>> reporter: good morning, robin. the images are disturbing. in those recent mass shootings, we've not seen the ugly reality of the victim's face in the final moments. today, we do. they are the haunting final moments before aaron alexis begins his killing spree. all captured in chilling, living color. we first see alexis just before 8:00 a.m., showing his entry pass before being waved in by a security guard. he drives into this parking garage. and moments later, walks into the navy yard through the front door of building 197. it's 8:08 a.m. no metal detector. no bag check. somewhere hidden, he is carrying this sawed-off shotgun. the fbi says he goes to this bathroom stall on the fourth floor. takes out the weapon. and reemerges, intent on killing. he's armed. peeking around corners. checking doors. looking for someone, anyone to ambush and murder. he appears methodical, calm, driven. he moves quickly down the stairwell. and watch as he ducks behind the wall, after spotting potential victims at the end of the hall. look at the body language, his intent is clear. she he's hunting. >> he was able to obtain a firearm two days before he carried out attacks. >> reporter: on the shotgun, alexis carved, end to the torment. better off this way. and my e.l.f. weapon. >> alexis held a delusional belief he was being controlled by e.l.f., electromagnetic waves. >> reporter: on computer files from his backpack, they find his final message. ultra-low frequency attack is what i've been subject to the last few months. and that's what driven me to this. this meant killing 12 innocent people and wounding 4 more. the release of the video is sparking some controversy. at least one family telling cnn overnight, they were angry they were not told beforehand. robin? >> quite understandable. thank you, pierre. >> it's hard to watch. let's get the latest on the looming government shutdown. less than five days to go before the money runs out. and the threat of a shutdown is hitting home in everyone's 401(k). the stock market sliding on fears of paralysis in washington. jon karl is tracking all from the white house. your new reporting overnight suggests the chance that some kind of shutdown still quite high. >> reporter: it is, george. congress is simply running out of time. here's how it will play out. the senate, despite ted cruz's talk-a-thon, will vote some time tomorrow, or saturday, to fund the government and take out that republican effort to defund obama care. but what republicans are telling me this morning is that the house will then take up the bill and still want to make changes, make another run, perhaps, at doing something to the health care law. that means it has to go back to the senate. george, this will go on through the weekend, into next week. and here is the problem. the government runs out of money on midnight on monday. and it's very hard to see this all getting done by then. >> and we also learned about something even more serious yesterday. the treasury secretary, jack lew, saying the government's going to run out of its ability to borrow money on october 17th. that raises the possibility of default. and there's a showdown on that, with republicans demanding big reforms in return for raising the debt limit. >> reporter: this is, by far, the bigger problem. republicans will unveil their plan later today to raise the debt ceiling raise that borrowing authority. and it's going to have demands that the white house is says unacceptable. including a one-year delay in the implementation of the health care law. and the white house said they will not negotiate on that. that means there is nothing going on when it comes to negotiations. and no solution on the horizon at all. >> we'll be watching closely. jon karl, thanks very much. let's get the rest of today's top stories. amy robach in for josh. >> we begin with breaking news. an alarming report that points to the problem of extreme fatigue among airline pilots. this morning, we're learning the details about a flight on which both pilots were asleep at the same time. it happened last month on an airbus a330 during a flight to britain. the airline it has occurred on has not been released. but the pilots voluntarily reported themselves. saying they had slept just five hours each over the two previous nights. they are not expected to be seriously disciplined. developing right now, the nation's biggest bank may be about to pay the price for its role in the mortgage mess. jpmorgan chase is in talks to pay an $11 billion settlement for using those sophisticated investments that caused the financial crisis. billions of that money could go to homeowners who are still hurt by that crisis. and a terror group that attacked a shopping mall in kenya, has raided a border post today and killing two police officers. this morning, new pictures of the smoking ruins of that mall. this is the parking garage. on its roof, one official said soldiers fired grenades to let the hostages escape. but it undermined the roof. a series of fires in l.a. prompted an all-night manhunt. the most severe started outside a strip mall and spread to an apartment building. thankfully, no one was hurt. this morning, police announced they have a suspect in custody. and it is a nightmare commute right now for thousands in the northeast. a power failure causing delays and cancellations on the metro north commuter railroad and on amtrak. there's no high-speed trains today between boston and new york. and a small plane crashed and burned in a suburban chicago parking lot, killing one person and seriously injured the pilot. the plane clipped several trees, parked cars and a light pole before erupting in a fireball. firefighters used foam to put out those flames. in canada, an extraordinary sight was captured on a dashboard camera. first, the sky brightened. then, it turned to day. and a fireball whizzes into view. a local astronomer confirms it was a meteor. look at that. >> or -- and major advances to thousands of americans who use artificial limbs. a washington state man can now control his robotic leg, using only his thought. he just imagines the movement. and the technology makes it happen. researchers who made the device have an $8 million grant from the army. and the interesting thing is, when you're walking on a prosthetic leg, it helps going up and down stairs. >> look how smoothly he's going. that's fantastic. now, to the latest on the montana judge who made comments about a victim in a rape case that sparked national outrage. and then, sentenced her attacker to only one month in prison. well, today, that month is up. and now, there's mounting pressure to get the judge kicked off the bench. abc's clayton sandell has the story. >> reporter: this morning, former teacher, stacy rambold, will walk out of a montana jail, after serving just one month for raping a student. >> what do we want? >> justice. >> when do we want it? >> now. >> reporter: now, activists are filing a state ethics complaint against the judge who handed out that sentence, hoping to get him thrown off the bench. >> if we can't get him removed for this, there's something wrong with the system. >> reporter: rambold was sentenced in august, convicted of raping charisse morales in 2007. morales committed suicide. rambold got just 31 days. the judge calling morales, older than her chronological age and in control of her situation. that sparked international outrage. the judge quickly apologized. >> what i said was demeaning to all women. not what i believe in. >> reporter: he backtracked, even trying to change the sentence he had imposed. but -- >> you don't get do-overs in this way if you're a judge. >> reporter: prosecutors will argue rambold's sentence was illegal. they're appealing to the montana supreme court. >> if the judgment is that he needs to serve more time, he'll have to serve more time. >> reporter: judge baugh is still on the bench. rambold goes free for now. but montana's highest court will soon decide if his punishment fits his crime. for "good morning america," clayton sandell, abc news, denver. now, friendly fire for president obama. he first skyrocketed to the national stage on the strength of his eloquent speeches. but now, a famous supporter is taking him on for talking down to his audiences. ron claiborne has more on that. >> reporter: that criticism is coming from samuel l. jackson who accuses president obama of effecting a just regular folks way of speaking to people that jackson says, is not only fake but unpresidential. >> hello, cbc. >> reporter: you've heard it. the president getting all folksy, talking to the people. going to changes to gonna. the gs disappear. >> i don't think he minds telling me he turns 90 in a couple weeks. he's been causing a ruckus for about 89 of those years. >> reporter: it turns out samuel l. jackson, the maestro of the on-screen f-bomb, has taken notice. and he's filing a grammatical grievance against the president. jackson talks about what he thinks of educated people, like our harvard-educated president, trying to sound like average joes. jackson says, i say stop trying to relate. be a leader. be expletive presidential. tailoring your accent and slang to your audience, is as political a tradition as kissing babies. remember -- >> thank you all for coming. >> reporter: and mitt romney's awkward efforts to talk southern. >> i got started right with a biscuit and cheesy grits. >> reporter: even a genuine southerner, like bill clinton, would lay on the molasses when he ventured south of the mason/dixon line. >> they said, what does your momma do for a living, he can give an answer. >> the president speaking at the united nations in one form, he'll speak in front of a church audience in another form. >> reporter: jackson went on to say that while he sprinkles his own language with ain'ts, when i'm out presenting myself to the world as me, i expletive conjugate. on twitter, jackson is apparently widely known as the grammar police for correcting other people's sloppy tweets. ironic that his own tweets are heavily laden with colorful vernacular. and this being samuel l. jackson, the occasional expletive. >> that was a well-written story. >> thank you very much. >> okay. now, to the michael jackson wrongful death trial. the defense making its closing arguments. pointing the finger at the king of pop himself. saying his own bad choices, not concert promoters aeg lied. david wright has more. >> good morning, everybody. >> reporter: more than $1 billion of his clients' money hang on his arguments. >> you've been asked to decide if aeg lied, killed michael jackson. >> reporter: but if the lawyer defending concert promoter aeg against a wrongful death lawsuit felt the pressure, he didn't let on. >> aeg live would never have agreed to finance this tour if it knew mr. jackson was playing russian roulette every night in his bedroom. the attorney claimed that aeg never hired dr. can rod murray. that murray was jackson's private doctor for years. >> aeg live didn't hire him. on the contrary, they tried to talk mr. jackson out of it. >> reporter: on the incriminating e-mail in which paul gongaware, he wanted to remind murray, it's aeg, not jackson, paying his salary. >> he wanted to help mr. jackson any way he could. >> reporter: but they insist that the jacksons' demand for $1.5 billion in damages is outrageous. >> at the time he died, he was spending $20 million more per year than he earned. when he passed in 2009, he was well over $400 million in debt. >> reporter: he said a more realistic sum reflecting the lost earnings, would be about $21 million or so. >> a lot of money, more money than most people will see in their lives. but that's nowhere close to $1.5 billion. >> reporter: today, the jacksons' lawyer get one more chance for rebuttal before the case finally goes to the jury. for "good morning america," david wright, abc news, los angeles. we turn, now, to that stunning come-from-behind upset in the america's cup. team usa needed to win eight-straight races, which they did. and nick watt is in san francisco with the winning boat. good morning, nick. >> reporter: good morning, george. i used to think sailing was all sipping rum punch there's one thing i can't do. >> reporter: this sport will never be the same again. >> i think they're going to be back. and what jimmy said, we're facing them back out in the water in the not-too-distant future. >> reporter: that kind of passion for sailing? you just did. george, i'm embarrassed to say, i barely slept last night. i'm still so excited. you know, i guess if you're sailing a boat that looks like it could take you to mars, you'd believe anything is possible. and the moral of this miracle on the bay, never, ever give up. >> and i -- no question about that. but like you said, nick, larry ellison does not want to say what he did to the boat. is there any speculation what it might be? >> reporter: i mean, they say that they tweaked bits and bobs on the front. i mean, they have engineers in this warehouse working on that boat. working on the boat through the night, when they were 8-1 down. they thought, we need to pull this out of the bag. they did the
