>> it shows the president is not listening to the advice of his lawyers to stop tweeting and stop personally attacking robert mueller. he's personally shown it's getting under his skin. when asked about it, he said, no, it's not the way. he made a point to say to the lawyers that his lawyers didn't prep him and he wrote the answers to the questions all by himself. i have to point out to you, dara, this is the role of lawyers. any american would want a luier's advice if they were facing questions. the fact that he's leaving no daylight there, he's really boxing himself in on whatever he wrote. >> it will certainly be interesting to see what he did right. the judge has ordered the white house to restore the press pass of cnn's jim acosta. here's how the president reacted in a fox sunday interview. take a listen. >> we're doing that. we going to write them up right now. it's not a big deal. and if he miss dehaev. you can't keep asking questions. knob believes in the first amendment more than i do. if i think somebody is acting out of sorts, i will leave. >> kevin, does this business really resonate outside the beltway? >> reporter: good morning. we heard last night the death toll has climbed to 71. meantime the missing is more than 1,000. a lot of loved ones haven't been able to connect with the missing. he will be joyed today by the governor and governor-elect. that comes after a statement. he put out a tweet criticizing forest management, and it wasn't well received. however, the governor put out a statement they're grateful for the visit. meanwhile thousands of evacuees are picking up the pieces. we're here in chico at an evac yagsz center. a lot of these evacuation shelters are filled to capacity. a lot of people are sleeping in a walmart parking lot. it's a grave situation. the area is just socked in this thick blanket of smoke. people in oregon seeing this as well. they continue to look for bodies throughout the community of paradise. the rain could potentially make that challenging. dara? >> no legal team would allow the president, particularly this president, to answer questions given by a prosecutor, but it assumed facts in evidence. prosecutors never give questions to defendants, suspects, or someone else. if they did, lawyers would be screaming if they submitted them themselves. no matter what, the lawyers will review his answers and possibly redraft them or suggest edits. and they must have the influence of his lawyers. otherwise i would. be surprised if his attorneys withdrew from representation. >> he also expressed his concern about muellers intentions. take a listen. >> i was asked a series of questions. i've answered them very easily. i'm sure they're tricked up. he said it may have been a good day. it was rainy. therefore, he told a lie. he puerjured himself. >> danny, what's your take on a perjury trap? >> on one hand it would imply some type of prosecutorial misconduct. i don't think that's fair to say the prosecutor is doing something in bad faith. on the other hand, prosecutors ask questions they already have the answers the and that's how they gauge whether the witness, the suspect, or defendant is answering truthfully. they have crafted these questions surely to gauge whether or not trump tells the truth or concealing the truth or omits the truth. if he does, they'll have a new thread to pick up on and go further with his investigation. >> he is kay lated his facts saying, quote, the president's gone completely nuts. what does that tell you? >> going nuts is not actually a legal term, but the president clearly believes the mueller team has been going on for too long. it may be the case the president genuinely believes he has committed no crime and that there's nothing for the muller team to find against him. but actual awareness that there's a crime you may have committed is immaterial. as long as you intented to commit the conduct that constituted a crime. it's legally presumed we all know the law. if the mueller team thinks there's something to be done, he'll continue to do his work. >> hypothetically we know there may be promises made to lock down the appointment. does he become a part of the obstruction of justice argument? >> any time a government official gives another government official a job based on promises that are not defined to benefit a constituency but are designed to benefit a gran tore, then that could be a real problematic thing. it potentially could be bribely, it could be a form of extortion or strukz as you said. it's very problematic. but in any of these cases, key is what exactly was the quid pro quo. what was given. if it's of personal benefit, it might run afoul of the criminal code. as a criminal defense attorney, should a president plead the fifth?
