stories right now. great to have you with me. i'm thomas roberts at msnbc headquarters in new york. we're following this breaking news. nbc news now confirming an indictment connected to the russian investigation, the mueller investigation, all eyes now on president trump's inner circle as suspicion is swirling over who could face criminal charges and when. it might not just be one. it could be one, two, maybe up to five folks or even less. the white house on offense about this. they know what's coming, but they are silent in the wake of this latest report. we want to begin in washington, again facing the details about this story with nbc news confirming this indictment. it is in connection with the mueller special counsel and his team's work for the russia investigation. it is expected to come out on monday. he still don't know who or what charges he or she will face. we should have those answers in roughly 48 hours from now. that's if everything is triggered for it to happen on monday. the big if, kelly o., everybody waiting to find out if this will really happen on monday or not. we know the president has been pretty quiet on twitter for a saturday, hasn't he? >> reporter: he has. in the last six or seven minutes, the president has returned here to the white house, spending several hours at his virginia golf club. we saw the motorcade come in and the president enter the north portico of the white house. he's back home now and that for me is a signal to pay attention to his twitter feed because he's back and maybe will want to communicate in some way now that he's back from his afternoon at the golf course. what i have tried to do is reach out to various officials here at the white house to get some sort of reaction. and so far there is nothing on the record, no official comment. in part they're saying they just don't know what to respond to because, as you pointed out, the expected indictment stemming from the russia investigation, has a lot of missing pieces for our consumption right now. the who, the what, the coming charges. how close would it be to the president or inner circle. sometimes what happens is some of the obvious players could be those involved in this or could be someone less well known to us or it could be an offense that is not obvious related to a russia collusion matter because sometimes investigators will find other evidence of crimes that on the surface might not seem to be exactly about the campaign season. all those kinds of questions to be dealt with. what is certain is this is a significant development in what has been am months' process of talking about russian interference in the 2016 campaign. was there any help from americans who might have been associated with the campaign of donald trump or in his business world. or now we're also considering the possibility of democratic involvement because there is that so-called dossier of unflattering information about candidate donald trump that was paid for as opposition research, at first by a conservative media outlet that didn't want to see him get the nomination and later by the dnc and the clinton campaign in the course of their campaign looking for material perhaps to use against the candidate. so it has been a long twisted path, lots of different characters. we've seen michael flynn, the former national security adviser leave his position. we've seen paul manafort the one-time chair of the chain be subjected to a search at his home. we've seen family members of the president, his son and son-in-law speaking to congressional committees that are looking at this. so it's a big cast of potential characters. right now few answers except monday will be high stakes here in washington. thomas? >> kelly o'donnell at the white house. thank you very much laying it out quite well for us about what monday could mean. joining me nbc news and intelligence and national security reporter ken dilanian. author of "the plot to hack america" malcolm nance. danny cevallos and senior national security correspondent mark hosenbaugh. the scene for monday, we're expecting news, something to be triggered on monday. there's also the possibility that nothing could happen. >> our sources saying an indictment will be made public on monday. it could be one person, more than one person. and the big questions that remain to be answered are the ones that kelly laid out which is will these charges relate to collusion with russia or will they be some other offense and are these targets in the inner circle of donald trump or are they not? both things are possible. if it is somebody like a paul manafort of a mike flynn, that will be a political earthquake of a story. if it's some lesser figure, still very significant, thomas. in terms of logistics, when somebody is indicted, danny can fill in the blanks. when someone is indicted, they either arrange for their arrest or our arrest are brought to a magistrate for an appearance and a bond hearing. generally these kinds of white collar defendants are then released on bond. >> we'll ask danny that in a second. mark, working for reuters as the senior national security correspondent -- >> cnn came out with it first i believe. after i heard about it on cnn i started checking around and i think within not too long of a time, i managed to establish that it was true, that there is an indictment. contrary to what ken said, at least my information as of last night, was that it was likely on monday, but maybe nottely 100% on monday. >> the thought i had was, we've got wire service. we've got the "wall street journal," a tv outlet. this seems like a very controlled confirmation of how this information is going to get out. so what you're saying about reuters, if it doesn't happen on monday, from the sources we've spoken to, was there any feeling that they were trying to get this story out there to make other people sweat? >> no. i just -- i don't think there was any coordination between me and cnn -- >> i don't mean from you. i mean the sources inside mueller's campaign releasing feathers to the wind. >> at this point you're speculating, making stuff up about how this information got up. i'm not going to go further as to how i found out about it. >> not making stuff up. you're talking about it may come monday, may not come monday. the facts are reuters got the story, cnn got the story, "wall street journal" got the story. is that true? >> i believe so. but it wasn't fed to me by anybody: the idea that somebody is feeding this is silly. >> no, no. i was trying to look at what is in plain sight in front of this about how this could all come out. in terms of the reporting that you were able to gather and the information you were able to confirm, is there a feeling that this will be larger of a name or multiple names when it is publicly revealed? >> i just don't know. the one thing i can tell you is kelly o'donnell's reporting on this totally matches what i heard except for the question of the date. number two, it's absolutely clear to me this does somehow relate to things to do with either the russia business or people who were involved in the russia business simply because the people -- -- the drks i heard it from is from other people working on issues related to donald trump and russia. that's a very, very large now area to look at. but in terms of further detail, i don't know -- all i know is it's happening, an indictment has been issued. i don't know who, i don't know what the charges are. >> certainly major news. danny, as ken was talking about though, explain from the legal perspective how the process works judicially, if someone is going to be named in this indictment, how it rolls out, what's done. >> here is what we know so far and what we can glean from that information. the fact that there's an indictment and that it is sealed gives us some interesting information. typically indictments are sealed in order to not alert the defendant in case the defendant might ob escondido. practically speaking, there are more reasons than that. for example, the prosecutors want to keep the investigation quiet. what we have to keep open as a possibility is this may be a voluntary surrender situation. it could be a situation where -- think about it, all the suspects, all the people out there are lawyered up. so it's likely that the -- whoever is being indicted knows he's being indicted. this could be a voluntary surrender as a predicate to becoming a cooperating witness. in other words, someone who helps the government prosecute other co-defendants. so what happens from here is there will be an initial appearance and arraignment. those will usually be done at the same time unless the defendant was arrested out of state. that won't be likely. if this defendant knows he's going to be indicted, he will probably travel to the district so he can be arrested, arraigned, have his initial appearance, get bail -- in all likelihood, i don't know what the charges are, there will not be what's called a presumption case. it's likely he'll be able to get bail and he will be released. >> if we have one person, could be a he or a she, we're trying to figure out exactly -- >> could be many people. >> could be many people at once. the president has been tweeting and doing so, taking aim at hillary clinton, saying that clinton is the one who really colluded with the russians. also, i'ive got a fund-raising t from the trump people, saying exposed -- i don't know if you can get a shot of the iphone here, this whole long text message that they're trying to fundraise off of. i get these a lot from the trump folks, using headlines to get people to drive in and donate cash, whether it's one buck, two bucks or even more. from the latest tweets and trying to deflect, how big of a concern is that, of trump trying focus hillary clinton and prove some type of dnc collusion? >> there certainly had to be some inkling going on in the white house something was coming down the pike. this last few days has been a blizzard of information where they tried to literally make the case, with sarah huckabee sanders as press secretary standing on the podium saying hillary clinton was the won who colluded with russia. this is a massive misdirection. you know what? it's all going to dissipate monday, tuesday, whatever day that someone is indicted. this is a criminal investigation run initially by the national security division of the fbi which started out as a counterintelligence hunt and is going into seeing whether american citizens work with a foreign intelligence agency in power to influence an election. this is the first time that's happened in history. this will be the biggest week since watergate. it doesn't matter what level the person is. if it's related to the trump-russia scandal, it's going to be as big as water game. >> here are some of the other facts. "the new york times" reporting that the washington free beacon, a conservative website, first funded research to be compiled by fusion gps that led to the trump dossier. republicans have been using reports that the dnc and the clinton camp helped fund the research to argue that bob mueller and his investigation should be terminated. so malcolm, when we think about op o research, campaigns are not supposed to accept foreign aid, certainly not accept foreign aid for free. can american organizations be able to reach across borderlines to other countries in seeking opposition research. >> it's a question of where the information and the source of the information is. the information that was acquired by fusion gps, which, by the way, was done by a republican, like you said, the free beacon, it was not a foreign government agency providing that. it was a subcontractor with americans involved who did analysis and gained information that was what we call rumor intelligence. anybody can do that. if you saw the opposition research folder that the dnc had that was hacked and released by russian intelligence, you'll just see this is information gathering. on the other hand, what we saw with the e-mail chain that had donald trump junior, paul manafort and jared kushner involved, a foreign agency with information and personnel from that foreign government came to the united states and said our prosecutor has information about hillary clinton. we want to give that to you to benefit you so that donald trump can be elected, that violates federal electioneering laws. if it is an intelligence operation that americans were involved in, it could violate other things like the espionage act. that's apples and oranges what people are talking about. >> we'll have to wait and see what's going to happen, when it happens on monday. gentleman, thank you very much. i appreciate your time. malcolm, danny, mark, i appreciate your insight and time. a party with a problem. republican senators are lashing out against the trump administration before the russia news. >> when such behavior emanates from the top of our government, it is something else. it is dangerous to a democracy. >> i think the worst of it is going to be just the whole debasing, if you will, of our nation. >> still ahead, what the infighting could mean for the gop establishment and the trump agenda. stay with me. it's like when am i gonna be able to sneak out of here and go have a cigarette? >> it may have been there or it may have been they sensed a different sea change that mr. frank alluded to in his farewell address. that is there is no room for moderation in the republican party anymore. the party moved over and become really the party of trump now. that will last only as long as mr. trump lasts, and mr. mueller may have something to say about that. this is trump's party now. if you're a republican senator or congressman or want to be one, you need to ask yourselves some questions. if this is the party of trump, that means certain things. it means, for one thing, you have to be post factual. you have to be comfortable with reality. if mr. trump says that down is out, you have to be ready to march out in front of the cameras and confirm that down is, indeed, up. you have to engage what i would call traitorist. the russian efforts on social media, the internet regarding or democratic system are on going. they will be going in 2018 in the midterm elections. so for mr. trump to go out and say this was all a hoax, to continue to insist this is a hoax is aiding and abetting the russian effort right now. whatever happened during the campaign, that's one thing and mr. mueller will get to the bottom of that i'm sure. but right now, mr. trump and his fellow republicans are aiding and abetting the russians -- the russian effort to sabotage our democracy by digging in their heels and contending this is all a hoax and it didn't really happen. >> ron, you know how washington, d.c. works. as a first son you also now how the commander-in-chief will work during crisis time and what is not so much a red herring, but a way to get folks to look the other way. >> sure. >> for people with political calculations and know how to operate in d.c., jeff flake or corker, these are guys that are politically calculated and thinking about their future. now they don't want a future in d.c. anymore. if there are other republicans that don't rise up ahead of the russian news or ahead of what bob mueller is doing or what it means for this administration, how much do they risk of their political future? >> they risk a great deal of their political future. i don't know what the numbers actually are or ow they break down. the majority of the republican party right now is still solidly behind donald trump. many congressmen, many senators up for re-election don't want to get on the wrong side of that equation. they've got that on their minds. they've got the tax cut on their minds. the one thing republicans care about more than anything is delivering a tax cut to their wealthy donors and their wealthy donors really want this. they think trump can help them get there. as long as that's the case, as long as they think their re-election is dependent on him, they're going to stick with them. >> we know the president in meeting last sunday, having a call with house republicans, then showing up for that luncheon on tuesday with senate republicans, we'd like everybody to think that all is well in d.c., certainly with the gop. take a listen to this. >> i think we had a -- i called it a love fest. it was almost a love fest. maybe it was a love fest. standing ovations. the fact is there was tremendous unity in that room, and we're really unified, we're really unified on what we want to do. >> so if they're really unified on what they want to do, that's what the president is saying, there have been no legislative wins for a republican party that has the white house, the senate and the house. how does he justify that? >> well, you can't justify it. remember up is down with donald trump. so you just have to accept this unreality he puts forth is, in fact, the new reality, the new normal. if you're a republican, that's what you have to accept. but no, in fact, there's no accomplishment because, in part, he's incompetent. he has no real agenda here. this is the big thing. i know i keep repeating myself, but donald trump is unfit for office. by any measure the man is unfit for office. people like bob corker and jeff flake and many, many republicans as well as all democrats realize that. people close to the situation understand that. this is a danger to our country. it is a danger to the world, and this is a central fact that, instead of chasing tweets like we do, he throws out these things and we all go running after them. we need to grapple with the central fact here. this is a deeply damaged human being in the white house right now, and he is dragging our country down. it's a danger. >> we probably in our history books, ron, we have had deeply disturbed or damaged folks that get to be president. some can do a great job, some not so much. but also for the opposing party, chaos can create opportunity. are the democrats seasoning up a bit, is that going to help in the midterms or are they not on course for any big wins come 2018? >> you can make a lot of money betting that the democrats will somehow seize failure from the jaws of victory. that seems to be their way. they should be -- the numbers are certainly in their favor. the favorable, unfavorable numbers for republican versus democrat in generic congressional elections, massively in the democrats favor right now. a solid block of people on the republican side who are pro tum people who are just immovable. they can't be moved by facts or evidence. trump could, in fact, shoot somebody on the middle of fifth avenue or whatever he said during the campaign, and they wouldn't care. the fact that people like me get upset about donald trump just means to them that he's doing something right frankly. i can holler all i want. it won't get any good. >> the person who gets shot, that's going to be the person who really cares, maybe less than 50% of the voting population. ron, great to see you. appreciate it. >> thank you. >> straight ahead, where were you one year ago today? start today. ♪ hi everybody. welcome back. i'm thomas roberts at msnbc headquarters. some of the headlines we're following at this hour, the breaking news of the russia investigation with nbc news confirming a federal grand jury in d.c. has approved the first charges in the investigation being led by special counsel robert mueller. the indictment is expected to come on monday though the target or targets and charge or charges, that's still unknown. president trump vowed to release all the remaining classified files of the assassination of president john f. kennedy but will withhold thousands of sensitive documents due to national security concerns. that was in his purview to do. so far nearly 3,000 previously undisclosed documents were released for public consumption. according to u.s. officials, the four u.s. soldiers killed in niger were pursuing a militant who escaped an an isis recruiter. one year ago today, that october surprise, one that shocked the nation, 11 days before the 2016 presidential election, former fbi director james comey sent the now infamous letter to members of congress explaining the fbi was reopening its investigation into hillary clinton after recovering thousands of e-mails in an unrelated probe involving anthony weiner two days before the 2016 election, he disclosed that the fbi investigation had found no wrongdoing by secretary clinton. four months after trump was sworn in as president, he fired comey, citing the fbi director's mishandling of clinton's e-mail investigation. now, we know the president had praised james comey and thought james comey was somebody he considered to be doing a good job prior to this. remember that video of them in the white house, when he called james comey up out of the crowd and they shook hands. well, that was then and this is now. we'll explain how what happened over a year ago is playing out in realtime now. the suspension, everybody wants to know what's going to happen because nbc news has the exclusive reporting about multiple closed door meetings tied to special counsel robert mueller and the senate intelligence committee's russia investigation. those details when we come back. your big idea... will people know it means they'll get the lowest price guaranteed on our rooms by booking direct on choicehotels.com? "the new york times" reporting that talking points brought to that trump tower meeting by the russian lawyer were shared in advance with the kremlin. nbc news exclusively reporting that mike cullen was grilled about a trump tower in russia. carter page also questioned for five hours yesterday by a senate panel and page is back next year to appear off camera before the house intelligence committee. as congress is grappling with the role social media played. we have reps from facebook, google and twitter going before through congressional committees next week. next week is bound to be a busy one. joining me susan del pers i don't, democratic strategist simon rosenberg, jesse eisen at republica and brittany cooper. good to have you all with me. suzy, let me start with you. what do you make of the breaking news of bob mueller an his team and the big reveal for an indictment. >> like you said at the top, it's certainly big news. it's going to put a lot of shock waves no matter who it turns out to be. obviously the higher up in the chain it goes, the more noise there's going to be. but one thing is for sure, we now see that this investigation is moving -- will be moving out of the speculative into the legal. that's where the donald trump team has to be very careful in how they proceed on this. they probably don't know anything right now or at least they're not supposed to. going forward, it's interesting we haven't heard a tweet from donald trump today. my guess is his lawyers are really putting it onto him saying just be quiet on this matter. >> when we think, susan, about donald trump, the team of folks that have been around him. we've got the former campaign manager of donald trump, cory lewin dow ski reacting to the mueller news today. other folks have remained suspiciously mum about what's going on. do you think that it will be the usual suspect for lack of a better phrase in this or potentially somebody that we haven't had on our radar? >> that's exactly what we don't know. i've been speculating that it could possibly be not michael flynn, the former foreign policy adviser but rather his son who has been involved and we know hasn't been good about keeping his mouth shut and tight-lipped about some of the work he's done. either way, it's certainly going to put a lot of concerns throughout the white house because, as we know, they've already started lawyering up. now more people will. >> with political reporting that some republicans are going to put up a fight over the on going probe of bob mueller, the budget for this. is that realistic? do you think they'll balk at it? >> no, i don't think so. actually the treasury controls the budget. there's going to be a lot of noise about this. we've seen a campaign of distraction already, talking about the uranium deal and clinton. mueller is going to proceed, going to have a lot of room to proceed. he's got his special counsel edicts and the powers that come with that. he's going to move very slowly and deliberately. he's going to have a lot of room to operate. it's going to be political pressure, but he's used to that. >> simon, republicans announcing investigation into an obama-era uranium deal. i talked earlier in the show how i got a text from the trump team talking about this and saying that the dnc worked on this file trying to take down president trump. they refer to him as if it's in the now, as opposed to that this was op o research done on a candidate who was a reality star businessman at the time. i want you to take a look at hillary clinton's reaction. >> i would say it's the same ball loan any they've been peddling for years and there's been no credible evidence by anyone. in fact, it's been debunked repeatedly and will continue to be debunked. >> do you think that that is the position of power, simon, she should be operating from, that that is where she needs to stay? >> i think the republican effort to deflect from what we now know -- we know why they kicked up so much dirt in the last few weeks, i don't think this stuff is going to be lasting. it's not insignificant. we learned through the benghazi experience that if they decide to start subpoenaing people, this thing could become very significant. i think at the end of the day it is going to be a sideshow to what is the real show here, we're starting to move into a very grave and serious point of the trump-russia investigation. it's going to be interesting to see how the whole republican party reacts. remember we just had two of the most important senators in the republican party just this week essentially say donald trump was unfit for office. if you start to see now this erosion of support, it could grow if this investigation looks like it could get serious. this is an important time for trump. he's in bad shape, i think. it will be interesting to see how the white house reacts this week. >> brittany, from what you've been watching out of this, out of shear spectacle but reporting on and writing about. when we think about what congress's role has been in the russia probe, how important is it to the ultimate work of bob mueller? >> i think we're at a moment when the integrity of the entire political process is at stake. so what congress needs to do is make sure they don't get in mueller's way. he's the one person in many respects, he and his team, moving with a certain level of integrity and who can -- who are in a unique position where they don't have to respond to certain kinds of political pressure. congress should move to protect the integrity of this investigation. certainly they can do their own investigation absolutely, but there's a real problem here because, frankly, trump's team and trump himself engage in this periodic gaslighting of the american public. they keep on engaging in these dog-and-pony shows designed to distract us from what's going on. i think that's dangerous because now that we're getting real evidence that there are real charges that will be brought in the collusion scandal, then the trump campaign is saying no, no, no, it's clinton who engaged in collusion. that's absolutely ludicrous. we're alsoali at a point that t the american public only wants to support who maintains their point of view. to allow bob mueller to do his work. >> jesse, from what you've learned and from different sources you've been talking to around what could happen on monday, who are some of the more likely people? are they the manaforts, the flynns or potentially somebody that isn't on the radar, like a roger stone for that matter? >> those are the obvious names. those are all the people being speculated on. what mueller is going to do is work his way up. this is the way a good white collar investigation needs to proceed, you want to indict lower level people, put pressure on them and flip them to get to higher level people. they're not going to go to a high-level person right away. it's possible they get manafort because it seems like the evidence against him has accumulated over the last several weeks in many reports. if i'm betting, i would say manafort. i would be very surprised if it's somebody higher level. i doubt that very strongly. >> simon, when we think about what this means and the opportunity that democrats have, are they going to be able to use this to advantage to have a way to get back to governing power. as we think about 2018 coming at us, will they recognize a moment that demands attention?
