reports. of their loved ones reunited after a gunman opened fire in historyon, kansas. >> i seen a guy pull up and he stopped and hopped out and yelled something with an ak-47 and fired a few shots outside before he went in and ducked down and went into the building. >> law enforcement sources confirm to cbs news the shooter is 38-year-old succeed rig ford a painter at xl industries. gunfire erupted in the parking lot and inside the building. >> we heard pop pop and i guess a gentleman named adam had got shot. >> family folks quickly arrive at the scene after hearing the news. third woman was in the middle of her husband during a live interview. he did say somebody next to him got shot. oh my god! oh my god! . >> first responders rushed to out on stretchers. law enforcement officials moved in with high powered rifles to find the active shooter. ford was killed by authorities. video posted to the gunman's facebook page shows him firing an empty field. other pictures show him posing with firearms and this video he sings along to a song called looking for revenge. any reason as to why ford targeted his work place hasn't been uncovered. >> never would have thought in a million >> prosecutors say this was an agregous violation of power. burke has been in custody since december and today we are expecting to hear whether he will take a plea deal or if he will opt for a trial. this was the last tomb we saw the former suffolk county police chief in public. f.b.i. agents arresting james burke back in december. federal prosecutors accusing the 51-year-old of using his power to assault prisoner christopher loeb and corse to help him cover up the crime. >> burke repeatedly met with the police department who had witnessed the assault and agree straight. >> loeb was arrested for breaking into the unmarked police suv admitting to stealing the chief's police duffel bag. chief's police belt and ammunition but loeb says there was more insisting he found pornography and sex toys. burke showed up at loeb's home to confront him and while he was later chained in the police station house he sought revenge repeatedly beating him. >> when i asked for a lawyer i got hit, choked, punched, slapped, kicked. >> a federal judge denied bail calling him a danger to his community with a long history of coercion, corruption and conspiracy. today we may see whether he admits to the charges against him. >> no one is above the law. >> and burke is scheduled to be here in court at 11: 00 this morning. the u.s. attorney says if he is convicted he faces up to five and a half years in prison. reporting live this morning from central long island janelle burrell cbs 2 news. >> thank you. sources tell cbs 2 an nypd his badge and gun because he couldn't be found when two officers were shot last weekend. he was supposed to be on duty until 4:00 a.m. this past saturday but our sources say when the officers were wounded at 3: 30 he was not in the building. he's been placed on off duty and internal affairs are investigating. a bad man 42-year-old jose martinez swiped money from a tourist on wednesday. investigators say a 63-year-old was tipping martinez after they took a picture together and then he reached into her wallet and grabbed a $50 bill. he was arrested a short time later. demanding republicans hold hearings to replace justice scalia. they won't consider anyone president obama nominates. >> we felt it was extremely important to make sure the american people understand that we have instruction that is on never in the history of the country has there been anything like this. >> the absence of one of the nine justices on the court is far from clam mouse but a hastily made life time appointment could be. >> the court is split between four conservatives and four liberals. the white house was considering brian sandoval but he is not interested in the job. an update on the story we first told you about yesterday crew members board a fishing boat and coast guard members all safe in the waters off of queens. >> the marine radio apparently they have seven members on board and nobody needs medical attention. >> the fishing boat with seven people ran aground in east rock away inland and coast guard crews capsized in rough waters. it was too dangerous for them to swim the short distance to shore. swimmer was in the water and couldn't handle the conditions so they are deceiving. >> they swam to shore and no one was injured on either boat. >> nine minutes past the hour and still to come a big change that could effect the mets and yankees. what they do in and out of the dug out. plus this. >> from the evidence i have i can tell you it's not there. >> and the sexting scandal involving the county executive. why the investigation is far from over. and will they or won't they strike? absolutely. >> there are two schools of thought about whether deleted imessages can be recovered even with pass word clearance. manny gomez is a former f.b.i. agent. >> from what you know about eight iphones and imessages can you delete them? against him and were expecting to hear whether he will in fact go ahead and take a plea deal or if he will opt for a trial. now it was back in december that we saw burke taken into custody where he's been held since with out bail. federal prosecutors say in 2012 he assaulted and repetedly beat christopher loeb who admitted to break into his unmarked police suv stealing his duffel bag where he found his gun ammunition as well as porn and sex toys. loeb says while he was chained burke sought revenge and tried to cover it up. >> every time i asked for a lawyer i got hit again i got hit again
