be easier to administer. positive news on the first wave of the government h1n1. drew levinson reports for wjz now in today's flu watch report from new york. the h1n1 vaccine will be distributed the first week of october. and at first, it's going to be a nasal spray, not a traditional shot. >> initially, we anticipate that about 3.4 million doses of vaccine will be available. >> reporter: the nasal vaccine is made with a live form of the virus, and some high-risk groups may not be able to take it. the cdc is still waiting for the injectable vaccine to become available and believes it will have doses sometime next month. >> we will anticipate that once we're up and going, we should be seeing at least 20 million new doses of vaccine weekly, going right on into december. >> reporter: so far, the united states has ordered 195 million doses from five companies. now, 21 states are reporting widespread swine flu activity. >> we find the virus that is circulating right now is a good match. the new vaccine that is being developed. >> reporter: high-risk groups, including pregnant women, the young and healthcare workers are first in line to receive the vaccine. but not everyone, including nursing student carlo medina is sure he wants he wants to get it. >> i feel like it's rushed. the way they prepared it at all. >> they insist, the best way to protect yourself is to get vaccinated from the h1n1 and the seasonal flu. drew levinson, cbs news, new york. the university of maryland school of medicine is one of several locations in the u.s. where the h1n1 vaccine is being tested. >> six people are under arrest and two remain on the loose after a stabbing in baltimore county. vic is in the newsroom with more on the suspects and the four victims. hi, vic. >> the attack appears to be in retaliation for an alleged assault this month. sky eye chopper 13 is over the 3900 block in baltimore highlands area, baltimore county. police say on september 12th, police approach malachi malloy. all four were stabbed. those arrested include five dunbar students. and one of the students' mother. who police say drove the person to the crime scene. all of the students are being charged as adults with assaults. much more on this crime, coming up new at 5:00. the state's attorney's office is reviewing the case of a johns hopkins student who killed a man with a samurai sword. wjz stays on the story. mike hellgren has more on the scene near campus. >> reporter: that review process could take days or weeks. police have already recreated the scene. and they say the student hit the man one time with the sword. >> reporter: the state's attorney's office has still not decided whether to file charges against the johns hopkins student who police say killed a man with the samurai sword. yesterday, investigators told wjz, new information about the incident, saying hopkins security went to the home near campus, after neighbors reported suspicious activity. they searched it with john pontolillo and his roommates but found nothing. but security left and the students decided to do another search themselves, with pontol pontolillo, grabbing his samurai sword. >> he raised his sword, asked him to stop. asked his roommates to call police. they went inside to get their cell fon. and during -- phone. and during that time, the hopkins police heard some commotion and made their way back to the home to see what was going on. at that time, the student struck at the suspect, after the suspect lunged at him. and it does truly sound like he was in fear for his life and was a means of self-defense. >> reporter: outside the pontolillo family home, neighbors expressed remorse for the students. >> luckily, i was outside. >> the guy was breaking into the house. he had a right to protect himself. >> reporter: rice has a long history of 29 burglaries. but his sister believes he was not armed and this was excessive force. >> if you made a 911 call, what reason did you have to go outdoors? my brother was in the building. wasn't like he was trying to shake on the back door or anything. he was crouched down, hiding. >> reporter: the university had extensive patrols in the area. they've urged students to be on alert after at least a dozen burglaries near campus. in north baltimore, mike hellgren, wjz eyewitness news. >> thanks, mike. donald rice was 49 years old. the student is turning 21 this week. teens may soon find it hard to visit a tanning salon, even with their parents' permission. weijia jiang is in the newsroom with more on a proposal to ban minors from using tanning beds. >> everyone under 18 would be banned from using indoor tanning beds. the howard county executive and the house commissioner wants the regulations because of increased risk of skin cancer. hay new propose -- a new proposal will be held. minors need parental permission to use a tanning bed. after another cloudy start to the day, things are improving. a live look outside. weekend long, as dryer air moves in. pleasant. all of the rain kept way to the south. it will be chilly up there, with frost likely in some areas, tomorrow night, up across portions. fall is on its way. >> thank you, bob. let's check on the roads now with sharon gibala. at wjz traffic control. problems on 95, in both directions at this point. one of those accidents is actually in the northbound lanes at 895 blocking the right lane. you're looking at a significant backup there. watch for a second crash on 95 southbound, approaching the beltway. that's on the right shoulder. in the clearing stages, one more in dundalk, weiss avenue. blocking the lane between 138. 95 northbound slow between 895 and the beltway, a 27-minute delay there. so definitely leave yourself some extra time there. there's a look at 50. big delay there as well. eastbound lanes jammed from 97 to the severn river bridge. there's a look at the west side, where we have typical delays on the inner loop. this traffic blitz on five different tv talk shows this weekend. joel brown reports for wjz now, and the presidential push for healthcare reform. >> reporter: president obama will try to dominate the air waves, with a sunday morning media blitz. his healthcare reform will be on five different talk shows. it's a presidential first. the only network not on the list, fox news channel. the president needs to sell a skeptical public on has plan, and he needs to win republican support. each the latest draft, put together by a bipartisan group of senators is not getting backing from the gop majority. >> i think there -- i don't think there is any chance that these big government healthcare proposals are going to pass. >> reporter: the president has already made 157 speeches and done 66 television appearances, all aimed at selling his healthcare reform plan. at his upcoming -- add his upcoming talk show rounds to that, and some say it could be overkill. >> if it's all obam aall the time, then probably, people are going to tune out some of the message. >> reporter: but white house agents say the president is the best salesman for his number 1 priority. now they're backing him up with the first lady. michelle obama will try to put a softer touch on the pinch with events like this one. she held a town hall style meeting. >> this is why we are fighting so hard for health insurance. this is it. this is the face of the fight. >> reporter: top administration officials are counting on her high approval rating and her background to help take the edge off. the president's hard sell. joel service. however, a public memorial is being set in the town that was the setting for "dirty dancing." an investigation is under way. the note found in one of the bathrooms suggested a bomb might be on board the plane, forcing the boston-bound flight to return to miami shortly after takeoff. the passengers were evacuated as a precaution. nothing suspicious was found on that plane. 168 passengers about 3 points. the nasdaq is up 6. let's go to new york right now, where alexis christoforous has tonight's cbs money watch update. the recession may be fading. but that's little consolation to the millions of out-of-work americans. 14 states now have an unemployment rate of 10% or more. that's above the national rate of 9.7%. michigan, which has suffered massive layoffs in the auto industry, has the highest jobless rate of 15.2%. the fdic is in a cash crunch. the head of the federal fund that insures bank deposits, up to $250,000, is considering tapping the treasury to replenish its cash. 92 banks have failed so far this year. hundreds more are expected to fall in the coming years, largely because of souring loans for commercial real estate. the federal housing administration is also in a cash squeeze. the agency is a major source of funding for first-time home buyers. and its cash cushions are about to fall below levels for the first time. and low mortgage rates continue to help we're going to have this weekend. perfect weather. san diego has some of the nicest weather in the country, in case you didn't know. but this week here, it will be fantastic. as we cleared out beautifully. started off pretty cloudy. even had drizzle. take a look at temperatures around the region. very pleasant afternoon. we're at 75. west winds at 5. barometer, holding steady. humidity beginning to drop. dew point is up a little at 64. around the region now. a west wind has kicked in. and that's helped to get rid of the clouds. down to the south, still clouds on the lower eastern shore. basically, had some clearing overnight. and a lot of moisture and fog. low clouds form. and the sun this time of year, it's much lower in the sky. not as intense. it takes a long time. and really didn't have wind to kick anything out. got a slight breeze now. and that will continue to kind of blow around. tomorrow, it's going to start shifting again back to the north and northeast. a new air mass will come in tomorrow. cool us down a little bit. 86, the hot spot. in cumberland. can you believe that? 80. 80 in hagerstown. ocean city, still kind of cloudy at 77 degrees. to the clouds, they go. right down to the south. come back east of the city. ocean city, salisbury, some cloud cover. west of the region, sunshine. and tomorrow night, with clear skies, we could get down on into the upper 40s. down to the south, showers continue in the carolinas and georgia. and a little in southwest virginia. for us, high pressure building in. this is a front that's going through new england. with a few sprinkles up there. new air mass moves in. dries us out. looks like a really, really nice weekend. stays wet, across portions of the deep south the we're not going to be concerned about that, until monday afternoon or evening. some of that moisture could approach us, maybe a shower by monday night. a better chance, i think, on tuesday. all in all, dry and cool conditions. for this time of year. two degrees above normal. above saturday and sunday. as i said, saturday night, it will be quite chilly. northeast winds tomorrow, a small craft advisory goes into effect late on [announcer] learn to speak the language of energy efficiency at bgesmartenergy.com, where you'll find plenty of energy-saving tips. ahhhhh. the passion. it is 4:28. 75 degrees. and partly cloudy. hello. thanks for staying with eyewitness news. i'm denise koch. >> and i'm vic carter. here's what people are talking about. >> not guilty. that was the verdict a former high school football coach heard at the end of his trial. cynthia bowers reports, one of the prosecutors hopes the case will prompt coaches to pay closer attention to their players. >> reporter: two weeks of emotional testimony, it took jurors less than two hours to return verdict in the rare trial of a coach accused in the death of one of his players. >> we, the jury, find the defendant, david jason stinson, not guilty. >> reporter: the verdict, a huge relief for 37-year-old jason stinson and his family, beating charges his attorney argued should not have been brought. >> i think it was a witch hunt when it started. this was a tragedy, but it wasn't a crime. it was never a crime. >> reporter: stinson ordered the team to order sprints in extreme hit as punishment. the case was complicated, however, by supplements and the adhd drug ader all that the boy took. afterwards, gilpin's mom says she still hopes some good will come from the tragedy. >> my main objective was that max's death not be in vain. and i do believe that -- i know that this trial has brought awareness. >> reporter: his lawyer says stinson wants to coach again, but with a civil suit still pending, he may be sidelined for quite a while. cynthia bowers, cbs news, chicago. >> this was the first time a football coach was charged in the death of a player. it has resulted in changes to kentucky law and other efforts to make practices safer for athletes. tonight, we're learning more about the violent murder of yale graduate student annie leigh. >> police investigating leigh's murder have found evidence linking the main suspect to the crime. dna evidence was found in a ceiling and crawl space, linking lab technician raymond clark to the crime. leigh's body was found in that area last weekend. police say clark tried to hide blood-spattered equipment and cleaned up areas leigh was in before she vanished. leigh disappeared on september 8th. her body was found sunday, the day she was expected to be married. a newborn baby was found in a storm drain. and tonight, the parents are facing serious charges. christopher king has more on this disturbing case. >> this was unbelievable. >> reporter: one of her neighbors is accused of dumping a newborn baby into a storm drain. >> yes, terribly disgusted. as a matter of fact, i'm shaking. can you see me shaking right now? i can't believe it. i can't believe it. that a mother would do something like that. >> reporter: police say someone did do something just that awful. overnight, police say an 18- year-old woman walked into a hospital and told staff she tossed her own child out like trash. investigators put on protective suits and scoured this dumpster at this gas station. sifting through garbage, looking for the newborn. but no luck. >> it is definitely a terrible time. i can't think of anything worse than that. >> reporter: police tracked down the woman's boyfriend, 19- year-old landis moore, who they say told investigators where to find the child. this storm drain up the street from his home. police found the baby boy alive. [ dog barking ] >> reporter: we went to moore's home. no one answered. >> i couldn't believe this. >> john and francine have lived here for years. they couldn't believe anyone would stoop to such a despicable act. >> i can't imagine that. >> baby? you can always take the baby to the hospital. people want babies now. that don't make sense. >> reporter: that infant child died and his parents are charged with felony cruelty to a child. murder charges are pending until an autopsy is complete. for the first time since the garridos were arrested, we are seeing how they lived. take a look. these are images taken from inside the kidnappers' home. investigators continued to search the property. the couple is accused of kidnapping then 11-year-old jaycee dugard and holding her as a sex slave for nearly two decades. tonight, there are new developments in the legal proceedings involving elizabeth smart. kai is in the newsroom now with more on the young girl who was also abducted. kai? >> reporter: defense attorneys for the man charged in the 2002 abduction of elizabeth smart are asking a federal judge to keep her from testifying during his competency hearing. the hearing is set to begin at the end of november. as of tonight, smart is one of 39 other witnesses. prosecutors expect to call to the stand. the judge is expected to hear arguments on the issue next friday. smart was 14 years old when she was taken at knife point from her salt lake city home in 2002. vic? >> thank you, kai. smart was found one year after her abduction, walking the streets of a nearby suburb, with mitchell and his now- estranged wife. a soldier from anne arundel county has been killed in the war in afghanistan. the military has confirmed that sergeant first class bradley buhle of glen burnie died this week. the 29-year-old was fatally injured whens had vehicle was struck by an -- when his vehicle was struck by an explosive improvised device. tonight, maryland state police are searching for a carjacker who led officials on a wild chase. it began in williams county and ended in prince george's county. it ended in a five-car collision, with the owner of the car being transported to the hospital for investigation. everyone involved suffered minor jurisdiction. surgeons in miami had performed an incredible procedure. this is the procedure giving site back to a 60-year-old woman who had been blind for the last nine years. >> reporter: the clouds were absolutely gorgeous. i don't believe i've seen clouds look that way. >> reporter: for sharon kay thornton, the world is a beautiful place. she is seeing it for the first time after nine years. >> now that i have sight, i will take every day and remember it. it will be more precious to me. >> reporter: the 60-year-old grandmother regained her sight through a surgical procedure performed for the first time ever in the u.s. the procedure was performed at baskin palmer eye institute, where they implanted sharon's tooth in her eye to serve as a base for the lens. hard to believe, but it's true. >> there's still people that don't believe, even though i say "i can see." how can you see? well, they put the tooth in the eye. you're joking? no, i'm not joking. >> reporter: for dr. victor perez, it was a far-fetched idea, but after meeting sharon, who was blinded by stevens johnson syndrome, he knew he had to think out of the box to help her. so he gathered a team and got to work on a procedure they had never done before. first step, they extracted her tooth and bone, shaved it. next, the tooth was implanted under her skin. two months later, it was removed and implanted in her eye. >> had he put that antibiotic in my eye and i could see that yellow, [ laughter ] antibody, i said, it's yellow. [ laughter ] and i knew then i could see. >> thornton's vision is expected to improve past the 2070 mark, where it currently stands. we have breaking news from eastern baltimore county. mike perry is live in sky eye chopper 13. he'll tell us what is going on. denise, we are over a spectacular water main break this. apparently has broken, somewhere around burning highway, at dundalk avenue. this is in the logan village shopping center area of the lower end of dundalk, baltimore county. now, this water main is a very large volume and has completely flooded dundalk avenue and portions of burning highway that go by the marine terminals is completely undermined. they do have significant issues here. water rescues are ongoing. a lot of this water has flooded into the neighborhood of logan village. behind the shopping center. you see the water, literally 2 1/2 feet of it, running down the roadway. cars stuck in there. now, they have some of these cars occupied. so the fire department is trying to figure out how to get to these folks. some of the folks that live in the neighborhood have just looked outside, seen what's going on, and they're trying to move their vehicles, so that they don't become further flooded. it is not clear at this point how big this water main is. or how long this is going to last. but as you can see, logan village shopping center and the adjoining neighborhood of logan village are completely flooded. we'll stay on the scene and keep you updated on the situation. >> i know we'll be coming back to you very soon to find out what is going on. radar. nothing around here at all. just a few clouds across southern portions of the region. no precipitation. and look at the weekend. high pressure is going to be moving in from the north, later tonight, winds will shift back to the north. pleasant, dry conditions. and actually, rather cool, particularly up to our north. may even be some frost and some interior locations across new york state by tomorrow night. each in our region, -- even in our region, maybe upper 40s as winds die down with previous skies on saturday. fall-like, sunny dry weekend. enjoy. >> thanks a lot. let's check in on the roads now with sharon gibala at wjz traffic control. we're obviously following that massive water main break as well. we're still trying to get a handle on all of the roads that are blocked. we have a live picture from sky eye chopper 13 of the situation again. that's again in dundalk on groaning highway. dun haven road is also affected. you can see just very deep water. and it's not just affecting one road. it is affecting all the roads that are nearby in that area. and this is in a residential neighborhood that is right near the water. so as far as alternates go, it's going to be a bit tough. definitely an area to avoid. i know a lot of people have tried to head home. we're going to try to get some exact lane closures for you. meanwhile, we have other problems, including a disabled vehicle. that 83, blocking the right lane with a backup. two accidents in the city. park heights at clover. and falls road at falls hill. watch for a downed tree in monkton. alternate there is going to be wesley chapel road. meantime, as far as delays go, 95 sluggish. 50 eastbound, completely jammed. that's going to be between niche and the severn river bridge. there's a look at 695 and 83. once you get beyond that disabled vehicle, you can see everything looking good. again, a 25-minute delay approaching that. typical west side delays. nothing too serious. this traffic report is straight ahead on eyewitness news at 4:00. once again, you're looking live at a massive water main break in dundalk. we'll have an update on the breaking news next. bob is just finishing up your first warning weather foreca we want to update that breaking news from dundalk. a massive water main break, creating river roads. let's go to captain mike perry. >> yeah, i'm sorry. i was communicating with the desk. but you're actually looking at the water main break, which has occurred in the dundalk logan village shopping area. this is long burning highway. a water main has broken and flooded completely burning highway. dundalk avenue. degree dun haven road. and logan view road. three large, residential streets along south of the residential shopping center. thou, we did have several people affect the by this. this is water running down court drive, which runs out of the back of the shopping center, and runnings downhill toward mcshane way. we do not have a report of injuries at this point. but we do have actually divers from the baltimore county fire department, responding to the scene in the event they are needed. we have several folks coming. at this point, we haven't seen that happen. but we do have several vehicles that have -- that are in several feet of water at this point. we have water reported going into some homes. and water actually reported going into some of the businesses here. in the logan village shopping center. it is an absolute mess. we do have the main road closure, where this water main apparently is broken from is coming from underneath a burning highway, as completely collapsed, burning highway. maryland transportation authority police do have that closed at this point. but as i said, looks like burning highway closed. dun haven closed. mcshane close. and logan view drive, and of course dundalk avenue. we'll stay on top television this and give you more information. and if you are watching us right now, and you living in that area, story. a massive water rain has broken. you're looking at live pictures now from sky eye chopper 13. let's go to captain mike perry with more. this water main break occurred just shortly after 4:00 this afternoon. baltimore county police and firefighters were called to the scene of a mawrt main break. when they arrived, they found this very large volume water main break that had broken, underneath a burning highway. this is just along burning highway. now, all of the water is running towards logan village, which is along dundalk avenue. when you're rooking at here is dundalk avenue, completely closed and flooded. as it comes down a little bit, you will see that that comes down a little bit. that is the logan village shopping center. and this is court road. along dun haven way. mcshane way. and loganville drive. police are here in the event that rescuers are needed. but at this point, we know of no ongoing rescues. although they are certainly making provision for that. we know of no injuries at this point. but it is a very, very dangerous situation foboth gas and electric persons. if you have electrical appliances and there is water coming into your home, you need to actually get out of your home or shut off all of your electric. they have bge and gas and electric personnel coming to the scene. you do not want to go out where there is water. it is officially dangerous. if you are in that area, you can hear us. we would like for you to call us if it is safe for you to do so. call us here. and we'd like to hear from you. right now, we're going to go to bob and get some weather report. bob? take a look at temperatures around the region. we dried out. sun came out. 75 here. 86. 77, ocean city. dew points beginning to come down. we have a west wind now. still a few clouds around the lower eastern shore. looks like a very nice night and weekend. to our south, continues to see some shower activity. some of that moisture may come back toward our region. but not until monday night or tuesday. until then, a front that is going through new england. a few showers will be across the region tonight. winds go back to the north and northeast. eye fall-like weekend. some of that is going to ride up toward the middle of the country. we'll be on the cool, dry side of that. by early next week, some of that may start cleepg in our direction. cool nights, sunny, pleasant days. kind of cool. northeast winds on the day. bay temp down to about 72 degrees. and tomorrow, lots of sunshine. a little cooler than we saw this afternoon. about 74 degrees. we continue to follow the breaking news tonight out of dundalk. sky eye chopper 13 is live over a massive water break, flooding neighborhoods. captain mike perry is live with the latest. >> reporter: this is a big deal. baltimore county police and fire setting up command posts in this area, for a large- volume water main that apparently has broken underneath the burning highway, which runs in front of the dundalk marine terminal. now, this break occurred shortly after 4:00 this afternoon. but the rushing water quickly filled dundalk avenue. then the logan shopping center. then the neighborhood to the south and west of the water main break. now, i just heard a police officer talking to his supervisor, say that court way, which is the road a little to the right of here, where there is a large volume of water waist-deep, running down the street, flooding this entire neighborhood. it is affecting dun haven road, mcshane way, logan view drive. and, of course, dundalk avenue, as well as burning highway. but those are the residential areas that it is affecting. baltimore county police at this time do have an automatic notification system, for anyone just in case they are inside and not paying attentio
