you think, you're watching him walk by, what's going through your mind as he walked out? >> i wanted to hurt him. i'm not a violent person, but anger, disgust. >> reporter: yeah, this case has obviously stirred extreme passions in a lot of people on both sides. you have people that are calling for the recall of the judge. there's going to be a protest to that effect later this morning around 10:00. across the street from the main jail behind our camera position and off to my left is a parking structure across the street. it's across the street from the main hall of justice here in san jose. that's where the protest to recall judge persky is going to be held around 10:00. this is a case not ended here. brock turner headed back to ohio where he will have to report to a probation officer in the next 48 hours and register as a sex offender. there will be protests at his home in ohio. we'll be obviously keeping an eye on that. we'll update you again in the next 30 to 60 minutes jail, the sheriff said she was disappointed he was sentenced to a county jail instead of state prison but said his release was handled just like any other inmate. >> no special favors. they walk out like everyone else does, and no back door anything. it's just our policy. >> now, also this morning, sheriff smith says she reports new legislation that's right now waiting for the governor's signature. the legislation would make prison sentences mandatory for anyone convicted of sexually assaulting an intoxicated and unconscious person. and as we showed you earlier, brock turner is still in the bay area. his exact destination right now, we don't know. however, he's expected to return to his family home in ohio. that's where he'll spend the next three years on probation. now, he'll need to meet with the probation department within 48 hours of his release this morning. he also needs to register as a sex offender. brock turner will have to complete a sex offender treatment program. and as part of that program, he'll be required to take polygraph lie detector tests. he's not allowed to drink alcohol or go to clubs or bars and he'll have to provide authorities with blood and dna samples. he'll be required to pay about a thousand dollars in court fees and fines. now, the sheriff of green county, ohio, says the former stanford student will not get any special treatment when he registers as a sex offender in ohio. green county sheriff gene fisher released this statement. we're not treating him with kid gloves. we're going to treat him like every other sex offender that comes through the doors. >> let's bring you video from just outside the jail where brock turner was released. later this morning a group of demonstrators says it will peddle bicycle billboards around the jail in protest. they will be supporting an effort to remove the judge who sentenced brock turner to six months in jail. a handful of other protesters did show up to the jail very early this morning. >> very frustrated. it just doesn't seem, i don't understand how they could justify this. it doesn't make sense to me how he could do that to someone who's unconscious and go behind bars for three months. >> and as jesse gary has been reporting, protests are planned today in turner's hometown in ohio. >> as we have been telling you, the brock turner case has created a nationwide uproar, ever since a decision in south bay courtroom was handed down earlier this year. in march, the former stanford swimmer was found guilty of three counts of sexual assault for an attack on an unconscious woman on the campus in january 2013. he was sentenced to six months in jail. prosecutors wanted six years in jail. turner's sentence was cut in half for good behavior. lawmakers from california to the nation's capitol, then went public with their outrage. in sacramento a group of female state senators read aloud the emotional letter written by the victim in the stanford sexual assault case. in that 12-page letter, the anonymous victim described how the crime has taken a physical, emotional, and psychological toll on her. a similar scene to this one in sacramento was played out in washington, d.c., on the floor of congress. now, we will have continuing coverage of brock turner's release throughout the morning for you including another live report coming up at 7:30. time only patchy right now. temperatures look to be a little bit below average, right where they should be inland. today we'll top it out on temps and start a cooling trend, especially away from the coast, even out to the valley, as we head in. systems going to dig into the northern part of the state late saturday into sunday. 50s on many temps. a couple isolated 60s. there's some very cool readings here, and most locations are running 1 to 5 degrees cooler than they were 24 hours ago. santa rosa is down five. if you are heading through the sierra northeast california, bernie basin, be advised there's going to be a pretty decent breeze and some very cool conditions. isolated showers are possible in the northeast part of the state. end result for us, 60s today, 70s and some 80s but it does look like a cooler weekend for all. exactly, anything -- all right, sal, anything new? it is light. definitely not an unusual day, as we take a live look at these pictures, we normally see very crowded. you look at the bay bridge and did looks like a sunday morning here. a lot of people have already left town for the long weekend or are not going to work and plan to be on the road later trying to get out of the bay area. and traditionally on the friday before labor day, we have a heavy commute, if you can call it that, leaving the bay area after noon. this is a look at 880 north and southbound. the traffic is moving well, so just because it is light this morning, if you happen to take your car into the city or into a commute center, you'll probably see slow traffic coming back. i drew an arrow on the san mateo bridge because on the dumbarton bridge, i like that as an alternate to the san mateo bridge. there was debris on westbound 92, and the high-rise, and that's why traffic has been very slow on 92. it's easy to get around it today since the other bridges are doing very well. don't take the san mateo bridge unless you absolutely have to because there's a lot of slow traffic on that bridge. 7:08. let's go back to the desk. there is another big story. 49ers quarterback colin kaepernick still refusing to stand during the national anthem. >> there's a new twist, christien kafton is in the studio. >> colin kaepernick took a knee during the national anthem, and was joined by a team member and player. eric reed and kaepernick both kneeled during the performance of the star spangled banner. you can see colin kaepernick taking a knee. eric was harder to see, in street closed and partially blocked from view. his message about social justice was getting lost in the public criticism that he was receiving, some saying he was disrespecting the military. kaepernick says he does respect the military and respects veterans but still needs to make a statement about what he sees as ongoing injustice in america. >> as far as taking a knee tonight, eric as well as myself had a long conversation with nate boyar who is a military vet, and we were talking to him about how can we get the message back on track. and not take away from the military. >> kaepernick also saying he plans on donating a million dollars to community organizations this year to help make a change for the better, and he says he is considering taking up the san francisco police department offer to come visit the academy to see the training that officers receive for himself. now we also received or he received some unexpected support from seattle seahawks corner back, jeremy lane who stayed seated before the seahawks victory over the raiders in oakland last night. lane said he did it mostly to show support for kaepernick. he will continue to sit for the national anthem until he feels justice is served. at home, there was a mixed response to kaepernick and other players. many said they supported their right to make a statement, and some said there is a time and place for political statements but they thought during the national anthem at an nfl game is not necessarily the right time or the right place. this is still an ongoing controversy and expected with more details to come, right, because the 489ers are going -- 49ers are going to be playing monday night football. we talked about that in a couple of weeks december 12th. so the big question is will kaepernick be there. will he take a knee. how is this going to proceed. will this spread to more nfl football players. >> thank you. kaepernick was booed by charger fans throughout the game last night, but some 49ers fans gave him plenty of support. >> as kaepernick was going to the locker room after the game, he jail. 20-year-old victor rodriguez was released wednesday night. a court clerk apparently made an error in the paperwork. that mistake wasn't discovered until yesterday morning. deputies say rodriguez is a gang member with a violent history, and he's accused of threatening police officers. uber has filed an $8 million building permit with the city of oakland to renovate its new headquarters. the ride share company plans to move into the old sears building in 19th and broadway. they bought the building last year but the city has to approve the building permit. you uber's headquarters are in san francisco. travel experts say there's no reason for high anxiety. for the most part, the labor day weekend is quieter than other big three-day weekends for travelers. more of a stay-at-home holiday. sfo expects 545,000 passengers to fly in and out of the airport from today through monday. aaa isn't giving any travel projections but says gasoline prices are a lot lower than in recently years and a lot of people are expected to hit the road. i have family leaving for tahoe at 3:00 this afternoon. sal, i thought of you as i tried to talk them out of it. >> everyone else has the same -- also a big system, a whopper, hurricane hermine, the first hurricane to hit florida since wilma back in 2005. that's a long time. you always think florida gets slammed, that's not the case. they went over a decade without a hurricane, not tropical storm, hurricane. it's now moving into the carolinas on its way. torrential rain, tornado a are out and it's -- tornado warnings are out, and be advised the track takes it close there. it will weaken now that it's over land. a little bit of fog here, but a lot of fog on the central coast. 50s, 40s, on some of the temps a few isolated 60s. most locations are running cooler by 1 to 5 degrees. santa rosa is down 5. petaluma 50. napa was 49. kelseyville, 50 degrees. 53 up in ukiah. if you are heading to the mountains it will be cool, windy at times, especially as we head towards late saturday into sunday. could be a few showers up in northeast california, but not here. for us, we get an increase in the fog tomorrow, but there's our system, which is going to give us a pretty good cool down over the weekend. 60s, coast and bay. 70s and then 80s through the interior but the 80s go good- bye tomorrow. upper 70s at best probably for many on saturday and sunday. a little warmer on monday. >> okay. thank you. >> you're welcome. time is 7:19. new from overnight, hurricane hermine made landfall in florida as steve told you. it's getting weaker as it moves over georgia. this is new video, flooding in pasco county, right in the path of the storm. florida's governor said a homeless man died this morning. a tree fell on him as the hurricane moved across the state. this is the first hurricane to directly hit florida in more than ten years, and several other states are affected as well. in georgia, tens of thousands of people have no power because of the storm. some in florida did evacuate before the storm hit. others decided to stay and ride it out. >> we usually have sand bags and everything to make sure we're prepared for it. but, i mean it came through the walls. there's no way to prepare for that such storm surge coming in. >> the hurricane hermine weakened to a tropical storm as it moved inland. it's expected to get weaker as it moves toward the carolinas. there are also worries this morning a tropical storm could have a bad effect on the efforts to fight the zika virus in florida. when the flood waters recede, that could create some new breeding sites for mosquitoes, just what they don't need. this comes as three of the insects collected from a trap in miami beach tested positive for zika. it's the first time the virus has been detected in mosquitoes in the continental u.s. scientists have already identified 47 cases of locally transmitted zika in miami decade county. -- miami-dade county. it is most dangerous for pregnant women because it can cause severe birth defects. >> as we have been reporting and showing you, brock turner was just released from jail this morning. we'll have another live report from the jailhouse as well as more on legislation inspired by this case that could change the punishment for sex offenders. but first, linked to as many as 200 burglaries here in the bay area, the arrest made after a yearlong investigation. persky time is 7:23. we are following developments out of dallas. the dallas police chief received high praise on the way he handled a deadly ambush on five officers. now he says he's ready to retire. chief david brown was in the spotlight overseeing the response to the july 7th july 7th sniper attack that killed five officers. he says he has decided to retire after 33 years with the dallas police department. six of those years with police. he plans to step down on his 56 56th birthday next month. the gunman accused in a deadly shooting rampage three years ago has agreed to plead guilty. prosecutors say 28-year-old paul ceansia shot and killed a tsa and injuring two others. he agreed to plead guilty to murder and other charges. this plea agreement means prosecutors won't seek the death penalty against him. seven men are in jail accused of being involved in 200 burglaries in san jose. part of operation cruise control. police say the men are tied to an east palo alto street gang. police say the crimes are similar. >> during the commission of these burglaries, they are using high end vehicles, such as porsches, bmws, mercedes, and items stolen are cash, jewelry, firearms. >> the officers say they are searching for these two suspects as part of the investigation. fighting a security guard and restrained inside a police car in florida. coming up next, more information in the latest trouble for a woman at the center of a sex scandal involving bay area law enforcement. and brock turner, here he is, released from jail this morning after serving three months for a sexual assault conviction. we just found out he's now at a palo palo alto hotel. we'll have more. today's commute seems lighter turner. the man just released from jail earlier this morning. these pictures of brock turner come after his release. our photographer caught up with brock turner here and his parents, this is happening as the three are walking into a hotel in palo alto. you can see jesse gary there asking questions. no one appears to respond. he is with his mother and father. brock turner in the center keeping his head down, not making eye contact. you see it here live. after serving three months in the county jail for sexually assaulting an unconscious, intoxicated woman outside a stanford party on the stanford campus. he's expected to head to his ohio home. in this case, he also walked quickly past reporters, did not say a word. some people were shouting things. i heard one person shout, what do you want to say to your victim, no comment from brock turner here at the jail or at the hotel where we caught up with him. at this point we're going to be bringing in a reporter in a few minutes who covers his hometown. that is where he's expected to serve out his probation. this is the big story of the day. i'm gasia mikaelian. >> and good morning, i'm dave clark, we are also following your weather. >> cool this morning, thank you, we do have mostly clear skies. fog is patchy at best, and most is down on the central coast. pretty quiet here, but the breeze will pick up over the weekend. might be some areas by tonight starting to show some, but i think more so late saturday into sunday. the fog, though is a lot of dryer air came in. it's been pushed to the south. there's patchy fog. nothing like we saw yesterday. a lot of 50s and even a lot of 40s this morning. there were cool readings starting to bounce off lows. 52, 53, 54 san ramon. 52 black hawk. so a little cool here. mostly sunny, the fog will retreat moving into the north, will usher in a rather interesting and cool taste of fall and don't be surprised by a few showers. especially up northeast, bernie basin northward, and probably a cool windy pattern in the sierra and tahoe, up in shasta, and that's what i'm trying to think of, 60s, 70s and 80s. cooler over the weekend. sal, i guess you could have your feet up on the desk if you wanted. it's been that quiet. >> it has been but now there are a couple of things that have popped up. just a little bit fast on calling it a day. we have heavy traffic, a stalled truck on the connector ramp from westbound 80 to southbound 880. that is right in the mcarthur maze. you can see all the traffic this is creating here coming down to the maze. a truck is at the maze but this is all the traffic we have getting down because of that stalled truck, and all it takes is one incident to make it very slow. all of a sudden, what had been a light commute is no longer a light commute, but since people aren't getting to the bay bridge, let's go to the bay bridge now. you can see it is light as you come up to the toll plaza. no major problems. that stalled before the bay bridge. the truck is at the maze. as a matter of fact, we're going to find it and show it to you coming up. let's move along and take a look at, well, let's take a look at the rest of the commute around the bay. highway 4 is slow still this morning coming through bay point. 680's not bad, and no major problems on 682, san ramon into the dublin area. one last thing, san mateo bridge, you want to avoid that. still very busy on the bridge getting to the peninsula. dumbarton bridge a good alternate. now back to dave. we want to update this morning's breaking news out of san jose. 21-year-old brock turner was released from the santa clara jail 90 minutes ago. the former sanford swimmer walked out of jail a few minutes after 6:00 this morning. he served three months of a six month sentence for sexually assaulting an unconscious woman on the stanford campus. county sheriff laurie smith talked about his release with ktvu and dozens of reporters around the country who gathered outside the jail. >> we want to make sure he's treated exactly the same way as anyone else is. certainly we have a lot of people here this morning, and we need to make sure the public is safe, but this is how everyone comes out, and there's no special treatment. >> brock turner will be serving out his probation in green county, ohio. that's where his parents live. >> law enforcement there say turner will not get any special treatment. joining us now by way of skype this morning, will garby. you're a writer for the dayton, ohio, daily news. you talked to us earlier. thank you for coming back. it's good to see you. >> my pleasure, good morning. >> what's the reaction. you saw him walk out. what's the reaction and what do you think the reaction of others is back there to brock turner getting out of jail. >> it's a wait and see at this moment. ktvu viewers saw the exclusive footage you had of him walking into the hotel. certainly he has five days to make it back here, and at that time, he will need to register as a sex offender with the green county sheriff. he will also need to register with the state of ohio's probation officers and when he does so, certainly that will be all public information. >> we see in these pictures as you do. brock turner has sunglasses on. he's wearing a gray hoody, it seems as if he wants to disappear in a sense. how likely is it that that can happen in his hometown of ohio. >> well, certainly among his neighbors, i mean, they will have of course, by law, tier three sex offender, they will have his name, photograph, sent to his house. to that extent, i'm sure his neighbors will know he's there, and you know, dayton, ohio, is a bit of a smaller place. people around here would certainly i imagine know who he is. but, you know, that's yet to be seen of course. once he gets back we might know a little more. >> now, are you expecting a media swarm around him when he gets back there? i know dayton, ohio. it is a smaller community. do you expect the media to react in a muted way or swarm around him? >> you know, i think at the dayton daily news, one of the things we have tried to do here is simply uphold the values of journalism that are, you know, standard. we certainly want to hype this more than it needs to be but we have focused on the facts of this. we recognize that in the state of california, the legislature there has taken actions to change some of the laws that now sits on the governor's desk. we recognize that this is a major issue, and we are covering it in a way that is respectful of such. >> have there been any changes specifically on college campuses there in ohio. stanford took the step to ban hard alcohol from campus. anything similar happening there in your community. >> you know, kind of concurrent with brock turner's year leading up to his trial, the dayton daily news, my colleague at the dayton daily news worked in investigation of ohio campuses. we haven't had anything like at stanford where they banned alcohol, but one of the things in our investigation that we learned was really that the thing of brock turner's trial, it wasn't his sentence that was unique. it was the fact that he was convicted at all. and we recognize that there are a number of reports in schools across ohio of sexual assault and nothing really ever happens with those reports. >> and yet so much attention on this one case. will garby of the dayton daily news. thank you again this morning. >> my pleasure, thank you for having me. santa clara county sheriff laurie smith told us the state should adopt a new law including the sentences of sex crimes. governor brown is considering a bill passed by the legislature earlier this week about prison sentences. it would create mandatory prison terms for people convicted of sex offenses where the victim was unconscious. sheriff smith made a point to talk to reporters outside the jail this morning in support of that legislation. >> i think that it should have been a state prison sentence. but that's why we're moving so quickly on getting the law changed and urging governor brown to sign the legislation that's on his desk now. >> governor brown has until september 30th to make a decision on the bill. he hasn't said whether he'll sign it or not. critics of the legislation say the decision on whether to put sex offenders in prison should be determined based on the threat that they pose to society. we'll continue tour coverage of brock turner and -- continue our coverage of brock turner and his release throughout the morning including another live report at 8:00. a woman at the center of a sex scandal involving several bay area law enforcement agencies was arrested in florida. the 19-year-old goes by the name celeste guap traveled there to enter rehabilitation for substance. the sheriff's office in martin county, florida, says guap was arrested monday, accused of assaulting a staff member at the rehabilitation facility. according to the police report, she tried to pull down a large safe and bit a security guard on the arm. the report also says guap had to be restrained in the back of a patrol car because she was beating her head against the window. she claims to have had sex with at least 30 bay area law enforcement officers and said some of the encounters happened before she turned 18. time is 7:38. last night the city of oakland held the first of ten community meetings getting public input on selecting a new police chief. the meeting at castle month high school focused on young people in oakland. a small group of teenagers, showed up talking about their concerns and what they want to see in the next police chief. >> but he shouldn't have fear, you know, you don't take the job just because of the pay. you got to want to really see change. don't be afraid to come and get your hands dirty. >> make sure they keep the streets more safe and make it safe so we can walk home. it's hard to walk home without getting robbed or something. >> now, the next community meeting, september 10th will be at mccliman's high school. the police commission says eleven applicants are current or former members of the police department. the application deadline was wednesday. the commission will now examine input from the community meetings that were held throughout the city as well as an online survey. they'll pick the top three candidates, then mayor ed lee will select the next chief from the list. 250 police officers in san francisco are now equipped with body cameras. the department started distributing the cameras last month. officers at the bay view and engelside stations are the first to be outfitted with the cameras. sfpd says it hopes all officers will be wearing body cameras by the end of the year: there's another chapter in the colin kaepernick national anthem controversy. coming up in 20 minutes, what he said after kneeling during the national anthem last night during the game and the they felt misled after trump's speech on immigration. many were hopeful after meeting with trump last month that he would tone down his wording on deporting otherwise law-abiding undocumented immigrants. one analyst says she expects at least half of the advisory council members to quit. those who have stepped down include a texas attorney who had earlier written an op-ed article explaining why latinos, should support trump. >> when i saw that he had abandoned his republican principles and adopted populous propaganda, i said this is it. this man is not doing what he said and he's acting like he doesn't even want to win. >> in a speech in phoenix on wednesday night, you'll remember trump said if elected president there would be no amnesty for people living in the u.s. illegally, and said they would have to leave the u.s. and then apply to return. hillary clinton's vice presidential running mate tim kaine wasted no time slamming trump. he said it's not the first time that has been given in the history of this country. hasn't done anything good for the country. >> senator kaine said trump choked when he couldn't look mexico's president in the eye and tell him he would ask mexico to pay to build a border wall with the u.s. yesterday's explosion of the unmanned spacex rocket at cape canaveral is a big set back for two billionaires with bay area ties. spacex chief executive, elon musk and mark zuckerberg. that rocket was scheduled to launch tomorrow carrying a satellite that zuckerberg was hoping to use to bring internet to remote parts of africa. zuckerberg is currently in florida. he wrote on his facebook page he was deeply disappointed his satellite was destroyed, as you see in the explosion, it is still not clear why that rocket exploded. time is 7:45. jetblue is investigating how two 5-year-old boys flying alone from the dominican republic were flown to the wrong cities. marybel martinez said her son andy was supposed to be on the flight to new york's jfk airport. when she went to pick him up, she was given the wrong little boy. it turns out her son was in boston. that's where the boy who ended up in new york was supposed to be. >> for three hours she believes her son may be kidnapped. she doesn't know where she is. jetblue has not communicated with her. she gets a call that the boy is in boston, and they put the boy on the phone with her, and she speaks with him. >> jetblue apologized to both families for the mixup, and also says they're investigating the incident to make sure it does not happen again. and by the way, it's an extra 100-dollar fee to have a jet blue representative escort children onto a plane. i have done that before. >> right. i think there was a movie, unaccompanied minors. they're supposed to be watching the child as that happens, part of the fee i'm assuming. let's go to south -- sal castaneda. >> you told me someone was trying to get away, had the idea of leaving this afternoon at 3:00. i wouldn't advise it, you know, if you go with the right attitude, though, it could be fun, but you are going to see a lot of traffic out there. >> i tried to tell them, sal. you know how the little brothers are. >> they might go out there with the right attitude saying, hey you're going to see a lot of traffic. that's fine. and 80 at the mcarthur maze, an earlier stalled truck. they cleared the truck and the traffic is beginning to recover. the traffic time got up to almost 40 minutes. now that the truck is gone, things should recover. again, it's a lighter volume today. we are talking about leaving the bay area this afternoon. a lot of people are going to be doing that, trying to get up to wherever they're going on the labor day holiday, and you're going to see a lot of crowds. a lot of people will be on interstate 80 and 580. let's move to the toll plaza. it has been light there, no major problems getting into san francisco. we are looking at contra costa county. you can see traffic here looks good. if we go to the maps, traffic on highway 4 is going to be okay. there have been no major issues on 680 as you drive through. silicon valley commute is here and there, a little bit of welcome back to mornings on 2. the monthly jobs report came in just two hours ago. it is not what wall street expected. pam cook back in the studio with this morning's money business. >> definitely a bit of a surprise this morning. pretty disappointing in terms of jobs, but stocks are gaining ground on the news. i'll explain why when i take a look at the opening bell. rang just about two hours ago, hour and a half ago, actually. and right from the get go, the numbers headed straight up. we want to take a look at the numbers right now. a live look at the dow jones shows it is up almost 100 points. about a 1/2 percent. that's exactly the same percentage for the nasdaq and the s&p 500. both up a little more than a 1/2 percent each for those indexes. now, the latest monthly jobs report was released this morning right at 5:30. it is disappointing wall street. economists were expecting 180,000 jobs added for the month of august. but the labor department reports 151,000 jobs last month. the unemployment rate held steady at 4.9% for a third straight month. wall street expected it to drop a little bit. now, the slow down in job growth means it is less likely that the federal reserve will raise interest rates when it meets later this month, and that is why wall street is up, looking for signs about interest rates hikes is what they were looking for this morning. samsung recalling its new smart phone after reports of the phones catching fire while charging. samsung just released the galaxy note 7 a month ago but the company issued the voluntary recall because of the fire danger. samsung traced the problem to an issue with the phone's lithium battery. it will replace all 2 1/2 million of the phones. there have been 35 reported cases of exploding or burning batteries worldwide. and just to let you know, the oakland a's are honoring breast cancer survivors in raising money for the american cancer society at their game sunday afternoon against the red sox, and they are handing out these wristbands, so wanted to let you know. i know dave and i were talking about it earlier today, but sunday, 1:05 game against the red sox. a lot of red sox fans out there. >> it's a good looking wristband, too. >> i'll leave it on your desk. >> thank you. 7:56, san francisco teachers will no longer be protected from being evicted during the school year after a superior court struck down the city ordinance that was approved unanimously by the board of supervisors in may. the court ruled the ordinance puts limits on when landlords can evict a tenant and that conflicts with state law. the city attorney's office says it's disappointed, reviewing the judge's order to determine a possible next step. california's new law requiring all students to be vaccinated before they go to school doesn't only apply to school children. it also requires that early childhood educators get vaccinated, regardless of their personal or religious beliefs. we have learned that in the san francisco school district, a number of teachers who have not complied are being suspended without pay. california joins mississippi and west virginia as the only states that require a medical exemption to get around being vaccinated. one teacher we talked to says for her the vaccination requirement may mean her teaching career is over. >> it's a personal and philosophical choice i'm making. i really don't believe in the injection of pharmaceutical concoctions into my body. >> now, the san francisco school district says on monday 40 staff members did not produce vaccination welcome back to mornings on 2. it is friday september 2nd. i'm mike mibach. >> i'm gasia mikaelian. more breaking news about brock turner. we caught up with brock turner, his mother and his father a short time ago after he got out of jail. >> anything to say, brock? >> anything you want to say at all? >> the voice you're hearing is that of ktvu photographer, tony trying to get a statement from brock turner and his family. >> they went from the santa clara jail to a hotel in the peninsula, and as you can see and hear, the turners refused comment. they are expected eventually to return to their home in the state of ohio. this case has sparked a national fire storm, and it is coming to a head this morning. we are live for you outside the county jail there in santa clara county where turner was released just a couple minutes after 6:00 serving three months of his six month sentence. >> you saw that happen live on mornings on 2. brock turner walked right past reporters and into a waiting white suv. protests are planned in the next few hours against brock turner as well as the judge who handed down that sentence. now, we do have reporters on a number of aspects of the story for you this morning. >> alex savidge is at the courthouse where a protest is scheduled during the hour. we begin our team coverage with ktvu's jesse gary at the jail in san jose. >> reporter: the official release time for brock turner was at 6:07 this morning. he walked out of the front door, the main door of the main jail just behind me and into an suv. let's go ahead and take a look at the video that we had. we had cameras on both angles. and it happened very quickly. 6:07, walked straight down the front steps, not press us through the front steps but downstairs, came upstairs, walked out into the waiting suv. i asked him if he was sorry for what he had done. no reply. got into the suv, one protester screamed that he was a loser as the suv was pulling off. i talked to one woman who is a san jose resident, felt compelled to come out early this morning and just watch brock turner leave jail. what did you think, i mean, you're watching him walk by, what's going through your mind as he walks out? >> i wanted to hurt him. i'm not a violent person, but anger, disgust. >> reporter: and after brock turner pulled away from the main jail here in san jose, that suv got on 101 northbound and then went up the peninsula, and we have learned that it has since stopped at a hotel, and he has checked into a hotel in the bay area where he's going to stay at least for some time before heading back to the family home in ohio. he has to check in with a probation department within 48 hours, and he also has to register as a sex offender. coming back live, i want to show you in a couple of hours, there's a protest scheduled across the street. that's directly in front of the hall of justice. kind of kitty corner here to the jail. there's going to be a protest there. that is to bring attention to the effort to remove judge aaron persky from the bench. persky is the one who sentenced brock turner to just six months in jail. a lot of people saying it's a light sentence. brock turner served three months of the six-month sentence because of jail overcrowding and because of jail behavior. that is not abnormal. that is generally what happens when you get sentenced. you generally serve about half your sentence. if you get a two-year sentence, you generally serve one year. in this case, six months down to three months, guys. >> for as much talk as the sheriff did about security and controlling the situation, this morning appears to have gone exactly as it was planned. >> reporter: that's exactly right. and i talked to sheriff laurie smith about that, about the amount of deputies that they had outside. they had plenty outside. she said a total of about 150 inside the jail and outside because this all happened during what she said was shift change. there were plenty of deputies, deputies outside. the only hint of something not going according to plan is when brock turner was about to get into that white suv, one protester went around the barricades that are out front and yelled at him and called him a loser. there were deputies quickly there to make sure she did not make contact with brock turner and he was allowed to leave the jail, and the jail grounds, get into the suv, and then speed off. and people ask, why is that the case. that is standard procedure for any inmate who is released here. the sheriff's deputies are required to protect their well being, their safety until they are off jail property. that's why they had the barricades and the deputies here keeping people back, and allowing brock turner free access to leave the front door down the steps and into the suv. >> great coverage for us this morning. jesse, thank you, live in san jose. moments after we saw brock turner be released from jail, we heard from the santa clara county jail. laurie smith said she was disappointed he was sentenced to county jail instead of federal prison. >> no special affairs. they walk out like everyone else. that's just our policy. >> this morning, sheriff smith said she supports new legislation that's currently awaiting governor brown's signature. that legislation would make prison sentences mandatory for anyone convicted of sexually assaulting an intoxicated and unconscious person. we know brock turner is in the bay area. we showed you pictures of him in a hotel. we do expect him soon to go back to ohio. once in ohio, that's where he'll have to register as a sex offender and spend the next three years on probation. the sheriff of green county, ohio, says the former stanford student won't be getting any special treatment there. released this statement saying quote we're not treating him with kid gloves. we're going to treat him like every other sex offender that comes through the doors. turner will likely be heading back to ohio very soon since he does need to meet with the probation department in the next 48 hours. he'll register as a sex offender and complete a treatment program. as part of the program he'll be required to take random polygraph tests. he'll not be allowed to drink alcohol or go to bars or clubs, and will need to provide authorities are blood and dna samples. turner will be required to pay about $1000 in court fees and fines. >> it has created a nationwide uproar ever since the sentence was handed down in a south bay courtroom earlier this year. in march, the former stanford swimmer was found guilty of three counts of sexual assault for an attack on an unconscious woman on campus in january. he was sentenced to six months in jail. prosecutors asked for six years. turner's sentence was cut in half for good behavior. lawmakers from california and to the nation's capitol then went public with their outrage. in sacramento a group of female state senators read aloud the letter. the victim described how the crime has taken a physical, emotional and psychological toll on her. a similar scene to this one in sacramento was played out in washington, d.c. on the floor of congress. we crash still blocking the two left lanes on 80 westbound, as you come up to ashby avenue. they put a motorcyclists down on the ground into a medic vehicle and that medic took off. we have the fire department blocking the two left lanes here, and traffic is very slow coming down from the carcinas bridge. this commute now is ruined. it's almost taking an hour to get to this point as you can see because of the crash west 88 ashby, and again, they're still blocking those two left lanes, and the traffic is just going to be a huge mess. i see them riding the motorcycle. they're going to put that on the tow truck. hopefully they're in the last stages and they can open the lanes any moment. let's go to the bay bridge now. i'll show you the bay bridge is light. a lot of people are not getting through this morning's volume at the bay bridge toll plaza. and we are looking at other commutes, highway 4 is still slow. 680 looks good from danville to san ramon. dumbarton, and san mateo bridge, developing story this morning, 49ers quarterback, colin kaepernick still not standing during the national anthem. >> right, last night, though, instead of sitting down, colin kaepernick took a knee along with a teammate. christien kafton is joining us with the story. >> as you said, colin kaepernick taking a knee during the national anthem, and now it seems others are following in his foot steps with protests of their own. kaepernick and teammate eric reed both took a knee during the performance of the star spangled banner. you can see kaepernick. eric reed a little harder to see. he was in street clothes and partially blocked from view. kaepernick said he talked the idea through with reed, and nate boyd, a teammate and veteran to make sure their message was focused on social justice while still trying to respect the military. >> the dream result would be equality. you know, justice for everybody. this is really something about human rights. it's about the people. this isn't about anything other than that, and some people aren't given the same rights, aren't given the same opportunities as others, and that's really what the issue is. >> kaepernick also putting his money where his mouth is, so to speak. he says he's planning on donating a million dollars to community organizations this year to help make a change for the better, and says he is considering taking up the san francisco police department on their invitation to visit the academy and see the training that officers receive for himself. kaepernick also received some unexpected support from seattle seahawks corner back jeremy lane who stayed seated during the national anthem before the seahawks 23-21 victory over the raiders in oakland. lane said he did it mostly to show support for kaepernick. he says he'll continue to sit for the national anthem until he believes justice is being served. and closer to home, there was a mixed response to kaepernick and other players refusing to stand. many said they supported their right to make a statement, and some said there's a time and a place for political statements and that time and place is not knowsly during the national an -- necessarily during the national anthem at an nfl game. we have seen two players taking similar action. nfl football kicks off in a couple days. the season kicks off. >> regular season. >> and the 9ers have their monday night start on the 12th 12th. so it will be interesting to see what kaepernick does on monday night football as well with the platform that it is. >> if he is there. though based on the performance of quarterbacks last night, it appears he would be on the team unless the organization wants to wipe its hands of colin kaepernick. >> if he's there, monday night football, you can't get a much bigger paperwork error that has the sheriff's office searching for a man with a violent history. flooding homes we have new video of the damage happening in florida caused by hurricane hermine. this is the friday in september. mostly clear unless you're down by santa cruz and monterey. the cool temps will pick up as the system drops in from the north. new from overnight, hurricane hermine made landfall in florida. it's getting weaker as it moves over to the state of georgia. florida's governor said a homeless man died this morning when a tree fell on him as the hurricane moved across the state. this is the first hurricane to directly hit florida in more than a decade and several other states are affected as well this morning. in georgia, tens of thousands of people have no power because of that storm. some in florida evacuated before the storm hit. others decided to stay and ride out. >> we have sand bags to make sure we are prepared for it. it came through the walls. there's no way to prepare for that much storm surge coming in. hurricane hermine weakened to a tropical storm as it moves end land. the storm -- inland. the storm is expected to get weaker as moves to the carolinas. there are worries it could have an adverse effect on efforts to fight the zika virus. when flood waters recede, that could create breeding sites for mosquitoes. this comes as three insects collected from a trap in miami beach tested pose for zika. it's the first time the virus has been detected in mosquitoes in the continental u.s. scientists have identified 47 cases of locally transmitted zika in miami-dade county. the disease is most dangerous for pregnant women because it can cause severe birth defects. some oakland residents are hoping to get their message across by dumping trash on the steps of city hall. they say oakland allows illegally dumped trash to sit uncollected in their neighborhoods for days at a time. the citizen group picked up trash in east oakland yesterday and brought that trash to city hall. the group says there aren't enough city crews to handle the illegally dumped trash, and they say police need to step in. >> the system is broken. it's not enough people working to deal with all this trash. usually we're the last ones they come to to pick up. >> i can tell you whose trash it is, but the city of oakland does not enforce it like we should. >> council member knoll guya says starting next year waste management has agreed to make 25 pickups for illegal dumping every day, and the city is looking at surveillance cameras, hoping to catch the illegal dumpers in the act. let's bring in sal castaneda right now, and not friday light for everyone out there. >> not quite. the east shore freeway is a mess. we had a couple of different crashes and stalled vehicles. they have moved the crash over to the side. the damage is done. it is very slow, taking a while to get from richmond into berkeley. and really it's going to take a while for this to unwind. later in the day on the other side of the freeway, you're expecting traffic to go eastbound 80 heading up toward the carcinas bridge as this is get away day for a lot of people. you're going to start seeing traffic, in fact you might start seeing the traffic heading out now believe it or not. let's move to the bay bridge toll plaza. it's not your typical commute day, though. we don't have a commute at the toll plaza so to speak coming into san francisco. dumbarton, san mateo bridge traffic is moderate. there's a little bit of slowing on 92 heading west out of hayward. at 8:20, let's go after sitting down with mexico's president, donald trump is doing damage control hoping to win back latino supporters. hillary clinton has new e- mail revelations. a bizarre twist in this story. disgraced subway pitchman jared fogle is suing the parents of one of the victims. time is 8:24. new this morning, gunmen wearing suicide vests attacked a christian neighborhood in pakistan today. the attack led to a shoot out between the militants and shooting forces. four attackers and one civilian were killed. a faction of the taliban in pakistan has claimed responsibility for the attack. much closer to home, the gunman accused in a deadly shooting rampage at lax three years ago has agreed to plead guilty. paul ciancia shot and killed a tsa airport screener and is accused of injuring three others, including two other tsa agents and a high school teacher. ciancia agreed to plead guilty to murder and other felony charges. this plea agreement means prosecutors won't seek the death penalty against him. the former pitchman for subway is taking legal action. jared fogle is suing the parents of one of his victims. last year fogle was sentenced to nearly 16 years in prison for having sex with minors. his lawsuit claims that the emotional distress suffered by one of his victims was caused by her parents and not him. fogle secretly video taped her undressing. he now claims that her parents abused alcohol and drugs in front of her. the girl's family sued fogle earlier this year for $150,000 related to his crimes. a man who played at cal football for nearly 50 years is now suing the ncaa and the pack 12 conference for concussion related injuries. neville hawkins played line backer at cal in 1970 and 71. the suit accused college football of failing to protect its athletes. he claims when he suffered a hit, that could have caused a concussion or brain injury, the coaches sent him back into the game without medical treatment. he blames his severe headaches and dementia on the concussions he suffered as a player. neither the school or conference are commenting about the lawsuit. oakland is starting to hold a series of community meetings to get input on the selection of a new police chief. >> make sure they keep the streets more safe. make it safe so we can walk home. >> coming up, the group that last night's meeting focused on, and why one city official is worried about the selection process. plus convicted sex offender, brock turner walked out of jail early this morning a free man after serving three months for a sexual assault, but the judge in this case who who sentenced turner to six months in jail. there's been an ongoing recall effort to get judge aaron persky off the bench. >> alex savidge is live with more. any crowd yet. >> reporter: we aren't seeing too many people yet. we understand maybe some of the demonstrators have begun to arrive here. they are vowing to keep the pressure on the judge, aaron persky who handed down the six month sentence. brock turner served half of the sentence, and many people viewed the sentence as far too lenient. in the next hour and a half or so, there are going to be a series of demonstrations and rallies that are going to be happening here across the street from us here. this is right next to the main jail where brock turner walked free just a couple hours ago after serving just three months behind bars. now, among other things shortly in a half hour, protesters will begin riding around the courthouse on bicycles, carrying billboards that look similar to the ones you are seeing on your screen. this demonstration is being organized by the group, ultra ultraviolet, and they are pushing for the removal of judge persky who sentenced turner after he was convicted of sexually assaulting an unconscious woman. an official recall effort is underway right now, and already because of the outcry over this case, and the sentence, judge per ski has decided he will -- persky has decided he will no longer hear criminal cases, only civil cases. they believe he gave preferential treatment to a convicted sex offender. >> a light sentence that judge persky is responsible for, getting in the stanford law professor, michelle dobber, she is the woman who was heading up the judge persky recall effort, more than a million signatures have been collected in support of that effort. she'll be speaking at a rally here outside the courthouse, along with a number of other local lawmakers, including congressman eric swalwell, those series of protests set to get underway at 9:00 here in front of the hall of justice, right next to the main jail here in santa clara county where, again, brock turner served that three month sentence and walked out early this morning. we'll be covering all these demonstrations throughout mornings on 2. >> alex, nothing in the way of protesters yet, how about security, any officers there or just business as usual. >> reporter: a few sheriffs deputy vehicles parked across the street from us here. certainly that is probably what they're going to do is make sure that the crowd remains peaceful. they have no reason to believe the crowd will not be peaceful. whenever they have a crowd like this, they want to have deputies on hand to make sure everything remains under control. they did the same thing with turners release this morning. a lot of sheriffs deputies were on hand to make sure things remained civil. they will probably do the same thing for these demonstrations. we'll stand by here, and see how many people show up for this. the first demonstration, the folks on the bicycles with the billboards, riding around the courthouse, that's supposed to get underway in a half hour. >> thank you for the live report in san jose. brock turner will serve out his probation in green county, ohio where his parents live. law enforcement says turner will not receive special treatment. earlier this morning, we talked to a writer for the dayton daily news about what's next for turner. >> he has five days to make it back here, and at that time he will need to register as a sex offender with the green county sheriff, and he will also need to register with the state of ohio's probation officers and and when he does so, certainly that will be all public information. >> protests are also planned today in turner's hometown there in ohio. >> now, this brock turner could lead to a new state law here in california. governor jerry brown concerning a bill passed by state lawmakers earlier this week that would change california's sentencing laws for felony sex offenders and it would create mandatory prison sentences for people convicted of sex offenses where the victim is unconscious. state senator jerry hill of san mateo one of the sponsors of the bill. >> the punishment would be either three and possibly six years in prison which is a major difference than three months in county jail. >> governor brown has until september 30th to make a decision on the bill. he has not said whether or not he intends to sign it. we have continuing coverage for you, brock turner's release coming up on the 9 and our ktvu mobile september feel to the air and to the weather as we head into sunday and monday. it's going to be a system dropping down and if you're heading up to i would say northeast california, the bernie basin, do not be surprised if you get shower activity on sunday morning. shasta last and probably not. areas of fog will probably be on the increase. breezy and cooler today. probably the best day over the next three, and it does look nicer as we head into monday. 50s, 60s on the temps. we did have 40s this morning but those are rebounding quick, though the nights are longer and except for patchy fog had a couple of things, you want to focus on one in particular. we have looked at the east shore freeway. there was an earlier motorcycle accident in berkeley, that's clear, and traffic is recovering a little bit. it's a good thing that volume was lighter today. it's still taking about 40 minutes to drive from the carcinas bridge to the bay. the traffic continues to move along nicely on most of these commutes as you drive through the area. we're looking at the east bay where northbound 880 hasn't gotten the message. it's supposed to be a lighter than usual day. and 580 is slow as i push in here a little bit. 880 northbound, and 580 westbound are slowing into oakland. at 8:37. let's go back to the desk. the city of oakland held the first of ten community meetings to get public input on selecting a new police chief. last night's meeting at castlemont high school was focused on young people in oakland. a small group of teenagers and youth activistings showed up to talk about their concerns and what they want to see in their next police chief. >> you shouldn't have fear. don't take the job just because of the pay. you got to want to really see change. don't be afraid to come in anything -- a search is underway for 20- year-old victor rodriguez. he was released wednesday night after a court clerk reportedly made an error in the paperwork. the mistake, though, wasn't resigned saying they feel misled after trump's fiery speech on immigration in arizona. many of trump's latino supporters were hopeful after meeting trump last month that he would tone down his rhetoric on deporting otherwise law- abiding undocumented immigrants. now one republican analyst says she expects at least half of donald trump's hispanic advisory council to quit. those who have stepped down include a texas attorney who had earlier written an op-ed article explaining why latinos should vote for donald trump. >> when i saw that he abandoned his republican principles and adopted populous propaganda, i said this is it, he's not doing what he said, and he's acting like he doesn't even want to win. >> tomorrow, donald trump will continue his efforts to reach out to minority voters, going to make an appearance at an african-american church in detroit. meanwhile, hillary clinton is bracing for another round of scrutiny over her activities while she served as secretary of state. last night, the state department announced it will be releasing all of clinton's daily minute by minute schedules of her time in secretary of state. that could lead to questions about her state department activities and the clinton foundation. she will take part in labor day events in ohio and illinois on monday. president obama is heading to china this weekend for an economic summit there. yesterday the president was on the remote pacific island of mid way during a trip to hawaii. built to honor the sacrifices made by servicemen during world war ii. midway is at the heart of the marine national monument. making it the world's largest marine reserve. the president talked about preserving engaged ecosystems around the world and said climate change is having a big effect on the pacific ocean. >> it's also critically important for us to examine the effects of climate change are taking here in the pacific ocean. the world's largest body of water. and as i said yesterday, there are countries that now are at risk and they have to move as a consequence of climate change. >> president obama will be heading to china for the g20 summit where he'll try to strengthen support for the worldwide climate deal signed last year in paris. yesterday's explosion of the unmanned spacex rocket at cape canaveral in florida is a set back for two billionaires with bay area ties. elon musk and facebook founder, mark zuckerberg. the rocket was scheduled to launch tomorrow the costly explosion has reportedly created some tension between zuckerberg and musk who runs spacex as well as tesla motors. zuckerberg wrote on facebook he was deeply disappointed the satellite was destroyed. the cause of the explosion is not known. marybel martinez says her son andy was supposed to be on a flight to new york's jfk. when she went to pick him up, she was given the wrong boy. it turns out her son was in boston which is where the boy who ended up in new york was supposed to be. >> for three hours she believes her son may be kidnapped. she doesn't know where he is. jetblue has not communicated with her. she gets a call from jetblue that the boy is in boston, and they put the boy on the phone with her. and she speaks with him. >> jetblue has apologized to both families for the mixup. the airline says it's reviewing the incident to make sure it does not happen again. it's an extra 100 fee for a jetblue representative to escort children on a plane. 15 people and a dog were rescued when their fishing boat ran into trouble. sky fox over the scene. that boat hit rocks and started taking on water just about 5:00 last night. the boat was close to shore and the coast guard crew was able to help everyone make it to the beach safely. 8:45. it's been a hermine the first hurricane to hit florida, in october of 2005. it's been a long time. tropical storm now, but it's producing a lot of rain, georgia, carolina, it will probably feed off warm atlantic month. . time is 8:50. firefighters say a car parked in garage may have sparked a fire at a home in kentfield last night. >> get back guys. >> you see an awful lot of smoke and now flames rising. the marin county fire department tweeted out this video. started at 7:30 at a home on evergreen drive. fire crews were able to keep the fire contained in the garage, and no one was hurt. cal fire says a grass fire is 40% contained. started about 1:30 yesterday afternoon near oakland avenue. the fire burned 25 acres. cal fire says two helicopters and four air tankers were sent to help firefighters. no homes are threatened. no one has been hurt. san francisco teachers will no longer be protected from being evicted during the school year. that's after a superior court struck down a city ordinance that was approved unanimously by the board of supervisors in may. the court ruled the ordinance puts limits on when land lords can evict tenants and that conflicts with state law. the city attorneys office says it's disappointed appointed and is reviewing the judge's order to determine a next step. california law requires students to be vaccinated before going to school, and requires that early childhood educators get vaccinated regardless of personal and religious beliefs. we have learned that in the san francisco school district. a number of teachers who haven't complied with being suspended without pay. one teacher we spoke with says for her the vaccination requirement may mean that her teaching career is over. >> it's a personal and a philosophical choice that i'm making. i really don't believe in the injection of pharmaceutical concoctions into my body. >> the san francisco school district says on monday 40 staff members did not produce vaccination record and now more and more educators complying after outreach by teacher unions. cloud computing company is helping to improve education in computer sciences. they made the donation official yesterday. city leaders and school administrators were on hand for a big celebration at frik impact economy in east oakland. it will help the city reach the goal of tripling the number of students who graduate from college. >> we expect you to measure high school and to finish college. we are here to put our money where our mouths are and say we are going to provide you with the resources to do that. >> along with boosting computer science and math courses, that money will help pay for career fairs, college tours and job shadowing opportunities. sales force is also funding programs in san francisco schools. sales force employees themselves will volunteer 20,000 hours in bay area schools this school year. there are reports billionaire elon musk is having cash problems combining tesla and solar city into one company. a new filing showed they owe 422 million-dollars to bondholders. and solar city is going through cash at a fast pace, with $146 million on hand down from 489 million last year. financial analysts say musk is going to have to raise a lot of cash to keep the combined companies going. samsung has reports of the phone catching fire while charging. they started selling the phone last month. there have
