"eyewitness news" reporter jan carabao is live from the cbs-3 news center, jan. >> good morning, this comes just weeks after deadly police shootings in tulsa oklahoma and charlotte north carolina. this time in suburban san diego, investigators say black man who was killed was acting erratically and then was shot by police after pulling an object from his pocket and pointing it at officers. take a look at this police released this photo of the incident it is a still frame, from cell phone video given to police by an eyewitness. investigators say it shows moment that this man pointed an object at police and assume what they called a shooting stance. now this all started around 2:00 p.m. at a strip mall, and police say sister of the man called police for help. she said her brother wasn't acting like himself and walking in traffic. when office's arrived the man refused multiple orders to take his hand out the of his pockets. police say he was shot when he took his hand out, with that object. one of the officers tried to subdue the man with the stun gun but failed, the other officer fired several times. now soon afterward news of this deadly shooting sparked peaceful protests although they were angry. tossens gathered throughout the night at shooting scene and outside of police headquarters. now some demonstrators claim that the man who was shot had his hand up but police say still frame and cell phone video dispute that, protesters want to see the whole video released. >> everybody wants the tape. there is no reason why you should confiscate the tape and hold it there, not being held accountable and it is just a system that is genocide. >> they shot him five times. you shoot somebody five times you are not trying to stop him or help him you are trying to kill
