at bryant park, dave carlin, cbs 2 news. gunfire erupts in a brooklyn neighborhood. there was a shootout between police and an armed suspect. it left multiple streets riddled with dozens of bullets and the alleged suspect in the hospital. cbs 2's ilana gold has new details. >> reporter: investigators say the shootings happened at three different locations within about a mile of each other. we just learned that 70 shots were fired. most were right here along broadway where police shot and injured a 27-year-old man. the intersection of broadway and jefferson avenues riddles with dozens of bullets. they pierce through the windows of a laundromat along with a truck and police cruiser just after 1 a.m. this morning. this afternoon nypd commissioner bill bratton surveyed the damage at the scene. >> really crazy. i actually was looking at the window and i could see the cops shooting across the street. >> reporter: van cook woke up to the sound of gun right outside his bedroom window. and you can hear it on the this nearby surveillance video. sources say four police officers got into a shootout with 27-year-old gerald harris, who allegedly led them on a chase through this neighborhood then opened fire at them several times. officers shot him in the leg. they were not injured. >> a little too close for comfort. >> reporter: the problems started on madison street. sources say a 52-year-old was packing up his car for a holiday weekend trip. he walked away and left the car unlocked. gerald harris got into the vehicle. when the owner returned he confronted the stranger and harris shot him and took off. >> i saw somebody running down the street. that was it. it was hectic. people were screaming throughout the night. >> reporter: police say the victim tried running after him and found some police officers. when the cops spotted harris at bushwick and jefferson, he hid behind a police cruiser and shot at them. those officers called for backup. when they chased the suspect down the block to broadway, he apparently ran towards them continuing to shoot until he was struck by one of their bullets. police recovered his gun from the scene. a glock .40. at this point he is still recovering at the hospital and criminal charges are pending. in the bushwick section of brooklyn, ilana gold, cbs 2 news. two former teachers assistants are facing child abuse charges. the women accused of encouraging little children to fight each other at a new they made their first appearances in court today. cbs 2's christine sloan was in the courtroom. >> reporter: the two former daycare workers in a courtroom here in union county defending themselves. but prosecutors say they obtained cell phone video of the little kids fighting each other at the daycare. anything you want to say chanese? fight? former day kay worker chanese white -- daycare worker chanese white not talking to me but telling a judge she is innocent. >> do you understand your rights? >> yes. >> have you read the charges? do you plead? >> not guilty. >> reporter: white and 22-year- old erica kenny accused of making 4-year-old and 6-year- olds fight each other on the campus of lightbridge academy of cranford while they were teacher assistants. investigators said it was for entertainment referencing the movie fight club. >> how do you plead, guilty or not guilty? >> not guilty. >> reporter: prosecutors say kenny took video of a dozen kids shoving each other posting several clips on snapchat. someone receiving it allegedly recorded it sending it to prosecutors even though it disappears in 10 seconds. >> daycare workers encourage it and videotape it. >> reporter: the complaint charges the two with child endangerment. kenny also accused of child abuse. those who know them stunned. >> i don't even know what they were thinking when they did something like this. and to do it more than once. >> reporter: this parent says her kids are safe at the daycare. >> i think this is the case of two bad apples. >> reporter: a spokesman for the daycare said they are reviewing procedures to make sure something like this never happens again. in elizabeth, new jersey, christine sloan, cbs2 news. >> the two women who have been fired are scheduled back in court next month. dozens of children were evacuated from their staten island preschool after reports of strong fumes. chopper 2 flew over the ivy league early academy in bulls head as the staff led the kids out of the building. ems workers evaluated the 65 children and five adults. fdny hazmat crews checked out the school on richmond avenue. >> we made entry with specialized hazmat resources using very sophisticated metering devices and we went over the building two times and declared that we did not find anything. >> they then did a third check and rule there was no cause for concern. the children were okay and everyone was allowed back inside. the fdny said the teachers did the right thing by evacuating the building as a precaution. a warning if you are planning a labor day weekend near the water. dangerous riptides have been spotted. lonnie quinn has more. >> as of right now, the toughest situation along the south shore of long island where it's a high risk for rip currents moderate along the jersey shore. into the late hours tonight into saturday, it's going to adjust a bit not so much a risk for the jersey shore, but all your south-facing beaches anywhere from atlantic beach, you go from there on your bike start riding just go east you're going to be dealing with a high risk throughout all the beaches from hampton to montauk. on the south shore be care he feel in the water. outside now, skies are getting better looking with each passing hour and the sky tomorrow is going to be the rain. i'll tell you if i see any for that holiday weekend coming up. a new york city schoolteacher is in trouble after his drone crashed the u.s. open last night. no one was hurt but the accident interrupted the game and raises questions about drone safety. here's cbs 2's sonia rincon. >> reporter: when the drone dropped out of the sky in the middle of the match, it rattled the players and brought the game to a stop. >> seemed as if that fell from somewhere -- a distraction. >> i think both players heard it. they both stopped and looked at it. >> reporter: even the announcers weren't sure what happened. >> whether it fell from above or whether it's something that's been left behind, if it's a projectile or a drone- like device. >> reporter: place say it was a drone belonging to a 26-year- old science teacher from the academy of innovative technology in brooklyn. daniel told police he had been playing with the drone near the unisphere thursday night when he lost control of t as soon as he found out what happened, police say he turned himself in took responsibility for the incident and got a ticket. he lives in jamaica, queens where no one answered the door. his father didn't want to talk about the incident. but neighbor mark haynes says he saw a drone here about a month ago. >> hovering over the house just flying around like that and just took off. >> reporter: now he says he is putting two and two together. >> i know we don't have aliens but now i know that's what it was. >> reporter: he doesn't think it was a good idea to be flying it near a big public event. >> that was very dangerous. if he has a toy like that should have had better control. but he didn't know. >> reporter: but the queens district attorney points out the drones aren't toys and people who operate them don't always know what they're doing. in a statement, the d.a. richard brown said those who engage in conduct of this nature will be held legally accountable for their actions. they will not be treated as hobbyists. the man will face charges of reckless endangerment and operating a drone where he shouldn' have. work discipline will depend on the outcome of the case. in jamaica, queens sonia rincon, cbs 2 news. >> senator schumer says drones should be programmed to stay away from events like the u.s. open and airports. hungarian police are in a standoff with thousands of migrants many refugees from syria desperate to board trains for germany from austria and cbs 2's dagostino. >> reporter: they showed little willingness to give up and hand themselves over to police who seemed just as determined to wait this one out. the drama began when desperate migrants packed on the first train they could at the budapest station. they thought it was going to germany but 45 minutes outside the capital, the train came to a stop. riot police were waiting. it was a trap. when police started pulling migrants off, others realized what was happening and refused to go. we got on board the next train out. and though this one traveled almost two hours close to the austrian border, it ended the same. police met us and lines of buses to herd the migrants to refugee camps. for youssef the team wouldn't confirm to money. the giants say $1.3 million by releasing -- saved $1.3 it wasn't an easy decision. >> let me say how difficult it was today to say good-bye to steve weatherford, who has been just an exceptional human being. what he has done in the community, the way he had a unique ability to touch people in all parts of life. >> reporter: the fan base was surprised. >> i'm very surprised that he got cut. >> yes, it's surprising he got cut. maybe they, you know, he wasn't like in the right -- not the right player for them. >> the giants picked up punter brad wing from the steelers. we don't know what steve weatherford's feature holds if he will play, go into broadcasting, which he has done, or spend time with his beautiful family. on a personal note, i'll miss steve. he was always such a positive guy with what looked like a permanent smile on his face. and a lot to be happy about. he just had that energy, you know, and i know one thing for sure no matter what his platform is going to be he will help others like he has done here. >> definitely. thank you. republican presidential candidate donald trump is looking for a tax cut but it's for one of his members only golf courses in westchester. it has some people living near the course upset. cbs 2's lou young has the story from briarcliff manor. >> reporter: the game is on at trump national golf club in westchester county. the posh 140-acre golf course is pleading poverty asking for a massive 90% property tax cut. the neighbors are not amused. >> i'm not surprised. he is always looking to get extra for him and less for everybody else. >> reporter: he is talking about donald trump, the man who evangelizes about the art of the deal. his lawyer filed papers saying the club, which trump bought for $7.5 million and renovated for $45 million, is now worth only $1.4 million because business is bad. but even he doesn't believe that. his lawyer says it's a tactic to get taxes lowered maybe 10 or 20%. >> blow him out of the water. the name is trump. if it wasn't trump it wouldn't be on the front page of the paper. >> reporter: but it is on the front page and the people are noticing it. the people closest to the golf course will be hit hardest if the club gets any kind of tax relief. >> so a huge decrease in one property would create a larger increase in the others. >> reporter: the neighbors would feel it? >> right. >> reporter: property tax experts here in westchester tell me the request for a reduction is just the beginning of the process. now trump's people have to present evidence to the ossining tax assessor that the value of the property is actually shrinking, that business is not good. and if the assessor doesn't agree, then they can go to court. this is a process trump's people went through five years ago when the club and the town first made a deal to lower the assessment to its current $13 million level. >> it's a world class golf course. he says so himself. >> reporter: the property is due for reassessment in june. we're in briarcliff manor, westchester county, lou young, cbs 2 news. an update on same-sex marriage licenses in kentucky. marriage licenses are now being issued to all couples in rowan county. deputy clerks agreed to obey the judge's order and give them to same-sex couples while the county clerk remains in jail for contempt. cbs 2's jamie yuccas has the story from moorhead, conduct kentucky. >> reporter: this is the 6th times two men tried to get a marriage license in kentucky. >> sign here. sign here. >> reporter: friday they finally got one. the men are the first same-sex couple to come here since a judge jailed the county clerk kim davis for refusing to comply with his order. did you think you would be the first couple today? >> no. i thought there was going to be two others before us. but i can see why -- i know a lot of people -- [ screaming ] >> reporter: davis is a born- again christian and says god's moral law prevents her from issuing licenses to same-sex couples. her deputy clerks have agreed to issue them. a large crowd gathered in front of the courthouse just as it was opening to see who would be the first to get a marriage license. reporters cheered while those who backed kim davis stood firm. >> i don't think people should have to go through all this. think there has to be another way to work this out. >> reporter: davis is an elected official and hopes the legislature will change kentucky laws so she can follow her conscience. >> she won't give up. there's no give up in her. >> reporter: the judge plans to revisit his decision to jail davis in a week. as for william smith, jr., and james yates, they are going to get married. kraft is expanding a cheese recall because of an issue with plastic packaging recalling 335,000 cases of kraft singles. the manufacturer says a thin strip of packaging film may stick to the slice after the wrapper has been removed creating a choking hazard. affected cases all have a manufacturing code of s54 or s55. consumers who purchased any of these products are warned not to eat them. kraft says the packages can be returned to the store for a refund. a high-end heist caught on camera. now police say they have their man. who they arrested for stealing handbags worth thousands and who they are still looking for. >> it's a big getaway weekend but will it break bank? [ crying ] >> you don't realize how precious life is until you are going to lose it. [ crying ] >> and i just am so thankful that god gave me the strength to make it and i stay positive because i -- if you stay positive, anything is possible. >> reporter: very positive message. the caught one of the two thieves. the pair seen here in surveillance video stealing thousands in merchandise from a westchester store. cbs 2's mark morgan has the new information. sean davis was arrested in brooklyn charged with grand larceny in connection with this crime. police say davis is shown in this surveillance video with a female accomplice, stealing over $24,000 worth of high-end handbags from penny pincher a consignment shop on harris road in bedford hills. on august 19, the two allegedly spent about 40 minutes in the store with the woman shoving chanel and birkin bags under her dress despite the presence of five employees, the two escaping with the mountains. davis has been at large until he was taken into custody this morning. >> he has been identified through several witnesses at the store that were working that day as the person who committed these larcenies. >> reporter: here at the consignment shop where davis and his female accomplice allegedly stole thousands in mountains, there is great relief that an arrest has been made. >> we knew they were going to be apprehended or at least somebody was going to be apprehended so we're very, very pleased that we could be instrumental in trying to get these people off the street. >> very happy. i mean, very, very happy. so this isn't just for us. it's for all the consignment shops that they have recently taken advantage of. >> reporter: she is referring to several other high-end boutique robberies in the villages of east hampton and southampton in suffolk county and rosalyn in nassau county. police suspect davis and his accomplice were involved in those crimes, as well. reporting from bedford hills in westchester county, mark morgan, cbs 2 news. >> the merchandise hasn't been recovered tonight. davis is being held without bail and is due back in court next week. police are still searching for his accomplice. a tsa agent at kennedy airport is arrested accused of stealing a $7,000 diamond watch. the woman allegedly took the $7,000 watch last week. it happened while it went through a screener bin in a plastic bin. investigators say grant admitted she took the watch and destroyed it when she saw coworkers looking for it. a commuter alert could make your labor day travel easier. governor cuomo announced today that he is lifting temporary lane closures on road and bridge construction projects on new york state highways for the holiday weekend. they will be lifted until 6 a.m. tuesday. some work may continue behind permanent concrete barriers or of course for emergency repairs. and there's more good news for drivers. gas prices haven't been this low on labor day weekend in 11- year-old. the cost of a gallon of gas -- in 11 years the cost is down a dollar. aaa says the average price for regular in new york is $2.61. in new jersey, of course, it's cheaper at $2.16. in connecticut, $2.57. aaa expects prices to drop to around $2 a gallon by christmas. three out of four flyers in a recent trip adviser survey complained about the size of their airline seat. if you think the playing field is more cramped it is unless you're in first class. kris van cleave shows us what passengers on both sides of the curtain can expect. >> reporter: for $229 million, this terminal in los angeles got an upgrade meant to appeal to elite flyers with a premium check-in area and access to a special lounge. and this plane has apartments in the sky. the airlines are racing to update their cabins and service with luxurious new options for a select few. for the rest of us, it may seem like we're stacked in there. the seats are tight. >> reporter: several airlines line seats. they take up less space allowing more seats to be squeezed on board. >> over 6 or 7 hours, people just -- they cannot even bear the idea of being in the back of the plane so they will step up and that's what the airline is hoping for. it's additional revenue for the airline. economy class. >> reporter: in fact, on long haul flights a number of carriers are finding a way to cash in on economy flyer fatigue with a premium economy at a cost far below business class but more than those cheap seats. singapore airlines installing these now, flyers will have the added perk of being able to order a fancy meal ahead of time to be delivered at their seat during the flight. in a statement airlines for america, around. pacemakers have been helping hearts beat probably for more than 50 years but they can have complications like wires breaking that connect to the the device to the heart. dr. max gomez tells us called a leadless pacemaker. it doesn't have wires and doesn't require any incisions. >> fully self-contained unit less than 10% the size of a traditional pacemaker. it gets around the long-standing limitations of the traditional pacemaker. >> reporter: a flexible tube is snaked through a vein in the leg up to the heart and the wireless pace maker is placed inside one chamber. it's anchored by eye tiny corkscrew-like tip. the device is still experimental but new research in the new england journal of medicine shows it's safe and effective especially for norm. >> he could preserve the benefits of having the pacemaker while alleviating the problems created by the traditional pacemaker, you know. it was an absolute home run. >> how was your day? >> reporter: norm feels like himself monday. a little cooler for all those days at the shore. you will be 90 on tuesday. 88 on wednesday. 87 on thursday. 87 on friday. so really all of next week looks to be well above average, as well. what's going on now is they did take a chainsaw to those tree limbs. they cut them up carted them away. there's still a small area cordoned off of but this area is finally getting back to normal. live at bryant park, dave carlin, cbs 2 news. gunfire erupts in a brooklyn neighborhood. there was a shootout between police and an armed suspect. it left multiple streets riddled with dozens of bullets and the alleged suspect in the hospital. cbs 2's ilana gold has new details. >> reporter: investigators say the shootings happened at three different locations within about a mile of each other. we just learned that 70 shots were fired. most were right here along broadway where police shot and injured a 27-year-old man. the intersection of broadway and jefferson avenues riddles with dozens of bullets. they pierce through the windows of a laundromat along with a truck and police cruiser just after 1 a.m. this morning. this afternoon nypd commissioner bill bratton surveyed the damage at the scene. >> really crazy. i actually was looking at the window and i could see the cops shooting across the street. >> reporter: van cook woke up to the sound of gun right outside his bedroom window. and you can hear it on the this nearby surveillance video. sources say four police officers got into a shootout with 27-year-old gerald harris, who allegedly led them on a chase through this neighborhood then opened fire at them several times. officers shot him in the leg. they were not injured. >> a little too close for comfort. >> reporter: the problems started on madison street. sources say a 52-year-old was packing up his car for a holiday weekend trip. he walked away and left the car unlocked. gerald harris got into the vehicle. when the owner returned he confronted the stranger and harris shot him and took off. >> i saw somebody running down the street. that was it. it was hectic. people were screaming throughout the night. >> reporter: police say the victim tried running after him and found some police officers. when the cops spotted harris at bushwick and jefferson, he hid behind a police cruiser and shot at them. those officers called for backup. when they chased the suspect down the block to broadway, he apparently ran towards them continuing to shoot until he was struck by one of their bullets. police recovered his gun from the scene. a glock .40. at this point he is still recovering at the hospital and criminal charges are pending. in the bushwick section of brooklyn, ilana gold, cbs 2 news. two former teachers assistants are facing child abuse charges. the women accused of encouraging little children to fight each other at a new they made their first appearances in court today. cbs 2's christine sloan was in the courtroom. >> reporter: the two former daycare workers in a courtroom here in union county defending themselves. but prosecutors say they obtained cell phone video of the little kids fighting each other at the daycare. anything you want to say chanese? fight? former day kay worker chanese white -- daycare worker chanese white not talking to me but telling a judge she is innocent. >> do you understand your rights? >> yes. >> have you read the charges? do you plead? >> not guilty. >> reporter: white and 22-year- old erica kenny accused of making 4-year-old and 6-year- olds fight each other on the campus of lightbridge academy of cranford while they were teacher assistants. investigators said it was for entertainment referencing the movie fight club. >> how do you plead, guilty or not guilty? >> not guilty. >> reporter: prosecutors say kenny took video of a dozen kids shoving each other posting several clips on snapchat. someone receiving it allegedly recorded it sending it to prosecutors even though it disappears in 10 seconds. >> daycare workers encourage it and videotape it. >> reporter: the complaint charges the two with child endangerment. kenny also accused of child abuse. those who know them stunned. >> i don't even know what they were thinking when they did something like this. and to do it more than once. >> reporter: this parent says her kids are safe at the daycare. >> i think this is the case of two bad apples. >> reporter: a spokesman for the daycare said they are reviewing procedures to make sure something like this never happens again. in elizabeth, new jersey, christine sloan, cbs2 news. >> the two women who have been fired are scheduled back in court next month. dozens of children were evacuated from their staten island preschool after reports of strong fumes. chopper 2 flew over the ivy league early academy in bulls head as the staff led the kids out of the building. ems workers evaluated the 65 children and five adults. fdny hazmat crews checked out the school on richmond avenue. >> we made entry with specialized hazmat resources using very sophisticated metering devices and we went over the building two times and declared that we did not find anything. >> they then did a third check and rule there was no cause for concern. the children were okay and everyone was allowed back inside. the fdny said the teachers did the right thing by evacuating the building as a precaution. a warning if you are planning a labor day weekend near the water. dangerous riptides have been spotted. lonnie quinn has more. >> as of right now, the toughest situation along the south shore of long island where it's a high risk for rip currents moderate along the jersey shore. into the late hours tonight into saturday, it's going to adjust a bit not so much a risk for the jersey shore, but all your south-facing beaches anywhere from atlantic beach, you go from there on your bike start riding just go east you're going to be dealing with a high risk throughout all the beaches from hampton to montauk. on the south shore be care he feel in the water. outside now, skies are getting better looking with each passing hour and the sky tomorrow is going to be better looking. right now, 83 degrees. kind of partly sunny out there. if you take a look at the vortex satellite and radar, notice how any flow in our atmosphere is going right now from the east to the west. not typical for us normally going the opposite direction. this is a back door cold front. this front didn't give us too much moisture. i don't want to keep beating the same drum but we need the rain. i'll tell you if i see any for that holiday weekend coming up. a new york city schoolteacher is in trouble after his drone crashed the u.s. open last night. no one was hurt but the accident interrupted the game and raises questions about drone safety. here's cbs 2's sonia rincon. >> reporter: when the drone dropped out of the sky in the middle of the match, it rattled the players and brought the game to a stop. >> seemed as if that fell from somewhere -- a distraction. >> i think both players heard it. they both stopped and looked at it. >> reporter: even the announcers weren't sure what happened. >> whether it fell from above or whether it's something that's been left behind, if it's a projectile or a drone- like device. >> reporter: place say it was a drone belonging to a 26-year- old science teacher from the academy of innovative technology in brooklyn. daniel told police he had been playing with the drone near the unisphere thursday night when he lost control of t as soon as he found out what happened, police say he turned himself in took responsibility for the incident and got a ticket. he lives in jamaica, queens where no one answered the door. his father didn't want to talk about the incident. but neighbor mark haynes says he saw a drone here about a month ago. >> hovering over the house just flying around like that and just took off. >> reporter: now he says he is putting two and two together. >> i know we don't have aliens but now i know that's what it was. >> reporter: he doesn't think it was a good idea to be flying it near a big public event. >> that was very dangerous. if he has a toy like that should have had better control. but he didn't know. >> reporter: but the queens district attorney points out the drones aren't toys and people who operate them don't always know what they're doing. in a statement, the d.a. richard brown said those who engage in conduct of this nature will be held legally accountable for their actions. they will not be treated as hobbyists. the man will face charges of reckless endangerment and operating a drone where he shouldn' have. work discipline will depend on the outcome of the case. in jamaica, queens sonia rincon, cbs 2 news. >> senator schumer says drones should be programmed to stay away from events like the u.s. open and airports. hungarian police are in a standoff with thousands of migrants many refugees from syria desperate to board trains for germany from austria and cbs 2's dagostino. >> reporter: they showed little willingness to give up and hand themselves over to police who seemed just as determined to wait this one out. the drama began when desperate migrants packed on the first train they could at the budapest station. they thought it was going to germany but 45 minutes outside the capital, the train came to a stop. riot police were waiting. it was a trap. when police started pulling migrants off, others realized what was happening and refused to go. we got on board the next train out. and though this one traveled almost two hours close to the austrian border, it ended the same. police met us and lines of buses to herd the migrants to refugee camps. for youssef the team wouldn't confirm to money. the giants say $1.3 million by releasing -- saved $1.3 it wasn't an easy decision. >> let me say how difficult it was today to say good-bye to steve weatherford, who has been just an exceptional human being. what he has done in the community, the way he had a unique ability to touch people in all parts of life. >> reporter: the fan base was surprised. >> i'm very surprised that he got cut. >> yes, it's surprising he got cut. maybe they, you know, he wasn't like in the right -- not the right player for them. >> the giants picked up punter brad wing from the steelers. we don't know what steve weatherford's feature holds if he will play, go into broadcasting, which he has done, or spend time with his beautiful family. on a personal note, i'll miss steve. he was always such a positive guy with what looked like a permanent smile on his face. and a lot to be happy about. he just had that energy, you know, and i know one thing for sure no matter what his platform is going to be he will help others like he has done here. >> definitely. thank you. republican presidential candidate donald trump is looking for a tax cut but it's for one of his members only golf courses in westchester. it has some people living near the course upset. cbs 2's lou young has the story from briarcliff manor. >> reporter: the game is on at trump national golf club in westchester county. the posh 140-acre golf course is pleading poverty asking for a massive 90% property tax cut. the neighbors are not amused. >> i'm not surprised. he is always looking to get extra for him and less for everybody else. >> reporter: he is talking about donald trump, the man who evangelizes about the art of the deal. his lawyer filed papers saying the club, which trump bought for $7.5 million and renovated for $45 million, is now worth only $1.4 million because business is bad. but even he doesn't believe that. his lawyer says it's a tactic to get taxes lowered maybe 10 or 20%. >> blow him out of the water. the name is trump. if it wasn't trump it wouldn't be on the front page of the paper. >> reporter: but it is on the front page and the people are noticing it. the people closest to the golf course will be hit hardest if the club gets any kind of tax relief. >> so a huge decrease in one property would create a larger increase in the others. >> reporter: the neighbors would feel it? >> right. >> reporter: property tax experts here in westchester tell me the request for a reduction is just the beginning of the process. now trump's people have to present evidence to the ossining tax assessor that the value of the property is actually shrinking, that business is not good. and if the assessor doesn't agree, then they can go to court. this is a process trump's people went through five years ago when the club and the town first made a deal to lower the assessment to its current $13 million level. >> it's a world class golf course. he says so himself. >> reporter: the property is due for reassessment in june. we're in briarcliff manor, westchester county, lou young, cbs 2 news. an update on same-sex marriage licenses in kentucky. marriage licenses are now being issued to all couples in rowan county. deputy clerks agreed to obey the judge's order and give them to same-sex couples while the county clerk remains in jail for contempt. cbs 2's jamie yuccas has the story from moorhead, conduct kentucky. >> reporter: this is the 6th times two men tried to get a marriage license in kentucky. >> sign here. sign here. >> reporter: friday they finally got one. the men are the first same-sex couple to come here since a judge jailed the county clerk kim davis for refusing to comply with his order. did you think you would be the first couple today? >> no. i thought there was going to be two others before us. but i can see why -- i know a lot of people -- [ screaming ] >> reporter: davis is a born- again christian and says god's moral law prevents her from issuing licenses to same-sex couples. her deputy clerks have agreed to issue them. a large crowd gathered in front of the courthouse just as it was opening to see who would be the first to get a marriage license. reporters cheered while those who backed kim davis stood firm. >> i don't think people should have to go through all this. think there has to be another way to work this out. >> reporter: davis is an elected official and hopes the legislature will change kentucky laws so she can follow her conscience. >> she won't give up. there's no give up in her. >> reporter: the judge plans to revisit his decision to jail davis in a week. as for william smith, jr., and james yates, they are going to get married. kraft is expanding a cheese recall because of an issue with plastic packaging recalling 335,000 cases of kraft singles. the manufacturer says a thin strip of packaging film may stick to the slice after the wrapper has been removed creating a choking hazard. affected cases all have a manufacturing code of s54 or s55. consumers who purchased any of these products are warned not to eat them. kraft says the packages can be returned to the store for a refund. a high-end heist caught on camera. now police say they have their man. who they arrested for stealing handbags worth thousands and who they are still looking for. >> it's a big getaway weekend but will it break bank? [ crying ] >> you don't realize how precious life is until you are going to lose it. caught one of the two thieves. the pair seen here in surveillance video stealing thousands in merchandise from a westchester store. cbs 2's mark morgan has the new information. sean davis was arrested in brooklyn charged with grand larceny in connection with this crime. police say davis is shown in this surveillance video with a female accomplice, stealing over $24,000 worth of high-end handbags from penny pincher a consignment shop on harris road in bedford hills. on august 19, the two allegedly spent about 40 minutes in the store with the woman shoving chanel and birkin bags under her dress despite the presence of five employees, the two escaping with the mountains. davis has been at large until he was taken into custody this morning. >> he has been identified through several witnesses at the store that were working that day as the person who committed these larcenies. >> reporter: here at the consignment shop where davis and his female accomplice allegedly stole thousands in mountains, there is great relief that an arrest has been made. >> we knew they were going to be apprehended or at least somebody was going to be apprehended so we're very, very pleased that we could be instrumental in trying to get these people off the street. >> very happy. i mean, very, very happy. so this isn't just for us. it's for all the consignment shops that they have recently taken advantage of. >> reporter: she is referring to several other high-end boutique robberies in the villages of east hampton and southampton in suffolk county and rosalyn in nassau county. police suspect davis and his accomplice were involved in those crimes, as well. reporting from bedford hills in westchester county, mark morgan, cbs 2 news. >> the merchandise hasn't been recovered tonight. davis is being held without bail and is due back in court next week. police are still searching for his accomplice. a tsa agent at kennedy airport is arrested accused of stealing a $7,000 diamond watch. the woman allegedly took the $7,000 watch last week. it happened while it went through a screener bin in a plastic bin. investigators say grant admitted she took the watch and destroyed it when she saw coworkers looking for it. a commuter alert could make your labor day travel easier. governor cuomo announced today that he is lifting temporary lane closures on road and bridge construction projects on new york state highways for the holiday weekend. they will be lifted until 6 a.m. tuesday. some work may continue behind permanent concrete barriers or of course for emergency repairs. and there's more good news for drivers. gas prices haven't been this low on labor day weekend in 11- year-old. the cost of a gallon of gas -- in 11 years the cost is down a dollar. aaa says the average price for regular in new york is $2.61. in new jersey, of course, it's cheaper at $2.16. in connecticut, $2.57. aaa expects prices to drop to around $2 a gallon by christmas. three out of four flyers in a recent trip adviser survey complained about the size of their airline seat. if you think the playing field is more cramped it is unless you're in first class. kris van cleave shows us what passengers on both sides of the curtain can expect. >> reporter: for $229 million, this terminal in los angeles got an upgrade meant to appeal to elite flyers with a premium check-in area and access to a special lounge. and this plane has apartments in the sky. the airlines are racing to update their cabins and service with luxurious new options for a select few. for the rest of us, it may seem like we're paying more for less shelling out money to check bags to eat on board sometimes to even choose a seat. >> i'm small. and yet you know you're just crammed into these seats. it's terrible. >> you're stacked in there. the seats are tight. >> reporter: several airlines line seats. they take up less space allowing more seats to be squeezed on board. >> over 6 or 7 hours, people just -- they cannot even bear the idea of being in the back of the plane so they will step up and that's what the airline is hoping for. it's additional revenue for the airline. economy class. >> reporter: in fact, on long haul flights a number of carriers are finding a way to cash in on economy flyer fatigue with a premium economy at a cost far below business class but more than those cheap seats. singapore airlines installing these now, flyers will have the added perk of being able to order a fancy meal ahead of time to be delivered at their seat during the flight. in a statement airlines for america, the trade group representing airlines, says those first class flyers paying those high fares keep fares down for the rest of us. kris van cleave, cbs news, washington dulles airport. >> the but teresa and jerry sal sanow have been married for 60 years today. the couple from manahawkin, new jersey, is checking into the waldorf-astoria. they are celebrating their diamond jubilee for a second honeymoon. the last time they were here was their wedding night. >> we went to the starlight room. we had a beautiful evening we had room service. it was just the epitome of what you want on 80-degree mark. you are now into the 70s. temperature. you hit 85 degrees. keep that 79 in the back of your head. when you look at the holiday weekend saturday is cool. sunday middle of the road. hottest. but when i say the coolest, none of the days will be down to like what the average should be. that's 79. you will be close on saturday at 81 with a good sunshine. sunday 86. monday hot and sweaty out there. 89 degrees. what are the skies doing? not too much. you can see that flow pushing some clouds and a trace little bit of moisture really not in our area. allentown pushes towards philadelphia. we didn't see anything in the rain bucket like i thought we would get. didn't amount to anything. no impact in our area. high pressure is too strong. that high pressure is going to do nothing but make itself home through monday. sunshine through that period. gets hotter each and every day. so for your day tomorrow, 81 degrees. pleasant skies. humidity starting to drop now. it will go down tomorrow and feel comfortable out there. beaches. what i mean is it's all about the riptides. high risk is a possibility for anywhere along the south shore tomorrow from atlantic beach to the hamptons. 4- to 6-foot swells so i know that beckons you to the water. i want you to be careful of the chance for a rip current. if you look out across the board at my numbers, 81 like i sunday, 89 on monday. a little cooler for all those days at the shore. you will be 90 on tuesday. 88 on wednesday. 87 on thursday. 87 on friday. so really all of next week looks to be well above average, as well. >> those rip currents, it's subtle. >> if you know what you're looking for you can see them. >> they seem very subtle. >> subtle is good. you have to know what you're looking for. it is dangerous if you get caught in rip current but the dangerous conditions did not stop lots of folks from today. in fact, we found people in all over the world hit the sand to celebrate summer's last holiday. at jones beach the crashing waves kept most folks close to the shore. that was thanks to a riptide warning and despite whipping be there. >> what i'm looking the at here is labor day weekend and any day not working is a good day. >> reporter: the raw conditions didn't stop the tour buses either. in fact, the guide for these visitors from china says they loved the kind of fall like weather. >> it's rodeo over here, maryann, and we gas up and go. >> last day of the summer we actually haven't been out here, i think, i haven't been out here in over 30 years and it's just one of those things we felt dig like a trench and then hunker down because it's rough out there. >> reporter: most everyone said they wanted just one last beach memory as summer closes. but baltimore native pat dornan says whoa, wait a minute, there are plenty of holidays left. >> it's not the last holiday of the year. you have halloween, thanksgiving, christmas all coming up. >> you bet. halloween and thanksgiving, just beckoning people to the shore. hey, just for the record, the last day of summer this year is going to be wednesday, september 23. so yeah, you still have 19 days left and whatever holiday gets you to
