in their wallet. mornings on 2 starts now. >> police bay area news coverage starts right now. this is ktvu mornings on 2. good morning, everyone, welcome to mornings on 2. it is sunday, may 25th. i'm mike mibach. >> good morning. i'm allie rasmus. claudine wong has the morning off. let's get a quick look at weather with rosemary. >> yes, how about we start off with something nice? a beautiful view over san francisco, mostly sunny skies, even the coast partly cloudy to mostly sunny this morning, and we are going to see our warmest day of this little mini heatup that we are experiencing, 63 to start your morning in antioch, widespread 50s from fairfield through concord, 57 in oakland, 52 san francisco, a cool start half moon bay but you have more sunshine this morning, 48 degrees for you, 49 in saud, low 50s -- novato, low 50s santa rosa, san jose checking in at 56. forecast model, not even really picking up on any patchy fog here, although i know it's out there but for your afternoon today, mostly sunny skies from the coast across the bay and inland, if you're thinking about heading to the beach, still going to be breezy there this afternoon so something to consider as well, but take a look at these -- well, at least the fingerprint of these -- footprint of these numbers, 60s along the coastline, 70s along the peninsula, east bay, widespread -- some of our areas like antioch, oakley going to hit into the low 90s today. 93 for antioch, 90 in concord, 89 for napa, 80 degrees oakland, 73 san francisco and mid-60s expected in pacifica, san jose checking in at 82. we will begin a cooling trend, subtle drop as we get into memorial day and then a bigger drop as we head into the business week. the extended forecast for you coming up. continuing coverage on the mass shooting near uc santa barbara that killed seven people including the gunman and injured 13 others. last night thousands of people showed up to a vigil at the uk campus to mourn the loss of the victims. [ singing ] >> 22-year-old elliot rodger was heavily armed when he went on a rampage in the isla vista community friday night. authorities say he stabbed and killed 33 people at his apartment before shooting and killing two women at a severity house -- sorority house and another person outside a deli. one victim was a university student out of alamo, nick pasashute suffered serious injured after he was ran into by rodger's bmi. he was in town visiting a water polo teammate. coming up we will have a live report from isla vista with the latest on the investigation. uc president janet napolitano says she is shocked and saddened by the shootings near the uc santa barbara campus. >> they clearly implicated our campus community so we want to make sure the members of our campus community feel safe and that the campus continues to thrive. >> nepal tauno -- nepal tauno made the speech yesterday and says she is working with uc santa barbara to help the students and families affected. california attorney general camila harris released a statement following the tragedy that says in part i extend my heartfelt sympathy to the family and friends of the victims of friday night's terrible shooting in isla vista, our thoughts and prayers are with all who have been affected by these tragic acts of violence. governor jerry brown expressed similar significantments in a -- arrest for dui following a crash that took out a fire hydrant in hayward. ktvu channel 2 news reporter christian kaplan has more. >> reporter: this accident scene here in the cleanup phase. there's a line worker for at&t. he's using a chain saw to actually start breaking down and cutting up one of those utility poles that was knocked out at about 12:45 a ford pickup truck came down mission boulevard here, knocked out the utility pole and the fire hydrant which was over there but first it hit another utility pole over in this direction and it sheared off, as i said, that fire hydrant in the process of this whole big accident this morning. investigators arrested the man who was driving. he is facing dui charges. add to that that there were two children and a woman in the pickup truck at the time, that driver also now facing charges of child endangerment. at this point investigators say it's unclear if the driver was trying to take off after the accident, but investigators arrived and say they determined quickly that he had been drinking. >> for unknown reasons the driver lost control and veered off the roadway and collided with a telephone pole and then continued northbound on mission boulevard and collided into another telephone pole followed by fire hydrant. >> now, as if that wasn't enough, while investigators were looking into that first incident, another driver passing the scene tried to make a u-turn and nearly hit a patrol car. investigators stopped that driver as well. after a brief investigation they determined he too was intoxicated and arrested him and take a look, you can see here's the utility pole sitting on the ground. you can imagine the amount of force was necessary not just to take this utility pole but another utility and a fire hydrant out all in one incident. the memorial day holiday means there are a number of special dui enforcements going on throughout the bay area, we will continue to monitor them and let you know what the results of those dui enforcement efforts are throughout the bay area. for now we are live in hayward, christian kaplan, ktvu channel 2 news. also new this morning, oakland police are investigating a shooting. the victim was found dead in his home. it happened about 1:30 this morning at an apartment on nicole avenue near champion street. police say a group of people went back to the apartment after a night out and at some point they started arguing. that's when police say one person started shooting. police say the group then left the apartment. the victim is described as a man in his late 20s, so far no arrests have been made. the first part of a three part seismic fix on interstate 280 in san francisco went off without a hitch. that's according to caltrans. caltrans has closed a 2-mile stretch between king and caesar chaviz streets -- cesar chavez streets -- which will allow it to expand and contract during an earthquake. the closed section of the interstate is scheduled to reopen by tuesday morning at 5:00 a.m. friends and family will gather tomorrow to remember a teenager who was killed in a crash near santa rosa earlier this month. ashley carlson was the passenger in a car her friend was driving. she attended rancho ca taughty high school in roanert park and tomorrow would have been her 18th birthday. the memorandumall service -- memorial service is tomorrow night. t-shirts and bracelets will be sold in honor of carlton and the proceeds given to the carlton family. orlando florida topped the list from santa margarita growth america followed by tampa and jacksonville, san francisco came in at 23rd. researchers say cities in the southeast and southwest make up most of the list because of the majority of the people who live there own cars and do not rely on walking to and from mass transit. san francisco did not make that list despite a high number of crashes involving pedestrians. 21 people were hit and killed by vehicles in industry streets last year. there have been seven deadly accidents involving pedestrians in san francisco this year. the city of san francisco is working to improve pedestrian safety with the vision zero initiative with the goal of having no traffic deaths within 10 years. a bay area beach may have made a big turnaround, mere beach in marin county could be clean enough to be often list -- off the list of states beaches with bad water. >> reporter: the rolling waves at mere beech are always tempting. >> the water looks nice to play in. >> reporter: and now it's safe to do just that if you can stand the cold. >> it's frigid, it's freezing, actually. >> reporter: the san francisco bay water quality control board is recommending it be removed from a list of impaired waterways, since 2006 high amounts of bacteria from runoff posed a health risk to swimmers and surfers. >> if i would have known that, i probably would have had second thoughts about going in but i can tell you i had a positively refreshing experience. >> i didn't know it was on the list and i'm glad to hear it's off. >> reporter: the california water resources control board says the water is safer because of a recently completed restoration project. >> i didn't notice anything that would have made me think it was unsafe or unclean so they must have done a good job. >> reporter: changes made near the mouth of red creek includes a new parking lot that acts as an interior buffer. it's designed to prevent flooding during rain. a pedestrian bridge keeps people from harming endangered species below. also a new picnic area and new places to go. there were no rest rooms before. >> this is the first time we have been down here since the restoration has been completed and it's been reopened like this. so we are just kind of wide eyed. >> much different experience than what used to be just parking lot and a beach. >> reporter: this couple says the area strikes a good balance for beachgoers and the wildlife. >> i like the fact that they are taking into consideration the habitat. it's so beautiful, they have to do this because we people are going to trash this place. >> reporter: each year 250,000 visit this beach and many more could were not seriously hurt. we are learning more about the mass shooting near uc santa barbara that left seven people dead and 13 injured. reporter sara sidner live for us this morning in the community of isla vista where authorities are still trying to piece together what led to the tragedy. good morning, sara. >> reporter: good morning. yeah, there are 10 different crime scenes, mike. i want to show you one of them. this is where christopher ross martinez, a 20-year-old student who was doing very well in school came into the ib deli mart to grab something to meet and he -- eat and he ended up being gunned down. this community trying to cope with the loss of so many, six innocent victims that were all taken by the suspect according to police elliot rodger was driving by and shooting up approximate town. i want to show you just another thing here because there is remnants of what happened. you can see the bullet holes here where people have come and stuffed bouquets of flowers inside them. two bullet holes inside. this is one of the crime scenes where a student was indeed killed. now, we know the names of two of the other students who were killed. katie cooper and veronica weiss, we know about their story because we talked to a witness who actually saw them die, a terrible story, they were going past a sorority, as they were walking past, the shooter came up, he started shooting them and they fell to the ground. one of them died immediately, the other one died on the scene as our witness was trying to help her and a third girl was with them. she actually has survived. she was talking to her mother on the cell phone, according to our witness, telling her how much she loved her because she wasn't sure she was going to survive. we know three other people, the three other victims who have not yet been named by the sheriff's department were actually inside the suspect's apartment stabbed to death. so the spree started there at his apartment and then he moved out to gun down and run over strangers. mike. >> sara sidner reporting live for us in the community of isla vista at this tragedy this memorial day weekend. sara, thank you for that report. back here in northern california, a lot of people with the tragedy on their minds trying to get along. rosemary with their day-to-day lives here in the bay area on this holiday weekend. a lot of people out, activities, little league games. saw a lot of that yesterday and also saw the wind pick up at my home yesterday. >> going to do it again today, especially along the coastline, more sunshine out there and as mike mentioned definitely a good day to be thankful for what you have and appreciate this beautiful weather, giving you a live look over the oakland estuary, mostly sunny skies, a bit of a haze but air quality just fine for today, partly cloudy skies, a little bit of patchy fog along the coastline. we are going to have more sunshine along the coastline but the sea breeze is going to wrap up once again and that's something we have not lost with this mini warmup if we will call it that. we have not lost the sea breeze and you're probably feeling it as we get into the afternoon and if you're at the coast it's been quite breezy. we will see that again for today. here's the ridge of high pressure giving you those airos there to sort of point you into the direction of the circulation, you could even see the high clouds, that's sort of been spilling over the bay area from time to time and we will have that again for today. as we get into the next day or two, we have changes coming our way and i want to point you to those changes right about here. do you see this circulation, the counterclockwise circulation going on above the ridge? this is going to break down the ridge over the next couple of days and eventually this will be the dominant element in our weather pattern and that will bring us a cooldown as we get into the business week. hurricane amanda a category 4, winds to 140 miles per hour and still moving west-northwest at about 5 miles per hour. it is expected to strengthen more before it finally weakens as we get into this afternoon and into tonight, winds to 145 and then you can see by monday and into monday night gips to weak -- begins to weaken once again, but the first named storm for the east pacific. so that's pretty interesting news there. 52 degrees in santa rosa right now, 56 in san francisco, upper 50s in oakland as well as concord, san jose with mostly sunny skies. if you're thinking about getting out to the farmers market it's a nice day. 76 in berkeley for the afternoon today upper 70s to low 80s around the bay area, 88 in novato. go inland it's a warm day, you're thinking about maybe water park, maybe head to the inner east bay because that's where it's going to be hot, 91 for livermore this afternoon, into san jose, 82 for you, santa cruz 80 degrees and beautiful beach day in santa cruz. so maybe make invitation to visit the vatican and pray for peace. the pope made an announcement after holding the mass in bethlehem during his three-day trip to the middle east. both palestinian president and israeli president says they will come to the vatican. the pope greeted abbas this morning at the mass in bethlehem and will meet privately with perez and israeli prime minister benjamin netanyahu in jerusalem. people in the city of portland are once again able to drink tap water after a boil water order for the city was lifted. health officials are still looking into what caused e. coli to be detected in two reservoirs that supply the city's drinking water. right now they believe a dead animal may have fallen into one of those reservoirs. the boil water order forced some restaurants to close and other retailers to throw out prepared food. many stores ran out of bottled water. >> i had to go to three stores yesterday actually to find bottled water. >> the two reservoirs are now being drained and will be thoroughly cleaned before they are put back into use. at least one person reported becoming violently ill after drinking the water. it's the first facility of its kind in the to attend a memorial day ceremony in san francisco's presidio tomorrow. the event at the san francisco national cemetery will mark 50 years since the escalation of the vietnam war. veterans will march from the presidio's main post to the national cemetery on lincoln boulevard starting at 10:30 a.m. this year's ceremony will be dedicated to vietnam veterans, many of whom were deployed from the practice sideio -- presidio. two military aircraft will also fly over oak hill memorial park in san jose on memorial day. the 129th rescue wing flyover is scheduled to get underway at 11:00. the california international guard unit is stationed at moffet field in mountain view. a senior at sacramento state got a special surprise on her graduation day. her brother came home from afghanistan to be at the ceremony. she had thought photographers had gathered to watch her receive her diploma so she was shocked when her younger brother there, army specialist anthony mcdaniel was waiting for her. >> it just happened to be the best time, perfect, college graduation, haven't seen her forever so just the best experience ever. hardest part about being away was being away from family, not being able to see family, not being able to talk to them every day, hug them, face-to- face conversation. >> anthony mcdaniel spent four months in afghanistan and now stationed at fort riley in kansas. what inside the bay and inner east bay as well as north bay and down into the south bay, mostly sunny skies. temperatures right now in the low 50s to low 60s, half moon bay checking in at 50 degrees, more sunshine this morning at half moon bay, 53 san francisco, upper 50s in walnut creek, 64 outside your door in antioch, so relatively mild already outside your door at antioch. 58 degrees livermore, 56 san jose. here's a comparison from yesterday into today, santa rosa, you went to 84, today you will go to 89, a big jump in san francisco for today. mid-80s in concord on saturday, today you will go to 90, and san jose you will also follow suit, 82 expected in your neighborhood this afternoon. here's a better look around as we get into the afternoon, today 84 for vallejo, as well as san rafael, 76 san mateo. the inner-city getting into the 90s, areas like fairfield, antioch, morgan hill go to 86, still a warm day for you, so again depending on how you like it, either head to the coast where we will have the sea breeze once again for the afternoon, mid-60s at pacifica or you go inland and you have it quite toasty. today going to be the hottest day, we begin a cooling trend as early as say 22-year- old elliot rodger was heavily armed when he went on a shooting rampage in the isla vista community friday night. authorities say he stabbed and killed three people at his apartment before shooting and killing two women at a sorority house and another person outside a deli. deputies say rodger then killed himself after getting into a gun battle with officers. last night thousands of people showed up for a vigil at the uc santa barbara campus to mourn the loss of the victims. ktvu's deborah villalon brings us the emotional memorial. [ singing ] >> reporter: it was a stunned and silent crowd, thousands of students, staff, santa barbaraians on store plaza at dusk, the center of campus. >> let us now take a moment of silence to remember those we lost. >> reporter: students veronika weiss, katie cooper, christopher martinez and three more names still how old old -- withheld. >> mainly an air of disbelief. >> reporter: streets lined with shops and apartments, streets they want to believe are safe. >> elliot rodger here. >> reporter: by now everyone has seen elliot rodger's video, heard the hate and the threat. >> it could have been happened anywhere. this could go wrong anywhere. somebody could have these thoughts and problems anywhere but it's sad it happened here. >> it's a college town, you know, every college town, parties and everything, but it's just not -- not the place you would expect something like this to happen. >> reporter: sheriff's deputies who checked on rodger only last month at his family's request described him as polite, even shy and left without realizing he had guns and a plot. students too wonder what they may have missed. >> why did he feel this way? like why did he have to attack everyone? >> it's the quiet ones that you don't really see coming. like they don't give off too much -- like they don't give too many signs. >> and that was deborah villalon reporting. one of the surviving victims is reportedly a university of pacific student from alamo, according to the san jose mercury news, nick pasichuke suffered serious injuries after rodger run over him with his bmw. elliot rodger is the son of a hollywood filmmaker who was an assistant director of the "hunger games." elliot rodger reportedly suffered from asperger's syndrome and depression. police say they had three earlier encounters with rodger including a welfare check last month after his parents were concerned about his mental state. authorities say they determined he was fine and did not think he met the criteria for an involuntary hold. hours before the shooting, rodger posted a youtube video where he ranted against the women who wouldn't pay attention to him. he also published a 140 page manifesto where he talked about his struggle to fit in and outlined his plan for revenge. he was a student at santa barbara city college. authorities a rodger was -- say rodger was carrying three semiautomatic handguns and had four rounds of ammunition with him during the rampage. >> all of these weapons were legally purchased from federally licensed firearms dealers and that they were all registered to the suspect. >> a surveillance camera inside a convenience store shows the moments when gunshots were fired into the building during the rampage. investigators say rodger went from one location to another and opened fire on random people over a 10 minute period. authorities say there were 10 crime scenes in all. it has been more than two years now since the mass shooting at oykas university in oakland. the school's founder talked to ktvu about friday's shooting and he says he knows the families are suffering and it breaks his heart on ktvu.com you will find more information about the deadly rampage near uc santa barbara. you can find it there under hot topics. an investigation is underway after an officer- involved shooting at a school near sacramento. police in citrus heights say on friday night they responded to calls of domestic violence. when they arrived, a man fled on a bicycle to a nearby school. police say when they got to the school they tried to approach the man and police say he then reached into his waistband and police say they responded by opening fire, shooting the man. he later died at the hospital. the santa clara county coroner is working to identify a body found in the south bay creek. a kayaker found the man's body yesterday morning in coyote creek. res crew crews from several agency -- rescue crews from several agencies recovered the body. it's too early to know if he was a victim of foul play or even how long the body was in the water. and one man is dead after his car went off an embankment and into a creek near spacecraft sa past paul -- they say the crash happened friday night but no one reported it until yesterday morning. people who live nearby say they often hear cars skidding around on that sketch of road. a pilot landing in the bay ran into trouble. his plane skidded off the runway. he wasn't hurt and no one else was on board. we are told that the landing gear collapsed when the plane turned down -- touched downed on the runway. another small plane flipped make being an emergency landing south of bakersfield. the pilot ran into some sort of trouble yesterday afternoon and tried to land in an open field. police say the ground was not as smooth as the pilot expected and the plane flipped over. the pilot and his passengers suffered minor injuries. the ntsb and faa are investigating. a 24-year-old man was airlifted to the hospital after falling from a rock at mount diablo state park. it happened yesterday in the popular area known as rock city. rangers say the man fell at least 20 feet. he suffered injuries to his head, face and arms. there's no word on his condition this morning. and a group of boaters had to jump ship off the san mateo county coast after their vessel crashed into a whale. this is a picture of the boat that was abandoned at pebble beach near atascadero point yesterday. the five people on board called 911 to ask for help after they said they hit a whale and lot power on the boat. the boat eventually ended up on the rocks. no one was seriously injured. a new book is shedding new light on the legal battle over same-sex marriage in california. according to the "san francisco chronicle," the book says some attorneys representing opponents of proposition 8 wanted to push a broader case. that would have made a ruling apply to all 50 states. the attorneys were apparently angry that the city of san francisco only wanted to focus on winning rights in california. some of the lawyers in the case thought they would have a better chance of winning if they only focused on this state. the department of homeland security is considering a plan to change their deportation policy. under this plan, most deportations would be limited to undocumented immigrants who have been convicted of violent crimes. the los angeles times reports the white house supports the change but republicans in congress oppose it. under the secure communities program federal agents can check the fingerprints of anyone booked by police against immigration databases. a state committee is refusing to release the legislative calendar of state senator leland yee following his arrest on corruption charges. the contra costa times reports the state senate rules committee has decided not to release the list of yee's official events. the announcement comes after yee withdrew from the race of california secretary of state after being arrested in march on eight felony counts. many local and state politicians including the governor do make their appointment calendars public by posting them online. tighter restrictions could be headed to foster city for people who smoke. according to the examiner, the city is considering whether or not to ban people from lighting up inside their own apartments. the city council sent out an amended smoking proposal after recommending to expand restrictions to smoking on sidewalks, inside apartments and in front of businesses and at shopping centers. if approved, the new ordinance would take effect in 2015. a napa county grand jury is recommending that the county jail be managed by the sheriff's office. it says the new jail population is more sophisticated and more violent than ever before. the grand jury also says reclassifying jailers as public safety officers under the sheriff's control would boost hiring and the jury says more assaults have occurred at the jail since the state's realignment plan took effect in october 2011. under that law, many inmates are sent to local county jails instead of state prison. a governor jerry brown. the "san francisco chronicle" reports the plan would more than double the amount that districts pay for teacher retirement costs each year. that would force the san francisco school district to pay an additional $34 million a year on top of the 25 million it currently pays for teacher pensions. supporters say the plan would help address a $74 billion shortfall in the state pension plan for teachers. if you've been behind the wheel lately of your car, it has likely been tracked by law enforcement. police say license plate readers on patrol cars and street poles can help catch criminals but lawmakers are debating whether more privacy protections are needed. the high tech cameras are capable of capturing the license plates of every vehicle that passes by. that's about morning. no homes have burned and a pre evacuation warning expected to be lifted tomorrow for people living in two subdivisions. the fire has been burning since tuesday and slide rock state park scenic recreation area between sedona and flagstaff. >> we are working very, very steep country. the footing, the ground on that steep country has been destroyed by a lot of this fire. so the logs, the rocks, the things are up above our firefighters can at any time break loose and roll down on top of them. >> the forest service says it has not determined the cause of that fire. this morning police are still looking for the gunman who opened fire at a jewish museum in belgium. the shooting left three people dead and one person in critical condition. the attack came on the eve of elections in belgium and throughout the european union. police have not determined a motive but say it appears to be a hate crime. it was the first home of its kind in the country but many people don't know it exists right here in the bay area. the george mark children's house provides hospice house exclusively for kids. their policy is not to turn anyone away because of their inability to pay. but now it apartment at the house with a kitchen, king sized bed and sun filled rooms. they were steps away from noah's room where he received round the clock care from the home's nurses and doctors. >> we really can provide a very high level of care outside of the hospital that is less expensive and more therapeutic for the families. >> reporter: kathy hall is the cofounder of the george mark children's house. 10 years ago when it opened it was the first pediatric hospice facility in the country. >> it's named for my two brothers, george and mark, and george died of cancer when he was 30. that as many as 40 veterans may have died while waiting for treatment at a va hospital in phoenix. the hospital is also accused of falsifying records to cover up delays in care. the veterans administration says its hospitals have been struggling to cope with the surge of veterans returning home from the wars in iraq and afghanistan. california has been named the worst state in the nation for military retirees. the survey from wallet hub compared all 50 states from the district of columbia when compiling the rankings. researchers say 18 factors including taxes on military benefits and by the national hurricane center to track storms in the atlantic. a hurricane hunter known as miss piggy has been flying through storms for almost 40 years. >> when there's hurricane or tropical storm center to help forecasters predict the path and strength of storms. a robbery suspect who is in a deadly car crash in san leandro friday night is now facing murder charges. the crash happened around 9:00 on san leandro boulevard near apricot street. police say the incident began a few minutes earlier when a man tried to buy some electronics at a nearby store with counterfeit money. when the clerk noticed the fake bills, the man reportedly threatened the clerk and took off. a high-speed chase in two vehicles followed. police say they called off the chase before the car hit the building. a woman who was in the car was killed in the crash. the man was injured and is currently in the hospital in police custody. following a verdict in its patent lawsuit, apple is seeking to ban the sale of samsung devices. on may 5th, the jury gave a mixed verdict in the patent fight and awarded apple about $120 million. that is much lower than the 2 billion plus the silicon valley giant asked for. on friday apple filed papers asking for a ban on new galaxy phones as well as the old models named in the lawsuit. the same judge has denied similar requests from apple twice before. pablo sandoval had a the gunman and injured 13 others. last night thousands of people showed up to a vigil at the uc campus to mourn the loss of the victims. [ singing ] >> sheriff deputies say 22-year- old elliot rodger was heavily armed when he went on a shooting rampage in the isla vista community friday night. authorities say he first stabbed and killed three people at his apartment before shooting and killing two women at a sorority house and another person outside a deli. reporter mary muller tells us how one man described the scene and what investigators are saying about rodger's history. >> multiple gunshot victims. >> reporter: investigators and the san bernardino community are -- santa barbara community are trying to make sense of why elliot rodger went on a violent rampage. authorities say he stabbed three men in his apartment complex before going on a shooting spree across isla vista where he lived and attended college. officials identified 10 locations where rodger rebounding havoc. -- wreaked havoc. he was carrying three semiautomatic rifles all of which he obtained legally. >> he had over 400 remaining rounds of ammunition in his possession. >> reporter: in this surveillance video you can see people crouched in fear as gun fire goes off. authorities still trying to figure out rodger's motive but after reading his manifesto, they believe mental illness played a large part. investigators are also looking at several youtube videos posted by rodger, one titled retribution since been removed. in it rodger goes to a rant about women ignoring and rejecting him. kyle sullivan describes a grisly scene outside a sorority house where he saw three women shot. >> one through her head. >> reporter: now parents of those killed can only grieve. the father of 20-year-old victim christopher martinez broke down. >> why did chris die? chris died because a craven irresponsible politicians and the nra. they talk about gun rights. what about chris' right to live? >> reporter: i'm mary muller, reporting. >> elliot rodger is the son of a hollywood filmmaker who was an assistant director of the "hunger games." elliot rodger reportedly suffered from asperger's syndrome and depression. police say they had three earlier encounters with rodger including a welfare check last month after his parents were concerned about his mental state. authorities say they determined he was fine and did not think he met the criteria for an involuntary hold. one of the surviving victims is reportedly university of pacific student from alamo. according to the san jose mercury news, nick pasichuke suffered serious injuries after police say rodger ran into him with his bmw. he reportedly broke both his legs and had surgery last night. the report says pasichuke was in santa barbara visiting a former san ramon valley classmate and water polo teammate. >> meantime janet napolitano says she is shocked and saddened by the shootings near the uc santa barbara campus. >> they clearly implicated our campus community so we want to make sure that the members of our campus community feel safe and that the campus continues to thrive. >> napolitano made the remarks yesterday after a commencement speech in oakland. she says she is working with uc santa barbara to help the students and families affected. california attorney general camila harris released a statement that says in part i extend my heartfelt sympathy to fends and families of the victims. our thoughts and prayers are with all who have been affected by these tragic acts of violence. governor jerry brown expressed similar sentiments in a statement saying ann and i were saddened to learn of this senseless tract, our thoughts and prayers go out to those for a dui following a crash in hayward. ktvu's christian kaplan live with a look at the damage and the big dui crackdown underway this weekend. christian. >> reporter: right now we are looking at the cleanup efforts after last night's big accident. you can see there's an at&t lineman out here working, you can see the remains of that power pole. this whole incident started about 12:45 this morning. a ford pickup truck, investigators say was being driven by a drunk driver, came barreling down mission boulevard heading in this direction here. if you take a look over across the street, you can see in that area there was also another utility pole that this driver struck and also a fire hydrant and he sheared that fire hydrant off in the course of this accident. now, investigators arrested the man who was driving, they say he is facing dui charges, add to the fact there were two children and a woman in the truck at the time. that driver is also facing charges of child endangerment. at this point investigators say it's unclear if the driver was trying to take off after that accident but investigators arrived and they determined that he had been drinking. then as investigators were investigating that initial incident, a second driver passing the scene made an abrupt u-turn and drew their attention. >> at that time that vehicle almost collided with our patrol cars, our units did make an enforcement stop on that vehicle which subsequently led to the driver of that vehicle being arrested for the suspicion of driving under the influence. >> reporter: that second driver was also arrested. meanwhile, in san francisco police set up a dui checkpoint in the ingleside district. one hour into that checkpoint officers had already arrested two suspected drunk drivers. officers there say stopping drunks is their primary focus but they also say they are out to educate the general driving public about the dangers of drinking and driving. new information into our newsroom about that san francisco dui checkpoint. in all, we are learning that 309 cars were stopped, they made three dui arrests for alcohol, one dui arrest for drugs. there was also a felony warrant arrest and one misdemeanor warrant arrest, six citations for unlicensed drivers, so obviously a very busy spot. meanwhile, here in hayward along mission boulevard, traffic is reopened along mission boulevard and you can see vehicles are moving through the area, but you can expect some delays, one lane is closed so if you're in the area, you need to be aware of that, that that lane will be closed as they work on the repair work here, again, replacing two utility poles knocked out by alleged drunk driver and also the fire hydrant in this area, which was sheared off in that same incident. for now we are live in hayward, christian kaplan, ktvu channel 2 news. also new this morning, oakland police investigating a homicide. the victim was found dead inside a home. it happened at about 1:30 this morning at an apartment on nicole avenue near champion street. police say a group of people went back to the apartment after a night out and at some point they started arguing. that's when police say one person started firing a gun. police say the group then left the apartment, the victim is described as a man in his late 20s, so far no arrests have been made. the first part of a three part seismic fix on interstate 280 in san francisco went off without a hitch. that's according to caltrans. caltrans closed a 2-mile stretch between king and cesar chavez streets this holiday weekend to do construction work, all part of a plan to change a hinge system in the roadway which will allow it to expand and contract during an earthquake. the closed section of the roadway is expected to reopen tuesday morning at 2:00 a.m. orlando florida topped the list from smart growth america followed by tampa and jacksonville. sacramento actually came in at 23rd. researchers say cities in the southeast and southwest make up most of the list because the majority of the people who live there own cars and do not rely on walking to and from mass transit. san francisco did not make that list despite a high number of deadly crashes involving pedestrians. 21 people were hit and killed by vehicles on city streets last year. there have been seven deadly accidents involving pedestrians in san francisco this year. city of san francisco is working to improve pedestrian safety with the vision zero initiative what with the goal of having no traffic deaths within 10 years. tonight is the last day of a controversial rave in richmond that has already prompted several emergency calls. the contra costa times reports firefighters responded to four overdoses friday on the first night of the audio on the bay rave. firefighters were also called out to investigate two false alarms. the event runs again tonight from 5:30 to 1:00 a.m. and if you bought a superlotto plus ticket in san francisco, you might to the emergency call, they knew how to read those currents and firefighters brought the two men to safety. >> family was on shore, very distressed watching their -- what could be more horrible, they are watching their family members out there possibly drowning. >> the surfers were not seriously hurt. a bay area beach may have made a big turnaround. muir beach could be off the state's list of cold. >> it's frigid, it's freezing, actually. >> reporter: the san francisco bay water quality control board is recommending it be removed from a list of impaired waterways. since 2006, high amounts of bacteria from runoff posed a health risk to swimmers and surfers. >> if i would have known that, i probably would have had second thoughts about going in but i can tell you i had a positively refreshing experience. >> i didn't know it was on the list and i'm glad to hear it's off. >> reporter: the california water resources control board says the water is safer because of a recently lot that acts as a bacteria buffer. it's designed to prevent flooding during rain. a pedestrian bridge keeps people from harming endangered species below. there's also a new picnic area and new places to go, there were no rest rooms before. >> this is the first time we have been down here since the restoration has been completed and it's been reopened like this so we are just kind of wide eyed. >> a much different experience than what used to be just parking lot and a beach. >> reporter: this couple says the area strikes a good balance for beachgoers and the wildlife. >> i like the fact that from the presidio's main post to the national cemetery on lincoln boulevard starting at 10:30 a.m. this year's ceremony will be dedicated to vietnam veterans, many of whom were deployed from the presidio. more than 60,000 u.s. soldiers were killed in vietnam, 300,000 more were injured. two military aircraft will also fly over oak hill memorial park in san jose on memorial day. the 129th res coverage on the mass shooting near uc santa barbara that killed seven people including the gunman and injured 13 others. sheriff's deputies say 22-year- old elliot rodger was heavily armed when he went on a shooting rampage in the isla vista community friday night. authorities say, though, he first stabbed and killed three people at his apartment before shooting and killing two women outside a sorority house and another person outside a deli. deputies say rodger then killed himself after getting into a gun battle with officers and deputies. a student at santa barbara city college says he was walking back from a fraternity when he heard the gunshots. that's when he found three girls who had been shot, one he says was already dead, another badly injured and a third was struggling to sit up. >> she was still conscious, she was talking, she immediately got on the phone with her mother and i was telling her mother about how much she loved her and she wasn't sure she was going to make it. >> kyle sullivan says he stayed with the girl telling her that she would be okay. he says a couple minutes later, they heard more gunshots, he says he is still shaken up about the whole incident and still trying to process what he saw. last night thousands of people held a candlelight vigil at stork plaza at the center of the uc santa barbara campus after the vigil people took part in a memorial walk through isla vista. they walked the same path that the gunman elliot rodger took during the rampage. the event was sponsored by the santa barbara response network, uc santa barbara and associated students. three of the victims have been identified as students veronika weiss, katie cooper and christopher martinez. the names of the three other people killed have not yet been released. the seventh victim was the shooter, elliot rodger, who reportedly took his own life. one of the surviving victims is reportedly a student from the university of pacific who lived in alamo. according to the santa rosa mercury news, nick pasichuke suffered serious injuries after police say rodger ran into him with his bmw. he reportedly broke both his legs and had surgery last night. pasichuke was in santa barbara visiting a former san ramon valley high school classmate and fellow polo teammate. elliot rodger reportedly suffered from asperger's syndrome and depression. police say they had three earlier encounters with him including a welfare check last month after his parents were concerned about his mental state. authorities say they determined he was fine and did not think he met the criteria for an involuntary hold. hours before the shooting rodger posted a youtube video where he ranted against the women who would not pay attention to him. he also published a 140 page manifesto where he talked about his struggle to fit in and outlined his plan for revenge. he was a student at santa barbara city college. authorities say rodger was carrying three semiautomatic handguns and had more than 400 rounds of ammunition during the shooting rampage. >> we have determined that all of these weapons were legally purchased from federally licensed firearms dealers and that they were all registered to the suspect. >> surveillance cameras inside a convenience store showed the moments when gunshots were fired into the building during that rampage. investigators say rodger went from one location to another and opened fire on random people over a 10 minute period. authorities say there were 10 crime scenes in all. on ktvu.com you will find more about the deadly rampage near uc santa barbara. you can find it under the hot topics section. new this morning, two drivers are under arrest for dui following a crash in hayward. ktvu's christian kaplan is live with a look at the damage and the big dui crackdown underway this weekend. christian. [ no audio ] >> reporter: that is the initial accident site where the driver of this pickup truck was coming along down mission boulevard, hit that first utility pole -- [ no audio ] >> christian kaplan having a little problem with his audio. allie rasmus. >> we will check back in with him in a second. the santa clara county coroner is working to identify a body found in a south bay creek. a kayaker found the man's body yesterday morning in coyote creek. res crew crews from several -- rescue crews from several agencies recovered the body. it is too early to know whether he was the victim of foul play or even how long the body was in the water. the area where the body was found is being considered a crime scene. a man is dead after his car went off an embankment and into a creek near sebastopol. it happened on bodega highway near sexton road. it appeared the victim was trapped underwater after the crash. he was a 41-year-old man from santa rosa and they say the crash happened friday night but no one reported it until yesterday morning. people who live nearby say they often hear cars skidding around on that stretch of road. a 24-year-old man was airlifted to the hospital after falling from a rock at mount diablo state park. it happened yesterday in the popular area known as rock city. they say the man fell at least 20 feet. he suffered injuries to his head, face and arms. no word on his condition this morning. a group of boaters had to jump ship off the san mateo county coast after their vessel crashed into a whale. this is a picture of the boat that was abandoned at pebble beach near atascadero point yesterday. five people on board called 911 to ask for help after they said they hit a whale and lost power on the boat. no one was seriously injured. another small plane flipped while making an emergency landing south of bakersfield. the pilot ran into some sort of trouble yesterday afternoon and tried to land in an open field. police say the ground was not as smooth as the pilot expected and the plane flipped over. the pilot and his passengers suffered minor injuries. the ntsb and faa are investigating. a new book is shedding new light on the legal battle over same-sex marriage in california. according to the "san francisco chronicle," the book says some attorneys representing opponents of proposition 8 wanted to push a broader case. that would have made a ruling apply to all 50 states. the attorneys were apparently angry that the city of san francisco only wanted to focus on winning rights in california. some of the lawyers in the case thought they would have a better chance of winning if they only focused on that state. the department of homeland security is considering a plan to change their deportation policy. under the plan most deportations would be limited to undocumented immigrants who have been convicted of violent crimes. the los angeles times reports the white house supports the change but republicans and congress oppose it. under the secure communities program, federal agents can check the fingerprints of anyone booked by police against immigration databases. two drivers under arrest for dui following a crash in hayward. let's go back to ktvu's christian kaplan live in the city of hayward. you were showing us some of the damage that was out there at the scene accident -- at the accident scene. >> reporter: it actually starts over there where you can see an at&t lineman over there, that is the utility pole where this pickup truck initially struck. that utility pole then continued on mission boulevard and take a look, you can see these divots here taken out of the cement as that truck came up here onto the sidewalk, knocked out another utility pole and then sheared off a fire hydrant over here. investigators arrested the man behind the wheel. he is now facing dui charges. add to that the fact that there were two children and a woman in the trunk at the time. that driver also facing charges of child endangerment. at this point investigators say it's unclear if the driver was trying to take off after the accident but investigators arrived and say they quickly determined that he had been drinking. >> for unknown reasons the driver lost control and veered off the roadway and collided with a telephone pole and then continued northbound on mission boulevard and collided into another telephone pole followed by a fire hydrant. >> reporter: while investigators were on scene for that initial incident, a second driver passing the scene made an abrupt u-turn and nearly smashed into a deputy's cruiser. officers stopped that vehicle and arrested the man in that vehicle as well. they arrested him for dui. now, meanwhile, in san francisco, police also set up a dui checkpoint in the ingleside district. in all, three arrests for alcohol-related duis from that one drug-related dui. officers there say stopping drunks obviously is their primary focus but say they are out to educate the general public about the dangers of drinking and driving. obviously this week there are numerous agencies conducting dui enforcement efforts some are going to be swarming the city and there are also more dui check points set up to go around the bay area. meanwhile, here in hayward, you can see this portion of mission boulevard open at this time but as you can tell, this curb lane is closed sporadically because they are again working on this lane so if you're driving in this area, be sure to use a little extra caution. we will continue to monitor the repair efforts out here in hayward. for now, we are live, christian kaplan, ktvu channel 2 news. tighter restrictions could be headed to foster city for people who smoke cigarettes. according to the examiner, the city is considering whether or not to ban people from lighting up inside their own apartments. the city council sent out an amended smoking proposal after recommending to expand restrictions to smoking on sidewalks, inside apartments and in front of businesses and at shopping centers. if approved, the new ordinance would take effect next year. if you've been behind the wheel lately of your car, you may have been tracked by law enforcement. police say license plate readers on patrol cars and street poles can help catch criminals but lawmakers are debating whether more privacy protections are needed. the high tech cameras are capable of capturing the license plates of every car that passes by and that's about 2000 images a minute. and another story affecting bay area drivers, specifically those in san francisco, interstate 280 in san francisco remains closed this morning but coming up we will have an update on the construction when that section of roadway is expected to open back up. presidential election is underway in ukraine but some voters say they are running into trouble and are unable to cast their ballots. a warmer day in store for the bay area. i'll have a look at the police are still looking for the gunman who opened fire at a jewish museum in belgium. the shooting left three people dead and one person in critical condition. the attack came on the eve of elections in belgium and throughout the european union. police have not determined a motive but say it appears to be a hate crime. voters in ukraine are heading to the polls today for an election that many home will stabilize the country. the vote comes three months after ukraine's president stepped down from power and fled the country. this is video of one of the candidates for president casting her vote. it is unclear whether all eligible voters will be able to access the polls. rebels in eastern ukraine have threatened to block the vote. it was the first home of its kind in the country, but many people don't even know it exists right here in the bay area. the george mark children's house provides hospice care exclusively for kids. their policy is to not turn anyone away because of their more people out of the office. according to the "wall street journal" employees in most countries do not use their paid time off. in japan workers only use 8.6 vacation days to give them a reason to areas like half moon bay and pacifica. we will continue with our warmup. today is going to be the warmest day. temperatures nearing the 90s for some of our inland cities, going into the low 90s for areas like antioch, brentwood and we are looking at a cooling trend as early as tomorrow. it will be a subtle one but as we get into tuesday, a more notable one. so we start out here, sort of warm, even a bit hot for our inland communities, tomorrow we shave off a few degrees and then we drop back to about the seasonal average by tuesday. we have a system that will be dropping in and that will bring us a cooldown, going to break down that ridge of high pressure, move it out of the area. temperatures again falling as early as tomorrow. we do have a variable wind out there. we typically get this with the ridge of high pressure in place, but we also have that onshore breeze. that's not giving up completely. take a look at fairfield, 14 miles per hour so that nice sea breeze kicking up in the afternoon once again, it helps to keep us comfortable but if you're going to the coast even with the mostly sunny skies going to be cool and brisk out there for today. 59 degrees in san francisco, 59 in oakland, widespread 50s, low 60s along the peninsula around the bay, 63 in concord and then we get to antioch, 71 already for you and, boy, antioch, it's going to be a hot one. take a look at this. as we get into about 11:00 or so, already in the low 80s, perhaps mid to upper 80s for your lunch hour and then for the afternoon, 93 degrees, 2:00, 3:00, 4:00 and into 5:00. by 8:00 5% contained this morning. no homes have burned and that preevacuation warning is expected to be lifted tomorrow for people living in two subdivisions nearby. the fire has been burning since tuesday and slide rock -- in slide rock state park, a scenic recreation area between sedona and flagstaff. people in portland being told they can now drink the water. even so, some companies say the recent getting a look this morning at the plane used by the national hurricane center to track storms in the atlantic. the hurricane hunter known as miss piggy has been flying through storms for almost 40 years. and the plane is equipped with radar and satellite technology. it can fly for 11 hours at a time. >> when there's hurricane or tropical storm out there, it serves a dual role because it collects data not just operationally to send to the hurricane center to help us do our forecasts and warnings but it does ongoing research to test and develop the latest technologies. >> the data is immediately transmitted to the national hurricane center to help forecasters predict the path and strength of storms. following a verdict in its patent lawsuit, apple is seeking to ban the sale of samsung devices. on may 5th the jury gave a mixed verdict in the patent fight and awarded apple about $120 million. that is much lower than the 2 billion plus the silicon valley giant asked for. on friday apple filed papers asking for a ban on new galaxy phones as well as the old models named in the lawsuit. the same judge has denied similar requests from apple twice before. when it comes to shopping, stores are buying into changing technology. industry watchers say in the future most of the retail stores that remain will be big named places and they expect to see holograms in dressing 22- year-old elliot rodger went on a violent rampage. authorities say he stabbed three men in his apartment complex before going on a shooting spree across isla vista where he lived and attended college. officials identified 10 locations where rodger wreaked havoc. he was carrying three semiautomatic handguns all of which he obtained legally. >> we have determined that the suspect had over 400 remaining rounds of ammunition in his possession. >> reporter: in this surveillance video, you can see people crouch in fear as gun fire goes off. authorities are still trying to figure out rodger's motive but after reading his manifesto, they believe mental illness played a large part. investigators are also looking at several youtube videos posted by rodger. one titled retribution has since been removed. in it rodger goes on a rant about when ignoring and rejecting him. kyle sullivan describes a grisly scene outside a sorority house where he found three girls shot. >> i saw a gunshot wound to her abdomen and like on her side and also one through her head. >> reporter: now parents of those killed can only grieve. the father of 20-year-old victim christopher martinez broke down. >> why did chris die? chris died because of craven, irresponsible politicians and the nra. they talk about gun rights. what about chris' right to live. >> reporter: mary mueller, reporting. >> elliot rodger a son of a hollywood filmmaker who was an assistant director on the hunter games. he reportedly suffered from asperger's syndrome and depression. police say they had three earlier encounters with rodger including a welfare check last month after his parents were concerned about his mental state. authorities say they determined he was fine and did not think he met the criteria for an involuntary hold. now as we continue to learn more information about the shooter and the events of friday night, reaction to the shootings is coming in from all over the state as well. >> that's right, uc president janet napolitano says she is shocked and saddened by the shootings near the uc santa barbara campus. >> they clearly implicated our campus community so we want to make sure that the members of our campus communities feel safe and that the campus continues to -- continues to thrive. >> napolitano made the remarks yesterday after a commencement speech at laney college in oakland. she says she is working with uc santa barbara to help the students and families affected. california attorney general kamala harris released a statement following the tragedy that says in part i extent my heartfelt sympathy to the family and friends of the victims. our thoughts and prayers are with all who have been affected by these tragic acts of violence. governor jerry brown expressed similar sentiments in a statement saying anne and i were saddened to learn of this senseless tragedy. our thoughts and prayers go out to those mourning the loss of their loved ones during poles and a fire hydrant in high -- hayward. christian kaplan is monitoring the cleanup efforts underway this morning and has new information about dui arrests from a weekend crackdown. >> reporter: this is new information we just got within the last 10 minutes or so and this is from the chp reporting the amount of arrests and accidents have occurred on bay area highways. this is just chp reporting and we hear this covers the time period from 6:00 friday evening until 6:00 this morning. the chp is reporting a total of two fatal dui accidents around on bay area highways and 147 dui arrests. now, this is one such incident, this was not handled by -- this was handled also by the chp. let's go ahead and walk you through this incident here. it starts over across the street there where the driver of a pickup truck was coming down this road, sheared off this utility pole, continued on through this area, hit another utility pole here across the street and finally sheared off a fire hydrant in this area. this incident had chp officers on the scene, investigators arrested the man who was driving. he is facing dui charges. add to that there were two children and a woman in the truck at the time, the driver also facing charges of child endangerment. at this point investigators say it's unclear if the driver was taking over after the accident but investigators determined quickly he had been drinking. while investigators were on scene for that initial incident, a second driver passing the scene made an abrupt u-turn and nearly smashed into a deputy's cruiser. officer stopped that man and arrested him as well. and across the bay in san francisco, police set up a dui checkpoint in the ingleside district. in all, three arrests for alcohol-related dui there and one drug-related dui. >> primarily to keep the streets safe for the drivers who are out there trying to get home from parties or from family functions or just going out to dinner, just so the roadways are safe. second thing is for education. >> reporter: coming back to our live shot, you can see that at&t line worker out here still trying to clear this scene, they are saying they are going to be bringing in new utility poles later on today. what that does mean is that one lane here of mission is going to be closed while crews work throughout the morning. we will continue to monitor the new this morning, a chp officer was injured when his car was rear-ended in santa rosa. it happened about an hour ago on northbound 101 at todd road. the chp tells us the officer was conducting a traffic stop when his patrol car was rear- ended. the driver of the car that hit the patrol car was taken to the hospital in critical condition. the chp officer suffered a leg injury. two lanes in the area remain closed this morning. the first part of a three part seismic fix on interstate 280 in san francisco went off without a hitch. that according to caltrans. caltrans closed a 2-mile stretch between canyon and cesar chavez streets to do construction work this weekend. all part of a plan to change a hinge system in the roadway which will allow it to expand and contract during an earthquake. the closed section of the interstate is scheduled to reopen by tuesday morning, 5:00. a new list of the 25 deadliest cities for pedestrians has been released and san francisco did not make the list. orlando florida topped the list from smart growth america followed by tampa and jacksonville. sacramento came in at 23rd on that list. researchers say cities in the southeast and southwest make up most of the list because the majority of people who live there own cars and do not rely on walking to and from mass transit. san francisco did not make that list despite a high number of deadly crashes involving pedestrians. 21 people were hit and killed by vehicles on city streets last year and there have been seven deadly accidents involving pedestrians in the city this year. the city of san francisco is working to improve pedestrian safety with a vision zero initiative with the goal of having no traffic-related deaths within 10 years. tonight is the last day of a controversial rave in richmond that has already prompted several emergency calls. the contra costa times reports firefighters responded to four overdoses friday on the first night of the audio on the bay rave. firefighters were also called out to investigate two false alarms. the event runs again tonight from 5:30 to 1:00 a.m. an investigation underway into an officer-involved shooting. the reason bottle company stand to lose $4 million. the production ground to halt as many as -- recalled because they could be contaminated. the company says the beverages will be tested to make sure they are at the main u.s. base there this morning after an overnight flight from washington, d.c. the president is expected to spend just a few hours at the base. he is also considering keeping a small number of u.s. troops in afghanistan for training in counter terrorism missions past the end of this year. bay area cub scouts and boy scouts marked the memorial day holiday with an event at the presidio. >> from pennsylvania started the readings. her son was the first in afghanistan to be killed in action. more than 2500 people are expected to attend a memorial day ceremony in san francisco's presidio tomorrow. that event at the san francisco national cemetery will mark 50 years since the escalation of the vietnam war. veterans will march from the presidio's main post to the national cemetery on lincoln boulevard starting at 10:30 a.m. this year's ceremony will be dedicated to vietnam veterans, many of whom were deployed from the presidio. more than 60,000 u.s. soldiers were killed in vietnam, 300,000 more were injured. two military aircraft will also fly over folk hill memorial park in san jose on memorial day day. the flyover scheduled to get underway at 11:00 a.m. california near uc santa barbara campus that killed seven people including the gunman and injuring 13 others. sheriff's deputies say 22-year- old elliot rodger was heavily armed when he went on a deadly rampage in the isla vista community friday night. authorities say he first stabbed and killed three people at his apartment before shooting and killing two women outside of a sorority house and another person outside of a deli. deputies say rodger then killed himself after getting into a gun battle with law enforcement. last night thousands of people showed up to a vigil at the uc santa barbara campus to mourn the loss of the victims. deborah villalon was there at the emotional memorial. to happen. >> reporter: sheriff's deputies who checked on rodger only last month at his family's request described him as polite, even shy, and left without realizing he had guns and a plot. students too wonder what they may have missed. >> why did he feel this way? like why did he have to attack everyone? >> it's the quiet ones that you don't really see coming, like they don't give off too much -- they don't give too many signs. >> that was deborah villalon reporting. >> one of the surviving victims is reportedly a university of pacific student from alamo. according to the san jose mercury news, nick pasichuke suffered serious injuries after police say rodger ran into him with his bmw. he reportedly broke both of his legs and had surgery last night. the report says pasichuke was in santa barbara visiting a former san ramon valley high school classmate and water polo teammate. >> elliot rodger is the son of a hollywood film director who was an assistant director of the "hunger for an involuntary hold. hours before the shooting rodger posted a youtube video where he ranted against the women who would not pay attention to him. rodger also published 140 page manifesto where he talked about his struggle to fit in and outlined his plan for revenge. he was a student at santa barbara city college. this is the same area where 14 years 14 years ago a man killed four people, david addious was an 18-year-old santa barbara student when police say he deliberately hit a number of people with his car. at the time witnesses reported he was screaming i am the angel of death. a jury two drivers are under arrest for dui following a crash that took out a fire hydrant in hayward. ktvu channel 2 news reporter christian kaplan is live with a look at the damage and the big dui was in a deadly car crash in san leandro friday night is now facing murder charges. the crash happened around 9:00 on san leandro boulevard near apricot street. police say the incident began a few minutes earlier when a man tried to buy some electronics at a nearby store with counterfeit money. when the clerk noticed the bills were fake, the man reportedly threatened the clerk and ran. a high-speed chase followed. police say they called off that chase before the car hit the building, a woman who was in the car was killed in the crash. the man who was injured is currently in the hospital in police custody. an investigation is underway after an officer- involved shooting at a school near sacramento. police in citrus heights say on friday night they responded to calls of domestic violence when they arrived, the man fled on a bicycle to a nearby school. police say when they got that school, they tried to approach the man, they say he reached into his waistband and police opened fire shooting the man. he later died at the hospital. a 24-year-old man was airlifted to the hospital after falling from a rock in mount diablo state park. it happened yesterday in the popular area known as rock city and rangers say that man fell at least 20 feet. he suffered injuries to his head, face and arms, no word this morning on his condition. a group of boaters had to jump ship off the san mateo county coast after their vessel crashed into a whale. this is a picture of the boat that was abandoned at pebble beach near atascadero point yesterday. the five people on board called 911 to ask for help after they said they hit a whale and lost power on the boat. that boat eventually ended up on the rocks. no one was seriously injured. a new book is shedding new light on the legal battle over same-sex marriage in california. according to the "san francisco chronicle," the book says some attorneys representing opponents of proposition 8 wanted to push for a broader case. that would have made a ruling apply to all 50 states. the attorneys were angry that the city of san francisco only wanted to focus on winning rights in california. some of the lawyers in that case thought they would have a better chance of winning if they only focused on our state. the department of homeland security is considering a plan to change their deportation policy. under the plan, most deportations would be limited to undocumented immigrants who have been convicted of violent crimes. the los angeles times reports that the white house sports that change -- supports that change but republicans in congress oppose it. under the secure communities program, federal agents can check the fingerprints of anyone booked by police against immigration databases. at least two students who say they were injured in a protest at city college of san francisco say they plan to file a claim against the school. students say they will hold a press conference tuesday at 10:00 a.m. to demand an apology from the chancellor of the college. six students were injured in a demonstration back in march when clashes between protesters and police turned violent. that protest called for the resignation of a trustee who students say played a role in the school's loss of accreditation. if you've been behind the wheel lately in your car, you may have been tracked by law enforcement. police say license plate readers on patrol cars and street polls can help catch criminals but lawmakers now are debating whether more privacy protections are needed. the high tech cameras are capable of capturing the license plates of every car that passes by. caring for children, the unknown bay area home that is looking after young patients and the help it's going to be getting from police are continuing to baths a massive wildfire that has now burned more than 11,000 acres. the slide fire is just 5% contained this morning. no homes have burned and a preevacuation warning is expected to be lifted tomorrow for people living in two subdivisions. that fire has been burning since tuesday in slide rock state park, a scenic recreation area between sedona and flagstaff. >> we are working in very, very steep country. the footing, the ground on that steep country has been destroyed by a lot of the fire so the logs, rocks, the things that are up above our firefighters can at any time break loose and roll down on top of them. >> the forest service says it has not determined the cause of that fire and we are getting a look this morning at the plane used by the national hurricane center to track storms in the atlantic. the hurricane hunter known as miss piggy has been flying through storms for almost 40 years. the plane is equipped with radar and satellite technology and can fly for 11 hours at a time. >> when there's hurricane or tropical storm out there, it serves a dual role because it collects data not just operationally to send to the hurricane center to help us do our forecasts and warnings, but it does ongoing research to test and develop the latest technologies. >> the data is immediately transmitted to the national hurricane center to help forecasters predict the path and strength of storms. it was the first home of its kind in the country but many people in the bay area don't even know it exists. the george mark children's house provides hospice care exclusively for kids. their policy is to not turn anyone away because of their ability to pay. but now the nonprofit is getting a big boost from local law enforcement. >> imagine a beautiful mansion tucked away in a hill. >> it is a sacred place for jennifer mckay weber. she comes to this home often to touch the tile she decorated -- >> our daughter did the little angel drawing. >> and pick up the stone with the name noah engraved on it. >> those are beautiful things that connect us continually to our child. >> the george mark children's house in the san leandro hills is where she and her family spent some of the most bittersweet moments of their life. >> i actually love coming back here. it's home to me, it feels like home. i wish i could come back here to that time. >> two years ago her 11 week old son noah came here after he was diagnosed with a rare liver disease. >> when we came to george mark, they thought he would only survive maybe a few days. >> he lived for two more months. during that time the family lived in this apartment at the house with a kitchen, king side bed is sun filled rooms. they were steps away from noah's room where he received round the clock hair from the home's nurses and doctors. >> we really can provide a very high level of care outside of the hospital that is less expensive and more therapeutic for the families. >> kathy hall is the cofounder of the george mark children's health. 10 years ago when it opened it was the first peta pediatric hospice facility in the country. >> it's named after my two brothers, george and mark and george died of cancer when he was 30. >> her brother mark was killed in a car crash as a teenager. 75% of their $5 million a year budget comes from donations which is why the san leandro police are stepping in to help. >> we decided to adopt them as a charity. >> the department's organized a s.w.a.t. fitness challenge with 40 teams from across the state participating. >> our goal is really to raise $20,000 from the entry fees for the event. >> all of the money comes back here to help families like the mckay webers to make the most of the time they have left. >> i always say that it's our like, as our family, it's our painfully beautiful time together. people think -- and it is, it's really sad, it's really traumatic, but there's so much beauty in that too and that's for me what george thanks. the white house says a decision to allow veterans to get care at private hospitals could help ease long wait times at va facilities. the announcement comes amid claims that as many as 40 veterans may have died while waiting for treatment at a va hospital in phoenix. the hospital is also accused of falsifying records to cover up the delays in care. the veterans administration says its hospitals have been struggling to cope with the surge of veterans returning home from the wars in iraq and afghanistan. california has been named the worst state in the nation for military retirees. that according to a survey from wallet hub. the survey compared all 50 states and the district of columbia when compiling the rankings. researchers say 18 factors including taxes on military benefits and job opportunities for veterans were taken into account while compiling the list, wyoming topped that list followed by new hampshire and montana. happy memorial day weekend for everyone out there and then further cooling expected as we get back to work on tuesday. so in a nutshell today is the warmest day, temperatures warming into the low 90s for some of our warmest locations inland and then as we get into monday, it looks like temperatures are going to trail off, maybe cool down a few degrees, may not notice so much but by tuesday we are falling back to the seasonal average. we have been anywhere from 5 degrees above average recently and today five to 10 degrees above the seasonal average. right now 70 degrees in fairfield, 81 degrees in antioch and i keep going to antioch because, boy, it's already a warm one, not even 10:00 in the morning. let's take a look at the day planner here for you. as we get into the lunch hour, upper 80s in the forecast, i have us going to 93 today but this model shows 94, it's like splitting hairs at this point but plenty of sunshine, warm, warm weather in store for you, sunset is at about 8:20 and by 9:00 still 77 degrees, so if you have evening plans, it's going to be a beautiful evening. in fact, hold onto the evening unless you need to be outdoors for the afternoon because that may be the better time to be outdoors. 61 in oakland right now, 61 in napa, 63 san francisco, 64 in mountain view, san jose checking in at 63, numbers are expected to warm a few degrees anywhere from three to six to maybe 8 degrees above yesterday's wednesday and thursday. back to the d -- desk. a new proposal in foster city. the ban on smoking being considered and why it hits very close to home. and a new report says most people don't use all their paid vacation time in this particular country. the effort that country is now making to force people out of the office. smokers in foster city could face tighter restrictions about where they can light up. according to the examiner, foster city is considering whether or not to ban people from lighting up in their own apartments. the city council sent out an amended smoking proposal after recommending to expand restrictions to smoking on sidewalks, inside apartments and in front of businesses and at shopping centers. if approved, the new ordinance would take effect in 2015. and following a verdict in its patent lawsuit, apple is seeking to ban the sale of some samsung devices. on may 5th the jury gave a mixed verdict in the patent fight and awarded apple about $120 million. that is much lower than the 2 billion plus the silicon valley giant initially asked for. on friday apple filed papers asking for a ban on new galaxy phones as well as the old models named in the stores are buying into changing technology. industry experts say in the future most of the retail stores that remain will be big named places and they expect to see other technological advances like holograms in dressing rooms that will allow people to try clothes without getting undressed. stores will also recognize your phone when you walk in and send you deals on the items you usually buy.
