sterman provides something for us. this is an interesting one. h1n1 is actually, scam artists are basically honing in on this trying to get your money out of you because of the virus and because of the vaccine shortage. we're going to learn more about that. what to look for. >> i think it's on the internet. >> yes. >> and sugary cereals? >> you like them? >> i would eat that every morning growing up. >> really? >> captain crunch with the crunch berries, favorite. >> we were not allowed to have that in the house. they are under investigation this morning. the cereal industry is, for mismarketting to your kids. saying that things are healthy, are they really? some say they are not. we'll find out about that. and more about baby einstein. not so much. you have a baby smarty pants at home. >> i do. my baby's a genius. those dvd's that were marketed to parents basically saying, if your child watches this it will help them learn and hopefully, you know, make them smarter. a lot of parents are finding out that is not the case. some are getting their money back. >> we'll learn more about that. in the meantime let's learn more about weather. >> let's go. by the way, linda, i'm jowllous. my parents -- yelllous. my parents wouldn't let me eat cereal with sugar in the first three ingredients. it was the policy they had. though my first cavity, age of 23. maybe there's guaranteed high of 64. 9:03. back to you. >> every morning we start with our top stories. this one is a sad one. the family of a baltimore county police officer is planning his funeral this morning. 42-year-old jeffrey neral was killed in a motorcycle crash as he headed to work over the weekend. police say a woman in a ford focus caused the accident when she pulled out of the loch raven presbyterian church into oncoming traffic and hit the officer. he was thrown from the bike into the side of a car. he had worked for the parkville precinct, he was a 17-year rhett -- veteran. the son of a baltimore city police officer is dead after a crash that happened in anne arundel county. happened saturday morning at the intersection of new cut road in upton road in severn. investigators say 20-year-old joseph zapushek lost control of his car which slammed into a utility pole no one else was hurt. today four members of a religious cult accused of starving a 1-year-old boy to death will go on trial. the cult leader, and another member are acting as their own attorneys. authorities say the cult members starved 1-year-old javon thompson because the boy refused to say amen after meals. his mother, who was also part of the cult pleaded guilty to child abuse resulting in death. she's expected to be freed after testifying against the other members. a man is behind bars this morning in connection with that deadly hit-and-run that killed a johns hopkins student. police say 39-year-old thomas neegan struck and killed miriam frankl as she crossed a street near campus two weeks ago. he was questioned by police last week. as we first reported he had an extensive record including four dui convictions. governor martin o'malley is backing a joint venture between constellation energy group and france's edf. o'malley says his support for the $4.5 billion deal to sell half of concentration's nuclear business -- constellations knew clear business depends on bge customers getting one-time credits, that could be $200 a household. now the latest on the swine flu epidemic. president obama declared the outbreak a national emergency. health authorities say more than 1,000 people in the u.s. have died and 46 states have widespread flu activity. the deaths include nearly 100 children. an 18-year-old from anne arundel county is the latest young person in our area to symbolize the potentially deadly impactd of h1n1. walter brooks' parents say he came down with what appeared to be a cold but quickly got worse. he was hospitalized and that is when doctors told them that walter brooks had h1n1. it attacked his immune system allowing another infection to take hold. now family and friends are saying their final goodbyes to walter brooks. they are going to be viewing today, the first from 3:00 to 5:00, the other from 7:00 to 9:00 at the singleton funeral home in glen burnie his funeral will then be held tomorrow morning, 11:00 at the heritage community church in severn. delays in the h1n1 vaccine have plagued distribution nationwide. the centers for disease control just released the numbers of doses shipped to each state. so far, maryland has received just over 229,000 doses, dc by comparison has only gotten 34,000. recent swine flu clinics in our area have brought out long lines and huge crowds. we have been keeping you updated on where to find the vaccine. stadium place apartments where legionnaires disease is blamed for one death and sending six others to the hospital. in order to kill the waterborne bacteria residents at the senior complex in waverly are being told to run their hot water for a-hour. cold water is being treated with chlorine. in the meantime the red cross has been helping residents out by giving out bottled water. this week maryland transportation officials will hold hearings on a proposed toll plan for the intercounty connector. some critics say plans to charge more than $6 just to travel the nearly 19-mile connector between 95 and 270 is too high. the latest now in developments in the investigation regarding somer thompson. the young florida girl who was abducted and murdered. authorities say they've gotten more than a thousand tips. the 7-year-old vanished while walking home from school a week ago. her body was found in georgia in a landfill two days later. a public viewing will be held today in florida. another sad farewell in the sunshine state. university of connecticut cornerback jasper howard will be laid to rest today after a funeral in his hometown of miami. howard was stabbed to death during a fight outside a dance on connecticut's campus early last sunday. the school's football coach, randy he hadle says he expects a wide range of emotions at the service and hoping for closure. no one has been charged in howard's death. less than a week after he admitted to having an affair with a 22-year-old production assistant, espn baseball analyst steve phillips is now jobless. he was fired by espn, a representative for phillips has announced that the former mets general manager is entering a treatment facility "to address his personal issues." in washington, the dc city council plans to vote on a bill recognizing same-sex marriage but it's being met with a lot of resistance especially from religious leaders. yesterday, local pastors demanded that voters be allowed to decide on the issue in a referendum. leaders rejected that calling it a civil rights issue. a counterprotest near the rally said the solution might be for governments to perform only civil unions with marriage available as an additional religious ceremony for those who want it. after being hit hard by the tough economic times a bittersweet reunion for the students who are the last group to attend towson catholic high before it was abruptly closed this summer. there was a cookout in parkville to give the students the yearbook they had bought. >> making new friends and everything. but i would have rather, -- everyone knows everybody, everybody is cool to everybody. >> i am amazed at how many kids came. it could have been our opening picnic at school. it's amazing how many of them came and it's a tribute to what towson catholic meant to them. >> the 86-year-old high school was closed in august. the diocese said it had to shut the school down because of low enrollment. love them or hate them, "2 your health" -- an exclusive first look at a new report on a massive marketing effort aimed at kids. one that researchers say is feeding the epidemic of childhood obesity. today investigators will report they have definite proof the cereals with the least nutritional value are getting the biggest push. the food industry's effort to police itself is a failure. ♪ i love my r double e♪ >> reporter: before the average american child reaches kindergarten according to a new report from yale university he or she is seeing 642 cereal ads a year. the vast majority of them for sugared cereals. >> marshmallow power. >> reporter: the report names names listing the 10 least nutritional cereals as developed by a system at oxford university. the study shows most of the cereals are the ones that get the heaviest marketing push. >> if one looks at the rank order list of the worst nutrition cereals it's stunning how the worst ones are marketed so aggressively to children. >> reporter: it's not just on saturday morning tv anymore. makers of sugared cereals have developed slick web sites with games and music and cartoons which critics say suck children into an entire world controlled by the brand. all of it, says study author kelly brownll is feeding america's growing childhood obesity epidemic. >> kids today and this is your term, live in a toxic food environment? >> the word toxic is strong but i think it's justified here. >> reporter: three years ago the industry announced with some fanfare it would police itself. changing the way it markets to children but yale researchers point out that under the industry's new standards many of the least nutritional cereals qualify as "better for you foods." >> if you take the top 10 cereals that have the worst nutrition ratings every one is considered by industry a better for you food, because they have set the standards that they then meet. >> reporter: so, sounds like it's a demonstrable failure? >> it's a demonstrable failure >> i think he's demonstrably wrong in drawing that conclusion. >> reporter: eileen colish who oversees the industry's self-regulation initiative points out that sugared cereals have been made more nutritious. so, froot loops, cocoa puffs, all better for you, you think? i would think there's nothing worse for you. >> i don't know how they came to the conclusion they are the least nutritional products because children's cereals that are advertised in our program are low in calories, chock full of vitamins and nutrients. >> reporter: the federal trade commission says while food companies have made some changes they are not enough. >> definitely more needs to be done and we expect that with the nutritional standards that we're developing along with our sister federal agencies we'll set the bar a lot higher. >> reporter: but, and this is key, the new standards will be voluntary, not mandatory. abc news reached out to some of the companies named in yale's study. none of them have seen the report but kellogg's says it's reduced advertising to kids under 12 by 50% and quaker which owns captain crunch says it's working to make that cereal more nutritious. dan harris, abc news, new york. also "2 your health" -- a new study shows at least one in five american children don't get enough vitamin d. that could put them at risk for a variety of health problems including weak bones. the numbers are even higher for black and hispanic kids. the analysis he is being released on-line today by the journal of pediatrics. let's go back to you. >> time is 9:18. millions of parents introduced infants and toddlers to the baby einstein products. but the videos have been the target of critics who say that many misrepresent themselves as educational tools. it's been a public battle for several years but the company recently announced a refund offer to parents who are dissatisfied with this. so what is behind the decision? david curlye reports. >> reporter: alexis has bought plenty of baby einstein videos for her kids. now she wanted to she could get all her money back. the company is offering a full refund for anyone who bought a dvd in the past five years. why? it's all a question of marketing. >> the name of the company is baby einstein. that in itself suggested that the videos were educational. >> reporter: in 2006 susan filed a complaint with the federal trade commission, alleging that baby einstein was being sold as an educational tool. the group pointed to testimonials and statements on the web site that "development at skills increased and that your little one can learn new words by watching the videos." but several academic studies have shown no educational benefit from this type of video. the american academy of pediatrics says children under 2 should spend no time in front of a screen watching television or videos. >> the best thing that parents can do is interact with their children, talk one-on-one with their children, videos will not educate your child. we believe in it 100%. we have not claimed that we are educational. >> reporter: baby instein did remove the statements on its web site in 2007. satisfied, the ftc dismissed the complaint but public interest lawyers threatened a lawsuit against disney, the parent company of baby einstein and abc news. last month disney issued the refund offer. >> we believe this is an acknowledgment by baby einstein that their videos are not educational for babies. >> reporter: baby einstein says she's missing the point. >> at the heart of what the brand has stood for from the very beginning, exposure to beautiful things, sharing the arts and humanities with parents and their babies. >> reporter: baby einstein doesn't know how many parents will ask for a refund. >> i'll keep mine. i like that she's happy watching it and that makes me happy. >> reporter: alexy won't be one of them. david curley, abc news, washington. >> that is actually very interesting because those dvd's were very popular. i have a 1-year-old, he's not into it. >> he's too smart. >> we're going to go on to cars now. you know that old adage, you should finance your car through the bank instead of a dealer. is that always true? fred wants to know which is better and why. >> good morning. great question, fred. the answer is not clear cut. the answer is always do your homework, but my advice would be to prearrange your financing much like you might with a mortgage. to prearrange your financing with your local bank or your credit union. oftentimes when a customer goes into the dealership, the dealership is offering zero percent, what we call a subventive fein unanimous rate, from the automobile manufacturer. you may be better off passing on the zero percent even though it never gets cheaper than zero you may be better off passing and taking the rebate, it could be $4,000, $r5,000, as opposed to your credit union may charge you a 5% rate for a 36-month loan, you'll find that you end up paying a lesser price taking the rebate and the 5% 36-month loan. so the answer is do your homework as always. know what you can get on the outside before you go in to purchase. >> so, if you are able to get a loan from the outside, say but into the dealer and they offer a better rate. they offer a higher rate that is comparable to the one - >> there's a little wiggle room. i was a dealer for many years, the dealer is a middle man. consequently the average rate markup for a dealership is approximately 2%. in other words, if they purchased the money for 6, selling it for 8%. so the dealer does have a little wiggle room in there. also, your bank does as well. depends on how good a customer you are. do you have your mortgage with them. do you have credit cards with them. maybe you have a home equity loan, or you've just been a good depositor of i don't you are bank for many years. you can -- good depositor of your bank for many years. you can negotiate but it's best going in, knowing a hard fact of what you can do on the outside. that way you're always going to make your best decision when you're informed. >> the lesson here is do i don't you are -- the less. here is do your homework. thank you. back to megan. just like scott, card cashed comes in every monday to give you mortgage advice. carl delmont from freedmont mortgage. thank you for coming in. how was your weekend? >> good, yours? >> excellent. we're talking today about the $8,000 tax credit. we've been hearing so much bit. the deadline i almost here. if someone were to buy a house today would they be able to use it? >> i think you're pushing your luck. november is really a three-week month, with the long week and holiday and everything. again, geniuses in congress who decided to make the last day in november, after a long holiday the deadline, now there's a lot of talk of extending it. the number one question i get, there's a lot of stuff coming from dc, senator dodd's plan is to extend it to march, for a cusm months after that -- couple of months after that, cut it down to maybe $4,000. that seems to be an irs nightmare. may not actually work. they did extend it for veterans, though. that's good news, they don't seem to do too many nice things for veterans, so that's nice. if you're going to buy a house now, it's typically taken about 40, 45 days in a good-case scenario with all the new laws and rules and waiting periods. so it will be kind of tough. we notice that contracts are up. how many of them will try to get out of it if they don't get the tax credit. are you buying the house just to get the tax credit? or are you buying it because you like the house and the tax credit is just a cherry on your sundae? >> doesn't it seem like they should extend it? sooner? >> you would think sooner rather than later because we're in the lame duck period now. they probably should extend it. i think what they should have done in hindsight. go all the way to january 31st and got us past the holiday season, but again, they always say they talk to industry insiders. it does seem though that a lot of rules are devoid of logic. they should have a date for contracts. let's say they decided to end it in julyful next year -- july of next year. by may 1st of next year you have to have the contract prior to that and close by july 31st. there's two deadlines so maybe people won't be disappointed. they know contract in, and then everyone gets the time to clear stuff up. i can imagine, november 30th, how mortgages work, your loan finally approved the money is wired from the bank to the federal reserve, the federal reserve to the title company so get the money. that is going to be a big backlog that day, november 30th if they don't extend it. hopefully logic will present itself and they will fix it. >> wouldn't it make sense to extend it into the spring since you always hear home sales are always very slow in the winter in >> a lot of economists think the tax credit is a waste because you are extending to people who will buy anyway. there's a big groundswell of people saying let's stop this. especially one senator from maryland doesn't like it too much. we'll see what he thinks. >> stay tuned for that. in the meantime, off question for carl delmont e-mail us, he'll answer it on the air. there's the address, morningshow@wmar.com. he comes in every monday. thank you so much for coming in. >> thank you. >> linda? for scam artists who are using the outbreak to make a buck. abc2 news joce sterman has details on why you shouldn't buy into their claims. >> reporter: the swine flu has folks looking everywhere for a shot to keep the illness at bay but the vaccines are hard to come by and that is good for con artists. they are on the web marketing products they claim will prevent, treat or even cure h1n1 from hand sanitizers to air filters many claim they can keep you safe from swine flu but the feds are warning you not to believe the hype and are cracking down on companies that make those claims. the fda has already told more than 75 web sites to stop selling h1n1-related products and they posted those companies if a fraudulent products list on their web site. the fda is also sending out warning letters to certain companies telling them to stop marketing and selling unapproved or unauthorized swine flu products. if they don't they could face legal action. it's a threat designed to keep you from falling for products that the federal 2r5eud commission sayser not only frauds but potentially dangerous. that's why the fda says stick to products that have the agency's stamp of approval or risk being swindled in a swine flu scam. joce sterman, abc2 news. >> that was joce sterman reporting. some doctors say they are beyond co-pays but coming up we'll tell you why doctors say they want all of welcome back to "good morning maryland" at 9:00. like it or not health insurance is expensive and we can expect higher premiums these days. when it comes to care typically you pay some now and then you wait and pay some later. for many that is changing. physicians tired of waiting for their money are making sure they collect their fees while you're still in their office. as delia goncalves explains. >> reporter: it's pretty common for patients to fork over a co-pay at the doctor, $10, $15, $20. what about anything else? >> they bill me. >> reporter: that's been the norm but when cat andre recently made an appointment for an exam and osteoporosissies treatment she would told to be prepared to pay over and above her co-pay. why? her insurance only covers a percentage of the bill. she's responsible for the rest and the doctor wanted it before treatment. >> if you don't have the money you don't get the care. >> reporter: in a recent survey more than half of the 650 doctors who responded say they now collect the entire patient portion up front. for things like surgeries or imaging scans. the trend concerns patient advocates who are worried about cash-strapped consumers. >> it can be a serious issue for consumers who need to see the doctor. >> reporter: proponents say it's necessary. recent statistics show when bills are sent to patients after treatment physicians typically recover only about half. it's not always about covering your portion either. some doctors like dolores kent are taking insurers out of the equation all together requiring patients to cover the entire cost up front. >> we also tell them that they can send this to their insurance company. the patient will get reimbursed for their visit. at whatever contract amount has been negotiated with their insurance company. >> reporter: her current patients have adapted to the change but that is not always the case. >> some patients go elsewhere. don't patients don't really hear or understand it on the phone. they actually get to the front desk and they are appalled, outraged, amazed. >> reporter: dr. kent believes her patients get better care because she doesn't have to waste time or personnel trying to collect payments ordeal with insurance companies. >> hear i get a chance to listen to my patients, talk to them and i think this has a huge effect not only on my patient relationships but also on my ability to treat the patient. diagnose them. >> reporter: it's easier now for doctors to determine how much a patient owes, thanks to all kinds of new software and of the next couple of days. because the wind is going to shift from the northeast and we've got another developing storm system here, just trying to look at new data coming into the storm center. forecast models indicating while we have this one storm diving to the south, more rain, maybe some more flooding for east texas and liz louisiana, it's also kicking up moisture from the gulf of mexico but here we have a developing wave of low pressure likely to ride up the mountains, pass just to the south, keep us on the chilly side, mind you, with the wind coming from the northeast the whole time and that could spell out hefty rains here as we head through wednesday. we're watching development of the system, we're going to see periods of clouds, especially the high thin clouds that the models are indicating, they will start to dominate later today through tonight. the main batch of rain is going to hold off until wednesday morning. we could see showers develop as soon as tomorrow afternoon and night but wednesday itself is going to be a wet day and there's heavier rain coming from the south that will filter in across central maryland. today plan for increasing clouds, especially late in the day, our 2-degree guaranteed high 64. we're back to 47 overnight. and tomorrow we are looking for at least some showers in the afternoon. a chillier 57 degrees. we stay in the 50s on wednesday back, he was going to be deployed to iraq, wanted something to come home to. his family is not from the area. he lives in fort meade. he got the happy news on saturday. his puppy eel ellie was back. >> cute. >> she walked past me and kind of stuck her nose up and caught my scent and freaked out and jumped around, jumped at me from the back. came out front. kissing my face and licking me and everything. it was great. >> the dog was in a crate, they believe the crate was just dumped with the dog in it after the car had been stolen. now they are looking for the car. >> he says that's all he wanted. i wasn't sure this was going to happen so it's a pleasant surprise. we want to leave you on that note.
