now abc 2 news, latest at 11:00. breaking news. investigators believe they have identified a woman whose ipod was found down in a manhole in north baltimore last week. good evening, i'm cristian schaefer. police now have a man in custody in connection with the murder of that woman, this news just coming in within the past couple hours. we have been updating abc 2 news.com. alva vazquez has been missing since january of 2008. almost two years. investigators have now charged her boyfriend with killing her. he is in custody. carol connor is here with details. >> reporter: the information is right here in the charging documents, the baltimore state's office sent us the documents which spells out how a missing person's investigation is now a murder case. >> reporter: the 289-year-old lived in columbia where she worked at two restaurants. in january 2008 her colleagues reported her missing after she failed to show up to work. >> she was a good worker you know, she would come you know and she had any problems, you know, not coming in to work she will call me. >> now the mystery has apparently been solved. charging documents say her decomposed body were found in a manhole. they charged her boy present, . she said she was grabbed, struck in the head and he attempted to drag her into the woods. a protective order was issued directing crews to have no contact with vazquez. the charging document also states that crews was the last person to be seen with vazquez. that takes us to friday when a grizzly discovery was made in the man hole. neighbors stood in shock as the remains were brought out. >> well it seems like it would be hard for somebody to flip that down. >> unless in the middle of the night when she was sleeping. >> they said her body was floating in about 6 feet of water, changing the missing person investigation into a murder investigation which ended with the arrest of her boyfriend. victor hernandez crews entered the country illegally, again he is charged with first degree murder, a preliminary hearing is scheduled for next month, cheryl connor, abc 2 news. >> thanks cheryl, we'll continue to monitor that story. >> a teenage ager is dead after being shot in west baltimore. darrius anderson was shot in the head around 7:30 friday night at west lafayette avenue and west payson street. a four-door malibu was speeding away from the scene. they are asking anyone who might have witnessed that to call in. anne arundel county police officer shot a man during a struggle last night. that officer made a traffic stop while patrolling route 4 around 6:00. but the car continued for a short distance. finally pulling off across the line. a struggle started after the officer approached the car. the unidentified officer was hospitalised with injuries. demetrius thompson suffered none life-threatening injuries in the shooting. charges against him are pending. a big drive to fight the flu. 6,000 people got their seasonal flu shots without leaving their car. they said it was the largest drive-through clinic in the country. cars lined up well before the start time and they had to start turning people away by noon. >> it was about three hours, we got in at 9:30 on snowden river and it was backed up and it was a long track and i'm running out of gas. >> the vast majority of the flu, about 95% of it in maryland and in the united states right now is actually h1n1 but it's still important to protect yourself against the seasonal flu which will likely come later on in the season. >> the flu clinks have started early to try to get people prepared for the h1n1 vaccine. they hope to get their first shipments by this tuesday. doesn't mean you'll be vaccinated why just yet. the first doses will be offered to health care workers. 1million doses but tougher to see. clouds are rolling in out of the west to southwest. you see it here on the satellite pictures, no precipitation for these clouds. the nearest rain way down in deep southwest virginia hundreds of miles away, temperature-wise we're looking at a cool night already, although there's clouds coming in started slowing down the drop in the mercury, we still have a few 40s out there at lynwood. down to 489 degrees, dropping to 50 or so in baltimore. various blow cooler out in the suburbs and just look for a cool morning start tomorrow. we're gonna talk more about some more nice weather to kick off the week and when we might see some rain around here. all those details trait ahead. thanks. a two-year-old boy is safe after being abducted from his home in baltimore county. the boy was dropped off safely at a relative's home this morning after being taken from his own home just after midnight. the boy was taken by his father who threatened to harm himself and his father. he dropped off the boy. funeral services for the dalton family were health at the liberty baptist church saturday. 38-year-old charles dalton senior shot his wife, two children and the family dog before killing himself. they believe financial problems were part of the reason but, police say, they still have no solid answers. more women are coming forward and claiming that a prominent baltimore rabbi touched them inappropriately. 85-year-old rabbi jacob max was sentenced to a suspended one- year prison term after being convicted of molesting a woman in a funeral home. max's lawyer says his client is innocent. in news around the nation tonight, as in president obama's national security advisor is trying to scale back fears militants are gaining ground in afghanistan. retired general james jones says that country is not in imminent danger of falling to the taliban and al qaeda is not capable of launching attacks there. but they did attack a pair of remote out posts, the taliban was behind those attacks which killed eight u.s. soldiers. troops in eastern afghanistan have been fighting on remote bases difficult to defend. the new u.s. policy calls for some of those bases to be closed and the troops moved to more populated areas. >> we must focus our resources and prioritise in those areas where the population is most threatened. we don't have enough forces to do everything everywhere at once. >> this is the heaviest u.s. loss of life in a single battle since july of last year. in your stan province is some of the least-hospitable terrain on the planet but it is their back yard. it was 2:00 a.m. when hundreds of fighters left a moving and attacked the u.s. bases. they attacked with rocket propelled grenades. it was a massive assault. the troops were outnumbered and living your life in constant pain. it would affect everything you do from work to play to sleep. an organization called the american pain foundation says 50 million americans suffer from some form of chronic pain. for one woman in our area nearly 20 years of trying to manage her condition have been complicated, she says, by her insurance company. she claims a new kind of treatment made her feel better, until the insurance company stopped paying for it. >> there is no reprieve for angela quay-yard run of anne arundel county. >> it's all there. it's worse towards the end of the day. >> all day, all night, chronic unending pain whether she is trying to make dinner or at work. >> it hurts just to sit in a chair normally. if i'm sitting at work i'm with an ice pack or with a heating pad. >> reporter: it never ends. >> basically when we're doin' anything where she is gonna have to stand and will strap an ice bag to her. >> it started with diagnosis of sky attic a and a botched back surgery in 199 # 3. she has tried physical therapy, a chiropractor, even a second back surgery in the year 2000. >> i tried everything. >> including pills. >> this one is the most relaxant. i have to use this at nights so i can sleep. >> eventually angela visited dr. fred rick sutter in annapolis who used a new kind of treatment called trigger point injection. shots directly into her backs and legs targeting the painful knots knots in her muscles. she was skeptic. >> i was able to work better, i wasn't missing days. at the end of the day my pain wasn't as bad as before. >> reporter: but after what she considered a success in march of 2008 angela got a letter from her insurance company. guardian life insurance determined her injections were not medicalliness. that meant her claims totaling nearly $3,000 would be denied. we contacted guardian life insurance of america to talk about angela's case. but a spokesman declined to comment. the impact of a company's decision went far beyond her checkbook. >> i was using my cane again, i was barely able to walk. i lost -- i used up all of my sick and vacation leave. >> reporter: she felt she only had one choice. >> i was facing going on disability or paying out of pocket and, um, so i started paying out of pocket. >> reporter: she challenged guardian's decision appealing it to the maryland insurance administration, the mia's independent review sided with the insurance company agreeing that angela's trigger point injections were not medicalliness. >> the definition of medical necessity is not weather 0 not you believe that it is something that has provided relief to you but whether or not it is a standard within the medical community. >> angela then appealed the mia's decision this, time to the state office of administrative hearings where the hearings are recorded. here is some of angela's testimony. >> i tried all of the standard treatments and they have not worked and many have made the pain worse. >> an attorney for the insurance company argued medical evidence on trigger point injections is tentative. but the case for the insurance company comes down to this. angela's insurance policy states that guardian can only reimburse for services that are medicalliness. >> it is clear that she didn't like the decision and i respect that and -- but it's also clear that guardian has this duty in all aspects of this business and they are simply following that duty here. >> reporter: in the end the judge also ruled the insurance company did nothing wrong. angela can appeal the ruling in circuit court but she says she probably won't. >> it's hard for me to come home at the end of the day and then get on the computer and try to write letters and appeals and all the, i mean it's exhausting, and that's what they are counting on is that you're just going to give up. >> reporter: the entire process has left her feeling disillusioned. >> they are just clearly trying to make a profit and i'm cuting into their bottom line so they have to cut me off. >> reporter: still coping with pain, happening le continues to pay for trigger point injections out of pocket. >> and angela quay-yard run says she has been keeping a close eye on the health care debate in washington. she hopes the controversial public option which would provide competition for private health care insurance companies would be passed. last week they rejected two proposals that would have created the public option. >> now the forecast certified baltimore's most accurate by weather rate and maryland's most tomorrow. probably most of tuesday, then things start to change mid- week. >> yeah. >> and the night is field goal a lot more like fall. >> this is cleaning weather. >> yeah, look outside right now. cool night in the inner harbor there. taking a look at the inner harbor we do see temperature- wise we're at 53 right now. humidity is up around 80% although don't let that fool you. the air is quite dry. the relative humidity, as the temperature continues to blum met out there, is at 80%. i want to show you a sunset this evening. you can see a little bit of shake in the trees here. that's our light west wind, you do see that, eh, it was a pretty nice evening out there. a few clouds rolled in. a real nice evening there in annapolis and across maryland. here is a look at the high temperatures. the so-called high temperature map looking more fall-like. the high country, hagerstown up to 69 today, cooler air out in western pa but on the eastern shore back to the mid-70s, a couple degrees above average. but the entire area has cooled off dropping into the 50s, a few spots already down the 40s, york down to 46 right now. but some spots still holding onto the low 60s, all depends did exactly where you are. one thing that tends to hold up the low temperatures. take a bit of that crisp nets out. overnight cloud cover, that's what we're getting right now. acts as a little bit of an insurance lay tore, allows some of the remaining warmth to hang out over part of the overnight hours. we will drop through the overnight hours temperature- wise, not as sharply as if we had kept a clear sky. we'll get into some more clear weather tomorrow. we'll see it back towards the upper and midwest area. across ohio, that clearing weather will head our way, big rainmaker through the southeast, that is going to miss us completely. deep south virginia may get squirted with a few showers overnight. we don't pick up much at all in the way of rain. decent sunshine tomorrow. we'll see some few fair weather clouds, nice looking day, fall weather warming up around 70 in the afternoon. here is your forecast tuesday. things begin to change here, this is tuesday night. you do see some wet weather moving in out of the west. this is our next weather-maker, it will come in late tuesday evening, most of the day tuesday looks pretty nice, bring in rain tuesday night that could linger into the day wednesday as well. our overnight forecast tonight, down to 50 ore so in the city, outer suburbs expecting 40s. definitely get the extra layer out there, look out the window as the clouds pass and break up a little bit. a little moonshine out there, a little moon in baltimore. on the bay area, 5 to 10, sunrise 7:01 in the morning. the sunrise mostly a clearing day scenario. we may have some clearing cloud cover, plenty of sunshine and just a light please out of that west northwest. here is a look at the first couple days of the week. nice looking stuff. 70, 71, 72 degrees monday and tuesday. however as we go toward the middle of the week we see a possible rainy day wednesday and cooler towards the weekend back down into the 60s. cristian. >> things looked a little different at the nfl games today. everybody was wearing pink. the patriots, even the referees wore something pink as the league showed its support for national breast cancer awareness month. the game balls also
