bay, 86. oakland, 77. 7 # san francisco. redwood city, 74. this cooling trend will continue and we will have a look at how low we will go coming up. new this morning, san jose police are investigating a deadly overnight shooting. alley? >> reporter: san jose police are not telling us money about the man. he was walking to the 711 around 2:00 this morning when he was shot. now, here's the scene behind us. san jose police patrol cars are conducting their investigation. and the building to our left is the 711. now a short time ago we were parked on the other side of'den view, and you could see more of what's going on. police have moved us over here. there's about a dozen san jose police officers and detectives and gathering evidence at the scene here. they have been here since the early morning hours. this happened just before 2:00 a.m. police don't know the motive or the circumstances surrounding this shooting. i spoke briefly to the owner and he said his clerk didn't hear any shouting o or fighting. there was nothing out of the ordinary. the clerk heard gunshots and ran into the back of the store and called 911. there was four or five customers inside the 711 when the shooting happened. a single gunman is responsible and police are still looking for him. this is sun hosea's 23rd 23rd homicide this year according to police. edan view is closed to traffic while the investigation is being conducted. police and investigators are expecting to be out here for the next several hours. we're waiting for the update by a police sergeant. >> thank you, alley. also new, a teenage girl out shopping with her younger brother was hit by a stray bullet in oakland. it happened last night around 10:40. 15-year-old girl was with her brother on foothill boulevard, the boy told police he heard another gunshot and that's when his sister yelled "i've been shot." she was hit in the neck but was alert when paramedics took her to the hospital. it's unclear who the intended target was. surveillance video will likely play key roles in two separate mini crashes that injured 40 passengers. both within 7 minutes apart. a t line train collided with a big rig. surveillance video from an auto shop captured the crash at the top of your screen. police believe the 18 wheeler made an illegal left turn into the path of the light rail train, knocking it off the track. >> it was just like an earthquake, you know. and you know, the brakes just stopped. you know how when brakes just stop, and everybody just rocked? >> in the 38 bus crash, the driver tried to avoid hitting one dump truck and rammed another dump truck instead. investigators are reviewing footage from the campana ares to vision your out what happened. the bus driver had been with puny for about three years. he was tested for alcohol and drugs after the crash. 20 people were hurt in each accident. the number of victims was high enough to trigger the emergency procedures. an alert was sent to the hospitals. while some of the victims were treated at the crash scenes, others had to be taken to the hospital. there's at least one bus passenger whose injuries are said to be serious. san francisco sis sew emergency a deadly overnight shooting. alley rasmus is live this morning with what we're learning about the victim. >> reporter: we learned a little more about this man from some of his friends and neighbors. he was in his 30s, he was a father, and he was engaged on the married soon. a short time ago his wife to be was watching various sets as the victim's body was removed. this happened around 2:00 this morning. the 711 is off to my left here. the man was shot in front of the gas station just before 2:00. and the investigators have been here ever since. the shooting happened just before 2:00 this morning. police don't moe the motive but a friend of the victim believes he was tar getted. i spoke after camera to the owner of the 711 and the clerk didn't hear any shouting or fighting right before the gunshots rang out. once they heard the gun fire, the clerk ran into the back of the store, and there was 4-5 customers inside the 711. police believe a single gunman is responsible for the shooting. they have not been located or arrested. now again, edan view is closed to traffic while police conduct their investigation. you can see the north and southbound directions are moving. police expect to be out here for the next several hours. this is the 23rd homicide this year. >> thank you, alley. we got offer the phone with oakland police who have given us new information about a teenage girl shot last at a convenient store. police tell us the girl is 13 years old, and was hit in the shoulder by a stray bullet while she went shopping with her younger brother on foothill boulevard. now the boy told police he first heard gun fire, and he ducked. he heard another gunshot, and his sister yelled "i've been shot." it's unclear what the intended target was. a crash p happened this week on university avenue, during the busy lunch hour, the driver in his 90s, now as has to take an emergency retest at the department of motor vehicles if he wants to keep driving. five people were hurt in the crash. san jose police are hoping video will help them find a robbery suspect. this was taken tuesday night at the chevron station in san jose. a man wearing a black beanny and long black jacket pulled out the assault rifle and robbed four people. anyone with information is being asked to call police. the man accused of groping two women in the south bay is facing misdemeanor battery charges. amad pore was arrested thursday he was spotted on the street and recognized him from a police sketch. the first incident happened on july 11, when a woman in a pow wow took part. he began aggressively touching and kissing her. on july 22, a woman reported a similar incident to police. a concord schoolteacher joseph martin is charged with molesting male students. his defense attorney told us most a better day for inland communities. i will have a look at the extended forecast coming up. police have investigating a deadly overnight shooting at 1:30 this morning. a man was shot at least once while walking to a 711 and died at the scene. the officer have not released information about a suspect or a motive. also new, a 13-year-old girl is recovering after getting hit by a stray bullet while shopping with her younger brother in oakland. it was around 10:40 last night, the boy told police he ducked after hearing gunshots. the sister said "i've been shot" and she was taken to the hospital with the gunshot wound to the shoulder. police have not made any arrests yet and it's unclear who was the intended target. surveillance video will play a key role in the investigations into two separate crashes that injured 40 passengers. the first crash involved a bus that rear ended a dump truck. the second accident happened on 3rd street 7 minutes later. a t line train collided be a big rig and the video camera from the auto shop shows the illegal left turn be the big rig and knocking the train off the track. >> it was just like an earthquake. you know, the brakes just stopped. you know how when brakes just clamp, and everybody just rocked. >> in the 38th gory bus crash, he tried to dodge one truck and rammed another truck. they are reviewing footage to figure out what happened. the bus driver who was not injured, has been with the company for three years. and in accordance to standard protocall, he was tested for alcohol and drugs after the crash. 20 people were hurt in each accident and the number of victims were high enough to trigger the emergency management procedures. an alert was sent to 7 area hospitals. while some of the victims were treated at the crash scenes, other victims had to be taken to the hospitals. most are minor the moderate injuries. there's one that's said to be serious. >> the emergency management system notifies hospitals when there's a major incident, just so that we're on alert that we could have patients coming in. >> all of the passengers in each crash are expected to be okay. the two accidents tied up traffic for hours. now in the south bay, the transportation authority is looking into what sparked this fire on one of its buses. a twitter user sent us these pictures of the bus it was headed to the maintenance yard while the driver noticed smoke and pulled over. the flames sparked a small vegetation fire alongside the road and the driver was not hurt the first sporting event at levi stadium and fans should expect pump and circumstance. they are finishing the touches and workers have been testing out the sound system and working wi-fi from every seat. the first 49ers preseason home game is on the 17th, but the sounders will be playing tonight. 40-50,000 people are expected. >> we have a half time show attributed to championships, the earthquakes and the 49ers and it will have a lot of pictures and asking people to use clipper cards to speed up the process especially if fans plan to connect to other transit systems, such as call train or bart. and other workers in hard hats and yellow vests will be stationed throughout the system to guide passengers to the right lines. the 49ers take the field on august 17 in a preseason game against the denver broncos. soccer returns to levi on september they are part of an $80 million smart corridor project. fire fighter in northern california continue to battle several wild fires including a fire in rural county. the fire near the town of days burned more than 50% contained. lightning has sparked more than 40,000 fires since wednesday. heyward will hold an event for homeowners to reduce the risk of fire danger. they will talk about defensible space and fire hazards, stone bray elementary school on heyward boulevard. a 55-year-old man is accused of stabbing his own father. the democrat took the photo of the swat operation last night. the suspect hector vasquez stabbed his father and ran into a house on mission drive, and barricaded himself inside for nearly 7 hours. the swat offersers broke in and arrested him. it's unclear what led to the stabbing but the father's injuries are not considered life threatening. an iraq war veteran is speaking out about the decision to reinstate an officer who was fired after a protest he was involved in. he is outraged by an arbitrator's ruling that caused roach to be rehired with back pay and benefits. roach was fired after throw august can of tear gas into a group of people trying to help him after he was struck by a police bean bag in 2011. the city of oakland has agreed to pay him $4.5 million to settle a federal lawsuit over the incident. >> throwing a grenade at people who missionaries who came down with the abola virus is scheduled to return to united states for treatment. it's the first time that anyone has been allowed into the country with the virus. the missionary will arrive in a special containment chamber and then be moved to emory university hospital in atlanta, which has one of the most sophisticated isolation units in the country. a second missionary is expected to arrive in a few days. >> we're one of only four institutions in the united states capable of handling patients of this nature. >> officials say both missionaries were infected while working at a hospital in liberia that treats patients. the world help organization says more than 700 people in africa have died in recent months from the outbreak. there's currently no plans to screen passengers returning to the u.s. from africa for the virus because it would be too costly. if an infected person flied to the u.s., two airports have areas where the passengers can be examined 49ers. it's a different type of football today. alley rasmus joins us live from san p at that clair with what's in store for fans tonight. >> reporter: 5:30 this evening, the an san jose earthquakes will sound off against the sounders. now the pitch is hours away. but there's still preparations underway. you can see traffic is blocked off on part of the drive here. and they are getting traffic and crowd control underway here ahead of the game. in fact, the hillton inn next to the stadium is preparing for a tail get party later today. we have seen a few cars pulling into the parking lot. the city has been preparing for all of this for a while. maintenance crews are doing last-minute rounds and testing the equipment. and the scoreboard, and the field is making sure the wi-fi works for every single seat. it's just one of the technology features the stadium will have. there will be 100 security guards. there's 40,000 soccer fans expected at the game tonight. once the regular season starts, that will nearly double to 70,000 fans coming to the stadium on game days. san jose earthquakes can draw a crowd but they will be paying their respects to the 49ers during the half time show. >> we have a half time show. it's a tribute to championships, the earthquakes and the 49ers and it will have a lot of photos and exciting highlights of the past championship teams of both clubs. >> now officials are urging fans to take public transit to get to this event because there's already 100 cones set up. one of the lanes of traffic is the only lane you can get to the stadium from here. learned drought calls to east bay have gone up 1200% in the last 30 days. it can lead to phone calls reminding home owners about and drought and repeats can have their water shut off. >> some people get a little defensive because they think they are already doing a lot to conserve water. >> east bay is expected to declare a drought emergency and adopt mandatory restrictions at a meeting later this month. forecaster say the state of california set a new record for the average high temperature in the first six months of the year. the average from january to june was 58-degrees. that's proposed a challenge to fire fighters this year and worsened the drought more than 80% of the state, which is experiencing extreme drought. : bay area grape growers say the drought is forcing them to bring in the crop a little earlier. they are still expecting a high quality vintage. they are harvesting two weeks earlier than usual. grape picking began wednesday night and will continue next week. while wineries can't say they are entirely sure, early estimates are that the 2014 year should be a good year. >> the stuff i've tasted coming off the press pan from what we have pressed for sparkling wine, it had good concentration, and good balance of sugar to acidity. so, so far so good. >> the wines from the grapes now being harvested will be on store shelves in two to three years. this year's harvest is expected to end in mid october. a creek has been contaminated by a leaking sewer line. after receiving a number of odor complaints, they tested the water. they famed a broken sewer line 3/4 of a mile away and it was leaking into the creek. park goers found the news disturbing. >> that's a little frightening, and this is a pretty popular park especially with kids and my own kids. so that worries me. the same test failed to spot the con tame nation three days ago. -- contamination three days ago. public works say the creek may be opened as early as tuesday. a man who drove his car onto a sidewalk cafe will have to take a new test order to keep his driver's license. the crash happened earlier this week on university avenue during the busy lunch hour. the police say the driver is in his 90s and must take an emergency retest if he wants to keep driving. five people were injured in the crash. police are hoping new video will help them find a robbery suspect. this video was taken tuesday night at the chevron station on bird avenue in san jose. a man wearing a black beanny and long black jacket robbed four people with the assault rifle. he should be considered dangerous, and anyone with information about this case is asked to call police. city colleges of san francisco may have a chance at achieving restoration status. san francisco examiner reports the commission has laid out the next steps for city college to restore its status to achieve restoration, and they must submit a self-e vag weigh report by october 15 and under go a new evaluation. and they will visit the school november 16, and then decide whether or not to grant restoration status no later than january. two tech shuttle buses were blocked by people protesting the ellis act evictions. protesters say people on fixed incomes are bearing the front of the evictions and say in the past three years, almost 70% of no fault evictions were within four blocks of private tech bus stops. >> it's becoming a moe know culture. it's like they clear cut the rain forest and plant palm oil trees. it doesn't work. >> yesterday was also the first day that tech shuttle buses began paying a fee of $3.55. protesters say it's not enough. shuttle buses run by companies by apple and google and shows the changing demographic. : we're learning about bumps in the road for the san francisco marathon. an app was supposed to allow family and friends to track runner and didn't work. water was unavailable at some parts of the course and it was confusion about the winner of the woman's half marathon. phony tickets continue to show up at the box office county fair since opening a week ago. more than $10,000 worth of fake tickets have been collected. fair management says whoever created them did a good job. the covent fit tickets look close to the real ones. the scammers turned to the internet to amp up the sales. >> craigs list, facebook, it was a big part of this. they were selling them on those different social medias. they were standing in parking lots across the street from the fair too. >> fair management decided to help out and anyone who shows up with the phony tickets will be offed a extended forecast, coming up. . new this morning, police in hollister are looking for a suspect in a shooting and say he may have a 20-year-old woman with him who is being held against her will. police are looking for 20-year- old jose barajas in connection with a shooting last night. they believe 20-year-old vanessa florez may be with him. family members tell ktvu she was kidnapped and used to date barajas. if the you have any information about florez' whereabouts, call 911. san jose police are investigating a deadly overnight shooting. it happened about 1:30 this morning on monterey road and eden view drive. police say a man was shot at least once while walking to a 7- eleven and died at the scene. officers have not released information about a suspect or possible motive. a 13-year-old girl is recovering after getting hit by a stray bullet while shopping with her younger brother in oakland. the siblings were inside the hunts berry market around 10:40 last night. the boy told police he immediately ducked after hearing gunshots. when he heard more gunfire, he says his sister said, i've been shot. she was taken to oakland children's hospital with a gunshot wound to the shoulder. police have not made any arrests yet and it is unclear who was the intended target. a 55-year-old man in sonoma county is under arrest this morning, accused of stabbing his own father. the press democrat took this photo of a s.w.a.t. operation going on last night. investigators tell the paper the suspect, hector gustavo stabbed his father, then ran into a home on mission drive, barricading himself nearly seven hours. s.w.a.t. officers broke in and arrested him. the father's injuries are not life threatening. surveillance video will likely play a key role in the investigations into two separate muni crashes that injured 40 passengers. the first crash involved a 38 bus that rear ended a dump truck near japan town. the second accident happened on third street and ennis in the bay district. a muni t-line train collided with a big rig. surveillance video, watch at the top of the screen, you can see it captured the crash from a nearby auto shop. police believe the 18-wheeler made an illegal left turn into the path of the light rail, knocking it off the track. it was like an earthquake. the brick stopped. you know how when bricks clap? everybody just rocked. >> in the 38 gary bus crash, the driver tried to avoid hitting one dump truck and ended up ramming another one instead. the windshield of the bus, as you see, is smashed. muni investigators are reviewing surveillance footage from bus cameras to try to figure out what happened. ktvu has learned the bus driver, who was not hurt, has been with muni for about three years. in accordance with standard muni protocol was tested for alcohol and drugs after the crash. 20 people were hurt in each accident. the number of victims was high enough to trigger the city's emergency management procedures. an alert was sent to seven area hospitals, including san francisco general, california pacific medical center, and st. mary's. while some of the victims were treated at the scene, other victims did have to be taken to hospitals. most of the injuries are minor to moderate. but there is at least one bus passenger whose injuries are said to be serious. >> san francisco emergency management notifies hospital when there's a major incident so we're on alert that we could have patients coming in. >> all the passengers in each crash are expected to be okay. the two accidents, though, tied up traffic for hours. in the south bay, the santa clara valley transportation authority is trying to figure out what sparked a fire on one of its buses. a twitter user sent us pictures of the vta bus. it was headed to the maintenance yard when the driver noticed smoke, pulled over on highway 101 in south san jose, and then those flames started sparking a small vegetation fire alongside the road. the driver wasn't hurt. happening today, the first sporting event at levi's stadium in santa clara. while the soccer match is still hours away, there is already excitement around the billion dollar sports palace. ktvu's allie rasmus is live outside levi's stadium with a look at what fans have to look forward to tonight. allie? >> reporter: the san jose earthquakes will face-off against the seattle sounders this evening. they start practicing at 5:30 and then kickoff is at 7:30. even though it's a soccer game, it is, as you mentioned, the first major sporting event to happen at levi's stadium. kickoff is still hours away, but game day preparations are already under way. traffic wise, you can see they have set up several cones here that they have blocked off the area, as cars are turned around at the intersection by police. businesses in the area near the convention center and stadium are waiting for the crowds to descend on the area. in fact, this hilton hotel is going to be hosting a tailgate for some of the people staying here because of the events happening this evening here at levi's stadium. maintenance crews, engineers, operations officials have been doing last-minute rounds at the stadium. yesterday, they were testing the equipment, the scoreboard, checking the field, making sure the wi-fi works in the stadium. santa clara police department is also bringing in 100 part- time police officers from other cities to work security and do drunk driving patrols in the area. there are 40,000 soccer fans expected here tonight. we talked to one man coming to the game tonight who admits he's not a huge soccer fan, but he says he wanted to be the first of his friends to check out the new stadium. >> one of the key things today is going to the soccer game to check out the new stadium. >> we're not going to see soccer? >> no, no, we like soccer, but we really like the new stadium. even the planter boxes are nice! i don't know if you've seen them, but everything on the stadium is pretty amazing. >> reporter: once the 49ers' regular season begins, you can expect about 70,000 fans coming to the stadium on game days. officials are urging people to take public transit to get to this event and future games at levi's stadium. speaking of future games, the 49ers take the field at levi's stadium august 17 in a preseason game against the denver balboa park and colma stations, also one service between 24th and daly city stations. the improvements include replacing platform edge tiles, performing preventive maintenance and addressing issues with the tracks. bart officials say riders heading to san francisco and beyond should board a fremont- bound train and transfer at the mcarthur station. this week, construction crews will start putting smart signs along interstate 80. the first sign will be installed on tuesday in richmond. more signs will go up over the next few months. according to the contra costa times, once those signs are turned on next year, the signs will flash information about traffic accidents, blocked lanes, and travel times. the installation will require some nighttime lane closures. signs are part of an $80 million smartcore dorr project. an iraq war veteran who suffered brain damage at an occupy protest in oakland is speaking out about a decision to reinstate an officer who was fired after that protest. [ screaming ] >> fred olson says he's outraged by an arbitrator's ruling that requires the officer to be rehired and receive back pay. the city of oakland has agreed to pay olson $4.5 million to angeles county sheriff deputies. deputies say the 24-year-old was shot when they stormed into the house early this morning. the deadly stand-off began about 5:30 last night and lasted nearly eight hours. authorities say at some point, the man did exchange fire with the deputies. a man who was standing nearby was shot and pronounced dead at the scene. no deputies were injured in the gunfire. the hostage is a bit shaken up, but appears to be okay. dangerous thunderstorms are expected to hit the los angeles area again this weekend, raising the risk and concern about lightning strikes. the warning about severe weather comes a week after more than 1400 lightning strikes jolted southern california last weekend when a rare summer storm moved through that area. a 20-year-old man was killed and 13 more people were hurt after being struck by lightning a venice beach. officials are asking people to stay inside or in their cars during that severe weather and to expect brief and heavy downpours. happening now, one of two american missionaries who contracted the ebola virus in africa has returned to the u.s. for treatment. these are live pictures of the ambulance carrying dr. kent brantley to the hospital in atlanta. a plane carrying brantley landed within the past 20 minutes at daubins air force base in marietta, georgia. it is the first time anyone with the ebola virus has been allowed into the country. the missionary was flown in a special containment chamber created by the centers for disease control and it will be moved to emery university hospital in atlanta, as we showed you in the live pictures. that hospital has one of the most sophisticated isolation units in the country. now, a second missionary who also has ebola is scheduled to arrive in the u.s. in a few days. >> we are one of only four institutions in the united states capable of handling patients of this nature. >> officials say both missionaries were infected while working at a hospital in liberia that treats ebola patients. the world health organization says more than 700 people in africa have died in recent months from the ebola outbreak. there are currently no plans to screen passengers returning to the u.s. from africa for the ebola virus because officials say it would just be too costly. but officials say if an infected person did fly to the u.s., two dozen airports have areas where passengers can be quarantined and examined. u.s. health officials are asking americans to avoid nonessential travel to guinea, liberia and sierra leone, the countries hardest hit by the outbreak. good news for travelers who may be gearing up for a trip overseas. delta air lines is now going to allow passengers to switch on those electronic devices during take-off and landing on international flights. last year, the carrier was one of the first to allow passengers on domestic flights to use electronics throughout the entire flight. united, american, jetblue and other major airlines have since lifted the ban on using electronic devices when those planes are below 10,000 feet. the fcc is also considering a plan to allow cell phone calls on planes. time now, 9:17. let's cross word scratcher ticket at danville wine and liquor. he told lottery officials he plans to buy a new car and put the rest of the money in the bank. a whale fossil believed to be 14 to 17 million years old is now in its new home in a los angeles museum. that fossil was originally discovered back in 1978, embedded in a 1000-pound rock. at the time, the natural history museum of los angeles didn't have the resources to dig it up, but then when another whaig fossil was found earlier this year in the same area, there was renewed interest. it took a team of 10 people about four hours to get the job done. boaters on monterey bay are being warned to keep their distance from humpback whales feeding close to shore. people who are too close are putting themselves at risk. an adult humpback whale can weigh about 150,000 pounds and they sometimes travel in groups of three or more. marine officials say being struck by one is comparable to getting hit by a freight train. they recommend staying at least 100 yards away from the whales. a wildlife rehab center in morgan hill so going to great lengths to rescue bob cats. workers are wearing bob cat costumes to reduce contact with the animals so they can be released back into the wild. >> that little guy is not happy. more than 40 bobcats have been rescued by the center in morgan hill. wildlife experts say rescues have been on the rise because the bobcats are struggling to find food and water in these drought conditions. a bobcat that was rescued by a driver on an east bay highway has been released back into the wild. >> come on, come on, dude! >> a good samaritan stopped to help after seeing the young male bobcat lying on the side of the roadway along highway 84. olga silca loaded the bobcat in her prius and drove to her floor at pauley pavillion. ucla will replace the floor by the end of october and says no regular season games will be affected. the court, two parking structures and other campus facilities were flooded when two lines burst on nearby sunset boulevard. ucla had just spent $136 million to upgrade pauley pavillion two years ago. an east bay drought hotline has been inundated with calls from people complaining about neighbors who waste water. >> i can't water my yard and these people have extremely green grass and water is running down the gutters. a ridiculous amount of water. please, somebody, check this out! >> ktvu has learned drought calls to east bay mud have gone up 1200% in just the past 30 days. complaints to the hotline can lead to phone calls reminding homeowners about the drought and even inspections. repeat water wasters can be forced to install flow restrictors or even have their water shut off. >> some people get a little defensive because they think they are already doing a lot to conserve water. >> east bay mud is expected to declare a drought emergency and adopt mandatory restrictions at a meeting later this month. california may not get a break from drought conditions any time soon. forecasters say a state -- the state set a new record for the average high temperature in the first six months of the year. the average temp in california from january to june was 58 degrees. that's posed a challenge for firefighters who have battled more than 3600 fires this year. more than 80% of the state is experiencing extreme drought. well, bay area grape growers say the drought is forcing them to bring in the crop a little early. but despite the dry weather, they are still expecting a high quality vintage. jay vineyards has already started harvesting there, two weeks earlier than usual. grape picking began wednesday night and is expected to continue next week. wineries say they can't be entirely sure, but early estimates predict the 2014 year will still be a very good year. >> the stuff that i've tasted coming off of the press pan from what we have pressed for sparkling wine has had good concentration, good balance of sugar to acidity, so far, so good. >> the wines and the grapes being harvested will be on store shelves in two to three years. this year's harvest is expected to end in mid-october. well, crews are working to clean a creek in san mateo that's been contaminated by a leaking sewer line. yesterday, signs were put up at laurel wood park warning people to stay out of the creek. the deputy director of environmental services says after receiving a number of complaints, they tested the water. crews found a broken sewer line three quarters of a mile away and says it was leaking into the creek. park goers say they found that news disturbing. >> that's a little frightening and this is a pretty popular park, especially with kids and my own kids. that worries me. >> the same test was conducted three days ago, but failed to spot the contamination. nearby residents are asking the city to rethink its testing protocols. public works says the creek may be reopened to the public as early as tuesday. an elderly man who drove his car onto the sidewalk into a palo alto cafe will have to take a new test in order to keep his license. the crash happened this week on university avenue during the busy lunch hour. the driver is in his nineties and police say he must take an emergency retest at the department of motor vehicles if he wants to keep driving. five people were injured in that crash. san jose police are hoping new surveillance video will help them find a robbery suspect. this surveillance video was taken tuesday night at the chevron station on bird avenue in san jose. police say a man wearing a black beanie and long black jacket pulled out an assault rifle and robbed four people working at the station. police say he should be considered quite dangerous. anyone with information about this case is asked to call police. new developments in the molestation case of a teacher is under way now. last night, martin's defense attorney told us 34 of the 150 counts have been dropped. the former teacher has maintained physical contact with students was not sexual. closing arguments are scheduled for monday. city college of san francisco may still have a chance of achieving restoration status. the san francisco examiner reports the commission that voted last summer to revoke the school's accreditation has now laid out the next steps for the city to restore its status. to achieve restoration, the college must submit a self evaluation report by october 15th and undergo a new evaluation. an evaluation team would visit the school the week of november 16th. then the commission would decide whether to grant restoration status no later than january. a home sharing website is launching a campaign to modify san francisco housing laws. the the "new york times" reports air b & b is calling the initiative fair to share san francisco. the website teamed up with other home sharing advocates to get as many people as possible to sign a petition. it calls for the city to change outdated housing laws. right now, city residents are not allowed to sublease their apartments and homes for fewer than 30 days. we are learning about bumps in the road for the san francisco marathon. the san francisco chronicle reports an app that was supposed to allow family and friends to track runners didn't work. water was unavailable at some parts of the course and there was also confusion about the winner of the women's half marathon. marathon organizers say they admit, water was late arriving to some locations and that a mistake was made in posting the original times for the women's half marathon. phony tickets continue to show up at the box office at the sonoma county fair. since opening a little more than a week ago, more than $10,000 worth of fake tickets have been collected. fair management says whoever created them did a good job. they say the counterfeit tickets look very close to the real tickets. according to fair management, the scammers turned to the internet to amp up sales. >> facebook, craigslist were big, selling on those types of media. they were also standing in parking lots across the street from the fair. >> fair management has decided to help out anyone affected by the scam. anyone who shows up with phony tickets is going to be offered a chance to buy one, get one free wrist band. the sonoma county fair will be open for another week. coming up next, new comments about how close former president clinton came to capturing and killing osama bin laden. >> and they were made just hours before hijackers took over the planes that were bill passed by the house of representatives. the bill would allocate $694 million in emergency funding for border security. president obama says it will not resolve the immigration crisis and accused house republicans of passing it for show. house republicans and senate democrats are at odds over how to address a flood of children from central america who have been caught crossing the border to escape violence in their home countries. antiimmigration protesters are marching from southern california to texas to call for action on the border crisis. demonstrators left marietta yesterday and plan to walk for nine days before arriving at mcallen, texas. marietta has also seen several protests blocking the path of transport vehicles. two weeks after a malaysia airlines plane was shot down in ukraine, an international team has finally arrived at the crash site, starting the process of recovering victims. recovery workers paused for a moment of silence after reaching the site and then began searching through the debris field that stretches 14 square miles. world leaders, including president obama, have accused militants loyal to russia of shooting down that plane. militants still control the area, but are allowing international observers to access that site while a cease- fire is in place. >> we are on a very special place and in a very special time on this field of remembrance. lot of grief is attached to this place. >> 298 people were killed when the plane was shot down, including several prominent aids researchers. a third of the victims have not been recovered. president obama has revealed after 9/11 some cia agents used torture during their interrogations. he says in the immediate aftermath of the 9/11 terrorist attacks, the united states did things that were wrong and crossed the line. but he says it's important to remember how horrified americans were after the attacks. his comments come after senate investigation into the cia's interrogation techniques. a report on that investigation is expected to be released in the next few weeks. a recording of former president bill clinton talking about almost killing osama bin laden is now public. president clinton made the comments on september 10th, 2001, just hours before the planes used in the september 11th attacks were hijacked. >> and i could have gotten, i could have killed him, but i would have had to destroy a little town called kandahar in afghanistan, killed 300 innocent women and children. i would have been no better than him. so i didn't do it. >> the u.s. was after bin laden at the time because he was believed to have been the mastermind behind the bombings at the american embassies in tanzania and kenya in 1998. u.s. special forces killed osama bin laden team seriously injured in an apartment fire will not allow it to keep him from the sport he loves most. on the first day of football practice, jared lee was must watch from the sideline wearing bandages to protect him from the hot sun. he suffered second and third degree burns to half his body while running out of his apartment when it caught on fire in april. lee says he's putting the negotiations to extend his contract until after this season. he's entering the fourth year of a five-year deal which pays him $5 million a year. some say harbaugh is waiting to cash in, hoping he wins a super bowl, but those experts say if he doesn't win this season, the 49ers could continue to play hard ball with him over money and that could open the door for some other team to possibly sway him
