earlier accident kind of in the area of the san mateo bridge. but that's gone. you can see the traffic is still slow in the area on southbound 880 from about 238 and it gets better after you pass union city and that's because of the earlier issue. let's go back to the desk. we do have new developments on the police standoff in the south bay. milpitas police have been outside a gun store and shooting range since very early this morning. janine de la vega is out there as well. and janine, they are telling you the final suspect has been taken into custody? >> reporter: yes, it took a couple hours but yes, the fourth suspect is now in custody. he was found outside the building. and we understand police officers are searching the area to see if he dropped any firearms because this all stemmed from an attempted burglary inside a gun store right off milpitas boulevard. it's not far from the milpitas police department. i'm joined by lieutenant -- how did you get this fourth suspect in custody? >> the fourth suspect was seen fleeing from the scene south of the actual business. and he was running on the railway tracks. we asked for the surgery police department and the sheriff's office so send additional personnel to the location. >> did they use cogs? >> i believe he ended up giving up. >> reporter: it was around 2:00 inside the target masters gun store? >> one of my sergeants was leaving the building and heard an alarm sounding. and he went to investigate and saw a suspect get in a vehicle and start driving away. another stopped the vehicle on the north side of the loop. and two people were taken into custody. >> the third suspect came through the door and was listening to the commands. and it took us time to take him into custody. >> you were being really cautious. they had so much access to firearms. it was a pretty tense situation. >> lots of firearms and ammunition. so we have to make sure our personnel is safe and we do everything safely for a good ending to this. >> at no time were shots fired. >> i have to thank the san jose police and sheriff's office for their help. >> reporter: all four suspects are in custody. in the last 30 minutes we've seen the santa clara sheriff's deputies and san jose police and fire department all leave the scene. they are walking the railroad cracks, officers from milpitas, to wrap this up and see if they can find any firearms and make sure that they collect evidence. the managers of the gun store are waiting to talk to police. to their knowledge, the store had not been burglarized before. we'll bring you up to date in the next hour. time now is 6:05. and police in fremont trying to identify the torso of a woman found near the dumbarton bridge. the remains were found on sunday night. investigators returned to try to look for more evidence. they have not said if anything else was found out there. anyone with information is asked to call fremont police. the san francisco school board approved a controversial proposal that provides free condoms to middle school students. the people on both sides of the issue, they packed into the school board meeting last night. some of the parents found themselves at odds with other parents and teachers. after a long public comment session, the school board unanimously approved the condom plan. >> even though the state mandates minors' -- there's no -- >> i want to make sure that shows who are have the precautions, have the supplies that they need to stay safe and are able to talk to caring adults in their school. >> the condoms will already available at high schools. middle school students have to talk to a school nurse or a social worker in order to receive condoms. and parents cannot opt their children out of the program. bill gates says his position on apple's defiance is being oversimplified. he has said in several interviews he believes apple should turn over the information the fbi is asking for as it continues to investigate the san bernardino terrorist attack. it's not uncommon for phone companies and banks to hand over customer information. and tech companies should not be exempt. he does not think the government should from nepal. we have received updated vote totals from the nevada republican caucuses. donald trump is still the clear winner. marco rubio edged out ted cruz by fewer than 2000 votes. doug luzader is or possibilities here. the northbound traffic looks good from fremont to hayward. if you're taking 880 to the south bay, it looks good so far in the santa clara valley. clear skies, a few more 30s this morning. and more so towards the east bay and santa cruz mountains, and a couple of the peninsula. i saw woodside at 39 degrees. and there's a few in the east bay. danville. walnut creek. but it will be clear or mostly clear. when i start talking about a few high clouds, this is clear. delta view is so nice. we have a few of the higher clouds and a sunny and nice day although temperatures are a little cool. san francisco forecast today, 72, 52. average is 61, 48. the record high 78 in 1991. some of you might remember that. the record low -- nobody remembers this. 14 in 1891. my goodness, the southeastern united states and killed two people. the national weather service says at least seven tornadoes hit louisiana and mississippi. this is video of a mobile home park in louisiana where the two people died and 30 others were hurt. at least 100 mobile homes were damaged and about 300 people live in the park but it's not known how many were actually home when the weather hit. search and rescue operations are now underway. concerns are growing this morning that the zika virus may be transmitted through sexual assault contact a lot easier than first thought. u.s. health officials are investigating 14 new cases that may have been sexually transmitted and some of those cases with r infections in pregnant women. the only risk factor was contact with an infected man who traveled to an area where the zika virus was present. most experts were thinking that sexual transmission was rare. zynga has been cutting its work force and wants to lease part of the property. harvard university plans to work with the oakland school district to improve on how students do in school. oakland is one of six cities chosen for harvard's new program. it doesn't allow students to be educated for success the way they should so harvard wants to redesign the education system getting input from educators and community leader as well as people in health, social services, and the arts. for the first time in 30 years, richmond high school has put the band back together. >> one, two, one, two. ♪ [ music ] >> an anonymous donor gave the school $60,000 to buy 42 new instruments and the 20-minute delay before you make it to the span if you're in the cash lanes and looking at the other commutes. 880 is slow in some areas, getting closer to 238 is where it is. we had an earlier accident on 880 and that traffic in hayward is going to be slow from san leandro to union city. and after that it's okay. in south frymont a little bit of a backup and nothing major. 101 northbound is slowing up towards sunnyvale from the capital expressway. still a little bit of an opportunity to get on the freeway system before it gets super crowded. as 6:31. back to the desk. >> milpitas have all four burglary suspects in custody after an early morning incident at a gun store right near police headquarters. three of the suspects were arrested early this morning. and just in the last hour, the fourth suspect who had been inside the store since before 2:00 this morning, he was arrested. he was outside the store and appeared to be walking down the railroad tracks. the police are out there looking for any guns the suspects may have stolen or dropped as he was trying to escape. no shots were fired. no injuries have been reported. the ktvu fox 2's janine de la vega is there. she's been there since early this morning and we'll have an update. today is sentencing day for leland yee. alex savidge is in san francisco right now to tell us the factors the judge will consider. >> reporter: leland yee and one of his associates will be sentenced later on this morning. it will happen during a hearing that starts at 10 a.m. at the federal courthouse in san francisco. prosecutors are asking for leland yee to spend eight years in prison. but his attorneys on the other hand are arguing that the sentence should be no more than five years and three months. the defense attorneys cite his history of public service and point out that leland yee's wife is sick right now. yee pleaded guilty to accepting thousands of dollars in bribes from undercover fbi agents who were posing as campaign contributors. this was the result of a five- year investigation into organized crime in san francisco's chinatown. more than two dozen people were charged and that led to the murder conviction of raymond chow. yee has remained free while awaiting sentencing. one of his associates is due to be sentenced today. that's former school board president keith jackson who served as one of yee's sculpts. and he'll be sentenced along with yee. and to put this in context, this corruption case is part of what prompted the san francisco district attorney to team up with the fbi last week. they announced the formation of a public corruption task force that focuses on these sorts of issues here in the city. >> alex savidge here in san francisco, thank you. two oakland police officers are reportedly on administrative leave, accused of entering the home of a county probation officer and then assaults her. the east bay express obtained a report about an alleged december home invasion in the oakland hills. the probation officer called 911 saying two men -- one with a gun -- stormed in her house and attacked her. she and her husband fought off the intruders who appeared to be drunk. the alameda district attorney's office tells the paper this case is under review. there's another complaint about a violent uber driver, this time at san jose mineta airport. an airport worker flagged down the uber driver for speeding through the airport. the employee took photos and the uber driver got out of his car, grabbed him by the shirt, starting yelling at him. and then pushed him. the driver took off with the passenger still inside. police are looking for driver to get his side of the story. people we talked with who use uber say the report upsets them. >> i would not have gotten in that car. i would have said nope, i'll wait for the another ride. i love uber and their service but it's saturday to think that these people will do these crazy things. uner issued a statement saying we have a zero tolerance policy for violence of any kind. and it checks drivers' federal, state, and local records and all trips are tracked by gps. homeless people living in a growing tent city in san francisco have to move out. allie rasmus is at the tent city now with more on the action the city is taking out there. good morning. >> reporter: monday is when public works crews started letting people know at ninth and division that they have until friday to leave. since then a lot of folks who have been camped out have left. i want to show you the sidewalk across the street from us. two weeks ago when i covered the story, there were tents up and down that sidewalk. and you couldn't walk on the sidewalk from the stop sign to the intersection. there were more tents two weeks ago than what you see now. there are still a few tents and minicamps. >> this is where the city would like the homeless to go. a temporary shelter on pier 80 has 150 beds. and it's not usually full or close to capacity. i had a chance to talk with one of the residents of the homeless encampment and he has no interest or desire to go to the shelter. he's never been there before. but it has barbed wire his friends told him. and there are deputies hovering over you. city leaders say the alternative is staying in tents in the street and that's not an option. there's human feces and used needles. mayor ed lee says there are other homeless encampments that they need to take a look at. >> we're working on 18th and sanchez and places where we know encampments have arisen. we have really good alternatives for them. >> reporter: some of the residents in the tent city at ninth and division were obviously frustrated when told they have to leave. some said they don't know where they're going to go. and one person will leave if forced to. but he's not going to to pier 80 shelter. and that's the question we have for city officials. what can they do to make that pier 80 shelter a little bit more attractive and encourage the folks here to use it as a resource. we're hoping to hear from them sometime this morning. back to you guys. time now 6:38. the san francisco school board is praising students at lowell high school for standing up against intolerance. >> i applaud these students for speaking up about their experience. [ applause ] >> a group of african-american students were at the school board meeting demanding action. they claim that lowell high school, the city's most prestigious public school, has a problem with racism. student demonstrators walked out of class in protest. >> we don't get looked the same as the same students who are right next to us. but we go to the same school. we took the same test. we passed the same test. >> they are listening to the concerns and it's unacceptable that african-american students don't see their race, culture, and history reflected in the curriculum. a texas sheriff's report on the death of antonin scalia says there was nothing out of place in the hotel room where he was found dead. he died during a hunting trip 11 days ago. the washington post obtained the report which says his arms were lying at his side. a pillow was near his forehead but not obstructing his breathing. senate majority leader mitch mcconnell says the next president should make the nomination and that's supported by precedent. >> you have to go back to 1888 when grover cleveland was in the white house to find the last time a senate confirmed a nominee in an election year. >> some republican senators say they would not even meet with the nominee. harry reid accused republicans of venturing their moral compass to donald trump and ted cruz. >> it's wrong and the american people won't stand for this. the senate needs to do its job. >> senator dianne feinstein who is on the judiciary committee says public pressure might convince senate republicans to rethink their plan. san francisco voters rejected it two years ago but a proposed soda tax may be headed back to the ballot in san francisco. in 20 minutes, what's different this time?
