of, that the unsealing of the indictment, formal arraignment, and all of th logistics that go along with it, none of that is happened yet but trump many of his allies have already begun criticizing and accusing the justice syste of being corrupt and biase against him. donald trump, like anyon accused of a crime in th united states is presume innocent until proven guilty he's entitled to his day republican part with him the vast majority of elected members of which have alread come to trump's defense. including former attorne general bill barr, who ech some of trump's talking points when often found an exception except for congressman in nebraska. for someone said wow, he's gonna get his day in court he's innocent till prove guilty, what an opportunity to clear his name and show thes charges are false. instead it was filled with witch hunt, left-wing, radical socialist, max, da, manhatta brag language. >> it's not surprising, thes things, these responses, these tweets, the phoenix of the justice system by electe republicans have probably been written for weeks. these are things that they wer prepared to release. as donald trump's poll numbers within the republican primar have been steady or gone up at least over 10% in one of those polls. you have these members o congress who are in safe districts, who have nothing to lose by supporting only today they've bee supporting donald trump. do you look at the house o representatives for example. let's say two to 3% of those seats are ever in play now it' been so gerrymandered. when you support donald trum in your district you're doin just fine you're speaking to your audience. i was struck by bill barr just now he's speaking at the national review so in essenc he speaking to his audit, a bi group of conservatives, an he's defending donald trump. because that's the thing you d right now, still in th republican party probably to their peril. you look at the senate, it becomes a little different they're little more careful, they're not in remainder districts. so the reaction, while still adhering to trump, is in uniso probably because it's been rai already, and in the books for while. >> michael let me ask you, i'm worried about something else on one hand the motivation for most of these republicans mayb don't cross donald trump right now, he gets convicted and goes to jail, you can cost him dead maybe but i'm more worried about the fact that this is reminiscen of the days before the election, or the months before the election when donald trump would warn people that the election was gonna be corrupted, so it ma not have to accept the results of it. obviously you can't not accept the results if it's a guilty verdict, but his followers cannot accept it >> it's true and there is a delegitimizatio of in the house are doing right now. these are the same people that said house hearings don' matter oversight does it matter and i think you're gonna see that a little bit with these indictments. sure, new york doesn't release mugshots but somehow that mugshot wil be released i would guess. you'll see him sort of, yo know, lionized by people on th republican party after this. but i think this group o people that it here to wha donald trump says and does, think it's a shrinking group, think that's gonna be what you'll see come out. don bacon is a good example. >> the thing i found interesting was kevin mccarthy again, without seeing th diamond, without hearing the case, he's decided by congress will hold the manhattan da accountable for what he call an unprecedented abuse o power. now i think notoriety here what effect does the fact that this is, for better or worse, celebrity person being indicted? >> i read it should make a difference in the way that you approach the case. what you do is, you make sur everything is done by the book >> right because they're such a microscope >> i should be done with every case, big or small but where cases that will be looked at, getting media tension, this is you know, the case that will get the mos attention. as far as we remember. you're gonna make sure all eye are dotted, all the t's ar crossed. >> you think that's being done because alvin bragg is under a microscope here. he's being accused by everybod of pretty much everything. though no actual accusations nothing that would go throug judicial review. >> no it appears he is following the letter of the law, and doing things by the book his letter response to members of congress, who are seeking t get information about hi investigation, i thought tha was an incredibly professional letter, saying you don't hav jurisdiction i'm doing the work, my team is doing the work, we have criminal investigation that we need to maintain, and keep secret and we're not going to this by all accounts was a professional judge who handled it very professionally the las time around. they're also used to the kin of attacks unfortunately tha he seeing. they're also used to makin sure that high profile i bigger cases are handled especially well. >> does this judge have to d anything by virtue of the fact that he oversaw a case in whic trump's company wa unsuccessful >> he certainly familiar wit the players involved he's a person who set alle weissenberg in connection with that case. he has familiarity wit organization but really, the judge is gonna be looking at the evidence i this for two killer case, an evaluating that evidence >> there may be a role for allen weissenberg for this trial. as the money guy does the fact that judge convicted him, or wilson charg of the proceeding that convicted him relevant here? >> it's relevant in the sens that, it's a reason of going t that judge, it's because it's related case but that's not uncommon for judge to know some of th underlying facts because of an existing case. it's not relevant in the sense that it's inappropriate in any way. it's actually quite common for a judge to have some knowledge about the case, because they handled a related one. >> one of our producers lisa rubin who practices law an observation the other day, sai trump is now talking about thi prosecution as electio interference now in the face of, it it's. not from a legal perspective it's not, but as we're jus discussing with michael short, that may be a political thin that is meant to make people see the outcome of this tria is illegitimate no matter what >> look at this investigatio has been pending for quite som time well before he announced his candidacy. he is gonna have to have a rea uphill battle in trying to say that this was in any way politically motivated. or that is being done to break down his candidacy >> there is a practice and policy within the department o justice. if you're handling a case when investigation could impact a upcoming election, we need t do it, need to take action sufficiently in advance have a election and not doing anything in th lead up. because you don't want t impact [ chuckling ] >> back with me, june cam, service the actor united state attorney for the souther district of new york for march 2017 to january 2018, christie greenberg, who served as deput chief of the criminal division of the u.s. attorney's offic for the southern district of new york thank you for staying with me. kristie, let me ask you, wha you've gleaned in the last 24, 48 hours about the charges and what's likely to happen? because it seems like there ar multiple charges, and many o most of them are misdemeanors, but there may be a felon charge involved here somehow >> right, there's been reporting that there are anywhere from two dozen to 3 counts in the indictment so what i would expect i would expect one of those counts t be a conspiracy count. that really allows the prosecutor to tell the story to be able to say, here's what the criminal scheme was. and here is how donald trump fit into that. he is the person directing others to engage in criminal conduct. also allows them, they don't have to send out the motive, but here would be a way fo them to set forth who is the one who is getting the benefit from all of this and that was donald trump to win the election it also allows them to set forth max where they can g towards proving the intent t defraud. and if it's a felony, you also need to show intent to further or conceal another crime so setting this fourth as conspiracy allows them to se the stage and really do that provide more information also expect that there's gonna be substantive counts. so you could charge each falsified business record as its own count. so you have the checks fro donald trump to michael cohen. those could be each check coul be its own account you also have the correspondin entries in the trump organization business records. where they're listed as lega expenses, which of course, that's false, we know they weren't. each of those entries coul also be its own falsifie business record count. so again, those would be misdemeanor counts, unless you are able to connect it to this further concealing of anothe crime. what could those be? that's a 64,000 dollar question, we don't know. we'll be federal, will it be state. there is reporting that it could be campaign finance law, it could be election law, it could be tax law you know we just don't have th visibility to know what that will look like >> which might make this judge who has been put in charge o this relevant. because this idea of different kinds of entries in your books your two kinds of books, that' something that is been pursued by the course with respect t the trump organization, and is still being pursued by the new york attorney general, letitia james. these things are connected the whole story of how the trump organization and weisselberg and everybody operated it migh be relevant to telling the story. >> the judge is gonna be ver relevant going forward i think you're gonna see thi play out in two stages he's going to show up for hi arraignment, and then there' going to be a schedule set the schedules gonna firs involve legal briefing, an motions. that's when the judge is gonna be very important. i'm sure that there will be an number of motions to dismiss the indictment, for a number o reasons, to move the venue and that motion, those motions are gonna be decided by th judge before it gets to a jury until the judge is gonna play very significant role in sayin as a legal matter these charge are appropriate. there's been a lot of talk it's all speculation, but th talk about this bein unprecedented pattern. those things will be litigated in court as a legal matter the judge will decide that, an then the indictment, and the charges, that survives those attacks, they'll go to a jury. and so, i think you're right to note that this judge is gonna play a big role. >> right to the extent that he doesn't have to keep on access asking wait explain this to me, thi is complicated i guess the trick is how you make this easy for a jury. because these white-collar cases tend to be a little hard sometimes for folks to understand thanks again to both of you fo being here we always appreciate you, we'r gonna need to hear a lot june, kim christy reiber nbc's learned that donald trum is heading to new york cit monday night before heading back to the airport to fly to florida. optics were gonna try and make sense on what is motivatin trump right now and someone wh has reported on the presiden for over three decades so it's decided, we'll park even deeper into parking spaces so people think they're open. surprise.
