view of the tanker as it spilled gasoline all over that road. nbc 10 learned around 8:30 tonight the tanker's driver lost control of the truck and it turned on its side, spilling 4,000 gallons of gasoline. now, this wreck involved two other cars, we know five other people were hurt, they have minor injuries. one of the drivers is at abington hospital and when we first arrived we saw firefighters and police redirecting traffic as route 611 is shut down for hazmat crews. we also saw them working with a bunch of homeowners in the nearby area. we spoke to the fire chief, here's what he had to say five minutes ago. >> we've evacuated some of the nearby residents to a nearby school and the situation is stabiliz stabilized. we've called a hazmat company to clean up the leak from the accident. we expect route 611 to be closed down for several hours, probably somewhere in the area of six to nine hours. >> reporter: there you go. it will be closed to the next six to nine hours as fire crews work to get this tanker truck off of the road. we'll see how this will impact traffic tomorrow morning. coming back live now we also saw septa buses out here so we'll see if that's for evacuated homeowners while they wait and try to figure out the best of this situation. firefighters expect this to be a long night. i'm brandon hudson, nbc 10 news. >> brandon, good to hear it's stabilized at this point. thank you. earlier today, we heard warnings about the potential for slick roads because of the refreeze from today's snow. >> glenn hurricane sworts chwar here with more on that. glenn? >> that area you were looking at had more snow than we had in philadelphia. the main highways in philadelphia looked okay, there was less snow and slush on the road that melted and refroze like has happened in the north earn suburbs. the current temperatures indicative of anything that was slushy and wet is now frozen and will be for the morning, too, so take care of that. 25 in philadelphia 20, in allentown and, of course, the wind added on top of that is still 10 to 20 miles an hour, not quite as strong as it was earlier today. we had gusts up 60 miles an hour in cape may. remember yesterday? 66 degrees at 3:00 only 18 hours later felt like 11:00 if anything it will feel a few degrees colder than that when you wake up in the morning. >> all right, glenn. tonight we can report all archdiocesan high schools and parochial elementary schools in the city of philadelphia are open tomorrow. >> that does not necessarily apply to the schools in the suburbs so keep an eye on refreeze threat. nbc 4 wi10 will begin at 4:00 a. tonight president trump says the fight isn't over after an appeals court decided not to reinstate his travel ban. >> minutes after the ruling he tweeted in all caps "see you in court, the security of our nation is at stake." that's not all he said tonight. >> nbc 10's keith jones is live with the breaking news on. that keith? >> reporter: the legal fight is just beginning. this 29-page decision by a federal appeals court sparked indignation from the president and relief for those against his temporary travel ban. from philly international to a federal appeals court in california which tonight refused to reinstraate president trump' ban against travelers from seven predominantly muslim countries. >> he's not going about in the the right way. he's not looking at the interests of us as people here. he's just looking at what's benefitting him. >> reporter: north philly's jose colon wasn't surprised by the unanimous ruling. philadelphia mayor jim kenney called it a victory because it reaffirms "that the courts are not going to blindly defer to the executive branch and, most importantly, that our constitution protects everyone, including refugees and undocumented residents." many disagree with the court ruling like chester county sheriff bunny welch, she was among 10 sheriffs gathered by the president two days ago. >> they put a temporary order in place to restrict people coming from countries where there's no internal control over there makes sense to me from a law enforcement and a security perspective. >> tonight's ruling is the tip of the iceberg. >> it's a preliminary opinion. it's moving very quickly. there will be more briefing on both sides and more ability for both the administration and the states to flesh out their arguments. >> reporter: senior fellow for constitutional studies tom donnelly expects the administration whether appeal to the supreme court. >> we have a situation where the security get some myself today. >> conway promoted first daughter ivanka trump's fashion line during an interview this morning. the comments come after nordstrom dropped ivanka's line of clothing and accessories. the white house says conway has been counseled but lawmakers are asking ethics officials to review those remarks. president trump signed three new executive orders today focused on crime and violence against police officers. the president said one would break the backs of criminal cartels, another would create a task force to reduce violent crime. the third order is to stop violence against law enforcement officials. but eagles star defensive player malcolm jenks jenkins sent several treats about the executive order. one of the tweets said "how do you ignore 968 lives lost to law enforcement? you can support the police and hold them accountable simultaneously. >> new at 11:00, pizzagate in philly. conspiracy theorists are targeting two popular places in our area. there are online threats directed at the owner of the pizza brain and little babies. the pizza restaurant and ice cream parlor share a space in fishtown. a youtube video that has been viewed nearly 100,000 times claims a connection between the businesses and "sick perversions." it's led to hundreds of outraged comments online and harassing phone calls. remember what happened in d.c.? a north carolina man is charged with firing shots in a pizza police there. he thought hillary clinton was running a child sex ring out of the place. the fake conspiracy theory was circulated online last year. a deli owner shot a robber inside an overbrook store tonight. around 8:00 a man walked into the store on 65th and lebanon avenue and said this is a holdup. the owner pulled out his own gun and shot the man in the groin. the suspect is in the hospital. the owner did have a gun permit. also new, an 80-year-old man became the victim of road rage in lehigh county. police say it happened yesterday afternoon around 3:00 at a walmart. the man was just walking in the crosswalk when a driver nearly hit him, they exchanged words and the driver accelerated toward the victim and used his suv to push a shopping cart into him. police are looki g fain ing for jeep liberty. councilman david oh wants to lower the philadelphia cigarette tax. he's planning hearings before the city council to discuss the issue. fewer people are buying cigarettes in the city and councilman oh says the school district isn't getting enough money from the tax. the city has seen a 23% drop in cigarette sales. the tax on a pack of cigarettes is $4.60. in delaware, 11 students are expected to be okay after a school bus crash sent them to the hospital. it happened around 2:30 this afternoon outside lake forest high school in felton, kent county. investigators say the bus driver pulled out of the parking lot into the path of a student driving a jeep. no alcohol at penn state frat parties. the university banned all alcohol-related social events until further notice following the death of a new jersey student on saturday. beta theta pi told police the sophomore student was drunk when he fell down a stairwell at a party. police say his frat brothers didn't call for help until about 12 hours later. the fraternity has been suspended. new at 11:00, the criminal case involving a former pennsylvania house speaker will get a fresh look by a state appeals court. former former. he served nearly two years in prison and was released in 2014. his appeal focuses on whether he should have to pay the state a million big hug. >> police have found the vehicle involved in the crash but they're still looking for the driver who left the scene. tonight, complaints about delaware's prison system are growing louder. >> tomorrow services begin for the corrections officer killed during an inmate revolt. nbc 10's drew smith reports from smyrna. >> the governor promises an independent investigation into what happened but now days after that deadly standoff, another attack on an officer has only amplified the concern here. the association of delaware details an attack on officer this is week as they moved an inmate from the showers to his cell. punches flew and they say one officer had multiple injuries to the face. >> i guess it's a really serious what the inmates want out of this are and somebody better take some action real quick. >> reporter: now a week after the hostage standoff which left lieutenant steven floyd dead, the union's lawyer told me on the phone there are troubling policies that are empowering inmates. >> they're too easy on the inmates. they ought to have stricter rules. >> a dover woman has 2500 signatures on a petition demanding the state remove the aclu from prisons. she's referencing an agreement reached between the state and civil liberties advocates which allows mental health workers to monitor inmates, but the union argues it has led to a dangerous mixing of prison population. its president wrote in the statement "as long as this agreement is in place, inmates will continue to disrespect and assault or worse our officers. this has to stop." the aclu says that is just not true, meanwhile, the investigations into what happened are nowhere near complete. >> everybody will come down with a better insight. >> reporter: the union is working with the department of corrections to adjust staffing so as many people can attend the visitation for lieutenant floyd tomorrow and the funeral on saturday. in smyrna, drew smith, nbc 10 news. at 11:00, we are hearing from the university of pennsylvania police officer now back on the job after she was shot during a deadly rampage last september. officer ed miller returned to full duty yesterday. the 35-year veteran was shot in his ankle and hip during a gun battle but the suspect in west philadelphia. miller says despite his ordeal he won't approach the job any differently. >> i always knew what it entailed after a total of 35 years in the police department. it's -- it's what you deal with everyday. >> four other people were injured, including a philadelphia police sergeant. one woman was killed, the suspect was killed in a shootout with police. an nbc 10 exclusive. we're hearing from a good samaritan who rescued a dog he found starving and tied up on the back of a river in cumberland county. alex gaunt was out for a walk whe he found a dog trained to a tree in bridge ton. he said the dog was inside an upside down plastic carrier slivering. animal cruelty investigators are trying to figure out who left her there. >> i mean imagine if it was high tide it would have been flooded out. i took it off the chain and we got out of there. >> the dog is in the care of the cumberland county spca, staffers have named her sweetie and she should be ready for adoption coming up in a few weeks. back to our chilly or cold and windy night. >> it's definitely cold. nbc 10 on the campus of rutgers-camden tonight. understandably we didn't find too many students walking around in the cold. >> dangerous scene in massachusetts today. look at this. an suv out of the driveway there then slide sliding and spinning on a hilly road caked in ice. you can see the suv just knocking into car after car along the way. and a little bit later at one point narrowly missing these people on the side of the road. fortunately no one was hurt. it's a reminder to be careful on the roads when it is this cold and there's precipitation around. >> wow, we're talking about ice it is spots, not an entire road like that fortunately. we had either snow or rain for the most part early this morning and they got snow in the poconos. they got close to tension inches of snow this morning. it's 25 in philadelphia and it feels like it's in the teens and even in the single digits. coatesville, 17 degrees, the northwest wind gusty but not nearly what it was earlier 29 miles an hour in atlantic city. these are single digit windchills going into the morning so it will be bitter cold when you get up and it won't warm up a whole lot. during 11:00 a.m. still feeling like it's in the teens. in the afternoon the wind will be diminishing somewhat so it won't feel quite as cold. temperatures feeling like in the 20s. over the weekend we'll see a considerable warmup. winter radar showing a few flurries in cape may county and the storm itself is way offshore. we had that rain/snow line on top of thus morning at about 5:00 a.m., there it was, snow to the north, rain to the south and the areas north of the pennsylvania turnpike obviously had the most. and cape may county not much. 1.3 inches in dennisville. less than an inch at galway township. two inches in hampton on the l. the farther north you go the more snow there was.
