I sat down with him for a conversation of his home this week to discuss the legal peril surrounding the former president. You have said that the maralago Documents Case is the strongest against trump and there is new reporting, prosecutors reporting from 2021 in which trump acknowledge that he lowing the retained documents that he knew or classified. If you are prosecuting him or just giving your experienced and how would you use evidence to help the case and how much does help the case . I once it without playing it that laurie i hope they are okay. Not about this case but it is very applicable. And dozens of times sense. But tapes are amazing for a prosecutor because you cannot cross examine a tape. You cannot call a tape ally. Or deep state operative. A tape is you. Saying what you think which is why they are so valuable for a crime case. And will be so valuable and important to jack smith in this Documents Case. I do not know where the case will end up. But it makes it easy measurably stronger to have it be the subject of the investigation, saying in a way that that cannot be impeached, no pun intended, with. Trump cannot be criticized or undermine because the copies all around. That is why once everyone a hope there are tapes. I think it is a good thing there are tapes. Turns it is another grand statement in many of these cases and knowing what you know about trump and how he operates and acts, people have dove so quote closely into his mind in some ways, what advice would you give jack smith about how to approach this or what we mindful of . Im not sure that he needs any advice. I dont know where theyve never met him. He does not need any advice because he knows because this already started that trump comes for the rule of law system of justice and the agencies with a flame thrower. He will come and try to criticize and attack your family and your witnesses. There are no limits to what he will try to do to obstruct an effort to hold him accountable. But im sure they are prepared for that and i think its one of the reasons why im sure theyre being careful to make sure all of their eyes are dotted in their ts are crossed, if theyre planning charge this case. You know what it is like to lead a politically sensitive investigation around a campaign. Given the current timetable of the cases and the potential cases against trump which are multiple, he could be the presumptive nominee before any of these even go to trial. How concerning is that to you . It is concerning to a prosecutor leading investigation into the fbi. Because despite his history, we desperately do not want to be involved in an election time investigation. It or near them. So they are feeling Something Else that we talked, probably, i just know the system. They are feeling intense pressure to move so they are not in the position to make the decision next year. When donald trump may be the nominee. So i think they are likely working very hard and trying to get ahead of where even the normal pace of the investigation might be. Can you envision a scenario where trump managed to open up the white house and it to the justices delight . I. Could i dont want to but i could. It is a crazy world that donald trump is dragging this country into. He could be wearing an ankle brace it while accepting the nomination. As republican convention. He could be wearing Ankle Bracelet and be elected the november . Yeah. It would be rejected if you put in a script for a show. But you could have a president who is potentially incarcerated. When hes elected president. That would be weird and awkward and it seems even crazy to becoming it of my mouth. But that is a situation we face. It looks like the republicans likely could nominate somebody who is under serious threat of criminal destination, is indicted. And who knows what is going to lead . If hes elected and sworn in as president , which they pause . Would the president be that they positivity or consideration of these legal cases . Or is up to the jurisdiction of the Law Enforcement officials at the time . There is no precedent order whatsoever that im aware of. Weve never contemplate electing again somebody like donald trump. So i dont know what would happen. The federal government does not control the manhattan d. A. Or the Fulton County d. A. So none of the normal traditions and norms around respecting the office of the presidency, and not distracting the president s criminal charges on the federal level, one of those would be applicable. And i cannot imagine a circumstance with supportive justice wouldnt, if theyre going to charge, you wouldnt have done so far in advance of a resolution before he took office. So do it in, time do it this summer. I know you dont have insight into this, but do it the summer that would mean that they could complete the case before he were to take office . Yes. I dont know anything obviously. But i predict what your summer will be did not plan in the long vacations as a journalist. You say that trump poses a near existential threat to the rule of law, and this is something similar language that i hear privately from National Security officials and some people that you and i both know who will say this privately. About a second term could mean. But tell me a little bit about the specifics of what you could try to do. What do you mean by that . Think about what four years of Retribution Presidency michael look like. He could order the investigation and prosecution of individuals. Who he sees as enemies. On this news list. Because the president , constitutionally, does oversee the Executive Branch entirely. Most of them are one of justice. So we close a commission interact that individuals be pursued. He could also direct all kinds of other conduct that people would maybe take to courts to try to stop but who enforces court orders . Most of the United States Marshal Service which is in part of the Executive Branch and reports to the president. So President Trump to say, i dont care what the Supreme Court says. Or at least what the district judges side. I am telling the marshall, service do not enforce that court order. Our constitution really does give a rogue president , which is what this would be, tremendous power to destroy. And thats why im trying to warn people, given the way he says that he intends to operative he is reelected, this would be something we could never have a match and. It seems like Science Fiction in a way. But this would another four years of donald trump really promises, which is why people criticize cnn for their town hall. I want the American People to stay at the threat that we are facing, and understand that they cannot take the next election off. You are republican most of your life but voted for biden in 2020. You still consider self one. Do you intend to vote for him again or is there anyone on the republican side you might consider . It has to be joe biden. And i am glad he is running to serve. Glad he is willing to serve. It has to be somebody committed to the rule of law and committed to the values of this country and im not talking about policy. We can disappear agree about policy. There are things about those disagreements. The president must be someone who will advise the law and our constitution. And there is no one else but joe biden. One of the focuses it seems to a faded from the headlines is the threat of Russia Intervening in our electoral process and system. Trump recently said that ukraine would not see if ukraine would prevail over russia. Given this affinity for uprooted and his own war do you expect or should we expect russia to interfere on his behalf in 2024 . Yes, of course. Vladimir putin does not want joe biden to be president of the United States. For reasons that i hope the American People see. Because he acts in our national interest. He would very much like donald trump to be president again. Because donald trump is, for reasons i still cant explain, very fond of vladimir putin. And so they will find ways to interfere and i hope our Intelligence Community is equipped to respond maybe better than we did in 2016. But they will come for this election. What should the media be telling the public about how to protect themselves or how to watch for that . What do you wish people were doing out there . I wish people were taking a breath and a beat before accepting something that they see on line especially rumors about people or, i know we will be over the next year but documents of somebody discovered breathlessly take it all with a grain of salt. Now nbc news has revealed a Federal Grand Jury is set to reconvene this week in the Special Counsels probe into trumps mishandling of classified documents. So something is afoot here clearly and it has gotten legal experts wondering whether we might see fettermans treatment of the former president soon. Are the perfect person here to talk with me about what could be coming here this week who we literally call this morning because we know importantly story was it would be great to join us. Glenn kirschner thank you so much you are off 30 or federal prosecutor now msnbc analyst and i just want to start with the news that broke overnight because a grand jury is expected to meet this week. What does that mean for the timeline . Trivial be an indictment washed now or that premature . We should be an indictment watching here is why. What im seeing is prosecutorial Practice Wonowon and the last witness reportedly right before the grand jury, i want to know. Now they are being recalled and are going to be back in session this week. Let me tell you what i take away from that. When we are handling largescale investigations, big conspiracy cases, what we do is we try to present all of the witnesses and all of the evidence to the grand jury with the testimony and the documents we have subpoenaed the audio tapes and do the Surveillance Tapes of perhaps people moving boxes around. Once we are done or we think we are done then we take a step back and we basically sent to the grand jurors home. And what we do is we produce what is called a case impression memo. Which is a soup to nuts are in the count of every shred of evidence that the grand jury heard. Every charge we think might be supported by that evidence, and every Court Precedents that informs us about whether this evidence satisfies the elements of these crimes, once we are down all that they would make a prosecutorial decision. What, charges if, any to ask the grand jury to vote on . Of course in this case there is one intervening step that we usually dont have. Jack smith has to prevent all of that with his recommendation to the grand jury under the Special Counsel. To Merrick Garland, rather, not the grand jury. We have to present his recommendation to Merrick Garland and Merrick Garland has to be the thumbs up really thumbs down. If you ask me. To predict. Mayor garlands Elected Direct Smith precisely because he had the confidence in jack smith to make this recommendation. So i have a feeling that whatever dark smith commands Merrick Garland is going to give him the thumbs up assuming that he is recommending indictments. Then the next thing you do as you walk in the grand jury and you ask for a vote. So Evan Corcoran, there is also been reporting about voice memos that he took Donald Trumps former lawyer. One, is that significant . Do you typically do voice memos of as a federal prosecutor . And how could that be used against donald trump . He probably was not doing voice in the most when he was a federal prosecutor. In murder cases. I work murder cases with him, back in the day. Now that he is a criminal defense attorney, Defense Attorneys do memos to selfto file all the time. Why . Because nobody goes unpunished but when a client gets convicted at trial when the first things they do is they blame their lawyer. They claim their lawyer provided assistance of counsel, ineffective assistance of counsel. That is where the lawyer has to be prepared to defend him or herself with realtime contemporaneous members that say no, wait a minute, here is what my client told me and here is the advice i gave my clients. So you know, what it is on the client, it is not on me for the legal advice i gave. Or failed to give. So what does that put us . Summer of 2024 kind of on the cusp of the 2024 election. What keeps me up at night is the case is still pending against donald trump and has not gone to trial. You said there was a couch. What is the most rewarding thing about running this store . If you can name one thing, maybe more than one. I cry twice a week here. Its really amazing to see shoppers become, donors become volunteers. That cycle is really amazing. People here love you very. Much i know that her spending with time here. You can hear when you are seven years old with your mom and your brother. You are an undocumented immigrant. What was an experience like for you as a little kid . I watched America On Television so what i thought of america was just what i saw on tv. So it was just based on like home alone. All the houses look the same. I thought i remembered getting her and things been really cold. The hairs inside my nose were frozen. But, also feeling welcome. And i moved to queens it was kind of a melting pot and i had a soft spot and we did everything. Right we paid our tax system we worked really hard. And i remember thinking oh my gosh people do not want us to be here and there was a hard reality because i felt very american. Another fact about you that surprised me as you were also a volunteer firefighter. I am. That was a childhood dream in those are the oldest person at the academy. I was like the academy moment was the first time i was the oldest person in the room. Which was really cool to experience that shift. But i showed my kids never not to pursue a dream. So where leaving the free store and heading to some say they dont believe me as an event. Sure starting with me is so dont worry i dont scary. So here we are sitting at the project, a about good pga. What happens in this building . It is for, good we believe we should all of our lives forgotten do good things. So it is kind of a really special place. We have Women Entrepreneurs that work out of here. All women from the community. Working to break cycles of poverty with your family, as heads of households, single moms and an Incredible Group of women. You describe yourself as a bit of a reluctance political spouse. I think it is fair to say that you are not dying to get into politics. I mean i still hate politics i do not know how i ended up here. I just hate what it has become. And i think it can be very different, of. Course you need to elect the right people to change that but it is just so mean and i am just not that way. The conversation is you are very well aware, about Mental Health has been elevated in recent years in part thanks to what you and your husband in your family have done, being so vocal and outspoken about the need to talk about depression and address depression. Can you just share what it has been like for you and your family to see how that has inspired others . Especially men who are less inclined to be outspoken or seek help for Mental Health issues. Honestly, i am so proud of. Him it is so courageous, right . We always read in the news about when something tragic happens to someone. And instead, i want to read about someone talking openly about seeking help. When your husband checked into walter reed towards an incredibly powerful oped for l magazine about the attacks and threats directed at you. A lot of that stuff is there. But this quote which i wrote down which was included in there was, when we demand that women steal themselves in the face of unending attacks we teach the next generation to normalize that except harassment. And that start with me and i am sure many woman who read it because you are taught unconsciously, many of us, to just say everything is fine into just fight through whatever challenge you may be facing. Why was that important for you to include in their . Think about little girls coming home from school and the boys picking on them. How many times, they say oh he must like you. Right . These are the things we hear from women when we are very little. Entering this world of politics and i have been forced into, people would always say do not worry gisele. Youre gonna toughen up and you are going to get a thicker skin. And it was never like, we have been addressing issues. It was like, youre gonna be strict comes stronger to deal with that. Were gonna change. You and i was. Like i like my skin. It is fine. I dont want to think your skin. Lets talk about the actual issues not how we should become stronger to carry this weight. Weve received a significantly larger number of threats then your husband, you. Have even though he ran for office, was elected to the senate. What do you think that is . I think it is the immigrant part of it. I think it is easier to attack women. Men are just a targets. You have been attacked for a range of things. What do you wish that all of these people who caricature you wouldnt know about you and who you are . Im a really nice person. I was voted nicest girl in my high school. I dont know. It is not so much for me. I want them to know that i can take it. Again, i am fine. There are millions of young women and young girls that are watching this and maybe making decisions that are not what they want for fear that they are next. And that is harmful and im sure you have young people in your life that you love and you have the option to choose a better way and it is okay to disagree on so many things and there is a way to do it.
