across the country, including here at boston logan. let me explain this computer system process to you. we could tell you that the computer system itself it processes the flyers through customs but in the last 45 minutes or so fox 25 has learned that the computer running. now let me take you inside the boston logan airport. the lines seem to be moving just fine. here's what we do know. u.s. customs and border control confirming tonight that they have been looking into the outages that affected things here at logan and at other airports in new york, drt and texas and -- dallas-fort worth and texas and several other airports. this may have had something to do with the homeland security -- here at logan backups. but again at this hour we could tell you within the last 45 minutes that computer system is back up and running. exactly why this happened and how this happened we are still trying to figure out and we will update you as soon as we learn more. for now we are live at logan airport tonight. malini basu, fox 25 news. >> also breaking this hour the justice department and the f.b.i. will be investigating fantasy sports companies like boston-based draftkings and fanduel. that's according to the "wall street journal" that says the investigation is focusing on whether the companies violated u.s. gambling laws. f.b.i. agents have been reportedly contacting customers for information. more details as we get them. also tonight limping into school barely able to walk. a 5-year-old taken into d.c.f. custody tonight as jail. that mother is accused of allowing that abuse. fox 25's kathryn burcham live in worcester tonight and kathryn the boy's teacher sounded the alarm in this case? >> reporter: police tell us arrived here at his elementary school yesterday morning staff members not only noticed bruises on his body but that he was in so limping. tonight we obtained the court documents that show investigators believe this isn't the first time that he was beaten. >> reporter: cheerful curtains hide the windows of this worcester apartment and perhaps hid even more inside according to police. chantel wynn who lives here with her 5-year-old son was arrested yesterday for failing to report that he was physically abused. >> why wouldn't you as a parent as a parent that's your kid obviously carried him for nine months. >> reporter: neighbors who didn't want to be on camera tell us wynn should have stepped in to report the alleged abuse. instead police say it was a school staff member who called them after teachers at the boy's elementary school noticed bruises and significant trauma to that little boy's entire body. his head, face, arms, legs and lower back. and that the bruises were in different stages of healing. according to court documents pain that he had to be carried up and down the stairs. according to investigators wynn blamed her male roommate for the abuse but never reported him because he was a good care provider. at the apartment today a relative declined to respond to the allegations. >> no comment. >> reporter: after he was treated at u-mass for his injuries the 5-year-old was turned over to children's and family services. and tonight fox 25 has confirmed d.c.f. also took custody of the children of wynn's roommate as well. now police have not yet identified that male roommate nor have they charge h.d. william a crime which is why we are not identifying him as for wynn she is on bail i'm sorry out on bale tonight she will face a judge in december. catherine kathryn, fox 25 news. working to repair a gas main break in medfield that sent flames shooting 30 feet into the sky earlier. forced neighbors out of their homes. power lines were damaged by the flames we've learned it has affected internet service at at least one of the town schools. no word yet on what caused the initial explosion. westport police investigating a serious case of animal cruelty. new at 10:00 offers fouled squalor inside the home on sanford road two. dogs that had died were discovered inside trash bags and closets. officers also found a dead lizard. the home was filled with fleas, animal waste, trash and clutter. >> terrible. that's awful. if i had known that there were dogs in that house i would have broken in. >> it is really horrible, especially in a quiet neighborhood like this. >> they were removed from the home for treatment. the woman who owns that house and her estrange husband now face six charges of animal cruelty. a 17-year-old relative is also charged. a b.u. coach is now charged with rape. the alleged victim only recently told investigators about the alleged abuse by robert richardson. he's attacks allegedly happened in richardson's dorchester home. richardson will be arraigned in suffolk superior court on thursday. this video is from 2005. that's what richardson was found not guilty in a separate child rape accusation. that attack allegedly happened at a summer camp. a brookline firefighter accused of driving drunk tonight and crashing into another driver before taking off. its actually the second brookline firefighter arrested in just weeks. fox 25's kerry kavanaugh has that story from newton where they arrested this man walking away from his banged up s.u.v. >> reporter: the bumper still sits along lagrange trade in brookline. this was the intersection where the driver of that s.u.v. crossed over that line striking another car nearly head on. they say brookline firefighter jeremy joseph was behind the wheel. after the collision joseph got out and surveyed the damage then they say he got back into his pickup truck and took off. and drove more than two miles away. witnesses say they saw a black truck pull into this bank parking lot back into a slot park then the driver got out and started walking. >> the guy parked the car perfectly and just walked away as if nothing was wrong. >> reporter: one of those witnesses who lives near the bank in newton told us over the phone he could hear the driver coming first. >> i was like a muffler like a dragging sound it was all smashed up and the front driver's side wheel was gone. >> reporter: police say the driver was riding on a rim they later arrested him as he walked. police say the person in the other car was extricated with the jaws of life but was expected to be okay. we attempted to speak with mr. joseph today he did not want to comment. the brookline fire chief e-mailed us a statement saying that the firefighter is on paid administrative leave pending an investigation in newton, kerry kavanaugh, fox 25 news. more details now and arrest coming just days after another brookline firefighter was charged in a fight. joseph ward was released on personal recog distance and he's now on administrative leave from the fire department. prosecutors say he attacked a man on sunday night for allegedly taking too long to order his food. a pedestrian crash in plymouth. an elderly woman was trying to parallel park when she knocked down a 62-year-old man from out of state. a helicopter took that victim to a boston hospital where he later died. the crash is under investigation. another warm october worcester there will be towns in the upper 30s and especially just north of that city and into southern new hampshire and southern vermont. some towns will be as low as 39 or 38 particularly northern school telling police ninth grade english language teacher joseph sent naked pictures of himself to him over facebook messenger and more than once. >> one sent last year in october 2014, and then another set of images were sent in august of 2015. >> reporter: police were notified this week in 22-year-old turned himself in this afternoon. charged with dissemination minor. >> they have known each other for about two years. the student admitted that they had met at a church webster. then he was a teacher for >> reporter: in a statement the school department is extremely alarmed by these charges and has taken immediate steps to ensure the safety of our students. effective today this individual is no longer an employee with the district. south bridge administrators remaining tight-lipped about the employment history of this teacher. i pulled his linkedin page where he posted not only being a teacher but director of the early education program at worcester state either of man accused of murdering beloved teacher colleen ritzer stood behind a wall today while a court clinician raised questions about whether philip chism is fit to stand trial. a court clinician testified chism told her he talks to voices in his head had suicidal thoughts. the prosecutors are not buying it. >> the judge ruled at 9:00 tomorrow they will be able to have an independent expert to do this evaluation. the earliest day they would likely be need is next wednesday. a woman is recovering after shooting herself in the arm at a local gun range. skyfox police tell us they received a 9-1-1 call about a woman accidentally shot herself in the arm. an ambulance took that woman to newton wellesley hospital. still no arrest in the drive-by shooting of a car on 495 in wren them. this afternoon state police revealed that they have processed the car are currently looking at ballistic evidence. two men were shot ought just before 11:00 last night both are okay. they told state police that they did not get a good look at the other car. parishioners in scituate dealt another loss in their fight from keeping the church closing its doors. new tonight a judge said the order stands and the 11 was flown to a boston hospital. >> held without bail for a 23-year-old crime. today the man accused of murdering a tufts university graduate in 1992 stood in court and said he's not guilty. i had recently charged in south boston murder of 21-year-old lena. he was already serving time for an unrelatinged assault when a d.n.a. sample linked him to the bruce case. his attorney saying d.n.a. evidence is not 100% infallible. >> can it go wrong. other than the actual sample improper handling and procedure. >> the magistrate said the d.n.a. will undergo an independent evaluation. he is expected back in court next month. a huge lawsuit just filed against theco that many owned the ill-fated cargo ship el faro. they are seeking $100 million in damages. jordan is one of three people who died. the captain of the el faro is also named. jordan's estate says the company should be held accountable for putting the ship in the path of hurricane joaquin earlier this month. >> it's not just the negligence of these people and putting the ship on the water that was nearly not seaworthy no doubt about it shouldn't have been there, too old. >> two men from massachusetts were on board. the captain had a sound plan to avoid hurricane joaquin, a plan that only unraveled when the ship's main propulsion stopped working. the coast guard called off the search forethe ship after one week i winds die down temperature close to 40 for you as well. then plymouth 54 cool spot on the coast for sure light south wind at six miles per hour going down to 44 under clear skies that sunshine will allow us to rebound a bit tomorrow but only to get back to about average for this time of year. so in boston upper 40s by 3:00 in the morning then going down to the mid-40s at first light tomorrow morning 46 at 7:30. with that sun getting up in afternoon in boston with all kinds of sunshine. that's going to be the scene all across much of new england. only place you will see more clouds popping up will be northern and northwestern new england. if you are heading that way certainly be a big concern. boston around 5061 62 in rochester, to the south shore 63 in quincy, southwest will be 62 in franklin, massachusetts, then to the north shore and northwest of boston 62 in ipswich, 58 and bradle borough 61 temperature. again aify more clouds farther north and west you go. here's future cast. this is when our front is pushing towards us. can get a couple showers during the early morning hours of friday but note scattered about. rain coming through or heavy rain either. this is not going to be anything too significant. what it will do is lead the cold air on in here. another shot of cold air with that sun means more clouds developing just the risk of a shower or there just a sprinkle that would come on by. what it will really do is set the stage to are a weekend that will feature especially during the morning. upper 30s to low 40s on saturday much like we'll have tomorrow morning but saturday a reinforcing shot of cool air comes on through. a couple sprinkles again that sets the stage for a sunday morning that will be around freezing and a monday morning below freezing so frost and freeze are likely this weekend. we haven't seen air this cold in the morning since going back to about april middle of april when we had temperatures hitting at or below freezing with the frost and freeze possibility is there and some snow in the mountains talking about that. that came in from the european computer model put it into use that's some light snow falling in the northern inspiration. >> she loved to read, she loved theatre, she loved old movies she loved heroin at the end and that's what killed her. >> reporter: when tom parks daughter molly died last april her heartbreaking and honest obituary went viral. it started what some are calling a movement. we wanted people to know that people are dying of addiction and it's killing a lot of woung people. >> did you ever think it would go viral. >> not at all. >> reporter: the obituary i found several just like it. some were simple loved ones dying "unexpected from complications of a heroin overdose." or "succumbing to her battle with heroin addiction." the ownover one of the largest funeral firms in the northeast tell me they responded to over 50 heroin deaths this year alone. >> whether it be our on-line facebook or twitter or other avenues to really say yes, our family member has passed away it's very sad but she was a heroin abuser. seeing these brave obitaries didn't make it easier but it sanctuary. police are working to figure out what led families and church members to torture two teenage brothers. they say the beating was part of a church counselling session. one boy's injuries so severe doctors thought he had been shot his brother was beaten and left in the sanctuary for nearly 24 hours. the parents and four other suspects are in custody. seven children have been removed from the church. brockton man charged with shooting his pregnant girlfriend ordered held without bail tonight after a dangerousness hearing. dominick represented himself in court. prosecutors say he and his girl were fighting over sleep on friday morning when he tried to rip out her contact lenses and eventually shot her in the shoulder. he's due back in court in november. fire chief in charlton is responding to claims that the department didn't do enough to save a winery that burned to the ground. crews did what they could to save that source. these are part of scarecrows on the common and an event that marks the start of fall and attract tourists to the area. police are now searching for the person or persons who vandalized two of the scarecrows. that town plans to go through the event and leave the remaining scarecrows up until october 27th . scoring a big win tuesday night with a record-setting election turnout. residents voted to overturn the town council's budget in a special election. they voted for massive budget cuts to lower taxes but those cuts forced the closure of one of the town's fire stations and sparked outrage among many residents. >> there was a big uphill battle but as you can see a lot of people are here today to have their voices heard. >> the town gathered hundreds of signatures. they won the trite have the people vote on the budget. people of franklin, new hampshire won't have a curfew. faced with costly legal action by the civil liberties union the survey barred anyone under 16 from being on city streets. remembering baby bella by keeping we're going to have our first few freezing days here in franklin and the approaching winter got authorities thinking about how miserable basketball hoops left in the street last year made it to plow. >> reporter: they are staple of suburban life the neighborhood hoop with the street serving as back the time and play. >> reporter: but the town of franklin is now crackingdown on hoops. citing town and state laws residents. complaints that came in from such places as eagle drive, where fox 25 counted four hoops. franklin police put out this notice today. it advises residents to get the hoops off public spaces or else. or else run the risk getting fined $50 for the first offense jumping to $300 for the third. town administrator jeffrey nutting says the drive to get the hoops off public streets has a lot to do with avoiding a repeat of what happened last winter. >> they really inhibit the plowing to we want to give folks a heads up can you take them off the streets until the season is over. >> reporter: residents we spoke with see the wisdom in that. the plow guys need to do their job. >> even the lodgic. snow. >> reporter: but a fine. would you pull it off the sidewalk? >> yeah, we don't need any of those. >> reporter: now what happened last year was not only did the snow pile up around these basketball hoops but they became froze ton the ground they could not move them until the string. the town administrator says they will give residents every opportunity not to get fined by giving them the opportunity right now to get those hoops back into their own yards. live in franklin, jim morelli, fox 25 news. >> more details now franklin isn't the only community to consider this. back in 2014 peabody also mulled over making street size basketball nets and hockey goals. it's unclear if it ever passed. an upindict that new york woman who sued her own nephew for breaking her wrist. >> she only sued because she was force dodd so by the law. the boy broke her wrist when he was 8. the lawyers say she had no choice but to sue the boy because her insurance company was only willing to fork over a dollar to help pay for her medical treatment. the rest needed to come from the parents homeowners insurance. officials confirm today that the crash killed two people the plane's pilot and a 21-year-old girl who was inside the mobile home. ntsb investigators are on scene. a reporter: nicole doyle knew she and her friends wanted to help other children like bella so they decided to collect clothes for children who find themselves away from their family in foster care. >> i told us how sometimes kids come to them in the middle of the night with just the clothes on their back. >> the child i mean they're very self-aware that they don't have anything around them that they're used to and that they're not dressed quote/unquote appropriately. >> reporter: that's what nicole and her group want to change. they set up nearly 50 donation drop-off locations where they collect, sort then pack a backpack of goodies just for that child. >> some of these children like nicole mentioned they come into foster care with just the clothes on their back they're going from
