're not talking about a lot of rain. what we are talking about, the high pressure giving ground, a weak frontal system pushing clouds and some showers. that is going to swing through tonight. i've got to tell you, once that swings through it's going to blow up off the coast and we're going to get pretty good winds as it turns into a more important storm for new england with just a few showers for us. that's where our friday breeze will be coming from. let's talk about the forecast and the weekend, 56 tomorrow, 55 friday. saturday delightful, 60 degrees. and we could be in the mid-60s if not warmer ad saying he was profiting off his dead friend. what did spade tell you? >> we got him outside of bose steakhouse last night. he was serious about it and said look, if i wanted to make money off of chris farley, i would have written a book, done a lot of things and didn't. he said it's a situation where it was honoring tommy boy. he felt it was appropriate. then right after he said that chris farley's brother came out, because david spade is good friends with him. they have dinner every week and said, look, this is appropriate. and was solidly behind what spade had done. i got to tell you, on this one, i don't think there's any doubt dade spaifd was right, what he did was honorable and nothing he did he needs to apologize for. >> is there anything more he has to say about this? is this it? >> i think it's probably over. i mean, i can't imagine this is ging to -- this has the kind of legs a hollywood scandal has. he didn't do anything wrong. i think people were trying to invent a story that really doesn't exist but david spade is right, he could have written a lot of things about chris farley around the time of his death that could have -- the other thing is spade doesn't need
